meanwhile family members of the new ag are being oddly re-positioned. his son-in-law just joined the white house legal team. and his daughter just joined the financial crimes division of the treasury that deals with money laundering.

the only thing legally required is a summary by the ag (or whoever oversees the special counsel) based on the confidential mueller report. but the summary can be edited/redacted/etc at the discretion of the ag.

theres speculation about what dems in the house can do to make muellers findings public but if they get stiffarmed by a politically motivated doj and it heads to the supreme court...you know whos sitting there waiting.

...Mueller report. The federal government leaks like a sieve. This administration REALLY leaks like a sieve. If it gets issued, it'll get out there some way.

Now if the Senate does anything about it is a legit concern. But we'll know what it's there.

but my understanding is that theyre are workarounds that congress can attempt (dem majority in the house since repubs wont lift a finger)...like hearings, doj/fbi/sco subpoenas, etc.

its imperfect and subject to various confidentiality rules (like only gang of 8 can see certain material above a certain clearance). but its a piecemeal approach to forcing info out into the public sphere (like mueller including investigation information in grand jury documents).

but the point is that it isnt legally set in stone...and thus challengeable/obstructable.

theyve been trying to pass bipartisan legislation mandating that the special counsel release a report directly to congress/public without ag interference. naturally its been held up in the senate by mitch mcconnell tho.

ultimately this may just be left up to the court of public/political opinion. strong circumstantial evidence suggesting collusion. one side buys it. one side denies it. and the 2020 election ultimately decides how the american people weigh in.

What exactly gives you this confidence ? What judges/court filings/prosecutors are you referring to and so confident in, in this specific situation ?

WASHINGTON — The Trump administration asked the Supreme Court on Thursday to block Congress from seeing grand jury secrets gathered in the Russia investigation by the special counsel, Robert S. Mueller III, saying the executive branch would suffer irreparable harm if lawmakers see the evidence.

In a 35-page filing, Noel J. Francisco, the solicitor general, asked the justices to halt an order by a federal appeals court that imposed a May 11 deadline on the Justice Department to turn over the evidence to the House Judiciary Committee. He said the Justice Department should first get a chance to fully litigate an appeal of the ruling before the Supreme Court.

“The government will suffer irreparable harm absent a stay. Once the government discloses the secret grand-jury records, their secrecy will irrevocably be lost,” Mr. Francisco wrote, adding, “That is particularly so when, as here, they are disclosed to a congressional committee and its staff.”

House Democrats have argued that they need to see the grand jury evidence in part because of suspicions that Mr. Trump may have lied under oath in his written answers to Mr. Mueller, including about his campaign’s advance knowledge of and contacts with WikiLeaks about its possession of hacked Democratic emails and plans to publish them.

But under Attorney General William P. Barr, the Justice Department has fought to prevent House investigators from seeing the grand-jury material, including information that was blacked out in the report on the Mueller investigation it released last year and underlying testimony transcripts those passages derived from.

Usually, Congress has no right to view grand jury evidence. But in 1974, the courts permitted lawmakers to see such materials as they weighed whether to impeach President Richard M. Nixon. Last summer, as the House Judiciary Committee weighed whether to impeach President Trump, it sought a judicial order to see certain Mueller grand jury materials, too.


The politically charged fight turns on a technical legal issue: whether the impeachment process, which begins with a House inquiry and can culminate in a Senate trial, counts as a “judicial proceeding” under an exception to grand-jury secrecy rules that permits sharing evidence for that purpose.

Both a Federal District Court judge ruled last fall, and a panel of the Court of Appeals for the District of Columbia ruled this spring, that impeachment is a judicial proceeding, following the Nixon impeachment precedent. But the Trump administration has delayed any sharing of the evidence by continuing to argue at each level that it is not.

In the request to the Supreme Court that it halt the appeals court’s order that the Justice Department turn over the material by May 11, Mr. Francisco argued that “at least four justices” — the number necessary to take an appeal — are likely to decide that the Supreme Court should weigh in on the issue, and that “there is at least a fair prospect” that a majority will eventually rule in favor of Mr. Trump.

But if the House has already seen the evidence in the interim, he argued, the executive branch will be harmed even if it ultimately wins the case. He noted that nothing could stop House Democrats from publicly releasing the evidence Mr. Mueller gathered by a simple-majority vote in the Judiciary Committee.

The requester doesn't know who the unnamed person is beforehand. So my question is why did Flynn's name show up so much?

