ATLANTA — Extraordinary but so far unsubstantiated allegations that the Georgia prosecutor overseeing a criminal case against former President Donald Trump and others violated federal law will get their day in court.

A Thursday order from Fulton County Superior Court Judge Scott McAfee sets a Feb. 15 hearing for a motion filed by former Trump campaign official Mike Roman, alleging Fulton County District Attorney Fani Willis had an improper relationship with the case's lead prosecutor, Nathan Wade.

Roman, Trump and 17 others have been charged by the DA's office for various efforts to subvert Georgia's 2020 election results. Roman, Trump and most of the other defendants have pleaded not guilty.

Roman's attorney, Ashleigh Merchant, filed a motion Jan. 8 seeking to dismiss the charges against him and disqualify Willis and the DA's office from any further involvement with the case. The motion makes the extraordinary claim that Willis and Wade violated the same racketeering act used to charge Roman and the other defendants in the election interference case.

The filing claims that Willis is in a romantic relationship with Wade, and is receiving financial benefits from his employment and the investigation of Trump and his allies, but does not include corroborating evidence.

Wade, who has been paid more than $600,000 since 2021 for his work on the sweeping racketeering indictment, filed for divorce shortly after joining the team in 2021. Roman's 127-page filing claims Wade's divorce documents, which are currently under seal, could provide more evidence about the alleged relationship.

Willis and her office have yet to file a response to the motion in Fulton County, The judge's order gives the DA's office until Feb. 2 to file a response.

Willis did have a response in a separate case involving Wade on Thursday, though — Willis was subpoenaed to give a deposition in his divorce case. Responding to that subpoena on Thursday, the DA accuses Wade's estranged wife of conspiring with people involved with the election interference case to attack Willis' character and undermine the prosecution.


Willis goes on to say Wade's marriage was "irretrievably broken" and that her deposition was not needed in the unrelated matter. Willis accused Wade's wife of having an affair and noted that a request to unseal the divorce docket, her subpoena and the motion making the allegations of impropriety all happened on the same day, Jan. 8.

On Sunday, Willis alluded to the claims while speaking at Big Bethel AME Church in Atlanta without mentioning Wade by name, calling him a "superstar" and "great friend."

Later that day, Trump attacked Willis again at a rally in Indianola, Iowa, saying that the case against him should be dropped. Likewise, Trump allies have used the allegations to continue a longstanding effort to discredit Willis and the charges stemming from Trump's pressure campaign to undo his 2020 election defeat.

In court, however, Trump's legal team has shown more restraint around the claims. During a hearing last Trump attorney Steve Sadow declined to sign on to the motion against Willis, calling the filing "salacious and scandalous in nature" and opting to wait until the DA responded before making a decision.

but the dem/liberal strategy to ignore all the horrific things Biden is doing is a failed strategy...if the attempt is to make a clear distinction between Biden and Trump, he should have enacted actual policy that contrasts Trumps'.

If the idea is that a special prosecutor is supposed to be independent, then hiring the underqualified prosecutor who she is boning isn't independent.

And if you can pick any special prosecutor you want as a DA, why are you picking the one you are boning? SMH.

Was listening to Van Lathan's pod and they brought Yodit Tewolde to discuss it. If that's true then I don't know what the options were if folks didn't want to join in prosecuting Trump in Georgia. A lot of folks got skeletons that Trump would air out. Black man stepped up with his in tow.

Look at the backgrounds of the 3 special prosecutors. One is not like the other. You got one lawyer who has done dozens of Appellate Court and Supreme Court trials, one who wrote a text book on RICO trials and then Nathan Wade who is traffic court judge and personal injury lawyer. Nothing in his background speaks to him being qualified for this sort of work.

According to the The New York Times, “finding a lead prosecutor for what would be one of the highest-profile cases in the state’s history” proved to be a challenge for Willis. The Times reported that several candidates turned her down before she enlisted Wade, an old friend who hasn’t shied away from a fight in his years as a Cobb County jurist.

Wade became the first Black male judge in Marietta when he was appointed to the city’s municipal court in 2011. From there, he went on to run in three unsuccessful bids for a seat on the Cobb County Superior Court bench between 2012 and 2016.

Two of these runs were against incumbent Judge Reuben Green, whose 2016 run was mired in controversy after a courtroom video surfaced of the judge discussing how many witnesses a prosecution team planned to call at trial without a defense lawyer present. Wade said he was originally campaigning for a vacancy that year but set his sites on Green because “there was an outcry from the legal community, and then the general public at large.”

