http://usnews.msnbc.msn.com/_news/2012/06/22/12363955-sandusky-convicted-of-45-counts?lite

Updated at 10:19 p.m. ET: BELLEFONTE, Pa. Jerry Sandusky was convicted of 45 counts of child sexual abuse Friday night and faces spending the rest of his life in state prison.
Kimberly Kaplan and Michael Isikoff of NBC News reported from

Sandusky was immediately remanded into custody and was led out of the courthouse in handcuffs as a large crowd of onlookers cheered.

Jerry Sandusky and his wife, Dottie, arrive Friday night at Centre County Court in Bellefonte, Pa.

Sandusky, 68, the former longtime defensive coordinator at Penn State, had denied all 48 counts alleging that he abused 10 boys over 15 years. Two grand jury reports accused him of having used his connection to one of the nation's premier college football programs to "groom" the boys, whom he met through his Second Mile charity for troubled children, for sexual relationships.

Several of the counts are so-called mandated felonies, meaning McKean County (Pa.) Senior Judge John Cleland has no discretion in sentencing. NBC News reported that he faces a minimum of 60 years in prison.

Cleland was brought to Centre County to oversee the trial after local judges recused themselves.

The trial, which opened June 11, culminated months of intense attention that led to the firing of head coach Joe Paterno, who won more games than any other major college football coach in history, many of them with Sandusky at his side.

Paterno died exactly five months ago, a few weeks after the Penn State Board of Trustees dismissed him for not having done enough to stop Sandusky's alleged abuse.

Jurors heard often-graphic testimony from eight of the 10 alleged victims whose accounts were included in two grand jury reports. They told how Sandusky would first win their trust by giving them gifts and taking them on trips with the football team before progressing to hugging, kissing, increasingly sexual touching and, in some cases, oral and anal sex.

In a rare occurrence in an abuse trial, prosecutors also presented the testimony of a corroborating eyewitness Sandusky's former Penn State coaching colleague Michael McQueary, who said that he saw a young boy, identified in the first grand jury report as "Victim 2," in a Penn State shower with Sandusky.

McQueary said the boy had his hands against the wall and that Sandusky was standing up against him from behind. He said he heard a "skin-on-skin smacking sound" and that he had "no doubt" that Sandusky was engaging in anal sex with the boy.

Because they were sequestered, without access to computers, phones or any other way to hear news coverage, the jury of seven women and five men wouldn't have heard newer, potentially damaging information from two other accusers that emerged after they began deliberations.

Sandusky's adopted son Matt said he had been prepared to testify that he, too, was a victim of abuse by his father, according to a statement issued Thursday by attorneys who said they are representing the younger Sandusky.

(NBC News and msnbc.com generally do not identify victims of sexual assaults, but Matt Sandusky chose to identify himself in a public statement released through his attorneys.)

Sources told NBC News that Jerry Sandusky abandoned plans to testify in his own defense because of the prospect of damaging rebuttal testimony by his son.

Nor would they have heard the account of Travis Weaver, 30, of Ohio, who attended Second Mile camps as a youth. Weaver told NBC News in an interview that aired Thursday night that Sandusky performed oral sex on him in the upstairs bedroom of the Sanduskys' home.

Weaver testified to one of the two grand juries but wasn't mentioned in the grand jury reports or called as a witness during the trial.

The end of the trial doesn't mean the case is over.

Two former top Penn State officials, former Athletic Director Timothy Curley and former vice president Gary Schultz, face perjury charges in connection with their grand jury testimony in December, in which prosecutors alleged that concealed what they knew about Sandusky's conduct.

Law enforcement sources have told NBC News that former Penn State President Graham Spanier, who was fired in November, was under investigation for possible similar charges.

1. "Sandusky's lawyer expects him to be convicted on at least some counts"
In response to Reply # 0

By M. Alex Johnson, msnbc.com, and Kimberly Kaplan, NBC News

Updated at 7:34 p.m. ET: BELLEFONTE, Pa. Jerry Sandusky's attorney said Friday that he expects his client to be convicted on some of the 48 child sexual abuse counts against him.
Kimberly Kaplan of NBC News reported from Bellefonte, Pa. M. Alex Johnson is a reporter for msnbc.com. Follow M. Alex Johnson on Twitter and Facebook.

"I would die of a heart attack shocked if he was acquitted on all of the charges," Joseph Amendola, the head of Sandusky's defense team, told reporters in Centre County Court.

"It is just statistically unlikely," he said.

Jurors were into their 19th hour of deliberations in the trial of Sandusky, 68, the former defensive coordinator for Penn State University's storied football team and founder of the Second Mile charity for troubled children. He denies all 48 counts in two grand jury reports alleging that he abused 10 boys over 15 years.

Amendola spoke to reporters for a few minutes inside the courthouse before a court official cut him off. Judge John Cleland has issued a gag order prohibiting participants from making public statements "regarding the Defendant's guilt or innocence" (.pdf).

Before he was hustled away, Amendola acknowledged that "it's a daunting, daunting case," but he said Sandusky has "always been optimistic."

There was still no indication when the jurors might reach a verdict. They resumed working after dinner, just as they had Thursday night.

Earlier Friday, the jury asked Cleland for clarification on hearsay and circumstantial evidence, an indication that they were wrestling with secondhand testimony about an incident in which Sandusky was allegedly seen in a Penn State University shower with a young boy.

The question involved the testimony of Ronald Petrosky, a janitor at Penn State, who said that he saw "two pairs of legs" in the shower in November 2005. He said he discussed the incident with a colleague, Jim Calhoun, who told him that he had seen Sandusky performing oral sex on the boy, who is identified in a grand jury report as "Victim 8."

Calhoun is hospitalized with dementia and didn't testify. Cleland allowed Petrosky's secondhand testimony under an exception to rules barring hearsay evidence.

Cleland instructed the jurors that "the statement of Mr. Calhoun as related to you by Mr. Petrosky is not sufficient standing alone to sustain a conviction."

Ghosts of Sandusky's dreams haunt home where charity was born

Legal analysis by Wes Oliver

"You must be satisfied that there is other evidence that supports that a crime had been committed besides Mr. Calhoun's hearsay statement," he stressed.

Thursday night, jurors told Cleland that they wanted to rehear the testimony of former Penn State assistant coach Michael McQueary, who testified that he overheard and saw Sandusky apparently having sex with a young boy in a football locker room shower, and Jonathan Dranov, a family friend who testified that McQueary told him about incident. Both men's testimony was re-enacted Friday morning.

McQueary testified last week that he saw a young boy identified in the first grand jury report as "Victim 2" in a Penn State shower with his hands against the wall and Sandusky standing up against him from behind. He said he heard a "skin-on-skin smacking sound" and that he had "no doubt" that Sandusky was engaging in anal sex with the boy.

Testifying for the defense this week, Dranov said McQueary described hearing sounds he considered sexual in nature but didn't give a graphic description of what he saw.

Follow @msnbc_us

"I kept saying, 'What did you see?'" Dranov testified. "Each time, he would come back to the sounds. It just seemed to make him more upset, so I backed off that."

The lead defense attorney, Joseph Amendola, argued in his closing statements Thursday that McQueary "assumed" sex was occurring without having actually seen any.

And he contended that Dranov must not have believed that the incident was as serious as he later said because he didn't report it to police. As a physician, Dranov is required by law to report any indication of child abuse.

The jury of seven women and five men is being sequestered during deliberations without access to computers, phones or any other way to hear news coverage of the trial. That means they wouldn't have heard that Sandusky's adopted son Matt said that he had been prepared to testify that he, too, was a victim of abuse by his father, according to a statement issued by attorneys who said they are representing the younger Sandusky.

Matt Sandusky: From stalwart defender to possibly his father's most damning accuser

Travis Weaver, who alleges that he was abused by former Penn State assistant coach Jerry Sandusky, tells NBC Bews' Kate Snow, "I'll be OK when he's in prison."

Several of the counts are so-called mandated felonies, meaning Cleland would have no discretion in sentencing. Most carry sentences of 10 to 20 years in prison, meaning that even if he is convicted on only a handful of those counts, Sandusky could spend the rest of his life in prison.

That said, dude is never seeing the light of day again. They're saying he's facing a minimum of 60 years. Plus I imagine there's federal cases coming as well. Plus, maybe they prosecute over his adopted son? Who knows? But he's breathed the last of his air as a free citizen.

I'm with you. I even find myself feeling a little pinch of sympathy for Sandusky. I think dude truly doesn't realize how wrong what he was doing is.

I hope this gives some closure and relief to his victims. It doesn't make me want to celebrate, though.

Further, this guy was to being a pederast what Tommy Chong was to being a stoner. The more details came out, the more flagrant this shit was. Just all out shameful, has totally wiped out my rooting interest in Penn State and, by extension, most of my interest in college football.

Can we change the default animal associated with pedophiles to a Nittany Lion?

PSU has to come up off some of that $1.8 billion endowment. Lord knows how much of that was funded by a football program that allowed a Nittany Lion to rape little boys.

The football program must pay because the officials in charge including JoePa allowed this to occur. Joe Pa's wins over the last 15 years must be terminated. JoePa's statue should stand as a reminder of PSU allowing child rapists to prey on little boys for the school's financial gain.

Universities are businesses. They are held liable for this as well. University officials allowed this to happen in order to benefit the primary money maker for the school known as the PSU football program. The university must pay a harsh penalty for this because they received money at the cost of countless young boys' souls.

OH AND I BETTER NOT NEVER EVER HEAR ANY PSU FAN SLANDER ANY OTHER UNIVERSITY'S FANS OVER MORAL CONDUCT.

You can make the argument that PSU athletics serve as an advertisement or an inducement for regular students to go there instead of somewhere else, but it seems the only real money the athletic department contributes to the general fund are $16M in athletic scholarships.

That doesn't mean the university shouldn't answer for its failures on moral grounds, of course.

I suspect there's a pretty healthy middle ground where everybody who was harmed by this gets the eyepopping settlement they deserve and the university can continue to actually exist and educate students.

