Trump disqualified from Colorado’s 2024 primary ballot by state Supreme Court
The decision is certain to be appealed to the U.S. Supreme Court, but it will be up to the justices to decide whether to take the case

Swipe:
“A majority of the court holds that President Trump is disqualified from holding the office of President under Section Three of the Fourteenth Amendment to the United States Constitution,” the decision reads. “Because he is disqualified, it would be a wrongful act under the Election Code for the Colorado Secretary of State to list him as a candidate on the presidential primary ballot.”

Now the Supremes will bail him out.

don't blame this on one person..."We the People" saw the headlines about RBG falling cracking bones, etc. "We the People" should've came out and remedied the situation in 2016, because voting folks in/out of office (and affecting who then gets appointed) is OUR job. A lot of us didn't do our job and a maniac got to appoint, not one...not two...but three SC judges (and we won't even mention fed judges). That is not on RBG. Even if you want to call her actions "selfish", there was a remedy for that.

she was appointed by Bill, she wanted Hillary to appoint her replacement, and yes we all dropped the ball thinking Hillary was a forgone conclusion, that really should've been Biden's first term, he said he bowed out because of his son's death but everyone thought it was "her turn" and wanted to rush to this first woman president after the first black president and the strategy backfired and the country ended up getting set back decades

Because no one has yet articulated how things would've been better if she had stepped down If RBG staying in office was a problem, how would things be different without her in the mix? If you can't answer that...then her not stepping down wasn't a problem.

Conversely, I can list a whole lot of positives IF people came out to vote in 2016 and Trump didn't get elected (and during the previous mid-terms to dampen McConnell). We would've had a 6-3 SC court in our favor. Still would have RvW, probably the same with AA (I'm more concerned with gov contracts...which are next on the chopping block).

But she didn't win by 3 million votes; otherwise, she would've been in office. So, since we both know that the popular don't count, why keep bringing it up? If "We the People" were doing our job, we wouldn't need convincing to do what we're responsible for doing, especially in the context of a very soon to be vacant Supreme Court seat (again, everyone saw the headlines about RBG). If Voters (their job is in the name) did their job, HC would've gotten the EC votes she needed (you know, the thing that ACTUALLY wins presidential elections). A "rigged" system doesn't stop that IF people vote. Trump lost in 2020, despite a rigged system. Why? Because people came the fuck out to vote. Will he (or one of his acolytes) lose in 2024? Maybe not...the way people are murmuring about not wanting to come out to support Biden.

So, you can sit and complain about a "rigged system" or you can do something that actually works in said system, getting these folks out to vote. Because, checkmate is these repubs getting enough state control in order to ratify (and repeal) amendments. And when we don't come out to vote, they rig the system more to that end. We already fucked around and let them get control of the Supreme Court for a couple generations.

A special prosecutor should have been named on day 1 of the new administration when everyone...including some Republicans and even a few Trump supporters...were bugged out about J6.

Now the clock has ran out and a wannabe dictator who tried to overthrow an election is going to get at least very, very, very close to regaining power...if not accomplishing it.

I can't tell if Biden picked Garland because Dems always think they are playing 3d chess and then instantly get played, or if he picked him because he actually wanted to run against Trump.

Since he has actually said the 2nd one out loud, I'm assuming that at least played a part.

So Garland slow walked this and now Biden got his wish. Just...unreal.

Bottom line? Biden wanted to run against Trump. The Democrats are underestimating him yet again. Biden accomplished some good things, but history will judge his first 100 days/honeymoon phase as a complete failure. He wasted the juice.

There's erroneous misinformed idea that the investigation began with Smith and Garland was somehow dragging his feet. Yet less than a year after 1/6, over 700 people were indicted. DOJ wasn't dragging it's feet, it was working ground up. Because you don't win cases in the court of public opinion, you win them in federal court and that's their job.

Garland had built to subpoenas for records a full 7 months before Smith was even appointed and had been using the early Jan 6 interrogations to work up the chain a full 10 months before Smith was appointed. They were interviewing Mike Pence's aides before grand juries a full 6 months before Smith was appointed. They were digging into the fake elector plot back a full 6 months before Smith came on board. They were in PA 5 and had Scott Perry's phone 4 months before Smith came on board. They had flipped Jeffery Clark's aide by that time and he was giving up the goods.

I could keep going but the point is, DOJ investigation was up and running and being built brick by brick LONG before Smith was appointed, LONG before 1/6 Select Committee began hearings and it wasn't because State AGs put pressure on, all that is just stuff people say without or contrary to all actual evidence and because of just basic lack of understanding of even the most basic issues at hand like why Smith was appointed in the first place.

I will say I have seen much less of them the last 3 or 4 years.

Most democrats, at least, will agree that he obviously engaged in insurrection, so the 14th amendment says very clearly that he's not supposed to be allowed on ballots. For a state-level ballot authority, that's the end of the story. If they worry about how it might help a candidate, then THAT's the kind of political thinking that they've pledged to avoid.

Lawyers and judges are coming up with ahistorical workarounds, like saying article 5 supposedly requires congressional action, or even that the President supposedly isn't even an officer of the US. Whatever, let them do it. It's the job of judges to interpret the laws and the job of the Supreme Court to interpret the Constitution. If they choose to change the meaning of the 14th amendment, that's their job (for better, or in this case, for worse).

Of course it helps Trump politically. It's inherently antidemocratic, because that's what it's designed to be. If Jefferson Davis had been able to rally enough support to run for President, the 14th amendment would have been there to stop it. That's what it's there for.

Anyone who admits that Jan 6 was an insurrection needs to also admit either that Trump shouldn't be allowed on ballots or that the 14th amendment is a relic of the past. It seems like most of us are implicitly defaulting to "relic of the past", and that bothers me.

The hard thing about doing it is these accusations about political motivation. That's what scared off California, Michigan, and presumably other states. The Michigan court had to cook up the brilliant argument that "the President isn't an officer of the government because his oath is slightly different." You really think they would have strained credulity so bad if it was all politically moot?

It would be so easy for a court to follow the simple letter of the 14th amendment of it didn't mean standing in the way of the GOP frontrunner.

One silver lining that we have ahead is a Supreme Court ruling where all the purported "strict constructionists" flail around to explain that the 14th amendment was never supposed to apply to the most important office of the government.

First time I saw it, I was like "Ha, that's crazy." The story has snowballed since then with so many people admitting it now.

I'm sure all the PWT that would vote for him 20 more terms stink in their own way, so this isn't much of a deterrent.