Is the #obamagate that they did unmasking (a common process that goes through approval channels)?

Georgia Republicans cancel election for state Supreme Court, meaning governor can appoint a Republican

The state of Georgia was supposed to hold an election Tuesday to fill a seat on the state Supreme Court. Justice Keith Blackwell, a Republican whose six-year term expires on the last day of this year, did not plan to run for reelection. The election, between former Democratic Rep. John Barrow and former Republican state lawmaker Beth Beskin, would determine who would fill Blackwell’s seat.

But then something weird happened: Georgia’s Republican Gov. Brian Kemp and the state’s Republican secretary of state, Brad Raffensperger, canceled Tuesday’s election. Instead, Kemp will appoint Blackwell’s successor, and that successor will serve for at least two years — ensuring the seat will remain in Republican hands.

On May 14, the state Supreme Court handed down a decision that effectively blessed this scheme to keep Blackwell’s seat in the GOP’s hands. The court’s decision in Barrow v. Raffensperger is unusual in many regards — among other things, six of the state’s regular Supreme Court justices recused from the case, and they were replaced by five lower court judges who sat temporarily on the state’s highest court. The court’s decision in Barrow turns upon poorly drafted language in the state constitution, which does suggest that Blackwell, Kemp, and Raffensperger’s scheme was legal.

The scheme, briefly explained
In late February, just a few days before the deadline for candidates to file to run to replace Justice Blackwell was about to expire, Blackwell sent a letter to Kemp announcing that he intends to resign his seat, effective November 18. That means that Blackwell will leave office a few weeks before his term was set to expire on December 31.

Shortly after receiving this letter, Kemp formally accepted Blackwell’s future resignation. The governor then informed Raffensperger, the state’s chief elections officer, that he intended to fill Blackwell’s seat by gubernatorial appointment. In response, Raffensperger canceled the election to fill Blackwell’s seat, which was scheduled for May 19.

Both Democratic candidate Barrow and Republican candidate Beskin filed lawsuits seeking to reinstate the election, but these pleas were rejected by the state Supreme Court in a 6-2 vote.

The court’s decision in Barrow turns on the tension between two provisions of the Georgia Constitution. The first provides that “all Justices of the Supreme Court and the Judges of the Court of Appeals shall be elected on a nonpartisan basis for a term of six years,” and that the terms of these judges “shall begin the next January 1 after their election.” Because this language refers to “all Justices,” it suggests that an election must be held to fill Blackwell’s seat, and that whoever prevails in that election shall join the state Supreme Court on the first of January.

But a separate provision of the state constitution permits the governor to temporarily fill vacancies on the state Supreme Court, and it provides that “an appointee to an elective office shall serve until a successor is duly selected and qualified and until January 1 of the year following the next general election which is more than six months after such person’s appointment.”

Thus, while the first provision suggests that an election must be held to fill Blackwell’s seat — with the winner taking office on January 1, 2021 — the second provision indicates that an appointed justice may serve much longer. When Blackwell resigns on November 18, the “next general election which is more than six months” after that date won’t occur until 2022.

So the second provision seems to suggest that an appointed justice may serve until January 1, 2023 — and longer, if that justice eventually wins the 2022 election. The new justice will also be able to run with all the advantages incumbency provides.

A majority of the state Supreme Court concluded that the second provision effectively trumps the first provision’s suggestion that the primary method of choosing Georgia Supreme Court justices is an election. “When an incumbent Justice vacates his or her office before the end of his or her term,” the court explained, “the incumbent’s unexpired term disappears with the incumbent, along with any hypothetical future terms associated with that incumbent.”

Kemp’s appointee, in other words, will not simply serve out the remaining few weeks in Blackwell’s term. They will serve those remaining few weeks plus an additional two years.

The court’s decision in Barrow will be very easy to game
As a practical matter, this decision is likely to prove very easy for retiring justices to game if they belong to the same political party as the incumbent governor. Indeed, under the court’s decision in Barrow, Blackwell likely could have announced that he would resign effective December 30 — just one day before his term would have expired — and Kemp still would have gained the power to name Blackwell’s replacement.

Indeed, Kemp could potentially even appoint Blackwell to fill the vacancy created by Blackwell’s early resignation. That would effectively give Blackwell an eight-year term, rather than a six-year term. And nothing would prevent Blackwell from running for election again in 2022.

The upshot of Barrow is likely to be that when a justice who belongs to the same party as the governor wishes to retire, they will submit a postdated resignation similar to the one Blackwell submitted to Kemp. That will effectively give that justice’s party an extra two years to hold on to the justice’s seat before the next election takes place.