To be more specific, back in March a professor in Penn State's history department named Ronnie Hsia gave a completely awesome talk about Matteo Ricci's unique approach to spreading Catholicism in China. It was a great example of how big questions could be poked at with very close and thorough historical methods.

Once Penn State is made an example of, what happens to his work?

>big athletic colleges

The ones that own the town or state they are in.

that are frequently above the law, as evidenced by the earlier Sandusky rape "investigations", or who get too much money or too many tax breaks, while we cut social services, teachers, firemen, etc. You know, "the age of austerity".

Sucks that honest academic employees might get hurt in the shuffle (though I'd rather be an out of work academic than a Sandusky rape victim), but that's part of the problem of how college athletics (and pro to a different extent) have evolved in US society these days.

I love sports, but these old white men clubs have too much power.

cover-uppers going back through several investigations.

and the wife. no. way. in. hail. my wiz is letting me (who does a lot of community service and helps local youth) have sleepovers w/ kids in the basement.

that shit is incomprehensible.

you can close your eyes tight as shit and walk outside and still know the sun is there.

no way in hell she ain't know.

and mcqueary makes me queasy. no pun. big ol' mofo like that (ion't care if he was an ex-qb) letting some shit like that go down?

no fucking way.

they need to let ALL of the present players at PSU (football) transfer to whatever school without penalty to complete their ncaa eligibility.

football program needs to get the death penalty (i mean actually shutting the shit down). treat it like a radioactive site or some shit. give it like 5-10 years to cool down.

shit, if it was a (black) frat did some stupid shit on a campus, they get kicked off the yard for 3-5 years or so, don't they? (i'm only familiar w/ black frat fuckery, i'm sure it happens to white frats, too). there shouldn't be another 'line' of PSU football for half a generation.

don't penalize the other sports. but the entire machinery of the athletic department needs to be ripped out and replaced by folks w/ no ties to the current or past regimes.

and there needs to be an incredible settlement paid out to these victims. damn sure enough to pay for their future counseling and support, but also enough to let ANY other institution know that if they 'protect the institution' instead of protecting the kids they will be nothing but a shit stain on history.

an unrepentant monster.

enabled by other monsters.

peace & blessings,

Less students=less money.

In other words, people stop giving their money to a school that failed to stop this at every level.

It has nothing to do with "fuzzy memories of not going to class elsewhere", it means that money, that support, and those future alumni go elsewhere.

75. "Lawyer: Sandusky "defiant", insists on his innocence (SWIPE)"
In response to Reply # 0

Good luck with that, dude.

http://nbcsports.msnbc.com/id/45191337/ns/sports-college_football/

STATE COLLEGE, Pa. (AP) - As Jerry Sandusky insisted through a lawyer Monday that he is not guilty of sexually abusing children, a juror who voted to convict the retired Penn State assistant coach said she hoped the verdict would help his accusers heal.

The jury found the testimony of the eight victims who took the witness stand compelling, Ann Van Kuren said Monday. Jurors weighed the accounts and evidence diligently before finding Sandusky guilty last week of 45 counts for sexually abusing 10 boys over 15 years, she said.

She expressed empathy for the eight men who offered emotional and explicit testimony.

"I really feel for the victims and any other victims that are out there that haven't come forward," Van Kuren said. "That all of them need to heal. I'm hoping that this trial, with this verdict, will help them heal."

The sweeping case rocked the Penn State community following Sandusky's arrest in November. The ensuing scandal led to the ousters of Sandusky's former boss - Hall of Fame coach Joe Paterno - and the university's president, while forcing a re-examination of the role that college administrators played in reporting abuse allegations.

Sandusky, 68, is under observation at the Centre County jail, where he is being kept away from other inmates pending a psychological review that will help determine the next step toward his sentencing in about three months.

"He's defiant and wants the truth to be told. He wants people to know that he's not guilty," said defense lawyer Karl Rominger, who visited his incarcerated client Monday.

Also Monday, Judge John Cleland ordered county probation officers to evaluate whether Sandusky is a sexual predator, a finding that could factor into his prison placement. Such orders are pro forma in sex abuse cases. Sex offenders are required to undergo treatment while in prison, so Sandusky, if deemed a predator, would likely be sent to a facility with such a program.

Sandusky, who has been placed under a suicide watch, said he doesn't want to kill himself and wants to get the separate psychological examination done so that he can receive visits from his friends and family, Rominger said.

"He's fine but he's just not been evaluated," the lawyer said.

"He is very disappointed to be in prison. He is anxious to get out of this suicide watch," Rominger said, adding that Sandusky told him: "If I have to keep sitting in this room for another three or four days without being able to talk to anybody, I might start to need help at that point."

The state investigation into Sandusky didn't begin until after the ex-coach was barred from a high school in 2009, when a mother complained about the former coach. At the time, Gov. Tom Corbett was the state attorney general. Charges were filed in November 2011.

Investigators took into account Sandusky's status as a celebrated assistant coach in building the case, Corbett said Monday when asked in Harrisburg why charges weren't filed after the first accuser came forward.

"If it's one-on-one and now put the celebrity status in, put (that) Jerry Sandusky is loved by everybody ... how can anybody say there must be something wrong," Corbett said. "You'd better corroborate it, and that's what they started doing. They started pulling strings and gathering and gathering and gathering, and that's my experience. You build those cases, as well as you can."

Corbett said that while he worried that Sandusky might find a new victim while the investigation continued, "I believed (Sandusky) had to know we were looking at him at some point in time. In a sense, if you know that they're looking at you, you kind of back away. But it was a calculated risk, not one that you really easily want to take."

Sandusky has repeatedly maintained his innocence. He will likely die in prison, given mandatory minimum sentencing requirements.

The conviction is just the start of possibly years of legal proceedings over the case. Besides appeals, there remains an active investigation into Sandusky by the state attorney general's office, as well as a federal investigation.

Corbett said Penn State trustees are still awaiting the results of an internal investigation by former FBI director Louis Freeh into the school's handling of the Sandusky case.

The university could also face a wave of new lawsuits. An hour after the verdict Friday night, Penn State said in a statement it was inviting victims to "participate in a program to facilitate the resolution of claims against the university arising out of Mr. Sandusky's conduct." The school said it sought to address victims' concerns privately, expeditiously and fairly.

Asked to clarify Monday, school spokesman Dave LaTorre said the university won't discuss details about litigation or how much money might be set aside for potential settlements, and declined to comment further.

The verdict was another hurdle for a fractured Penn State community eager to continue what figures to be a long, arduous healing process. Artist Michael Pilato hoped to aid in that effort Monday when he painted a blue ribbon - a symbol for awareness of child sexual abuse - on the portion of his "Inspiration State College" mural downtown that once included Sandusky.

Over the weekend, he replaced the Sandusky image with Van Kuren's red handprint and a depiction of Dora McQuaid, a poet and advocate for domestic and sexual violence victims and issues. McQuaid is a Penn State graduate and former professor.

Van Kuren said she and Pilato were connected over the weekend through a mutual acquaintance.

"These young people that were the victims of the Sandusky case in my mind are the survivors," Pilato said. He painted the blue ribbon around McQuaid's image.

Van Kuren, who runs a nonprofit dance company, called the last few weeks difficult as she and other jurors were ordered to refrain from watching or reading the news and talking about the case with family and friends.

Jurors, she said, took a systematic approach in deliberations, weighing the counts in order as laid out in the state's presentment. Van Kuren said that in instances when jurors had additional questions for the judge - such as when the jury requested a re-reading of key prosecution witness Mike McQueary's testimony of a 2001 allegation between Sandusky and a child in a shower - they put counts related to that victim aside and moved to the next set of charges.

Asked about her perception now of Sandusky, Van Kuren said "I think we all felt that when we saw him, and even now what we hear about him, (that) he knows what he did."

The jury had a good rapport, but the difficult part about deliberations, she said, was the volume of testimony and evidence that had to be weighed. The jurors were respectful of the situations of "all parties" and took everything into consideration, she added.

coach paterno...

but these emails do seem to insinuate that Paterno's discussions with the AD promoted the idea of dealing directly with Sandusky without reporting the issue to Child services...

Not sure what legal obligations to report to the agency any of these people had...but the obvious moral responsibility rises to a level where there should be some very severe punishment for those involved in the cover up....individuals...the university ...and the football program.

I'm a mandated reporter ...the training and so forth we get every year is mandatory, and we have to sign off on getting that training every year. This year because of allegations at Miramonte school, the entire district had to get like extra training in the middle of the school year...

I just didn't know if a person who worked at a university was subjected to the same type of accountability in reporting as I would be at a high school..... I mean because if so...I cannot imagine anyone even thinking about not reporting these type of allegations...

It's like the law that you have to report that type of shit. It's amazing to me a president for such a university would be okay with HIM knowing that there were allegations, and being okay with not reporting that shit...

this is turning out to be a very sinister...very tragic situation...

regardless they all knew enough and were given more than ample enough info to report Sandusky to child services. Plus, take into consideration the strong ties between the 2nd Mile and PSU football and it makes it all the more irresponsible and reprensible. They knew he was a pedophile and basically gave him a free pass by choosing not to report him to the proper authorities or at the very least permanently ban him from all PSU facilities. I'd be interested to hear what their follow up plan was and what exactly was their thought process when making such morally reprensible decisions. Problem is, we will probably never get the full truth because none of these guys involved (the university and bot included) have demonstrated an ounce of responsibility or accountability in regards to their involvement. The blame game is gonna be in full effect.

and the university wanted to avoid reporting it, and keep the handling of the situation so-called in house...

what I'm curious about now is that once the allegations and red flags were observed and/or reported by people OUTSIDE of the program and AD and school president.....like once a parent reported the issue to the police or whomever..... How was the issue handled on that end. I mean once the police actually knew....what did they do.

Because I'm going to tell you....if the police handled the accusations in the same manner as the school president and AD at PSU did....or even worse...if they handled it similarily and there was a COLLABORATION between the police and PSU..... I mean if there is evidence of that then we are talking about some very serious Federal Charges towards the police and the university.

