That’s because the televised trial is captured by Senate camera operators and NOT a news network as is typically done in congressional hearings. The GOP blocked outside media cameras from the trial to deliberately make watching as dry and and uneventful as posssible.

The goal being...”nothing to see here”

It's been nearly impossible to beat an incumbent in the modern era.

You have to go all the way back to '92 when Clinton beat H.W. Bush - and it's only happened 5 times in history.

Since this Impeachment trial is essentially a formality (an inevitable acquittal is coming) - the efficacy of the proceedings may be judged on whether Trump is re-elected.

Somehow, I don't see Schumer & Schiff being of all that much help when it comes to electoral politics. Schumer is a tired, waning voice in the Senate. His arguments aren't terribly compelling, and he certainly isn't exciting on-the-fence voters to vote against Trump. Schiff - while being impressively meticulous in his methodology - is a technocrat (an effective one at that). In this environment of anti-intellectualism, short form thought, and lack of patience, I don't see how he is going to move the needle for Democrats in 2020 either.

Of course, Impeachment has nothing to do with the election - per se - but everyone knows this has monstrous 2020 electoral implications. After all - this is not a judicial or legal process - it's a political one.

Democrats better know what they're doing with this.

I watched the whole thing, but I was very high as the night went on. Only way to do it.

But yeah, today starts with the actual opening statements.

Schumer offered to put off consideration of some of his amendments to today. But Mitch was dead set on having his rules agreed to by the end of the session.

Mitch's rules were passed on a party line vote. All of Schumer's amendments failed on party line votes, apart from one Yea vote by Susan Collins on the most technical one.

Really these (up to) 6 days are where the case is entirely made. After that, there's 2 days (16 hours) of questions from senators, a quick vote on whether to subpoena witnesses, and assuming that motion fails, I think the closing statements are 2 hours from each side (just what I remember from '98).

So really the "opening statements" are the meat of the trial.

definitely want to see the opening statements of the house. ill at least start watching the defense statements but if it turns into the same thing as theyve been doing ill probably tune out at some point.

If I remember right, Pat Cipollone lied about something (or got his mind tied up in the admittedly elaborate Trump defense). Then when Jerry Nadler pointed it out he openly accused Cipollone of lying. And next time Cipollone was up he started raising his voice a little and generally seemed peeved. It looked like the kind of showy emotion that lawyers use in trial all the time. He probably had no idea it was out of bounds.

Supposedly both sides tested the limits of the usual (silly) Senate decorum rules.

Honestly I just think one of Roberts's clerks found the ancient "Pettifogging" objection and Roberts thought it was so cute he had to find a way to squeeze in a history lesson.

Sadly, no. That's just politicians lying. Happens all the time.

As for actually HOLDING a vote, I think that is listed in the trial rules that they passed last night. So yes they either have to have that vote or have another vote to amend the rules (which they could easily do). Definitely no senators are under any obligation to vote in the ways that they've told the press they'd vote. Mitt doesn't have to vote Yes on calling Bolton, for example, even though he said he wanted Bolton to testify.

Certainly it makes more sense to decide on witnesses ASAP, so that they can subpoena people now to show up next week. If they put it off to decide until next week, then the whole trial goes on pause while they figure out all the scheduling.

Part of it is simply that senators might be less interested in calling witnesses after they've been patiently sitting at their desks for a full, arduous week. They're not allowed to read, they're not allowed to talk, they're not even allowed to get up and go take a piss while the hearing is in session. People were visibly worn out at the end of the first day. At the end of the seventh day EVERYBODY in the senate is gonna want it over with. Not to say that people will be voting en masse just to go home, but we need to win over at least 4 Republican senators to get witnesses, and we still don't know if we'd be able to get them, even in the abstract. After seven days of arguments that will be an even harder sell. Especially since the vote will come up right after the Trump team has spent three days specifically arguing against witnesses.