Green ran with about one-tenth of the campaign funding of his competitor on a platform emphasizing experience and efficiency. During his campaign, he said he had 3,000 pending cases when he joined the magistrate court bench, which he whittled down to 810 in 2016.

In addition to his role as a special prosecutor in the case against Trump, Wade has a private practice that specializes in contract, family and personal injury law, as well as criminal defense. He serves as an associate municipal court judge and a pro hac state court judge in Cobb County, according to his firm’s website. Wade has also served as an assistant county solicitor.


Anna Cross
Cross is a regular face at the state Court of Appeals these days, but before she joined The Summerville Firm in 2018 and went on to found her own boutique appellate practice with Meredith Kincaid in 2022, she spent 20 years as a prosecutor in metro Atlanta.

Recently Cross was special counsel in suspended Court of Appeals Judge Christian Coomer’s judicial misconduct investigation that resulted in Coomer being removed from the bench.

According to her firm’s website, Cross is routinely brought into cases at the trial court stage to brief complex pretrial evidentiary issues, Daubert and other critical dispositive motions. She has “tried over 80 cases to verdict, briefed hundreds of cases in the Georgia Appellate Courts, and argued in the Georgia Supreme Court more than 60 times.”

Some of Cross’s victories include defending a $6.4 million birth injury judgment on appeal. She also has worked on high-profile murder cases as a prosecutor and special and appellate counsel, including a 2010 Dunwoody daycare murder conviction she helped prosecute and later secure in the state Supreme Court. Her website also sites the 1987 contract killing of Lita McClinton Sullivan (Georgia v. James Vincent Sullivan) and the 2000 murder of a Fulton County Sheriff’s Deputy (Georgia v. Jamil Abdullah Al-Amin, also known as H. Rap Brown) as previous successes. Her first civil trial resulted in a $129 million verdict out of Fannin County.

Anna brings out the best in those around her and approaches everything with the utmost integrity. She’s an invaluable member of any team she’s a part of.”


John Floyd

“Floyd is the nation’s leading authority on RICO,” said former DeKalb County District Attorney J. Tom Morgan, who met Floyd during his own RICO case against former DeKalb County Sherriff Sidney Dorsey for arranging the murder of his political rival 20 years ago.

Morgan said Floyd gave his team the idea to bring a RICO case against Dorsey and, while he never presented to the jury, he did a “phenomenal job” arguing motions before the court.

Willis hired Floyd on as an outside consultant in the Trump probe in March 2021, according to the Times.

According to his firm’s website, Floyd has pursued, defended and worked as special prosecutor on both state and federal RICO cases. He also works on False Claims Act cases, conducts internal investigations for institutional clients and represents plaintiffs and defense in business torts and professional liability cases.

Other notable cases Floyd has been involved with include representing the defense in a Cobb County criminal extortion case concerning a leaked sex tape featuring the former CEO of Waffle House that eventually made it to the state Supreme Court and Georgia gun firms in a criminal racketeering case against Glock in Fulton County State Court. He also served pro bono as a special assistant district attorney on the RICO case concerning the Atlanta Public Schools cheating scandal that ended in 2015.

“When it comes to defending a RICO indictment and all the behind-the-scenes stuff that people don’t know or care about that’s essential to the prosecutor’s case …that’s where Mr. Floyd is at his greatest,” Morgan said.

Cross, Floyd, Wade and the Fulton County District Attorney’s office did not respond to requests for comment for this article. It is unclear whether they are paid or pro bono.

Fulton County District Attorney Fani Willis on Friday acknowledged having a personal relationship with special prosecutor Nathan Wade as former President Donald Trump and another co-defendant have sought to get them disqualified from the Georgia election interference case.

In a 176-page filing, Willis seemed to respond to the allegations by stating that “any personal relationship among members of the prosecution team does not amount to a disqualifying conflict of interest or otherwise harm a criminal defendant.”

Willis and her office argued that the relationship hasn’t corrupted their ability to oversee the case.

"Defendants have done nothing to establish an actual conflict of interest, nor have they shown that, in the handling of the case, District Attorney Willis or Special Prosecutor Wade have acted out of any personal or financial motivation," it said.

"Apparently, the DA believes she can make public out-of-court statements about race, this case, and the defendants whenever she wants, and the Court is powerless to punish her by disqualification," Sadow said. "Such hubris for all to see. Nothing has changed. Our requested remedy remains clear: dismiss the case and disqualify the DA, together with her team and office, from any related matters."