This is all turning out to be worse than I think most would have imagined...

my previous statements about Coach Paterno may have seemed like I was taking up for him. My point then was that if he was involved in not reporting this issue....which I know see probably happened...there is still no way he should be scapegoated as being the primary person responsible for the cover up...I mean if it rose to the level of a university president as well as ranking members of the police purposely avoiding investigating this, or cover it up.....that goes well beyond a football coach.

is the fact that in the emails, they are talking about "the subject" "the incident" "the charitable organization" etc.

They were DELIBERATELY avoiding using the proper names and descriptions because they KNEW that it could be used as evidence against them if it ever got out.

That's some mafia shit, right there.

>the program and AD and school president.....like once a parent
>reported the issue to the police or whomever..... How was the
>issue handled on that end. I mean once the police actually

This is what I'm having trouble comprehending as well too. Also, what I'm wondering is, did the police contact the Second Mile Organization because it would certainly be in the organization's best interests to know that their head spokesman/founder was having (at the least to their knowledge) inappropriate contact with underrage kids.

I can't understand how there wasn't enough evidence to prosecute Sandsusky even with his admission that he 'wished he were dead' after pleading for forgiveness after showering naked with a young boy. The case was dropped by the DA and never reopened. One horrible statistic I recently learned is that PA has one of the lowest - if not the lowest overall - rates of prosecuting suspected child abusers/pedophiles. I think PA's rate of conviction is something like 1/100 vs. the national average of 9/100. Pretty eye-opening/scary thought.

>Because I'm going to tell you....if the police handled the

A lot of facts are yet to be determined, but this could very well be the case. My personal belief is that there was more collaboration between the 2nd Mile and PSU given how closely the two were intertwined.

>This is all turning out to be worse than I think most would
>have imagined...

Absolutely, and as someone who's parents and countless close friends and family members attended the univerisity it makes me sick to my stomach that the University/coaches had THAT much power to allow something like this to occur for so long.

>my previous statements about Coach Paterno may have seemed
>like I was taking up for him. My point then was that if he was

>cover up...I mean if it rose to the level of a university
>president as well as ranking members of the police purposely
>avoiding investigating this, or cover it up.....that goes well
>beyond a football coach.

I agree that he shouldn't be the primary person responsible for the cover up, but he had to have played a role in it given his stature at PSU. But yes, absolutely there are a number of other grown adults who were in a primary position to step up and do right thing and they failed to do so. Joe Pa is someone I grew up admiring so it definitely took me awhile to come to my senses and realize his role in the cover-up. The man got a TON of praise throughout his life and most of it centered on the strength of his character. As many people have stated over and over again, you can't have it both ways. So naturally, as the figurehead of PSU he will be the one who shoulders most of the blame.

http://thewriteeverydayproject.blogspot.com/2012/07/why-ncaa-shouldnt-punish-penn-state.html

Andy Staples at SI just posted an article that nails it. Read it now.

Staples spends most of the article running through the only needed justification why Penn State shouldn't get any NCAA punishment: because there's no NCAA bylaws against anything anyone at Penn State did. Do you think the NCAA should get in the business of making up what it sanctions on the fly?

As Staples points out, worrying that no NCAA punishment lets Penn State off the hook is completely misguided. "Besides, Penn State may have bigger problems. While this case doesn't fall under the jurisdiction of the NCAA, it does fall under the jurisdiction of the U.S. Department of Education. A Department of Education investigation that results in a termination of Penn State's accreditation would essentially amount to the Death Penalty for the entire university. Given the fact that such a punishment would put thousands of people out of work, Penn State might fall into the "too big to fail" category. Still, the possibility must fray the nerves of the thousands in State College who had nothing to do with this atrocity."

Far, far worse penalties are coming for all individuals involved and the institution as a whole. Penn State is not going to lose its accreditation, but ED is going to hit us with restrictions and sanctions with no precedent in American history.

The one set of punishments which Staples doesn't address but is very real are financial. In no way do I believe that any financial penalty can offset the harm Sandusky committed and Penn State ignored, but we often use financial penalties to penalize horrific deeds, because they serve as a deterrent to future offenders. By the time this ordeal is over, Penn State is going to have to write a nine-figure check, and the first digit might not be a one. ED is going to fine us at least 50 million dollars. I would say at least that much money and probably closer to 100 million will be needed to compensate Sandusky's victims. Then there's legal fees. By the end of this, it's very conceivable that we have to pay a total of 200 million dollars. That's more than 10 percent of our endowment. And that is a far, far greater penalty than losing the football team for a year or two.

Title:19.01.2 - Exemplary Conduct.
Individuals employed by or associated with member institutions for the administration, the conduct or the coaching of intercollegiate athletics are, in the final analysis, teachers of young people. Their responsibility is an affirmative one, and they must do more than avoid improper conduct or questionable acts. Their own moral values must be so certain and positive that those younger and more pliable will be influenced by a fine example. Much more is expected of them than of the less critically placed citizen.

PSU is an academic institution who's prestigious enough to survive without football.

The sham of JoePa has been fully exposed & I spit on the grave of his destroyed and criminally deviant legacy, the president & AD belong in jail, Sandusky belongs in hell if there is such a place but for now General Population & prolongued torture for the rest of his days will do while the rest of the people who continue to support this disgraced program can swim in the sweaty stink of the worst scandal in the history of college athletics.

They should have forfeited the rest of last season from the Nebraska game forward last year as an act of good faith but we know by now that would take a level of self-awareness & ability to look beyond football that this pathetic university/community is incable of doing as exemplified by Jerry Sandusky's very existence.

I didn't bother reading the article but LOL @ the bulletpoint about this being unprecedented in terms of the NCAA's previous rulings & areas in which they deem themselves capable of doling out punishment.

Uh, could any of that have to do with the fact that a legend of the sport aiding/abetting/facillitating/covering-up/lying-in-the-aftermath of twenty years of serial child rape is (thankfully) completely unprecedented/uncharted-waters in and of itself?

The NCAA can hide behind that bullshit technicality about it not being in the bylaws to excuse themselves from showing a spine here, that school in State College as well as the NCAA as an organization (likely the institution of big-time college football itself) already sold their souls a long time ago.

The Penn State University Nittany Lions just happen to be easily the most nefarious & offensive example of this sport's Cut-Blocking-In-Babylon culture and beyond athletics serves a sordid/sickening reminder of the true level of depravity which humans are capable.

So fuck their football program or worrying about anything that comes upon it on or off the football field.

I'm glad I won money off my prop-bet (pre-cancer reveal) that JoePa was gonna be dead before Thanksgiving 2012 but I'd easily give the money back to have him live long enough to have to answer for his degeneracy.

PSU's so far beyond anything remotely connected to football that it's not even worth drawing a parallel or comparing.

Jim Tressell willfully hid information in order to keep five or six of his best players eligible & lied about at each step of the process.

So contrasting 'tats/car-loans to mortgages' is a false premise.

I'm talking about the football team, not Tim Floyd & his bullshit with the basketball program.

We get it Bomb. Pete Carroll is a saint, despite giving a scholarship to a rapist. It's not his fault agents were in the locker room, on the field, and involved with the program and it's players as much as coaches were.

edit, Honestly, USC deserved a 3 or 4 year bowl ban, but it's USC so they skated with two.

Only a delusional USC fan would draw parallels between what went on @ USC and what players did with their OWN possessions at TOSU. Tressel lied and got canned, while Pete Carroll ran from a sinking ship like a coward

everyone knew he was laissez-fare with it and ran the team too much like a pro one but the best they could come up with is that he 'should have known' rather than actually have him get caught lying to save his ass, laughably tossing his players under the bus for shit he already knew occurred but acting as if it just occurred to him, then leaving an electronic-trail of bullshit in his wake.

I don't really give a fuck about Pete Carroll, we know Sneaky Pete was ducking out because he got paid and the Bush thing finally was coming around on them five years later due to OJ Mayo on the basketball side but they really ain't prove anyone even tangentially connected to the program for Reggie taking loans from gangsters and backing out of under-the-table agency agreements while getting famous for playing at SC.

Meanwhile Vest got caught lying & covering up for the sake of his own career/player-eligibility at every single turn.

On NCAA football terms, that's far more a smoking gun than Lloyd Lake.

I also don't pretend that SC is a clean program like OSU fans (and later PSU fans) claim it to be.

Bottom line is they gave the Trojans the stiffest penalty they'd given anybody in two decades thinking that would set a precedent & show they meant business then quickly were reminded they could end up suspending half the teams in D1 at a minimum if reporters started digging so they slapped OSU lighter (plus OSU could claim act like they jettisoned Tressel as a show of good faith).

Whether or not you want to recognize that is up to you, I never claimed to occupy some kind of football moral high-ground (like Tressel & many of his worshippers did) aside from not supporting a program facilitating child rape.

That hit was taken, it's over with & in the title hunt this year.

Somehow SC has managed to be better than the Buckeyes even in the face of that shit thus far, enjoy your upcoming non-bowl-eligible season.

At least you can live with the fact that much like the past couple years it wasn't going to be a game that mattered anyway.

You can have the last word from here if you choose, this is a Penn State post so as far as the Buckeyes are concerned 'I said what I had to say, y'all can continue on'(c)Rhianna-Rumor-P

Tressel is HOF bound, and his record speaks for itself. Meanwhile Pete Carroll is bombing out of the NFL again, and it wont be long before we see him back in the college ranks, except this time he wont be nearly as successful because he'll have to play within the rules while the NCAA keeps its scope on him every step of the way.

Actually, he covered for his players by lying to the NCAA and risking his job in the process.

Yea, that electronic trail was a mess. No argument here. Dude should have used a gmail address or something. Not his god damn .edu account

Google Todd McNair. You're wildly off base here.

Lol, hardly. We fully cooperated with the NCAA while McNair and that idiot ex AD stonewalled and forced their hand, once the Yahoo! investigation was published.

>I also don't pretend that SC is a clean program like OSU fans

Never claimed it was clean, just not as dirty as USC or other SEC programs that openly "buy" recruits.