Judge refuses to halt class-action suit accusing Trump of promoting pyramid scheme

A federal judge in Manhattan on Monday refused to halt a lawsuit against President Trump and his family alleging that they promoted a pyramid scheme.

Judge Lorna G. Schofield denied the Trump family’s request for a stay while they appeal an earlier ruling that allowed the lawsuit to move forward.

Schofield, who was appointed to the U.S. District Court for the Southern District of New York by President Obama, wrote in an opinion that the Trumps had failed to show a likelihood of success in the appeals court.

The class-action lawsuit was filed in 2018 by four anonymous plaintiffs alleging that Trump, his three eldest children and the family company had promoted a multilevel marketing company called American Communications Network (ACN) in exchange for millions of dollars in secret payments.

The plaintiffs alleged that Trump’s endorsement convinced them to invest hundreds of dollars to participate in ACN’s business that they never recouped.

“We intend to promptly move the Second Circuit for a stay pending appeal,” Trump’s attorney, Joanna Hendon, told The Hill.

The president’s legal team has argued that the plaintiffs lack legal ground to bring the suit because the Trump family had no control over ACN. They sought to have the case moved to arbitration, which would largely shield it from public view, but Schofield denied the motion, and her decision is now being appealed.

I recall being invited to one of these pyramid scheme meetings about a communications network by some girl I was trying to smash, the only reason I attended. This was in like 2006 maybe, 2007. I don't recall the name ACN specifically from that meeting but it rings a bell in general, so I'm curious if that was the company she was "working" for.

I used to be nice and listen to people's pitches about shit and then say I'm not interested. Never had to go to a meeting or anything. Although, I dated a woman who got heavy into Landmark and went to what I thought was a 'graduation' but it was really just a recruitment event for her cult.

Senate Majority Leader Mitch McConnell (R-Ky.) signaled on Tuesday that he is backing efforts to subpoena Obama-era officials.

McConnell, speaking from the Senate floor, referenced Senate Judiciary Committee Lindsey Graham’s (R-S.C.) announcement that he will schedule a vote for a wide-ranging subpoena on June 4.

“Senate Republicans are taking steps to issue new subpoenas to a wide variety of Obama administration officials. ... The American people deserve answers about how such abuses could happen. And we intend to get those answers,” he said.

Graham announced on Monday evening that that he would have the committee vote on the subpoena as part of an investigation into the court established by the Foreign Intelligence Surveillance Act (FISA) and “Crossfire Hurricane,” the name for the FBI’s investigation into Russian interference in the 2016 election.

Graham’s subpoena would cover dozens of officials including Attorney General William Barr and FBI Director Christopher Wray, as well as former Deputy Attorney General Sally Yates, former national security adviser Susan Rice, former Deputy Attorney General Rod Rosenstein and former FBI Director James Comey.

Sen. Ron Johnson (R-Wis.), the chairman of the Senate Homeland Security and Government Affairs Committee, is also months into a wide-ranging probe on potential wrongdoing or conflicts of interest stemming from the Obama administration and has indicated that he will also look into the investigation of former Trump national security adviser Michael Flynn.

President Trump has publicly pressured Republicans to dig into decisions stemming from the Obama-era Justice Department and FBI.

“Mitch, I love you, but this is 100% true. Time is running out. Get tough and move quickly, or it will be too late. The Dems are vicious, but got caught. They MUST pay a big price for what they have done to our Country. Don’t let them get away with this!“ Trump tweeted over the weekend in reference to the Obama administration.

McConnell, on Tuesday, said the Obama administration used the FISA court to “snoop” on Trump’s campaign. Justice Department Inspector General Michael Horowitz found a total of 17 inaccuracies and omissions in the FISA warrants involving former Trump campaign adviser Carter Page. Horowitz said in his report that he did not believe the opening of the investigation was motivated by political bias.

“This is just one of the realities that President Trump’s Democratic critics spent years calling conspiracy theories or inventions of the president’s mind. Yet here it is, in black and white, from exactly the kind of independent inspector general that Democrats rush to embrace when convenient,” McConnell said.

I'm just clarifying for others that this isn't a theoretical hypothetical lyrical miracle. It's not hyperbole, it's not a metaphor. It is a statement of fact.

There are a small, vocal subset of people on this board that minimize the situation we're in constantly.