Regarding campaigning: yes, Biden is free to campaign (though that might change for a day or two if he ends up getting called to testify). Buttigieg is, too. Also Yang, Steyer, and Bloomberg, if you wanna count them. Warren, Sanders, and Klobuchar are the only ones stuck in Washington.

i actually don't think we can actually call it a process at this point...
none of the decisions made on the floor of the senate
have any basis on fact, on actual events that happened, on any arguments made,
on precedent, on legality, rationality, preparation etc
its fluster and even lying on the senate floor
and this is all being presided by the chief justice of the supreme court
who is the gatekeeper to the constitution.
i honestly don't know what to think about all this
it is the culmination of all the gop efforts and this is their reward
but we are watching what happens when the very fundamentals of a system are completely broken
and its hard to claw back from that.

the only thing i can hold on to is that we can clearly see the deepset immorality and hypocrisy that is at the heart of the republican party

It wasn't that long ago (2010) when the Democrats won the presidency, the house, and the Senate (supermajority).

In 2018, the Senate was nearly tied (51-49 if you give the Dems the independents)

There was a time not too long ago (2012ish) that people believed the house would be in Republican hands forever because of gerrymandering. Then 2018 came along.

And it's looking like Democrats have a decent chance of gaining control of the Senate in 2020.

And it's happening in a cycle when Republicans are defending nearly twice as many seats as we are, in a presidential election year, with a historically unpopular Republican president.

In other words, this is really the best shot we could ever dream of, and the optimistic view is that we have a decent shot.

In the Senate, something really has changed. In the past we've overcome our baked-in disadvantage by cultivating centrist or conservative candidates in red states. That's not happening anymore, for a variety of reasons. And until that dynamic resumes, or some other mechanism gets dreamt up, I don't see how we're anything other than the permanent minority party in the Senate.

what i think is being baked in is a system in which decisions are made on a partisan basis, regardless of consequences or implications
that's what this trial has solidified - that there is no respect for the law, only respect for the party
and if republicans continue to hold the senate... this will become some sort of norm
if republicans do lose the senate -they will return to their obstructionism
a two-party system (imo) only functions if it serves to act as an exchange of ideas and to strengthen existing and future laws
if what we are going to continue seeing is a system that rewards opposition to any laws on the basis of party affiliation?
then yes the system is broken for one heckuva long time

*edit* and to be honest, the rewarding of judges not on the basis of qualifications but on the basis of who can best push forward regressive policies (that serves one party's interests) is a pretty good example of what this looks like

Bolton has not implicated Trump directly. What he supposedly said was that he wasn't gonna be a part of the "drug deal that Mulvaney and Sondland were cooking up."

Bolton probably wasn't a fan of this Ukraine scheme, but he's not looking to give up his career in the Republican rage industry. He supposedly hates Mulvaney and Sondland and would love to get revenge on them. And in a convenient coincidence they both seem to be on the outs with Trump.

If Bolton is the only meaningful witness, he pins the whole scheme on Mulvaney and Sondland, GOP senators take it as an excuse to acquit. Trump takes it as an excuse to fire both of them and tell his followers that they were swampy Never-Trumpers all along who tried to set him up (they had both supported others in the '16 primary), Bolton doubles his book sales and maybe even comes back to replace Mulvaney.

If Bolton hung it all on Mulvaney & Sondland, he'd be contradicting Sondland's house testimony. But obviously senators are gonna believe the GOP stalwart who testified directly to them over the in-over-his-head donor who gave a hesitant and sometimes inconsistent testimony in the house, revising earlier testimony after others had already implicated him.

