Supreme Court Highlights: Senate Confirms Ketanji Brown Jackson
The 53-47 vote elevated the first Black woman to the pinnacle of the judicial branch as senators erupted in cheers. Three Republicans joined Democrats in supporting President Biden’s nominee.

The Senate on Thursday confirmed Judge Ketanji Brown Jackson to the Supreme Court, making her the first Black woman to be elevated to the pinnacle of the judicial branch in what her supporters hailed as a needed step toward bringing new diversity and life experience to the court.

Overcoming a concerted effort by conservative Republicans to derail her nomination, Judge Jackson was confirmed on a 53-to-47 vote, with three Republicans joining all 50 members of the Democratic caucus in backing her. The vote was a rejection of Republican attempts to paint her as a liberal extremist who has coddled criminals. Dismissing those portrayals as distorted and offensive, Judge Jackson’s backers saw the confirmation as an uplifting occasion, one where a representative of a group often pushed into the background instead moved to the forefront.

The vote put her in line to replace Justice Stephen G. Breyer when he retires at the end of the court’s session this summer.

“Even in the darkest times, there are bright lights,” Senator Chuck Schumer of New York, the majority leader, said on the Senate floor. “Today is one of the brightest lights. Let us hope it’s a metaphor, an indication of many bright lights to come.”

He added, “How many millions of kids in generations past could have benefited from such a role model?” At the Capitol, the galleries to witness the historic vote, closed for much of the pandemic, were full of supporters. The chamber erupted in cheers, with senators, staff and visitors all jumping up for a lengthy standing ovation, after the vote was announced.

Not everyone shared in the joy of the day. As applause echoed from the marbled walls, Senator Mitch McConnell, Republican of Kentucky and the minority leader, turned his back and slowly walked out, as did most of the few Republicans remaining on the floor, leaving half of the chamber empty as the other half celebrated in a stark reflection of the partisan divide.


“When it came to one of the most consequential decisions a president can make, a lifetime appointment to our highest court, the Biden administration let the radicals run the show,” Mr. McConnell had said earlier, making one last argument against the judge, whose nomination he framed as an example of extremists taking control of the Democratic Party. “The far left got the reckless inflationary spending they wanted. The far left has gotten the insecure border they wanted. And today, the far left will get the Supreme Court justice they wanted.”

Three Republicans — Senators Susan Collins of Maine, Lisa Murkowski of Alaska and Mitt Romney of Utah — crossed party lines to support Judge Jackson, lending a modicum of bipartisanship to an otherwise bitterly polarized process.

Vice President Kamala Harris, the first Black woman to hold the position and one of just 11 Black senators in American history, presided over the vote — one historic figure presiding over the elevation of another — as senators stated their positions from their desks in a reflection of the magnitude of the moment. More than a dozen members of the Congressional Black Caucus, including Representatives Hakeem Jeffries of New York and Joyce Beatty of Ohio, clustered on the Senate floor to mark the occasion.

At the White House, Mr. Biden and Judge Jackson watched the vote together from the Roosevelt Room. Officials said the two would appear at an event on Friday to mark Judge Jackson’s confirmation, though she will not be sworn in for months.

“I’m overjoyed, deeply moved,” Ms. Harris told reporters after the vote. “There’s so much about what’s happening in the world now that is presenting some of the worst of this moment and human behaviors. And then we have a moment like this.”

Confirmed but on the sidelines: Judge Jackson is now a justice in waiting.

The last three justices to join the Supreme Court did so while its term was already underway, causing them to have to scramble to get up to speed. Judge Ketanji Brown Jackson will face the opposite problem: an extended stretch in which she will be in an unusual twilight space as a justice in waiting.

Her status is the consequence of Justice Stephen G. Breyer’s early and conditional announcement of his retirement and of quick action by Senate Democrats wary of taking risks in confirming his successor given the closely divided chamber.

The last member of the court to announce his retirement, Justice Anthony M. Kennedy, did so on June 27, 2018, which was the last day of the term. He said he would step down the next month, regardless of whether his replacement was confirmed. As it happened, his successor, Justice Brett M. Kavanaugh did not take his seat until Oct. 6 of that year, by which time the next term was underway.

Justice Breyer announced his own plans on Jan. 27. “I intend this decision to take effect,” he wrote, “when the court rises for the summer recess this year (typically late June or early July) assuming that by then my successor has been nominated and confirmed.”

That means Judge Jackson, who stopped participating in the appeals court’s work when she was nominated, will be an interested bystander as the Supreme Court issues its big decisions in the coming months, including ones on abortion and guns. She will have time to hire law clerks and study the next term’s docket.

But she will not take the required judicial oath and formally join the Supreme Court until Justice Breyer’s work is done.

According to the Supreme Court’s website, there have been a handful of instances in which new justices were confirmed before retiring ones completed their service. But the months that Judge Jackson will spend on the sidelines appear to set a record.

She will not take the bench until the court returns from its summer break in October, but she will presumably be rested and well prepared for the next term, which will include major cases on affirmative action, voting and gay rights.

of society and the welfare of humanity.