Nope, NCAA cooperation goes a long way. That was the main difference. You had a coach that was setting players up with cars, condos, cash while our coach lied about players selling their own shit for cash. HUGE difference. If you still choose to believe that Pete Carroll (and Lane Kiffin) didnt know, you're just being naive.

>Whether or not you want to recognize that is up to you,

I can say the same thing about you.

>That hit was taken, it's over with & in the title hunt this

You have Lane Kiffin as your head coach. A Rose Bowl is probably where you end up, in all honesty. Kiffin has a lot to prove before you can even begin chalking up a national title shot.

And you're telling me that a guy who wrote a book called 'Promises From God' doesn't qualify as a bible-thumper?

It's cute that you try to act like I'm somehow more personally invested in Jim Tressel than Buckeye fans such as yourself were & continue to be but the fact is I just called it like I see it and have spent far less time thinking about that clown than any of y'all ever did or will do.

Another hypocrite got his card pulled for all his lying/posturing which now has him going from video librarian to some sort of figurehead for the Akron Zips, that's fine.

I just happen to think the school itself got off easy with the egrious evidence linking the head of the school's athletic department (in the form of demigod head football coach) being directly connected to discarding evidence & lying.

But hey, at least it's nowhere near Paterno.

thats pretty standard issue for coaches.

>And you're telling me that a guy who wrote a book called

had never even heard of the book until now.

at no point as on OSU coach did i think tressel imposed his religious beliefs too heavily or alienate anyone that didnt believe similarly to him. i cant remember the word 'god' or discussion of faith appearing much in the course of about 10,000 tressel interviews and press conferences ive seen.

perhaps your brain isn't connected to your hands...cause you've typed out damn near a novels length amount of words on the subject. and here we are over a year later in a paterno thread and you keep going and going and going...

so no, im not *acting* like you're personally invested. its a factual observation. you'd be better writing it off as shtick at this point because otherwise it appears like you really got your feelings hurt on this one. deeply.

dawg, I've got damn near 70K posts on this damn board over the course of 13 years.

Stuttervest is barely a drop in the bucket.

The fact that you think Tressel is even Top 100 in terms of subjects for those shows that you really only take note of it when I spit some truth about Sweatervest, which again considering you went to the school & are in every post like you got a 'Buckeye Control F' alert function is way more a display of your investment than mine.

Funny it was so irrelevant that the head of the program decided it needed to be hidden, then when it came to light had to deny prior knowledge, then when it was proven he knew had to continue further lies/spin until eventually it became obvious he had to be jettisoned.

Why so much fuss over something so minor?

Nope, I just enjoy pointing out hypocrisy, whether it be from 'victory with honor' child-predators or clown-ass Buckeye fans/coaches/etc who tried to frame some sort of moral superiority off the field once they got repeatedly exposed as not being able to beat the best on it.

That play blew up like a Todd Boeckman slant turned Rey Rey INT TD return and now y'all are picking up the pieces while now talking up an SEC coach who curb-stomped you.

GOOD!

Wake me up when y'all get back into a big bowl because if SC's on the other side I'm gonna be taking bets & ready to party.

Oh I've been over it for quite sometime, it was never something I was overly concerned with outside of how it related to the team I rooted for but apparently my words on the matter meant more to you then they did me.

Now if you have nothing left to add we can go back to this post actually being about child molesters rather than Buckeye blather.

Feel free to link me where Tressel ever got on some self-righteous "I'm perfect, you are not, I do everything the morally superior and godly way while you are a heathen."

I know nothing about the 2nd book (take me at my word or not, i dont really care) but I did happen to read his first book and like i said, you really dont know what the fuck youre talking about.

His pious image that he 'cultivated' was a result of wearing a sweater vest and emphasizing charity work and trolls like you ran with it.

it had jack shit to do with the team that you root for. if the horrors of a memorabilia for tattoo cover-up happened in westwood you woldnt have made 2 posts about it and it wouldnt have been news for more than 1 day.

This is about kids, not sanctions.

There's probably a connection between the fanaticism of football fans and what happened at Penn St., but I'm to lazy to totally flesh it out. I would say that the way we as a culture consume football probably had some enabling effect in Penn St., and probably has enabled other wrongs in other places as well.

We could discuss ways to diminish the importance of football in our culture so that winning some games doesn't give you the right to molest kids or pretend it didn't happen.

But instead we have "SC got a slap on the wrist!" and "It was just tattoos!" and "You're wrong!" and "No, you're wrong!"

And it's because people care THAT MUCH about football that we are where we are today. It shows that the lessons we should have learned from Penn St. will be forgotten, and almost ensures that something really bad will happen again, because an awful person is going to win some games, and their awfulness will be excused or ignored because of it.

BTW, I'm not trying to call anyone out specifically, I'm just arguing that if we didn't place such importance on the on field results we never would have had such a black hole of despicable actions in the first place. The thing that we as a people can control is how important we think winning those games is.

most PSU fans had wanted joe pa out for the longest. back in 2001 they had a 5-7 season. this molestation shit wouldve been the perfect opportunity to force joe pa out. and joe pa knew that.

keeping joe pa in charge didn't exactly help the future of psu football, on or off the field.

This is the whole point...the fanatical culture of football at our schools has an effect that spreads far outside of football itself. In this case you had Paterno essentially running that entire city - the officials at the university, the police force, everything. According to the emails that were released you basically had the athletic director and school president and vice president (who ran the university police) saying that their plan was to report the incident to the authorities but "after talking to Joe" they were "uncomfortable with the next steps." So Paterno was the one who essentially gave the order to not report this stuff.

If football culture is so crazy that the coaches are running everything else, outside of normal legal channels, then what crazy things have happened at other universities but were covered up?

dishing off any percentage of the blame onto cfb fans that rock a jersey on saturdays isn't right. i think you'd be hard pressed to find a fan that wouldve signed off on joe pa and co.'s actions.

If you view this as the only instance of power run amok in college sports then that's fine logic. All I'm saying is that WE as a culture grant them that power, and we should consider what's been done with it in the past. Dave Bliss tried to cover up a murder. I'm sure there's tons of other nefarious shit that we've never heard about and never will when it happens again.

Also, it's not the people that put a jersey on for Saturdays. It's the people that wear the jersey all year, have a onesie to put on their kids the day they're born, and, for example, have a fucking riot when the coach that turns a blind eye to molestation gets kicked to the curb. That "fanaticism angle" is not a cop out, it's a real problem.

like i said in the above post, most PSU fans wanted joe pa gone. if it were up to the 'culture' then joe pa wouldve been gone over a decade ago. unfortunately joe pa rigged it up so that public opinion didn't mean shit.

oh, ok. so it's the ones who instill football traditions in their children who sign off on child molestation. gotcha.

to blame this on PSU fans or the culture would presuppose that they were happy with their football program in the first place. and happy with being a washed-up program that couldn't compete on the national level let alone consistently win the big-10.

I wasn't specifically talking about PSU fans. But to expand on that example, it isn't about what those PSU fans wanted at in 2011. It's about the culture that was built up over the decades of time that Joe was there. You said up above that Joe set it up for himself to have the power and the most PSU fans wanted him gone. PSU fans wanting to get rid of Joe didn't really happen until the last ten years. But all that time throughout the 60's, 70's, 80's, etc. set it up to where the majority of them viewed him as doing no wrong at all, and that's what allowed him to still have complete control and power through 2011.

Let me use my own school as an example because I'm not trying to specifically blame PSU fans at all. I grew up here in Ann Arbor and then went to Michigan for undergrad. I know that while Bo was alive he had enough power to have influence over MANY things outside of his role as coach and AD. I don't know if he ever abused that power, but he certainly could have if he wanted to. The image in my mind of who Bo was doesn't vibe with him abusing power, but through 2011 PSU fans would have said the same thing about Joe. Maybe we as fans shouldn't let the success on the football field and the image we have of these coaches affect the amount of unchecked power that they have.

Right. PSU fans took a lot of pride (naively) in their program doing things the 'right way'. So, it's not as if they consciously supported a win at all costs mentality.

It's not the fault of PSU fans that they were duped...but then again you're saying not to blame them. But then you're saying their fanaticism contributed to a sinister culture of absolute power, deceit and ultimately child molestation.

So, I guess I'm a little confused as to what the point is here.

>Maybe we as fans shouldn't let
>the success on the football field and the image we have of
>these coaches affect the amount of unchecked power that they
>have.

And what exactly could the fans have done differently over the past 20-30 years that would have altered this horrid chain of events?

Sometimes, we as fans give ourselves a little too much credit for our role in this. OSU fans didn't want tressel gone. But Les Wexner did and that's just about all that mattered.

have to be specific blame or innocence allocated to have a productive discussion. (And let me be clear - there is no question on the blame on Joe and the PSU administration, I'm talking about we as college football fans.)

What I'm talking about is the overall culture of college football fans that we hold our successful coaches in such high regard. It seems like this is something unique to college sports - you don't see longtime pro coaches with this much absolute power in their cities. But maybe that's because colleges are more typically in small towns where the university is the biggest thing in that city vs. pro teams that are in larger cities. But my point is I hope that an incident like this ends up shining enough of a light the issue to change the culture of these coaches as mini-gods on their campuses.

I'm just not going to extend that theme far enough to apply it to the PSU situation or say that somehow the fans could have intervened at any point along the way.

I also think the game has changed and the media coverage has changed to an extent where college coaches (even wildly successful ones) can no longer last for a lifetime Even with the great ones, its hard to last far belong the 10 year mark. The job is too stressful, there are too many potential NCAA pitfalls and the tolerance for losing seasons is far too minimal.

Joepa/PSU was just an extraordinarily unique situation. We'll never see a coach last that long or build up that kind of power again. That's a good thing.

Definitely. With all the independent blogs out there and other media it'll probably be impossible for a coach to get to be that powerful.

173. "Penn St.: Donations 2nd highest in school history (swipe)"
In response to Reply # 0

It says that alumni "rallied to the cause."

http://sports.yahoo.com/news/penn-st-donations-2nd-highest-180728556--ncaaf.html

STATE COLLEGE, Pa. (AP) -- Penn State received more than $208 million in donations for the fiscal year that just ended, the second-highest total in university history despite the upheaval after the arrest of Jerry Sandusky on child sex abuse charges.