Roman's attorney, Ashleigh Merchant, also filed a response Friday pushing to keep the evidentiary Feb. 15 hearing on Roman's allegations. The hearing was scheduled by Fulton County Superior Court Judge Scott McAfee, who is presiding over the election case. Roman has previously issued subpoenas to Willis and Wade to testify at the hearing, but the Friday filing said they intend to file motions to quash them.

In the filing Friday, Merchant pushed back on claims that Willis and Wade never cohabitated, adding that she believes testimony will show the relationship began even before Wade was hired.

"If they had nothing to hide in the first place because they did nothing wrong, then why did they intentionally not tell anyone about it until they got caught with their hand in the cookie jar?" Merchant's filing said.

In a court filing last month seeking dismissal of charges in the case, attorneys for Roman first accused Willis of engaging in an "improper, clandestine personal relationship" with Wade. Trump has also cited the allegations of a romantic relationship in his own efforts to get his charges tossed out.

Both Roman and Trump, who faces 13 criminal counts, have pleaded not guilty in the case. Four co-defendants have pleaded guilty.

A court filing last month from Wade's estranged wife included credit card statements that appeared to show Wade had purchased plane tickets for trips with Willis.

Wade on Tuesday reached a temporary agreement with his wife, Jocelyn Wade, in their divorce proceedings, canceling a court hearing where he had been expected to testify about the allegations.

The same day, an attorney for Roman subpoenaed Willis and Wade to testify at the Feb. 15 hearing in connection with motions to disqualify them from prosecuting the election case, according to a lawsuit that Ashleigh Merchant, Roman’s attorney, filed against Willis' office.

Merchant's lawsuit alleges that Willis has refused to provide many requested materials in violation of the Georgia Open Records Act. The lawsuit also claims that Willis "used taxpayer money to pay Wade, with whom she has had a romantic relationship at the time," and as a result has received "financial benefits from such payments" including vacations, hotel stays and gifts.

Willis has faced intensifying scrutiny over the alleged relationship in recent weeks.

Last week, the Republican-led Georgia Senate approved a resolution to establish a committee to investigate Willis, and state Rep. Charlie Byrd, a Republican, introduced articles of impeachment against Willis in Georgia’s lower chamber.

Bob Ellis, a member of Fulton County’s board of commissioners, also said in a statement last month that he would pursue a "full investigation" amid the allegations.

The filing said that Trump co-defendant Michael Roman — who first made the allegation that Willis and Wade had a relationship to get the charges tossed — “wildly speculates” that Willis “benefitted financially from the investigation and prosecution of this criminal case, but provides no support to justify that conclusion.”

“To be absolutely clear, the personal relationship between Special Prosecutor Wade and District Attorney Willis has never involved direct or indirect financial benefit to District Attorney Willis,” it said.

In an affidavit included in the filing, Wade directly acknowledged his personal relationship with Willis, which he said didn't exist at the time of his hiring.

"In 2022, District Attorney Willis and I developed a personal relationship in addition to our professional association and friendship," he said.

Addressing personal trips they took together, he said that they roughly split the cost of travel. Sometimes he booked flights, he said, and sometimes she did.

The filing Friday said that the allegations raised by Roman and other motions to disqualify Willis and Wade “are salacious and garnered the media attention they were designed to obtain.” But, it shot down accusations made by Trump and a co-defendant in the case.

“District Attorney Willis has no financial conflict of interest that constitutes a legal basis for disqualification,” it said. “District Attorney Willis has no personal conflict of interest that justifies her disqualification personally or that of the Fulton County District Attorney’s Office.”

It said that attacks on Wade’s qualifications “are factually inaccurate, unsupported, and malicious, in addition to providing no basis whatsoever to dismiss the indictment or disqualify” him.

Willis, it added, has also “made no public statements that warrant disqualification or judicial inquiry.”

Reacting to the news Friday, Trump railed against the Fulton County prosecutors in a post on Truth Social, saying that the case against him and others is a "scam" that is "totally discredited & over!"

Trump attorney Steve Sadow said in a statement Friday that Willis' response "asks the Court to turn a blind eye to her alleged personal and financial misconduct."

Not meaning to speak for Buddy (who knows more about this than I do), but there seems to be universal agreement that that case is the least damaging, both legally and politically.

The other case, I think, is technically against the Trump Organization, not Trump personally, except insofar as he's the head of the company. Also, while this case is very serious (more serious than the Stormy Daniels case, IMO), it's a civil case, not criminal.

There's also the E Jean Carrol case in NY, but that one's finished (at least until Trump starts openly slandering her again).