It seems like Mulvaney should be the goal for testimony, not Bolton.

i agree with you thats hes not a reliable witness. he clearly doesnt wanna testify despite him saying he would answer a senate subpoena (after dodging the house).

bolton is gonna look out for bolton and he wants to save as much info as possible for his book (a sign of the times). but if he doesnt tease it during congressional testimony while its still relevant...people will prolly lose interest in it once impeachment is over and the news cycle has moved on. no matter how damning the new information is.

there have been new mueller and other foia docs dropping consistently and reaffirming some of the loose ends on past hot button topics but theyve been pretty much ignored because people are over it now.

that anonymous book largely fell flat and didnt generate any sustained discussion because people were mostly over the past palace intrigue tales by then.

if bolton thinks his little memoir is gonna move the needle during the rapid fire news cycle of this election year...hes gonna be disappointed.

I think Democrats have always known that Bolton's not likely to be a useful witness.

Media talking-heads are forcing themselves to not be cynical about it, but this is a subject that deserves cynicism right now.

The reason that *anyone*'s talking about Bolton is just because he's at least said he'd show up if they sent him a subpoena. If they called Mick Mulvaney, he just wouldn't show up. We'd be in court over it, possibly for years, and at most the senate would try (and certainly fail) to charge him with contempt of congress. (And if they somehow succeeded at that the charge would then be referred to, well, William Barr, who would put it straight in the trash can.)

I'm pretty sure at this point that there just won't be witnesses. There isn't a way to get an honest trial in a hyperpartisan climate. We all knew this going in. I think the push for witnesses is just a (valid and justified) game to put five or six vulnerable Republican senators on the record opposing a fair trial and make that opposition as politically damaging as possible.

I saw a story this morning with polls claiming that opposition to witnesses is now starting to grow among Republicans in the general public. There've only been a couple days to take polls, so obviously the sample sizes will not be statistically useful.

The case they're laying out is extremely strong (on the question of witnesses/documents, and overall). So hopefully I'm wrong.

On the other hand, if GOP senators, who are legally required to be watching, are leaving the room for hours on end, it seems very unlikely that the case will break through to casual viewers at home. If there's public pressure for witnesses, it'd probably come from people like us who already wanted them, getting more and more enraged as the presentation goes on, and eventually calling their senators. Really, we should all be doing that. Nobody's gonna call their senator to say they *shouldn't* have witnesses.

one thing i noticed about the most recent series of 'lets visit this trump supporting town and interview trump supporters like swing voters' news segments...

they dont really parrot the usual talking points about hoaxes, presidential harassment, what about biden/hunter, etc anymore when discussing impeachment.

they just say they havent been paying attention because they have more important things to worry about like finding/keeping a job, plant/factory closing, farm going bankrupt, etc.

They just seem to be randomly throwing things into the air.

For acquittal, that's probably fine for them. If they obscure the facts, senators default to acquittal.

But yeah, it also seems to strengthen the case for witnesses. Maybe they're just not concerned about that anymore. They might just think McConnell has the votes he needs.

Cipollone, in his closing, now seems to be pushing for Schiff to testify. Maybe that'll be their backup plan (now that the Hunter Biden idea has fizzled). If Bolton testifies, they call Schiff too. Then they berate Schiff for a few hours about his mockery of the phone call, and about his staffers meeting with the whistleblower. All irrelevant, just further obfuscation. i didnt get to see the end of friday night so i watched the defenses statement on saturday morning. while watching i thought it sucked that the dems dont get to rebut some of these points. i thought what a missed opportunity. then i went and watched schiffs closing and saw he basically did anticipate and call out what the defense was going to argue.

That's still not in any doubt. All this clawing for witnesses is about trying to find four open-minded, anti-trump, institutionalist or politically vulnerable Republicans. There MAY be four such people in the Senate.

To convict, we still need to win over TWENTY Republicans (and perhaps a few more if Doug Jones, Joe Manchin, Jon Tester, Kirsten Synema, or others can't hold the line on our side). That's extremely unlikely to happen.

And ironically, the still-inevitable acquittal is central to the behind-the-scenes argument against witnesses. Every Republican (especially Mitch) knows that the more information is out there, the more politically damaging it will be for the Senate and the Republican party when they eventually let him go. The politically vulnerable Republicans (Collins, Gardner, Ernst, McSally) are the ones MOST terrified of witnesses, though they're also terrified of blocking witnesses.