The school said Monday there was a slight uptick in the number of alumni who donated money or gifts in the fiscal year that ended June 30 to more than 75,500, reversing two years of slight declines.

''We're very grateful - humbled really - to have this kind of response from Penn Staters, who I think have rallied to the cause ... by the side of the institution through a very difficult time,'' Rod Kirsch, senior vice president for development and alumni relations, said Monday in an interview.

The number of donors overall - which would include corporations and non-alumni - also rose slightly to more than 191,000. Donations included gifts for scholarships; as well as increases in giving to the football booster club and the annual student-organized dance marathon to raise money for pediatric cancer patients and research.

Only the 2010 fiscal year was more prolific for Penn State, when the school raised more than $274 million. What Kirsch described as a ''bonanza year'' for fundraising was due in large part to an $88 million gift by Terry Pegula, and founder and former president of an energy company involved in Pennsylvania's burgeoning natural gas industry. Pegula earmarked the gift, which is the largest private donation in Penn State history, to upgrade the school's club hockey team to Division I and build an arena.

Pegula has since increased his commitment to $102 million. He said at a groundbreaking ceremony in April that he didn't waver even after the turmoil that embroiled the campus after retired defensive coordinator Sandusky was arrested in November. It led to the ouster of head coach Joe Paterno, a move criticized by some alumni and former players.

Sandusky is awaiting sentencing after being convicted of 45 criminal counts last month.

The findings from the school's internal investigation, led by former FBI director Louis Freeh, are also expected to be released soon. Those conclusions could weigh heavily on whether the university can settle any civil lawsuits out of court.

The school has said private donations will not be used to pay for legal costs. The school isn't deviating from its overall goal of raising $2 billion in the current, seven-year fundraising campaign that began in 2007, Kirsch said. Including the most recent $208 million figure, about $1.6 billion has been raised for that campaign.

''Keep in mind we are not only dealing with the crisis we're still going through, but we're dealing with a tough economic environment still,'' Kirsch said. ''In that context, I'm not real surprised, but I'm very grateful for'' the donations.

Separately, Penn State reported $223 million in new donation commitments, down 37 percent from the previous year. Kirsch said that was expected given the size of Pegula's gift, and a big fundraising push by the school related to that donation.

The latest fundraising figures were released against the backdrop of a decline in recent years in state funding, which is used to help offset tuition for in-state residents. Penn State trustees are expected to vote on a potential tuition increase at their next meeting Friday in Scranton.

Kirsch said raising money for undergraduate scholarships remained a top priority to keep Penn State affordable. Last year, in-state freshmen and sophomores paid more than $15,000 a year in tuition to attend the main campus in State College, while out-of-state residents paid $27,000.

The school is seeking to raise more money to support faculty. Penn State said it has also raised more than $46 million from current or former faculty and staff, or $3 million more than its initial goal.

That total would include donations made by the Paterno family, such as the annual $100,000 gift in December, a month after Paterno was fired, for the library and an undergraduate fellow program that bears the family name. Paterno died in January of lung cancer at age 85.

Jump on board that Pitt bandwagon now.

http://i2.cdn.turner.com/cnn/2012/images/07/12/freeh.report.pdf

An internal probe into the Penn State child sex abuse scandal found that top university officials, including former president Graham Spanier and then-head football coach Joe Paterno, concealed allegations of abuse by ex-assistant football coach Jerry Sandusky to "avoid the consequences of bad publicity."

Spanier and Paterno, as well as former university vice president Gary Schultz and ex-athletic director Tim Curley, failed to protect victims from Sandusky, the report found. "Some coaches, administrators and football program staff members ignored the red flags of Sandusky's behaviors and no one warned the public about him," the report says.

The probe's leader, former FBI Director Louis Freeh, also said Thursday that Curley consulted with Paterno following sex abuse allegations against Sandusky, and "they changed the plan and decided not to make a report to the authorities."

Penn State leaders showed 'total disregard' for victims, review finds

The 200-page findings of the Penn State-funded internal review were released Thursday morning. CNN is examining the report, and this page will be updated with details. The report was expected to focus on what school officials knew about Sandusky's behavior and whether they tried to cover it up. The scandal led some people to claim the school put its reputation ahead of protecting potential child victims.

A jury last month convicted Sandusky, 68, the Nittany Lions' former defensive coordinator, on multiple charges of sexually abusing 10 boys over a period of 15 years.

We'll update this page with details here:

The internal probe found that prior to May 1998, "several staff members and football coaches regularly observed Sandusky showering with young boys," but "none of the individuals interviewed notified their superiors of this behavior."

The report also found that "University Police and the Department of Public Welfare responded promptly to the report by a young boy's mother of a possible sexual assault by Sandusky" in 1998, and that top university officials were "kept informed of the investigation."

At his news conference, Freeh reads from a statement, and zeros in on a sexual abuse allegation that came to Penn State officials' attention in 2001 (this was an incident in which a Penn State football graduate assistant, Mike McQueary, allegedly claimed to have seen Sandusky sexually abuse a child in a Penn State shower that year):

"In critical written correspondence that we uncovered on March 20 of this year, we see evidence of their proposed plan of action in February 2001 that included reporting allegations about Sandusky to the authorities.

"After Mr. Curley consulted with Mr. Paterno, however, they changed the plan and decided not to make a report to the
authorities. Their failure to protect the February 9, 2001 child victim, or make attempts to identify him, created a dangerous situation for other unknown, unsuspecting young boys who were lured to the Penn State campus and football games by Sandusky and victimized repeatedly by him.

"Further, they exposed this child to additional harm by alerting Sandusky, who was the only one who knew the childs identity, about what McQueary saw in the shower on the night of February 9, 2001.

"The stated reasons by ... Spanier, Schultz, Paterno and Curley for not taking action to identify the victim and for not reporting Sandusky to the police or Child Welfare are:

"(1) Through counsel, Messrs. Curley and Schultz have stated that the humane thing to do in 2001 was to carefully and responsibly assess the best way to handle vague but troubling allegations.

"(2) Mr. Paterno said that I didnt know exactly how to handle it and I was afraid to do something that might jeopardize what the university procedure was. So I backed away and turned it over to some other people, people I thought would have a little more expertise than I did. It didnt work out that way.

"(3) Mr. Spanier told the Special Investigative Counsel that he was never told by anyone that the February 2001 incident in the shower involved the sexual abuse of a child but only horsing around. He further stated that he never asked what horsing around by Sandusky entailed.

"Taking into account the available witness statements and evidence, it is more reasonable to conclude that, in order to avoid the consequences of bad publicity, the most powerful leaders at Penn State University - ... Spanier, Schultz, Paterno and Curley repeatedly concealed critical facts relating to Sanduskys child abuse from the authorities, the Board of Trustees, Penn State community, and the public at large.

"Although concern to treat the child abuser humanely was expressly stated, no such sentiments were ever expressed by them for Sanduskys victims."

Freeh, the former FBI director who led the Penn State-funded probe, is addressing the media. Updates shortly.

Here are what the report calls "key findings" relating to Penn State officials' response to the sexual abuse allegations:

Before May 1998, several staff members and football coaches regularly observed Sandusky showering with young boys in the Lasch Building (now the East Area Locker Building or Old Lasch). None of the individuals interviewed notified their superiors of this behavior.

University Police and the Department of Public Welfare responded promptly to the report by a young boys mother of a possible sexual assault by Sandusky in the Lasch Building on May 3, 1998.

While no information indicates University leaders interfered with the investigation, Spanier, Schultz, Paterno and Curley were kept informed of the investigation.

On May 5, 1998, Schultzs notes about the incident state: Is this opening of pandoras
box? Other children?"

On June 9, 1998, Schultz emails Spanier and Curley: I think the matter has been appropriately investigated and I hope it is now behind us .

Detective recalled interviewing Sandusky in the Lasch Building so as not to put him on the defensive. The detective advised Sandusky not to shower with any child and Sandusky said he wouldnt. At the conclusion of the investigation, no charges were filed against Sandusky.

Spanier, Schultz, Paterno and Curley did not even speak to Sandusky about his conduct on May 3, 1998 in the Lasch Building.

Despite their knowledge of the criminal investigation of Sandusky, Spanier, Schultz, Paterno and Curley took no action to limit Sanduskys access to Penn State facilities or took any measures to protect children on their campuses.

Spanier and Schultz failed to report the 1998 investigation to the Board of Trustees.

Sandusky was convicted of several assaults that occurred after the 1998 incident. Some of these sexual assaults against young boys might have been prevented had Sandusky been prohibited from bringing minors to University facilities and University football bowl
games.

The report says that in May 2011, Spanier and the school's general counsel, Cynthia Baldwin, minimized the seriousness of a child sex abuse investigation into Sandusky during a Board of Trustees meeting "by not fully describing the nature of the allegations or raising the issue of possible negative impact to the University."

The board also did not make "reasonable inquiry" about the investigation, the report says.

The Board of Trustees' dismissal of Paterno in November 2011 "was poorly handled, as were the Board's communications with public," the report says.

Penn State is scheduled to hold a 3:30 p.m. ET news conference Thursday regarding the internal review.

The report highlights Penn State's decision to allow Sandusky to retire in 1999 "as a valued member of the Penn State football legacy," after allegations in 1998, "essentially granted him license to bring boys to campus facilities for 'grooming' as targets for his assaults."

More from the findings: Four of the most powerful people at The Pennsylvania State University President Graham B. Spanier, Senior Vice President-Finance and Business Gary C. Schultz, Athletic Director Timothy M. Curley and Head Football Coach Joseph V. Paterno failed to protect against a child sexual predator harming children for over a decade.

These men concealed Sanduskys activities from the Board of Trustees, the University community and authorities. They exhibited a striking lack of empathy for Sanduskys victims by failing to inquire as to their safety and well-being, especially by not attempting to determine the identity of the child who Sandusky assaulted in the Lasch Building in 2001. ...