That’s it, and I don’t have a problem with saying NO or YES instead of just
being present when it comes to making decisions or in regards to
legislation.

Saying YES to legislation that is doing what you claim that you are against, is worse than just being present.

You have not taken a stance. Judge Jackson testified for more than 20 hours, she has a long a track record, and you said this is not a good selection based on one question and child porn sentencing.

That's not a "definitive stand" it's a parrot.

You want facts?

Go review the case of Leo Weekes. This is from
my own research, not from fucking Republicans. It’s quite disgusting
on how she was unmoved in regards to the sex crimes that he committed
towards his 13 year old niece, and on multiple occasions she sentenced
him way below the sentencing guidelines and sentenced him to far less time
than what the prosecutor recommended.

Her decision making in those situations were quite consistent in over 7 sex
criminal cases, and they were consistent in situations where she had to re-sentence
criminals because they violated their previous sentence.

This is not an attack on her qualifications and competency. She is well qualified.
However, her perception of the law and the decisions that she has issued based
upon that perception are highly questionable, and are cause for concern.

You offer no source and then you make a false claim that you did your own research that didn't come from Republicans. Do you really believe it's not obvious this Leo Weekes case was a last minute smear by Hawley/Cruz/Cotton pushed after the testimony ended, to feed the cult ?

Her decision making in "those situations" and her perception of the law and the decisions that she issued based upon that perception of the law" are so questionable and concerning that, she was endorsed by IACP, Fraternal Order of Police, 83 Republican and Democratic former attorneys general, American Bar Association, Crime Victim/Survivors and Advocates.

All of them want a Supreme Court judge who is too lenient toward child pornography offenders.

because I see you don’t understand the history here.

Here actions as a judge have been in question prior to her being nominated.
This isn’t some newly constructed political attack.

The Washington advocacy group for constitutional judges and the rule of law have
constantly questioned her actions and theories as a judge. From the time
she was appointed by Obama up until the time she was nominated by Biden,
she gave out reduced sentences to sex offenders as a trial judge, and consistently went against the recommended sentencing by prosecutors.


“She served as the tip of the spear in weakening federal sentencing policy for child pornographers as vice chair of the U.S. Sentencing Commission, where she ignored the advice of expert witnesses who disputed her theory that child pornographers are somehow not pedophiles,” said Mike Davis, president of the Article III Project, a Washington advocacy group for constitutional judges and the rule of law.

This ain’t new, buddy. This has always been her reputation. The truth and facts are there, no matter how many times you want to skate around it.

In a lot of those cases, she expressed more compassion for the
criminal than she did for the victim.

Take the Wesley Keith Hawkins situation....He is a young black gay man, who
was caught posting videos on YouTube of boys as young as 11 years old being
raped by men. Jackson gave him a slap on the wrist and showed overwhelming
sympathy towards him. So instead of sentencing him the recommended two years
of prison time by the prosecutor, she sentenced him to a few months in a lower
security facility, and even arranged for him to have special protection.

She stated that she didn’t believe that he was a pedophile and that
he didn’t pose a risk to children, and that his case didn’t warrant the 2 year jail time
sentence.

Well, after he completed his jail time, he was busted again by his probation
officer with having child pornography. She had to step in and essentially resentence him, this time to six months in a “residential reentry center,” according to her court filing. Asked about Hawkins’ relapse at her Senate hearing, she testified she could not recall the matter. But transcripts show that in her May 2021 sentencing of Adam Chazin, who was busted with 48 files of child porn including images of toddlers, she said “I remember Mr. Hawkin’s case well, even though it was many years ago.” Jackson cited her leniency toward Hawkins while giving Chazin just 28 months in prison (versus the 78 months prosecutors demanded).

This is not a person who should be a Supreme Court Judge.

if he runs again. some wont but i think his low approval numbers are a bit blown out of proportion.

theres probably 40% of the country that will disapprove of him no matter what, 40% that will support him through pretty much anything and the rest will be split on voting for him in 2024.

i kind of feel like we are where we were before he won SC. he looked bad yet was able to pull that off and run away with it when it came down to it. im thinking he and his team know what they need to do to get the votes they need and will just take the heat in the meanwhile.

i dont know how much of that will translate to the midterms though since he isnt on the ballot. it would be nice to see him pull that surprise off and at least hold both houses.

Even Hillary vs. Bernie or busters, those situations tell it all.

Basically, the left feel if moderates are destroyed (Hillary/Gore) the left will finally get a chance to win.

most people don't see this as affecting their lives. even for the people who can name a few SCOTUS justices, they're still the same minority they were when Biden took office.

but i hear you on the selling of anything. This admin is terrible at giving itself credit. the infrastructure bill was barely a blip. imagine if Trump signed a trillion dollar infrastructure bill.

Trump had himself for shit like this. he'd tweet shit he did (or better yet didn't even do) and his followers would repeat these lines verbatim in every argument. They'd be yelling "roads and bridges" like a kid with tourettes