A number has been floating around lately that a majority of senators now represent 18% of the population. That doesn't exactly mean that the GOP caucus represents 18% of the voters, because Texas is a big (so underrepresented) state while Rhode Island is small (overrepresented).

Still, there are a lot more states like Wyoming and California (overrepresented states being more Republican) than there are like Texas and Rhode Island.

Trying to look up this number just now, I saw old stories that the senators who confirmed Kavanaugh represent 44% of the people.

People are starting to question the legitimacy of the Senate itself, and for good reason. You'd think this would worry Mitch McConnell, but he also knows that nothing can be done about it by political means. So his political power is assured whether it's democratically legitimate or not!

gerrymandering, electoral college, unelected judgeships, etc.

they know democracy doesnt work in their favor. and they dont care about legitimacy. they know theres nothing anyone can do about it (like you said).

as far as the population/geographic distribution of senate seats...im reading the same numbers you are. im not sure exactly where we are on the scale right now but its only going to get worse as most of the population growth and diversifying is taking place in only a handful of areas.

there are more states getting redder/older/more conservative than there are ones getting bluer. and youre giving up 2 senate seats as those states move away from dems. which is why going further left is increasingly risky. its a political reality we dont really talk about much.

Progressive retirees, freelance workers, new college graduates looking for their next step; these people should be moving to places like South Carolina, Georgia, Wyoming, Montana. Tech companies shouldn't be trying to drive up Bay Area rent past the $5k mark, they should be moving en-masse to Ohio, Alabama, Idaho (in recruiting ads they could even list the price per sqft of a house in their chosen state vs California). Flip some of these states. The fact that they're underpopulated means that the supposedly-permanent GOP majorities in those states is fragile if only we worked in a coordinated way to take them over.

I mean, I understand it. By now I've lived in Ohio nearly twice as long as I lived in California, and I still feel like an Angeleno in exile. But a mass exodus of blue people to red states seems like the only way short of a civil war that these basic constitutional flaws get addressed.

I'm sure the vast majority of them have gamed out scenarios in their head for when they finally cut him off.

I still don't see it, though. Conviction, I mean. The party is in too deep by now. They also know that a lot of this stink will eventually spread to Mike Pence as well. Trump himself, early in the Ukraine scandal, was out there implying that Pence was more involved in the scheme than he was. Obviously Trump's motivation was just to protect himself. But just like everyone knows Trump is guilty, everyone also knows that Trump is perfectly happy to take down everyone within reach if he thinks it'll save him a little face. Look at how Pompeo flipped out over a totally predictable question the other day.

None of this shit Rudy was doing was the kind of thing that an attorney would professionally do for a private client. But they've said he was doing legal work the whole time, presumably so they can claim he can't be compelled to testify.

I wasn't aware that party leaders needed to okay them, but that sounds plausible. I believe the chief justice can decline to ask them if they're irrelevant (though 51 votes can overrule him).

One cute thing I heard: not only do they have to be written, but no technology is allowed. So they actually have to be handwritten. It'll be interesting to see if anybody's handwriting is illegible.

I don't know anything beyond that.

So I'm taking it that they'll do the question time tomorrow, maybe Thursday too (it's 16 hours total, iirc), and then they vote on witnesses & documents? Or do they vote on witnesses & documents tomorrow?

I think a lot of these questions are just very predictable and they prepared responses for the obvious ones.

I think Schiff said in an interview that all the managers were given particular areas to prepare for, and (I assume) anything that's unexpected goes to Schiff or Nadler.

All I'm saying is the fact that they have prepared answers does not mean they got the questions ahead of time. Very few of these questions have been surprising.

Some of them have been followup questions, referring explicitly to past responses from the lawyers or managers. Those questions were obviously not written ahead of time.