These individuals, unchecked by the Board of Trustees that did not perform its oversight duties, empowered Sandusky to attract potential victims to the campus and football events by allowing him to have continued, unrestricted and unsupervised access to the Universitys facilities and affiliation with the Universitys prominent football program.

From the findings: The most saddening finding by the by the Special Investigative Counsel is the total and consistent disregard by the most senior leaders at Penn State for the safety and welfare of Sanduskys child victims. As the Grand Jury similarly noted in its presentment, there was no attempt to investigate, to identify Victim 2, or to protect that child or any others from similar conduct except as related to preventing its re-occurrence on University property.

The top leadership at Penn State University including then-President Graham Spanier and then-head football coach Joe Paterno concealed Sandusky's activities from the public and the university community to "avoid the consequences of bad publicity," according to the internal review.

Louis Freeh, the former FBI director who led the Penn State-funded probe, said Thursday that former athletic director Tim Curley consulted with former head coach Joe Paterno following sex abuse allegations against Jerry Sandusky and "they changed the plan and decided not to make a report to the authorities."

The probe's leader, former FBI director Louis Freeh, has released a statement saying that the probe's "most saddening and sobering finding is the total disregard for the safety and welfare of Sanduskys child victims by the most senior leaders at Penn State.

"The most powerful men at Penn State failed to take any steps for 14 years to protect the children who Sandusky victimized," Freeh said. "Messrs. Spanier, Schultz, Paterno and Curley never demonstrated, through actions or words, any concern for the safety and well-being of Sanduskys victims until after Sanduskys arrest."

These are Freeh's remarks accompanying the report. CNN has yet to examine the entirety of the report itself.

More details:

The Sandusky case led to the November 2011 dismissal of legendary head coach Joe Paterno, as well as the ouster of the university's longtime president Graham Spanier and athletic director Tim Curley.

Freeh's internal investigation is separate from criminal investigations that have resulted in Sandusky's conviction and charges against former athletic director Tim Curley and former Penn State Vice President Gary Schultz.

The fact that they covered up crimes to protect the university doesn't surprise me. The strange thing is just how bad they were at the cover up...if they knew in 1998, and basically forced Sandusky to retire because of it, why did they continue to let him be around the program? They should have been easily able to convince him into giving up his position with the charity and also stop being around the program with the threat of reporting him to the police. Basically make him move far away and not come back around. They had another chance to do this in 2001 when it kept happening and they still did nothing to really protect themselves. I'm not even talking about the unknown number of kids that were victimized after them knowing about it - I'm just saying that if they were gonna sweep a mess under the rug, why leave half of the mess out on the floor?

Death penalty for the football program. And kick them out of the Big Ten permanently. Everyone that knew something needs to go to jail.

bad enough that I didn't think we needed to reach for this other stuff. But now that he's already convicted, and all this evidence (and not speculation) on who knew about it and when they knew, we got to go one step further and figure out WHY they'd go to such great lengths to protect someone actively doing this, on their campus.

they kept sandusky on campus so that should any 'situation' arise in the future they'd be able to keep a lid on it and use university police, intimidation, whatever to suppress the situation. let sandusky get his rocks off and shower up with kids in the locker room at PSU and anyone that see's something they shouldn't (ie. mcqueary, the janitor, etc.) will know not to say shit or at least be 'compelled' to not say shit.

if they banned sandusky from happy valley and shipped his ass out to wyoming...how long before he terrorizes that community and someone goes straight to the cops? if they weren't going to do the proper thing and hand sandusky over to the law then they needed to keep a close eye on him.

if PSU was on some mafia shit (and they were) the best course of action wouldve been to have sandusky offed. for reals.

It purports to organize and oversee collegiate athletics to promote "student athlete" life or some bullshit.

A football coach and his staff covering up a child rapist on their staff is easily in their jurisdiction.

Funny enough, adequate punishment is usually out of its jurisdiction, but collecting millions from unpaid athletes is.

Now that we know for a fact that they knew about the allegations in 1998, and that in 2001 they were ready to go to the police, but after talking to Joe they were no longer comfortable with turning Sandusky in. What did Paterno tell them that made them not comfortable? It couldn't have just been "don't turn him in, it'll be bad for the university". Did Paterno tell them that if Sandusky was turned in he'd snitch on other dirt that was happening at PSU?

I just can't believe that the administration was stupid enough to let Sandusky still be around unless he had some kind of leverage to use against them that stopped them from turning him in.

The power structure at PSU, just as at any major-sport university, has become dominated by the athletic program--in PSU's case by football, at some other universities by basketball. As such, it's easy to imagine the same sort of situation happening at any number of other universities, for athletics is king. And this must be the way we Americans want it to be, because it's exactly what we've ourselves created.

no administration is stupid enough to not recognize the potential fallout of such a cover-up...

and no administration is stupid enough to think that they could control a man with such a sick tendency, ESPECIALLY when they provide a free playground and a childrens charity to facilitate the whole process. 'don't do it again, jerry!' isn't gonna help a school president sleep at night. they knew they were dealing with a fucking basketcase and that the probability of the shit hitting the fan was really, really high..

this was the gamble of all gambles and frankly its amazing that nobody dropped a dime on sandusky earlier.

there's just no incentive for any other school to engage in this type of cover-up and downright facilitation.

This is NOT about respect for Joe or being worried about the image of PSU. This goes WAAAYYYY beyond that. Look at this, a quote straight from the report:

http://sports.yahoo.com/news/ncaaf--freeh-report-penn-state-key-findings-joe-paterno-jerry-sandusky-.html

"Based on the evidence, the only known, intervening factor between the decision made on February 25, 2001 by Messrs. Spanier, Curley and Schulz to report the incident to the Department of Public Welfare, and then agreeing not to do so on February 27th, was Mr. Paterno's February 26th conversation with Mr. Curley," the report wrote.

They got together, and made a decision to report this incident. Then Joe convinces them otherwise and they change their minds. Change their minds??? This wasn't some small university decision going on here. This was putting their and PSU's entire legacy on the line. Joe HAD to have told them about some type of leverage that Sandusky had. They didn't even kick him off campus! Even after another incident happened in 2001! There's NO possible way that a freaking university president, vice president, and athletic director are that stupid to just let him stay around because of Joe's word. Sandusky knew something.

the sports-driven universities. over the last 40 years, no other athletics program has played the morally superior card more than Penn State. insisting they are better human beings than you or I is their brand -- a retrospectively disgusting aura of hubris that fed into this delusional cover-up.

it's also hard to imagine a head coach earning a tenure as long as Paterno's anymore (which strengthened his power to the point he could keep a rapist free). win-at-all-costs universities care about winning-at-all-costs, not polishing their ivory tower and appeasing a has-been coach.

have fun trying to convince a newly hired up and coming offensive assistant coach from another state to risk his entire career and head coaching aspirations to go to bat for some retired defensive coordinator turned pedophile whom he's never met in his life.

they didn't have to hold to Pennsylvania's transparency laws? people being monsters is obviously not unique to PSU, but theirs was an incredibly insular university.

nobody in such positions of power could be that stupid.

and this is where there's a missing link to the story as to why they went through such lengths to protect sandusky. this wasnt about wins and losses and rah rah rah college football craziness where we as fans need to wallow in self-condemnation and toss our team apparel in the garbage lest we create another monster. as if we had some sort of role in this.

do you think graham spanier really gave a fuck about college football to the extent that he was willing to destroy his career and risk hard jail time? its not like PSU was hanging banners from the stadium year after year...they've been a middle of the road program for a minute now.

>Because frankly I don't see where PSU is any different than
>anywhere else. If it could happen there, why couldn't it
>happen anywhere?

like will said, paterno/happy valley was a very unique situation with an obvious void of checks and balances.

Maybe Sandusky had some dirt on the program that might have gotten them into trouble with the NCAA and the school sought out a way to quietly sweep the child abuse under the rug. If that is the case then the program should be punished severely. This has the makings of something that should get you a lifetime ban.

Once they committed to the lie they had to see it through. It worked out almost as well as it could have for Paterno, which I think is what pisses a lot of people off even more (understandably so).

You have to figure this goes up higher than the school, too, if there was an investigation in 1998 and people have ears, eyes and suspicions. Then again, there were small-time reporters and then big-time ones reporting this months and months before the big story broke and people showered them with hate mail.

Still, I have to think that at the law enforcement and government levels, there was some awareness even without the football program spilling its guts.

We'll never know how far down the rabbit hole it goes. Even this big investigation, all it really showed us was that there was some plan to go to the authorities and Paterno was the first to shoot it down. That's damning but it's the only real revelation. Anybody who couldn't see through the lies before was fooling themselves (cough *Rick Reilly* cough).

And you will know MY JACKET IS GOLD when I lay my vengeance upon thee.

In response to Reply # 0

I keep hearing people wanting the NCAA to use the death penalty. Well, it's simply not going to happen. Why? Because the NCAA has too much money on the line; and no matter how much moral BS you'll hear the NCAA spout about this situation - the NCAA is still about $

If they killed the PSU football program that would hurt the Big 10 and send a ripple throughout NCAA football that would hurt everybody monetarily.

And well, you know the NCAA isn't going to let that happen.

I realize that the NCAA is probably going hmmmm and haaaahhh, and then decide there's nothing they can do, while they make sure to say something really mean and condemning about PSU's behavior. Too much money at stake if you cancel games. I get that.

But still if a university and athletic department is covering up, and borderline facilitating child rape, and they don't get the death penalty then what would they have to do?

If anyone needs to take a time out from sports and put their lives in proper perspective, its PSU and the people of Happy Valley.

You worried about the athletes? cool, let them out of their scholarships and transfer to another school without penalty.

Big10 Network already has it's foot in the door all over the country on cable channels, dropping PSU won't mean shit to them at this point.

And the number of people expecting and wanting the death penalty, it would be boneheaded for the NCAA not to use it now. And if they don't, mark my words, this will end up in DC.

in the job market at the moment, obviously experience trumps shit but it would suck to get stuck on a technicality & you might not even know about it when that decision happens.