It is depressing and while I agree that the people in position to fight this have been ineffective and in many cases asleep at the wheel in a lot of cases they were just plain outmaneuvered by criminals and those willing to aide and abet.

Remember, the president was impeached however the Republicans in the senate voted not to even hear evidence for an actual trial. Mueller's investigation was shut down by Barr. Epstein was allowed to kill himself or be killed. Barr dropped charges against Flynn.

So yes, there have been abject failures by those in power to stop this. But there have also been things done that very few people accounted for. Some of that is based on the fact that we have long held the idea that we're special. That this doesn't happen in America. To us, it happens in small countries we can't find on a map that end in '-onia' Well, it finally has happened here and it has been orchestrated with a lot of the people who've been doing it in those countries we never really thought about.

As I said during impeachment, this has been a LONG play and is a culmination of a lot of hard work by a lot of very bad people for a long time. And we've ALL been asleep at the wheel. Now we're so far behind the 8-ball it is scary.

The ouster of the State Department’s inspector general, who had been investigating Secretary of State Mike Pompeo on at least two charges of misconduct, is yet another instance of how corruption—and the tolerance, almost the expectation, of corruption—pervades the upper tiers of the Trump administration.

Pompeo may, at first glance, seem an unlikely candidate to get tangled in this web. He was the top-ranked graduate of his class at West Point (whose code of honor commands cadets not to “lie, cheat, steal, or tolerate those who do”) and a church deacon with a strong moralistic bent (at least rhetorically).

Yet the firing of the IG, Steven Linick, appears to be Pompeo’s personal cover-up. Yes, President Donald Trump signed the letter notifying Congress that he was dismissing Linick because he’d lost confidence in his work. But when a reporter asked for elaboration, Trump replied that he didn’t know the guy, had never heard of him—that he fired him because “I was asked by the State Department, by Mike.” Meanwhile, Pompeo said that Linick hadn’t lived up to the department’s ethos and claimed that he didn’t even know Linick was investigating him. But the New York Times revealed on Tuesday that Pompeo refused to be interviewed by Linick about one of the probes—indicating that he knew about the probe after all.

Linick was looking into two issues brought to his attention by several employees. First, Pompeo and his wife, Susan, were using State Department political appointees for personal household tasks—having them pick up dry cleaning, walk their dog, buy groceries, and so forth. The couple have apparently made these demands quite a lot. A friend of the family told me that when Susan Pompeo visited her mother in Lafayette, Louisiana, security officials were ordered to pick her up at the airport. Last June, they were told to pack up the house in Lafayette and cart away boxes when her mother prepared to move to a retirement home in Overland Park, Kansas.

The second issue under investigation is that, last year, Pompeo illegally declared an “emergency” to circumvent a congressional ban on sending weapons to Saudi Arabia, which would use them for the war in Yemen—although, as was later discovered, there was no real emergency.

The second act is more serious than the first, but both reflect an arrogance in office and a contempt for the laws and regulations designed to rein in corrupt behavior.

So what happened to Pompeo on the road from valedictorian at the U.S. Military Academy, Class of 1986, to the latest paragon of dishonor in the Trump administration? Two mutually reinforcing factors seem to be at play. First, Pompeo’s career, at least for the past 20 years, has been marked by a relentless pursuit of power. Second, the glaring example of Trump’s own use of his office for personal gain has granted his underlings license to do likewise—the more so, as Trump demands from them loyalty and emulation above all else.

In her August 2019 New Yorker profile, “Mike Pompeo, the Secretary of Trump,” Susan Glasser laid out a highly detailed chronicle of her subject’s career. In the late 1990s, after a stint as a Washington lawyer, Pompeo divorced his first wife and moved to Wichita, Kansas, where he and three former West Point classmates started an aircraft company, which was funded in good part by the Koch brothers. (Pompeo has said that the Kochs put up only 2 percent of the capital, but Glasser found documents indicating they supplied 20 percent.) The business ultimately failed (again, contrary to Pompeo’s later claims), but he used his Koch connection to run for Congress as a Republican candidate affiliated with the then-burgeoning tea party movement. In the run-up to the 2016 election, Pompeo supported Marco Rubio and railed against Trump during the Kansas primary. When Trump won the nomination, Pompeo came around, as did most of the other candidates. A four-term congressman by this point, he had recently raised his profile by hammering Hillary Clinton in the House hearings on Benghazi. (He was one of just two Republicans who wrote a minority report, dissenting from the overwhelming bipartisan consensus that Clinton was not to blame for the terrorist killings of four Americans.)