Yeah, I think that was wrapped up about a week or two ago, which means technically Trump had three NY cases at the same time.

Somewhat surreal the presumptive Republican candidate to be the so-called leader for the Free World literally has multiple pending court cases across the country. Even worse the man actually had a hand in stopping pending legislation for border policy.

Sad times for this country politically, but I suppose that's for another post altogether.

Much media focus has breathlessly characterized the judge’s decision to hold a hearing as a signal the judge is leaning towards disqualification. That’s wrong. Let’s start with the fact that McAfee set clear limits about what the hearing is about.

First, despite the salacious focus of Roman’s legal team, the hearing is not about Willis’ romantic relationship with Nathan Wade. Given that Willis submitted pleadings in which the existence of a personal relationship that developed after Wade was hired, Judge McAfee rightly said the existence of a personal relationship is not at issue—and the only relevance of that relationship is the question of whether it creates an actual conflict of interest or the appearance of one.

Georgia law says that lawyers who are married to each other cannot be disqualified, even if they are on opposing sides of a case. As one Georgia court put it: “hile we cannot disagree with the proposition that the marital relationship may be the most intimate relationship of a person’s life, it does not follow that professional people allow this intimacy to interfere with professional obligations.”

Willis and Wade are on the same side of the case, so the possibility of conflict is even less than if they were adversaries in the case.

Roman’s legal team wants to get out from under this problem by claiming that the relationship between Willis and Wade creates a conflict of interest—not because of any romantic interest—but because Wade supposedly paid for trips or other possible “date”-related expenses. The theory being that these benefits somehow create a financial interest for Willis in the prosecution, since Wade is paid for his work on an hourly basis.

It’s important to know that it would be disqualifying if Willis (or Wade) had a financial stake in the outcome of the case. For example, in two cases, Georgia courts found that a special prosecutor had a conflict of interest when their pay was in the form of a contingency fee tied to whether they won a conviction or not. But neither Willis nor Wade is on a contingency fee—they get paid by the hour—so how much they get paid has nothing to do with whether they win the case.

To counter this, Roman’s attorney argues that the financial interest in the case is due to the fact Wade gets paid by the hour, Fani Willis has an interest in dragging out the case. But dragging out a case is not the same as having an interest in whether you win or lose.

Not only is Roman’s argument legally off-base, it’s also stunningly tone-deaf. His own lawyers, Ashleigh Merchant and Jonathan Merchant, are married to each other and—presumably being paid for their work on Roman’s case on an hourly or flat fee basis. Under this logic, any lawyer being paid for work on a case has a financial stake in the case that could result in disqualification. In other words, all paid lawyers must be disqualified.

A lot of unjustified criticism has been directed at Wade for his supposed lack of qualifications, but McAfee correctly has taken this issue off the table by saying “as long as a lawyer has a heartbeat and bar card” then the appointment was up to Willis’ discretion.”

But the biggest problem for Roman’s legal team is likely to be their star witness, Terrence Bradley, who is Wade’s former law partner and once represented him in Wade’s divorce case. Roman’s husband and wife legal team claim Bradley will testify about people that work in Willis’ office who know about the romantic relationship—including whether it began before or after Wade was hired. But this promised testimony presents several problems.

The first is an ethical problem. As Wade’s former divorce lawyer, it is easy to imagine that Bradley would have attorney-client privileged information about Wade’s romantic life that he is not allowed to share. Indeed, another lawyer— Gabe Banks, who turned down the special prosecutor job—told Judge McAfee that he had called Bradley (who is a friend and fraternity brother to Banks) about the possibility of Bradley testifying about Wade and “was concerned Bradley…might be ‘emotional’ and violating attorney-client privilege.”

Assuming the attorney-client privilege bar is somehow overcome by Roman’s lawyers, the next problem they have is that all of Bradley’s testimony is likely to be inadmissible hearsay. Unless Judge McAfee is not following the usual rules of evidence, Bradley is simply prohibited from getting on the stand and talking about what he heard from other people. All lawyers learn that as a matter of basic evidence.

But the biggest problem for Bradley’s testimony is that unless Roman’s lawyers plan to qualify him as a couples counselor, Bradley lacks any expertise to testify about when the relationship between Willis and Wade turned romantic.

Judge McAfee has thus far run a disciplined courtroom and this hearing is likely to quickly and decisively end Roman’s efforts to disqualify Fani Willis. That is, unless Roman’s attorneys succeed at turning the hearing into an episode of Divorce Court.

as far as I know, the county hasn't paid the ransom. I don't think the data has been make public either. it's a rock and a hard place because paying it doesn't mean Lockbit won't still release whatever they have.