Also, just because they're reading text off paper doesn't mean they had to predict whatever nuances might have existed in the questions as asked. Usually there are no such nuances. You just need to talk about this or that subject and connect it as necessary to how the question was phrased (or not!).

Politicians prepare responses to debate questions all the time. They just predict what they can and go with what they have when the time comes. Like they say: don't answer the question you were asked, answer the question you wish you were asked.

Schiff has not been using prepared remarks. He's been responding off the cuff (and even got hung up a few times). That's why I'm guessing it was his job to handle questions that nobody prepared for.

They're claiming any discussion of the events is classified. Which is strange, considering they're also claiming the story is untrue.

They're bluffing on this, and Bolton knows it. There isn't anything they could do to him if he did an interview.

Maybe he does an interview tomorrow. Maybe he just lets it hang until the book comes out. Maybe the House sends him a subpoena and he complies this time, possibly even leading to entirely new articles of impeachment.

We need to remember, though: the last thing Bolton is interested in is helping Democrats. He might want to distance himself from the WH. He almost certainly wants to embarrass Trump. But giving interviews or talking to the House outside of an active trial might help Democrats more than it hurts Trump. So he might lose interest in that scenario.

90% of these are just setups for either side to grandstand, but many of them would become probing questions if they went to the opposite side.

Actually, if we wanted the question phase to be useful, Democrats should only be allowed to direct questions to the President's counsel, and Republicans should only be allowed to direct questions to the house managers. Put them all on their toes and get past the bullshit.

and they know the more of a trial there is, the more embarrassing that acquittal will be for them. That seems to be the argument that's winning the day.

You can bet money that when John Bolton's book comes out they'll be furious at Democrats for not making it clear to them what Bolton had to say. But by then they won't want to relitigate the past.

On the plus side, it's getting clear the public won't fall for that. I think every Democratic Senate and House candidate just found something powerful to build their general election around. Not "we need to impeach the president," but "you can't trust those people to hold powerful people to account." And as a bonus "you (the voters) can do it for them."

I've been getting so annoyed with all the posing that I've started to wonder how many of the questions were serious, how that subset broke down wrt party lines, how it correlates with proximity to reelection, a state's partisan lean, etc. This would be a starting point if I or anyone else ended up doing that analysis (honestly someone at 538 or Vox should be doing it right now).

Nobody was more certain than I was, going in, that this would be a shitshow. But even I've gotten exasperated at just how pointless it got. And yeah, even I've had to turn it off and go back to work. This isn't even worth procrastinating to anymore. If anything interesting comes up, it'll be reported on, like Dersh's oh-shit answer yesterday (that he's already written articles trying to clear up), or Rand Paul's weird crusade.

I watched a lot, ALOT, but not every minute

My summary:

1st it was a perfect call, nothing wrong
Then it was no quid pro quo
Then it was legit motives
Then it was no crime was committed
Etc...
Now, it's yeah, we did it, it was a crime...but it's not impeachable
Dude yesterday, stated, Ghouliani was not executing foreign policy = outright admitting this was for personal gain

They've moved the goalposts everyday, almost by the hour

They've offered not a single shred of evidence to support any of their numerous defenses

...and I'm really confused how they can offer multiple defenses to begin with...

Anyway, having said alladat...if the Rs do move to acquit, without calling additional witnesses

They are complicit in the cover up.

But in general, I don't necessarily disagree with this. I thought the investigation into Clinton's sex life was dumb & intrusive. But once he committed perjury, impeachment was pretty much certain. Still, I didn't think that lying about some head called for him to be removed from office.

I certainly think that pressuring foreign countries to announce a fake-ass investigation against your political opponent is way worse than lying about a BJ. ANd I think 45 deserves to be removed.

I just don't think that every impeachable offense calls for removal from office.

They didn't allow witnesses NOR did they allow evidence. Anyone who would do that while under oath to be impartial isn't interpreting a goddamn thing. And they said that at the outset.

How someone could follow this trial and come to that conclusion is just utterly mind-boggling.