He was also a good friend of Mike Pence, who convinced Trump to nominate Pompeo as CIA director. Pompeo, who had a keen feel for how to butter up his superiors and donors, quickly detected that total subordination was the way to Trump’s heart—and to further advancement. Pompeo really wanted to be secretary of state—he involved himself in policy matters far more than CIA directors had traditionally done—and, when Trump tired of his first top diplomat, Rex Tillerson (who had famously referred to the president as a “fucking idiot”), Pompeo lobbied for the job and, after getting it, continued to do Trump’s bidding, in Trump’s style, even when he privately disagreed with his policies.

Pompeo has displayed a haughty sneer at every congressional hearing where he’s been asked confrontational questions. Some recall that same sneer when he questioned Hillary Clinton and other Obama-era witnesses from the other side of the dais. The sneer showed up again Wednesday morning, at a press conference where, after condemning the Chinese government for not letting reporters ask all the questions they like, he walked out of the room without answering several questions about the IG investigation. (He denied any wrongdoing and said, without proof, that all the leaks were coming from Sen. Bob Menendez and said he doesn’t need to take ethics lessons from a man who was tried on charges of bribery.) Back in his House days, his intended audiences for these displays were the rock-hard conservatives back in Kansas and the increasingly tea party-infused GOP leadership. Now, the audience—a singular target—is Trump.

For a while, Pompeo, who is just 55, has thought about going back to Kansas and running for Senate. (Mitch McConnell, the majority leader, is urging Pompeo to do just that; the race for an open seat is unusually competitive, and McConnell fears losing the party’s control of the Senate.*) One reason for Pompeo’s hesitancy is that he has a dream of running for president in 2024. NBC News reported on Tuesday that he has held several plush dinners in the State Department, at taxpayers’ expense, ostensibly to discuss foreign policy with outside experts, but most of the guests—according to leaked invitation lists—have been famous corporate and entertainment figures. Officials have raised concerns about these dinners, seeing them as vehicles to create what NBC called “a donor and supporter base for Pompeo’s political ambitions.” It is unclear whether the IG was investigating the dinners as well, but Congress is likely to take a look now.

A publicized probe into the misuse of public funds and abuses of power might tarnish higher political ambitions. So the inspector general had to be disposed of. But now that Pompeo’s own role in the ouster has come to light, now that it’s clear the accused was behind the sacking of the accuser, the cover-up—as the old saying has it—might appear worse than the malfeasance.

There’s a final irony. Linick, a career inspector general, was appointed to the State Department post in 2013 by President Barack Obama. That alone was sufficient cause for Trump to sign off on Pompeo’s request to fire him. He would be the fourth IG that Trump has dismissed for doing their jobs too diligently. But one thing that Trump didn’t know: Linick was the one who first investigated Secretary of State Hillary Clinton for sending official emails on her personal server. In this sense, Linick’s entirely nonpartisan doggedness is one reason Trump is president—and, by extension, why Pompeo is secretary of state. Trump, as usual, will suffer nothing from his latest obstruction of an independent inquiry. However, Pompeo—like many others who have served Trump, only to be pushed under the bus—may lose it all.

There's been speculation that he may have been left to hang by Trump administration due to his role on the Republican-led Senate Intel Committee and the recent report it published that Russia DID in fact work to interfere in the 2016 election. It was speculated that a lack of investigation into Loeffler's dealings would indicate that the failure to shield Burr from was retribution.

Sen. Loeffler’s husband cuts $1 million check to pro-Trump super PAC

The Georgia senator is facing a tough election battle amid questions about her stock trading

Jeff Sprecher, the husband of Sen. Kelly Loeffler (R-Ga.), sent a $1 million check to the leading pro-Trump super PAC even as she been fending off criticism around her family’s stock trading.

Sprecher, chairman of the New York Stock Exchange, donated to America First Action on April 29, according to a report the Federal Election Commission filed Wednesday evening. America First has been described as the sole “approved outside non-campaign group” by the Trump campaign.

Sprecher’s donation came as Loeffler has faced increasing criticism over stock trading during the coronavirus pandemic. She offloaded stocks shortly after a classified briefing on Covid-19 in January.

Loeffler has maintained she has done nothing wrong, saying she does not control her own stock trading. She later said she would no longer trade individual stocks.

Last week, Loeffler’s office said she turned over documents to the Justice Department, the Securities and Exchange Commission and the Senate Ethics Committee regarding the trading. “The documents and information demonstrated her and her husband’s lack of involvement in their managed accounts, as well the details of those accounts,” a statement from her office said last weekend.