If you're just divorcing yourself from the school on LinkedIn or social media than that's fine as a symbolic gesture but there's really nothing to be gained by you taking a degree that you worked for off.

I mean obviously, do what you feel is best but that just doesn't add up to me.

Just don't send them any money & let alumni know why.

The university I went to (Georgia State) isn't that great, but the business school (Robinson College) actually has a really high profile in finance and accountancy, so they coached us to list it as a "BA from the Robinson College of Business at Georgia State University".

So Associate of Science from the Eberly College of Science at State University, Pennsylvania.

Sounds fancy.

How Spanier hasn't been indicted yet, I will never know.

Then again, I do know, because Freeh's investigation is more detailed than the grand jury one. Hell; they thought the 01 incident was in 2002 until Freeh corrected the prosecutors on it.

As far as PSU's concerned, my guess as to how this snowballed is that it was evident that Sandusky had started engaging in pedophilia long before 1998. As the Freeh Report stated, 3 of the victims that Sandusky had been found guilty of sexually assaulting were done on that PSU campus before 1998. In fact, in 95 one of the kids was not only familiar with the campus, but Sandusky took him to the Rose Bowl game in 95. So by the time the 98 incident happened, the cat was out of the bag. That's why Gary Schultz referred to a "pandora's box" in an email in 98.

I doubt Paterno, Gary Schultz, and Tim Curley knew what exactly Sandusky was doing with those kids, but that's also because they didn't want to know. Sandusky had been around kids for so long due to his supposed mentor work that he had been interchangeable with them. Sandusky's hanging around kids turned into showers with them, and they probably frowned but decided not to confront him about it. It was probably denial that he would do such a thing as well. So when 98 came, they knew if this was a case of pedophilia, that it wasn't the first one, and for them to have a pedophile on the staff since 1969 would have brought down the entire program. So they kept it quiet, and it snowballed even further.

There's no question in my mind that if there was a full investigation of Sandusky in 1998, Paterno would have had to resign in disgrace alone. They probably would have found earlier victims. Schultz and Curley knew that, and so did Spanier. Thus, the less they knew, the better off THEY were, and I believe there was pressure placed on both the University Police and DPW (who had a conflict of interest as they were placing children within the Second Mile program and getting paid for it) to not go any further with the case if they didn't find outright sexual misconduct.

As for today, not only should Spanier be indicted yesterday, but I think the entire Board of Trustees should have a planned full turnover within 6-12 months. They need new people on that board that will set up a system within the school - not just the athletic dept - that will hold faculty and staff accountable for reporting problems with conduct, ethics, and criminality. The current Trustees were absolutely clueless about all of this stuff until it was reported in the media. In fact, they were clueless about Spanier and Paterno's involvement in the Sandusky coverup up until the weekend where they fired both. Part of this mess resulted from them being clueless and trusting in Spanier while he was deceiving them during the grand jury investigation. They need Trustees that will take an active approach to get to the bottom of any potential problems at PSU, and these guys didn't do that.

I'll have some more thoughts later. I'm sleepy.

243. "NYT: Paterno won sweeter deal even as scandal played out (swipe)"
In response to Reply # 0

In January 2011, Joe Paterno learned prosecutors were investigating his longtime assistant coach Jerry Sandusky for sexually assaulting young boys. Soon, Mr. Paterno had testified before a grand jury, and the rough outlines of what would become a giant scandal had been published in a local newspaper.

That same month, Mr. Paterno, the football coach at Penn State, began negotiating with his superiors to amend his contract, with the timing something of a surprise because the contract was not set to expire until the end of 2012, according to university documents and people with knowledge of the discussions. By August, Mr. Paterno and the universitys president, both of whom were by then embroiled in the Sandusky investigation, had reached an agreement.

Mr. Paterno was to be paid $3 million at the end of the 2011 season if he agreed it would be his last. Interest-free loans totaling $350,000 that the university had made to Mr. Paterno over the years would be forgiven as part of the retirement package. He would also have the use of the universitys private plane and a luxury box at Beaver Stadium for him and his family to use over the next 25 years.

The universitys full board of trustees was kept in the dark about the arrangement until November, when Mr. Sandusky was arrested and the contract arrangements, along with so much else at Penn State, were upended. Mr. Paterno was fired, two of the universitys top officials were indicted in connection with the scandal, and the trustees, who held Mr. Paternos financial fate in their hands, came under verbal assault from the coachs angry supporters.

Board members who raised questions about whether the university ought to go forward with the payments were quickly shut down, according to two people with direct knowledge of the negotiations.

In the end, the board of trustees bombarded with hate mail and threatened with a defamation lawsuit by Mr. Paternos family gave the family virtually everything it wanted, with a package worth roughly $5.5 million. Documents show that the board even tossed in some extras that the family demanded, like the use of specialized hydrotherapy massage equipment for Mr. Paternos wife at the universitys Lasch Building, where Mr. Sandusky had molested a number of his victims.

The details of Mr. Paterno and his familys fight for money seem to deepen one of the lasting truths of the Sandusky scandal: the significant power that Mr. Paterno exerted on the state institution, its officials, its alumni and its purse strings.

Since Mr. Paternos death in January, Mr. Paternos family, lawyers and publicists have mounted an aggressive campaign to protect his legacy. The family and its lawyers have hammered the universitys board of trustees, accusing members of attempting to deflect blame onto a dying Mr. Paterno. This week, they angrily disputed the conclusions of an independent investigation that asserted Mr. Paterno and other top university officials protected a serial predator in order to avoid the consequences of bad publicity for the university, its football program and its coachs reputation.

On Friday, Wick Sollers, a lawyer for Mr. Paterno and his family, said that it was Penn State that last summer proposed the lucrative retirement package, and that many of the aspects of the proposal use of the plane, the luxury box had existed in prior contracts.

Information about the salary paid to Mr. Paterno, one of the longest serving and most successful college football coaches in history, had for many years been hard to come by. In recent years, though, it became fairly common knowledge that he earned about $1 million annually, not counting his television deals and his contracts with shoe and apparel companies.

But speculation about just how long he was going to remain the well-compensated coach of Penn State had been going on for a decade or more. Mr. Paterno survived an attempt to force him into retirement in 2004, and before the Sandusky revelations, his most recent deal ran through the end of 2012.

According to university records, Mr. Paterno first expressed a desire to revisit his contract in January 2011. It was very early in that month that he learned he had been subpoenaed to testify before the Sandusky grand jury.

But it was not until summer after Mr. Paterno, the university president and two other senior officials at the university had all testified before the Sandusky grand jury that the idea that Mr. Paterno might retire in exchange for a multimillion-dollar payout gained traction.

By August, a deal had effectively been reached, though it and the idea that Mr. Paterno might make 2011 his last season had not been announced at the time. Details of the agreement were known to a handful of board members but not shared with the full board, according to people with knowledge of the events.

On Nov. 5, 2011, Mr. Sandusky was arrested, and two Penn State administrators men who were Mr. Paternos superiors were indicted on charges of failing to report to the authorities a 2001 allegation that Mr. Sandusky had attacked a young boy in the football buildings showers.

Quickly, it became clear that Mr. Paterno, too, had failed to go to the authorities or even to confront Mr. Sandusky after he had been told in person of the episode. The prospect that Mr. Paterno, a revered figure, might be fired by the board of trustees was suddenly real.

Mr. Paterno quickly issued a statement saying, in effect, that the board need not act, that he would resign at the end of the season. Neither he nor the university revealed that he had effectively agreed to do so already, in return for an expensive financial package.

The board fired him anyway, a decision that caused rioting and led to an angry and often very personal backlash against the trustees, but it agreed to honor his contract. It was then that the full board came to find out what the university was obligated to pay Mr. Paterno.

Over the ensuing months, as revelations about the role Mr. Paterno and other university officials played in the scandal mounted, a schism developed among the board members, according to several people with knowledge of the events.

There were some who argued that it was unseemly to pay the remainder of the money and other perks owed to Mr. Paterno, according to several people with knowledge of the discussions. They wondered whether, given Mr. Paternos failings, it might be possible to nullify the contract, or at least renegotiate it and reduce the payout, the people said.

Others worried about the hostility they would face if they tried to strip Mr. Paterno, still beloved in many quarters of the campus, of money that he was contractually owed a prospect that grew even more worrisome after he died on Jan. 22 this year. During a conference call, one board member worried aloud that failure to make good on what was owed to the Paterno estate could lead to another reign of terror by Mr. Paternos supporters, according to a person who was on the call.

With rumblings that the Paterno family was thinking of suing the board of trustees for defamation, the board dispatched its lawyer to negotiate the final payments. All the board wanted in return was a release protecting the university from such a lawsuit.

The Paternos refused. Mr. Sollers said in his statement that the retention of their legal rights in a case of this magnitude and complexity is customary and appropriate.

The board of trustees ultimately agreed to make good on the full package anyhow, and in April paid what was owed to the Paternos. Additional demands, like the desire by Mr. Paternos wife to make use of the athletic departments hydrotherapy facilities, were met. The board did draw the line at the familys request to use the universitys corporate jet, arguing that the contract limited that use to the coach himself. And it refused the familys demand to retain use of the stadium box next to the university presidents, the one reserved for the head coach, offering the family the choice of two other suites on a different floor.

Still, Frank T. Guadagnino, a lawyer hired by the board in November to handle a variety of aspects of the scandal, suggested that the board felt it did not have much maneuvering room when it came to the discussions with the Paterno family.

We were providing for payments due under the contract, he said in an interview Friday. So we werent really negotiating.

He added that, given revelations in the independent report released this week that suggest that Mr. Paterno knew about allegations of child abuse involving Mr. Sandusky as far back as 1998, the question over whether the university could rightfully renege on paying the Paterno family what was owed under the August amendments was complicated, and one that we havent looked at.

At a board of trustees news conference Friday, Karen B. Peetz, the boards chairwoman, made clear that the issue would not be revisited. Contracts are contracts, she said.