As far as calling more witnesses in the house, they were stonewalled. From what I gather, going to court to force witnesses (who refused to appear) to testify could have taken a year.

Now, I do think they should proceed with that now. And I also think because of the stonewalling, obstruction of justice should have been an article.


Even that said, Trump admitted on video to what he did (even asked China to chip in), then his Chief of Staff did also. Plus, its right in the transcript that the WH released.

I suppose you could make the argument that those three things is all they should have needed and/or talked about to keep things super simple.

But that doesn't seem to be the argument you're making.

If anything, your point about wanting something to get past the "the Ukraine call was wrong, but not enough to remove"...I think that makes the case it should have been more broad.


Include everything- from the Mueller report to enriching himself here and abroad to the Ukraine call...everything.

Then, they can't say "he made a mistake!"


The other thing I'd say, is just watch out cuz a few folks around here were for impeachment until the Dems actually pulled the trigger...and once Dems moved toward impeachment their arguments changed - seemingly to just disagree with the dems.

I believe the president is selfless, and always puts the nation’s interests first. I believe he isn’t a narcissist, but he’d be entitled to be one if he were one. I believe the president would never exercise his presidential powers to advance his personal interests, but if he did, that would be okay, because whatever is in his personal interests is necessarily in the nation’s interests as well.

I believe Article II of the Constitution gives the president the right to do whatever he wants.

Gabbard had called for him to be censured *before* his unconstitutional strike on Iran (specifically calling out the danger of such an action) - so there would’ve been a different set of circumstances at play if he was up for censure as he was making an executive decision to unilaterally strike Iran sans congressional approval - and likely an even more compelling article of impeachment floated because of it. But certainly not if our Senators abstained from voting (like many of them did with the 2020 NDAA.)

But no - I don’t actually think a censure would’ve been productive either. Not with the makeup of this Senate. I just couldn’t help but point out the irony.

All I'm saying is that right now NYTimes has a big banner headline that says "Trump Acquitted." As of now, Trump has zero reason not to declare an open season of impeachable offenses right out in the open, and Republican congressional candidates will justify it all because "he's been acquitted on every witch hunt."

So the "what for" is a formal acknowledgement that Trump did things that a President is not supposed to do -- wrong, illegal, even impeachable if you go by Rubio's logic. That's far less than what he deserves, but it's the most we were ever gonna get.

WASHINGTON — President Donald Trump delivered payback Friday to two key witnesses who testified in the House impeachment inquiry, firing Gordon Sondland, the U.S. ambassador to the European Union, and removing Lt. Col. Alexander Vindman from his White House job.

Both officials provided critical information about Trump during public hearings, with Sondland saying the president sought a "quid pro quo" with Ukraine's leader and Vindman criticizing Trump's conduct during a July 25th phone call with Ukrainian President Volodymyr Zelenskiy as "improper."

The moves came hours after Trump was asked about his press secretary's comments that his opponents should pay a price. “Well, you’ll see," the president told reporters.

Sondland said in a statement Friday night, "I was advised today that the President intends to recall me effective immediately as United States Ambassador to the European Union."

2 of the lead prosecutors resigned today after doj reversed course on the sentencing recommendations they made just *yesterday*. the change of heart on sentencing comes hours after trumps tweet about the unfair treatment of stone.

doj spokesperson said the decision was made before the tweet lol.

i remember asking on here if people would stay in their post to resist/provide oversight or if they would resign in protest if they held a GOV position. what would be better?

where at a point that i dont know what matters.

i do feel that there being so many open positions and people resigning is really bad. we have seen trump abuse this. is he firing these people or are they actually resigning?

the previous u.s. attorney that oversaw the stone case.

she left her post as the u.s. attorney for dc for a position in treasury (while barr installed a close loyalist as the new dc u.s. attorney).

now trump just pulled her treasury nomination before she was about to go in front of the senate for her confirmation hearing.