Loeffler is facing a tough intraparty challenge for her seat from Rep. Doug Collins (R-Ga.). Loeffler, Collins and a handful of Democratic candidates will face off in November in a special election, with the top two candidates advancing to a runoff if no candidate breaks 50 percent.

The National Republican Senatorial Committee has stuck with Loeffler despite the inquiry.

“Kelly Loeffler is a strong conservative voice for the people of Georgia,” NRSC Chair Todd Young (R-Ind.) said in an interview with POLITICO in early April. “She’s effectively representing them and she will continue to be an effective United States senator for the people of Georgia after November.”

Collins was Trump’s initial preference for the Senate seat left vacant when Sen. Johnny Isakson retired. But Georgia Gov. Brian Kemp bucked Trump and appointed Loeffler, who was sworn in as an interim senator in early January.

Loeffler has committed her sizable personal wealth to her campaign for November, loaning her campaign $10 million and pledging more.

Sprecher was not America First Action’s largest donor in April. Businessman Timothy Mellon gave $10 million to the super PAC.

The Justice Department will not file insider trading charges against Sen. Kelly Loeffler (R-GA), the Wall Street Journal reported on Tuesday. DOJ informed lawyers for Loeffler and two other senators scrutinized for their coronavirus-era stock trades that they are closing their investigations into the matters. A DOJ investigation into Sen. Richard Burr (R-NC) remains ongoing, the Journal reported. Loeffler and her husband, New York Stock Exchange chairman Jeffrey Sprecher, have vehemently denied that their sales of millions of dollars in stock this year were prompted or informed by information gleaned from a closed-door Senate briefing on the coronavirus in early January. Those sales were first reported by The Daily Beast in March.

Loeffler has nonetheless struggled to contain the political fallout from the controversy ahead of a tough primary fight against Rep. Doug Collins (R-GA). Loeffler announced in April that she and her husband would liquidate their individual stock holdings in response to the controversy. Her campaign has since poured money into advertising campaigns pushing back on insider-trading allegations.

As Trump removes federal watchdogs, some loyalists replacing them have ‘preposterous’ conflicts

The political appointee President Trump installed last week to investigate waste, fraud and abuse at the Transportation Department is the same official in charge of one of the agency’s key divisions.

That means Howard “Skip” Elliott is now running an office charged with investigating his own actions.

Elliott serves simultaneously as the Transportation Department’s inspector general and head of the department’s pipeline and hazardous materials agency, whose mission includes enforcement of safety regulations on nearly 1 million daily shipments of gas, oil and other dangerous compounds.

“The idea that an independent IG could simultaneously be part of the political team running an agency they are supposed to oversee is preposterous,” said Danielle Brian, executive director of the nonprofit Project on Government Oversight.

Elliott’s appointment was the fifth in two months in which Trump, chafing from oversight he perceived as criticism, replaced a career investigator with an appointee considered more loyal to the president. In three of the cases, Trump has installed new leadership drawn from the senior ranks of the agencies the inspectors general oversee.

For the first time since the system was created in the aftermath of the Watergate scandal, inspectors general find themselves under systematic attack from the president, putting independent oversight of federal spending and operations at risk as over $2 trillion in coronavirus relief spending courses through the government.

Inspectors general, some in acting roles to begin with, have been fired and demoted with no notice, leaving their staffs in disarray, multiple inspectors general said. Adding to their alarm, several White House nominees awaiting Senate vetting for permanent roles do not meet traditional qualifications for the job.

Some say the 40-year era of independent oversight of the executive branch is under threat more than ever.

“The Trump administration is attempting to make lap dogs out of watchdogs,” said Gordon Heddell, a former inspector general appointed to audit the Labor Department — and later the Defense Department — by President George W. Bush and who continued to serve in the Obama administration.

The White House did not respond to requests for comment.

Trump is stiffest challenge to Grassley’s role as defender of inspectors general

Past presidents removed federal watchdogs — but only occasionally. Lately, it’s been an almost weekly occurrence, leaving the offices that monitor wrongdoing across the government wary of who could be the next to go.

Elliott’s dual role at the Transportation Department is brimming with conflicts. Auditors who now work for him are monitoring the pipeline agency he leads. His boss is Transportation Secretary Elaine Chao — whose department he is supposed to investigate.

Elliott has said he would recuse himself from investigations of the hazardous materials division, but backers of the independent watchdog system said that would not work.