Judge allows Trump and co-defendants to appeal order letting Fani Willis continue on 2020 election case

A Georgia judge on Wednesday greenlit an effort by former President Donald Trump and his co-defendants to appeal the decision to allow Fulton County District Attorney Fani Willis to continue to prosecute the 2020 election subversion case there.

Fulton County Superior Court Judge Scott McAfee, who ruled last week against the defendants’ efforts to disqualify Willis, has issued a certificate of immediate review, allowing the case to be revealed by a Georgia Appeals Court.

The issue “is of such importance to the case that immediate review should be had,” McAfee wrote.

ADVERTISING

The move doesn’t pause the prosecution but allows appeals on the disqualification effort to play out before trial.

It is now up to the Georgia Court of Appeals to review the decision not to disqualify Willis and decide if it wants to take up the case. While McAfee’s ruling last week allowed Willis to stay on the case, it forced the resignation of her top deputy on the case, Nathan Wade.

Trump and his co-defendants have argued that a romantic relationship between Willis and Wade created a conflict of interest that should disqualify the both of them.

Steve Sadow, the lead defense counsel for Trump in the case, called Wednesday’s motion by McAfee “highly significant.”

“The defense is optimistic that appellate review will lead to the case being dismissed and the DA being disqualified,” Sadow said in a statement.

Also: If you attempt to defend yourself - even if everything you say is true what REALLY matters is how your attitude can be interpreted by others.

is this really ANY case to you? America is literally hanging in the balance of this election. She made a rookie mistake that NEVER should have happened. the post kinda died down and today i saw a new development that could be significant, so im kinda pissed off all over again.

it is grounds for trump and crew to be allowed to appeal, which keeps his hopes and motivations alive, which makes me uneasy. trump is a foe that you have to knock the fuck out if/when you can, and not allow him to hang around and make a run in the 4th. not sure what ur missing in all this.

It seemed like she was not going to have to until she barged in there like she was about to kick ass in a game of dodgeball.

The judge ruled in her favor but slammed her and Wade in his opinion. To me it looked like he winked and nodded at the defense to ask to be allowed to appeal so he could give it the ok.

It's INHERENTLY unethical to work with someone you are dating?

I still don't see how any of the facts here lead to any sort of conflict.

Trump's team argues basically that Fanni is trying to enrich herself by employing someone who would then pay for dates, food, and travel.

None of that seems true here except via the lens of "You can't 10000% prove that it didn't happen - so then you have to act like it did."

What if they were ex-lovers? Would that be a conflict?

What if they weren't lovers now, and Trump is convicted in in 2 years they became lovers - would that be grounds for appeal?

I had never heard of any rule where lawyers can't be in a relationship if they are both working on the same side. I've heard about lawyers on opposing teams. I've heard about lawyers and their clients.

But people working together can't fuck?

I'm pretty sure a lot of these "easy rules" are just bullshit you've bought into.

Their arguing a broad "conflict of interest" with the transparently ludicrous premise that:

1)Fanni wants free dinners.

2)Fanni realizes if she prosecutes Trump that she could hire lawyers and pay them money - money that can be used for DINNERS!!!

3)If she dates one of the lawyers who now have money becuase of her unwarranted prosecution of Trump - she could force him to buy her free dinners.

4)Fanni realizes there is little evidence against Trump but she NEEDS FREE DINNERS so she continues the prosecution --becuase once it is over the lawyers she hired won't have money and therefore she won't have free dinners.

And maybe dude doesn't even want to fuck her - but he needs a job so he does.

All of this is VERY UNFAIR to Trump and therefore the case must be dismissed.

Plus did she hug the dude in 2018 of not? When did they first kiss? When did they first French kiss? Why didn't she pay with credit cards and keep a sexual dairy so a forescenic account could compare the ledgers and make sure she didn't get free dinners/dick in exchange for a job?

Turns out no one has shit to say they can reasonably prove - but the judge hearing this shit says "This looks bad. Woman obviously wants free dinners and can't shut her yap --so fire the dinner guy and we'll continue this again on appeal."

Hey, I could be wrong. Maybe there is AMPLE case law and ethical codes that strictly prohibit this kind of behavior, but I've never heard of it. And some cursory googling shows nothing either. I even asked ChatGPT.

Seems like transparent bullshit to me - and you take it as fact, or law, or just as one of the most well know things that obviously can't be done.
