'The bigger the headache the bigger the pill' is a direct jack of a line from Parliament's 'Dr. Funkenstein'. the radio station DJ thing Charlie does on the song comes directly from Parliament's 'P. Funk (Wants to Get Funked Up)'. the use of nursery rhymes all throughout 'Oops' also comes from Parliament's 'Sir Nose D'voidoffunk (B3M)'.

but...George didn't get a co-writer credit on the Gap Band song. b/c acts didn't SUE EACH OTHER OVER THIS SHIT back then.

and my point was that this 'Uptown Funk' vs. 'Oops' thing isn't as much a plagiarism claim as it's a claim that 'Uptown Funk' borrowed production elements and feel and sound from 'Oops' but didn't necessarily borrow copyrighted material - as in the plagiarism claims you've referenced (which i also referenced earlier).

but i haven't seen the claim or potential claim from the Gap Band. but from listening to the 2 songs i don't hear plagiarism but i do hear inspiration.

its almost a necessity for certain bands of that era...

P-Funk had a template...

but it is kind of surprising how hard the Gap Band bit off of P-Funk.... really... Jam to the Mother.......


biting grooves back then at that level was acceptable though... people didn't trip like that ..

now some of these guys are biting classic grooves and passing it off as original..when there is now procedures for people to get compensated.....

there are plenty of people making music of that same vibe that's either original or giving appropriate credit..it's not that hard, and I can't be mad at people seeking legal compensation.

the procedures have existed since forever and they existed back when 'Oops Upside Your Head' was released. Clinton & company chose not to sue the Wilsons, et al.

until i learn differently i'm going to assume this move was made by the Gap Band's publishers and not the members themselves. or it could've come from Ronson, et al w/o any demand from the Gap Band. either way i'm going to assume this is not the writers of 'Oops' threatening to sue Ronson, et al for making a record that references 'Oops' w/o giving the writers a credit considering 'Oops' references at 3 if not 4 Parliament records and those writers aren't credited on 'Oops'. if this IS the Gap Band then they're incredible hypocrites and i dunno how they live w/themselves.

i think it's largely about the decline in revenue from music sales. like maybe acts didn't sue over this kind of thing back in the wayback b/c acts like P-Funk were making more money from record sales than an act like P-Funk would make today.

but shit...that doesn't hold up b/c record sales have been in the toilet before the current situation. and yet there wasn't this flurry of lawsuits over inspiration like we're seeing now. or maybe there was such a flurry and i'm unaware.

it's a recent development in the industry and i don't like it. i fear it may have a chilling effect on creation.

b/c several songs we dig - like 'I Don't Believe You Want To Get Up and Dance (Oops)' by the Gap Band - are derivative of other songs by uncredited writers. i wonder how many of those songs like the Gap Band's wouldn't have been released if acts were as litigious in the past as they are today.

Yes, 'Blurred Lines' sounds alot like 'Got to Give it Up' and 'Uptown Funk' sounds like the Gap Band and Cameo, but this case is even more troubling from a songwriter's perspective. Uptown Funk doesn't borrow directly from one song. It's more of a homage to the late 70's and early 80's funk.

The Gap Band and the Gaye estate may have a valid case, but viewing homage or influence as plagiarism limits the creativity of musicians. It also makes a songwriting credit closer to a patent than a right to fair payment for the work done on the song.

Or maybe these cases are legit, but because the songs that were under suit are R&B, the aspect of the 'sampled artist' doesn't seem justified?

if there is a silver lining maybe it'll at least encourage people to come up with actually new ideas... but i doubt it

also its happen before and things always been blatant.

when is the last time you heard of a artist having to pay up
and there was a fan backlash?

not a biggie. if that was the case then Led Zepplin would be lucky to have packed a Olan Mills back lot with all the sharing of credits they had to pay back.

it never wrecks a career only music geeks care about the details,etc..


and the irony is that gap band never got hadly a dime off of the original publishing because there label Boss Lonnie Simmons SUge Knight the publishing and collected for his own self