“How could they receive whistleblower disclosures with a straight face?” Brian said. She noted that inspectors general have responsibility for protecting whistleblowers.

Trump, who often opts to appoint acting officials for indefinite periods, named Elliott acting inspector general. His sudden appointment on May 17, which pushed aside the career auditor leading the office on an acting basis, prompted an angry response from Democrats on Capitol Hill.

“It is an outrageous and obvious conflict of interest,” said House Transportation Committee Chairman Peter A. DeFazio (D-Ore.), who has questioned Elliott’s agency over its recent decision to allow freight trains to transport liquefied natural gas.

Removing Mitch Behm and installing Elliott, who spent decades as an executive with CSX Railroad before joining the Trump administration, was “an indiscriminate dangerous and potentially disastrous move,” DeFazio said. Elliott will also recuse himself from oversight of the railroad, officials said.

The watchdog office in fiscal 2018 put the Pipeline and Hazardous Materials Safety Administration on a list of troubled divisions it would monitor.

In announcing an audit of the division’s safety culture last year, an assistant inspector general noted that in the previous five years, 3,319 U.S. pipeline incidents have caused an average of 15 fatalities and 62 injuries each year. In addition to monitoring hazardous shipments by rail, the division regulates 2.6 million miles of pipelines around the country.

Elliott also could find himself having to investigate his boss.

Before his appointment as inspector general, Elliott’s predecessors had been asked by congressional Democrats to investigate whether Chao used her office to provide political benefits to her husband, Senate Majority Leader Mitch McConnell (R-Ky.), and whether she had sufficiently divested from international shipping interests controlled by her family. It is unclear whether those probes will continue.

A Chao spokesman called allegations of favoritism “a politically motivated waste of time that stemmed from a phony media story.” He said agency ethics officials advised Chao that the stocks did not create a conflict of interest, but she recused herself from all matters involving the companies and has since sold her investments.

Elliott, through a spokeswoman, declined to comment.

Expansive view of power
Trump has made no secret of his hostility toward federal watchdogs, a number of whom were appointed by President Barack Obama. Trump has publicly denounced them for alerting Congress to a whistleblower complaint that triggered his impeachment, reporting shortcomings in his pandemic response and examining the actions of a loyal Cabinet member.

Among the biggest defenders of his actions is Attorney General William P. Barr, who told Fox News that the intelligence community watchdog overstepped his authority to report wrongdoing when he informed Congress of a whistleblower’s complaint about Trump’s dealings with Ukraine.

Advocates for government oversight in both parties see a dangerous precedent in this expansive view of presidential power as Trump makes quick work of the professionals who’ve been bulwarks against corruption for four decades — some of them making history. The watchdogs, overseeing 14,000 auditors and investigators across the government, have a broad mandate that ranges from routine audits of operations and spending to investigations of criminal activity.

They are rarely popular with government leaders, who often complain or are embarrassed by reports calling for corrective action. As Justice Department Inspector General Michael Horowitz said at a recent American University seminar on government oversight, the jobs are as comfortable “as straddling a barbed wire fence.”

Thirty-eight of the 75 current inspector general roles are presidential appointees at large agencies, with all but one of those, the special inspector general for Afghanistan recovery, requiring Senate confirmation. The rest are designated by the heads of small agencies. The appointees have no fixed terms, and many have served for years. They occupy an unusual place in the bureaucracy: They are not political appointees who come and go with each administration, nor are they civil servants with protections from firing by a president angered by their work.

A president can remove a Senate-confirmed watchdog. Congress must get an explanation, not a legal justification, a loophole that’s rekindled discussion on Capitol Hill of the need to strengthen the community against the kind of rapid-fire dismissals going on now.

President Ronald Reagan attempted to fire and replace all serving inspectors general when he assumed office in 1981. But he backed off after bipartisan criticism and allowed many of the veterans to stay.

Obama dismissed one in his first term and, like Trump, left multiple positions without permanent replacements during his tenure. The congressional response to Reagan’s and Obama’s actions was swift and strong, with bipartisan complaints directed at the White House.

Over the past four decades, inspectors general have built political capital through high-profile accomplishments, some of which paved the way for reforms and led to discipline of top officials.

The Navy inspector general began in 2007 to uncover one of the largest contracting and national security scandals in military history, revealing that Leonard Glenn Francis, a Malaysian port official known as “Fat Leonard,” provided cash, luxury items and prostitutes to a large number of officers of the U.S. Seventh Fleet. They, in turn, gave him classified material about ship movements and information about Navy contracting and law enforcement investigations.