Tim Rohan contributed reporting.

http://espn.go.com/espn/otl/story/_/id/8169124/sources-penn-state-trustees-pressed-ex-chairman-steve-garban-resign

As one trustee said Saturday: "If it wasn't for one trustee reading a newspaper article, we probably wouldn't have been told anything."

That article was published on March 31, 2011, in The Patriot-News. The article reported Sandusky was "the subject of a grand jury investigation into allegations that he indecently assaulted a teenage boy." The article reported to a 2009 incident involving a boy at Central Mountain High School and the 1998 incident when Sandusky showered with a 12-year-old boy in a football building on Penn State's campus. The article also reported that Schultz, Paterno and Curley had testified before the grand jury investigating Sandusky. The Freeh report notes that the article "went virtually unnoticed by the board. The article was not disseminated to the full board and many board members did not read the article."

A day after the story was published, an unnamed trustee emailed Spanier to ask "What is the story on allegations against Jerry Sandusky that required testimony by Joe Paterno and Tim Curley, and I heard also Garry Schultz? Is this something the board should know a be briefed on or what?"

Spanier replied, and he copied Baldwin and Garban, "I believe that Grand Jury matters are by law secret, and I'm not sure what one is permitted to say, if anything."

Spanier said he would check with Baldwin, who told Spanier by email that those who "testify before the Grand Jury are not held to secrecy and can disclose if they so desire."

On April 13, 2011, the trustee emailed Spanier again: "I frankly think that, despite grand jury secrecy, when high ranking people at the university are appearing before a grand jury, the university should communicate something about this to its Board of Trustees."

On that same day, Spanier replied to the trustee that "through media reports that the Grand Jury has been investigating for two years and has not yet brought charges. They continue their investigation. I'm not sure it is entirely our place to speak about this when we are only on the periphery of this." Spanier added that Baldwin would report on the issue at the next board meeting. Separately, Spanier told Baldwin in an email that the trustee "desires near total transparency. He will be uncomfortable and feel put off until he gets a report."

That same day, Spanier himself testified before the Sandusky grand jury, but he apparently chose to say nothing to the trustee about that.

On April 17, Garban met with Spanier and Baldwin about the investigation. Baldwin told Freeh investigators that Spanier "downplayed the Sandusky investigation" and added, "It was the third or fourth grand jury and nothing would come of it."

Baldwin told Freeh investigators that she believed that Spanier, as a board member, and Garban, as the board chairman, would relay information about the meeting to other board members.

The Freeh report scolds the few officials aware of The Patriot-News article for failing to ask "further about Sandusky and the possible risks of litigation or public relations issues, and, most importantly, whether the University has effective policies in place to protect children on its campuses."

On May 11, 2011, on the eve of a regularly scheduled board meeting, Spanier told Freeh investigators that he told four board members at a private dinner that he had recently testified before the Sandusky investigation and he provided an update on the Sandusky investigation. When Freeh's investigators interviewed the four trustees, none of the four trustees could recall Spanier saying anything at the dinner about the Sandusky grand jury or Spanier's own testimony.

http://espn.go.com/college-football/story/_/id/8170790/penn-state-nittany-lions-new-jerry-sandusky-accusers-say-abuse-dates-1970s-report-says

Report: Accusers say abuse pre-'90s

Three men have told investigators that Jerry Sandusky, the former Penn State defensive coordinator recently conficted of 45 counts of child sex abuse, molested them in the 1970s and 1980s, The Patriot-News of Harrisburg, Pa., has reported, citing sources close to the case.

None of Sandusky's 10 victims had predated the 1990s, and in his report released Thursday, former FBI director Louis Freeh said his review for Penn State's board of trustees had not found evidence predating the '90s.

One of the three men says he was abused in the early 1970s, the report says. Sandusky's defense had argued in his trial that a person doesn't become a pedophile in his or her 50s. Sandusky turned 68 in January.

The police are aware of the three new accusers, according to the report.

The Pennsylvania grand jury that brought the Sandusky indictment is still meeting and could potentially hear testimony from more potential victims, The Patriot-News report said. But it is not known whether the attorney general's office would be open to filing more charges.

Freeh's team interviewed more than 430 people and reviewed more than 3 million documents.

The 267-page Freeh report concluded that former Penn State coach Joe Paterno -- along with former president Graham Spanier, athletic director Tim Curley and former vice president Gary Schultz -- conducted a cover-up of abuse allegations against Sandusky.

Sandusky faces a minimum of 60 years in prison and is awaiting sentencing, which could take months to complete.

Information from ESPN.com senior writer Don Van Natta Jr. was used in this report.

I have a hard time believing that he would've started openly raping boys only after getting fired or "retiring." Everything we know about right now is awful enough, and there's probably still 20-30 years of abuse that predates it. Every step back in time is going to reveal more awful actions on the part of someone. Apparently Jerry's dad devoted his life to helping children as well; he ran a youth rec center and coached every youth sports team imaginable. I don't think it's a stretch to think that Sandusky was raised and spent most of his life in an environment where abuse was common, if not open. He certainly didn't have to hide it from his wife (who should be in prison too), and it doesn't appear that he had to hide it from anyone at Penn St. Given that Paterno and Sandusky were not just Catholics, but also in the Knights of Columbus, it's really scary to think about how far down this rabbit hole goes. At the same time, I also hope that we, as a culture, have the fortitude to find out.

In response to Reply # 0

Yep, I'm sure they will get to the bottom of how culpable Joe was during this whole ordeal. They are dismayed, DISMAYED I tell you, but the "conclusions and assertions" in the report.

http://espn.go.com/espn/otl/story/_/id/8169773/penn-state-nittany-lions-paternos-conduct-own-review-freeh-data

The family of former Penn State football coach Joe Paterno has instructed its lawyer to form a "group of experts" to conduct a comprehensive review of the facts and conclusions presented last week in the Freeh report.

"We are dismayed by, and vehemently disagree with, some of the conclusions and assertions and the process by which they were developed by the Freeh Group," Wick Sollers, the lawyer for the Paterno family, said in a statement Monday. "Mr. Freeh presented his opinions and interpretations as if they were absolute facts. We believe numerous issues in the report, and his commentary, bear further review."

The Paterno family also said it will ask its team of experts and lawyers "to go beyond the report and identify additional information that should be analyzed."

In addition, the Paterno family has asked the Freeh group to preserve all of its records, notes and materials collected during its eight-month investigation of the Jerry Sandusky child sex abuse scandal at Penn State. Sandusky was convicted last month of 45 counts of molesting 10 boys during a 15-year period.

Louis Freeh, the former director of the FBI, was hired by university trustees to conduct the inquiry. Freeh's team interviewed more than 430 people and reviewed more than 3 million documents.

The 267-page report, released July 12, concluded that Paterno -- along with former president Graham Spanier, athletic director Tim Curley and former vice president Gary Schultz -- conducted a cover-up of allegations that Sandusky, a former defensive coordinator, sexually abused young boys.

Sollers adamantly denied the conclusion of the Freeh report that Paterno covered up allegations of Sandusky's crimes that surfaced from any investigation in 1998 and 2001.

"The 1998 incident was fully and independently investigated by law enforcement officials," Sollers said. "The Freeh report confirms this. It is also a matter of record that Joe Paterno promptly and fully reported the 2001 incident to his superiors. It can certainly be asserted that Joe Paterno could have done more. He acknowledged this himself last fall. But to claim that he knowingly, intentionally protected a pedophile is false."

Since the Freeh report was released, several people, including Spanier and former university general counsel Cynthia Baldwin, have asserted that there are factual inaccuracies in the report.

The trials of Schultz and Curley, who have been charged with perjury, will occur later this year or early next year. Additional charges may be filed. Spanier has not been charged, but a grand jury investigation is ongoing.

"Since various investigations and legal cases are still pending, it is highly likely that additional critical information will emerge," Sollers said. "With that, we want to take this opportunity to reiterate that."

A source close to the Paternos estimated that it may take months, even years, for the Paterno family's team of lawyers and independent experts to conduct the review of the Freeh report.

"The process of reviewing the report and other relevant information is going to be a complicated and time consuming exercise," Sollers said. "It took the The Freeh Group roughly seven months to conduct more than 400 interviews and review 3 million documents. We do not expect or intend to duplicate this effort but we are going to be as thorough as reasonably possible. In the meantime, our attorneys have asked that we not make any further comment on this matter until they are ready to provide an update on their progress."

Sollers pledged that the Freeh report will not be "the last word" on the matter.

"In the meantime," Sollers said, "our attorneys have asked that we not make any further comment on this matter until they are ready to provide an update on their progress."

NCAA President Mark Emmert Talks Penn State, Freeh Report, 'Death Penalty' With Tavis Smiley (VIDEO)

What next at Penn State?

As far as the NCAA is concerned, all punishment options are in play after former F.B.I. director Louis J. Freeh delivered his scathing report on the university's handling of the Jerry Sandusky sexual abuse scandal.

In an exclusive interview with Tavis Smiley that aired on Monday night on PBS, NCAA President Mark Emmert discussed potential punishments as well as his own reactions to the 267-page report produced by Freeh's eight-month investigation. The report indicated that former head football coach Joe Paterno and three top PSU officials "concealed critical facts relating to Sandusky's child abuse."

"I dont want to take anything off the table," Emmert said when asked about the possible use of the NCAA "Death Penalty," which was applied to Southern Methodist University's football program in the 1980s. "The fact is this is completely different than an impermissible benefits scandal like happened at SMU, or anything else weve dealt with. This is as systemic, a cultural problem as it is a football problem."

Among the many aspects of the Freeh report that the NCAA may find troubling is the assertion that a "culture of reverence" around Paterno and the football program enabled Sandusky's crimes to be obscured.

"Well have to figure out exactly what the right penalties are," Emmert told Smiley. "I dont know that past precedent makes particularly good sense in this case because its really an unprecedented problem."

Shortly after the initial publication of Freeh's findings, NCAA Vice President of Communications Bob Williams issued a brief statement citing "four key questions" from a Nov. 17 2011 letter from Emmert to PSU that still need to be answered. According to the statement, these unanswered questions pertain to "compliance with institutional control and ethics policies."