The resulting Justice Department probe produced 33 indictments, 22 guilty pleas and an admission by Francis that his company bilked the Navy of $35 million.

After a whistleblower alleged that the CIA was engaged in “war crimes” by using harsh interrogation techniques on suspected terrorists, Inspector General John Helgerson began a review of a secret program set up after the Sept. 11, 2001, attacks to question suspected terrorists. His investigation questioned the effectiveness of the CIA’s interrogation techniques. Senate investigators later relied on the disclosures as they probed the use of torture in a 7,000-page investigation.

“I don’t think you can overstate the importance of aggressive and independent inspector generals,” said Daniel J. Jones, the lead investigator for the Senate “Torture Report.” His role in the inquiry was memorialized in last year’s film “The Report.”

The Trump era has brought high-profile targets, too, from multiple Cabinet secretaries ensnared in travel scandals to Horowitz’s review of applications the FBI made to the Foreign Intelligence Surveillance Court during its investigation into Russian interference in the 2016 election.

Among the most significant actions by a watchdog was that of Michael Atkinson, the intelligence community inspector general who alerted Congress to the whistleblower complaint that led to Trump’s impeachment. Trump, who had appointed Atkinson, fired him in April.

Atkinson was replaced in an acting capacity by Thomas Monheim, who took a leave from his job as general counsel of the National Geospatial-Intelligence Agency, one of the divisions his office is now monitoring for wrongdoing.

Education Secretary Betsy DeVos tried early last year to fire her agency’s acting inspector general, who was scrutinizing her role in promoting for-profit colleges, and install her deputy general counsel. The plan was scuttled after an outcry from congressional Democrats.

Firings rattle watchdogs
When asked last week why he fired Steve Linick, the well-regarded State Department inspector general, Trump said, “I have the absolute right as president to terminate.” That’s true. His dismissals have, however, breached a norm of independent scrutiny established over four decades.

Four days after axing Atkinson, Trump removed the acting Defense Department inspector general, Glenn Fine, from a new role as chairman of the Pandemic Response Accountability Committee, created to watch over relief spending.

Three weeks later, Trump pushed aside Christi Grimm as the top watchdog at the Health and Human Services Department after she released a report disclosing hospitals’ struggles to obtain basic supplies during the pandemic. Then Trump fired Linick, 24 hours before demoting Behm at the Transportation Department, on the recommendation of Secretary of State Mike Pompeo.

Congressional Democrats say Linick was investigating Pompeo for misuse of department staff and had been asked to review his efforts to use an emergency declaration to justify the sale of $8 billion in arms to Saudi Arabia. Pompeo complained to the president and asked him to remove Linick.

Linick’s replacement also will be in charge of investigating himself, and he has made no effort at recusal. Stephen Ackard, a political appointee and an ally of Vice President Pence, is keeping his position as head of the State Department’s Office of Foreign Missions, another conflict decried by congressional Democrats.

The office supports more than 800 U.S. embassies and consular offices around the world, operations that are routinely audited. A few months before Ackard took over the Office of Foreign Missions last year, Linick’s staff issued a hard-hitting report citing vacancies and management failures in the office.

The State Department did not respond to requests for comment.

The firings have rattled the community of federal watchdogs, who have pledged to their staffs that they will not back down on tough investigations. But there is deep anxiety in their ranks, according to four inspectors general who spoke on the condition of anonymity to discuss sensitive matters.

The first wave of Trump nominees the Senate confirmed for watchdog roles had traditional résumés for the job, either leading large staffs or working their way up through the inspector general community. But recent nominees to high-profile inspector general offices, including at the Defense Department, HHS and the CIA, have far less leadership experience. They lack a deep background in auditing or investigations, raising concerns about whether they can succeed in roles they may not be prepared for, according to four current watchdogs, who spoke on the condition of anonymity to talk candidly.

After Trump demoted Fine at the Defense Department, the government’s largest watchdog office, he appointed Sean O’Donnell to lead it on an acting basis. O’Donnell, a former Justice Department trial attorney, had served only four months as the Environmental Protection Agency inspector general when the White House told him he would be leading both offices.

In the past, inspectors general have received bipartisan support. But most Republicans have been muted following Trump’s recent actions or joined in the presidential criticism.

Senate Democrats joined House members in calling for limits on a future president’s power to fire inspectors general. The latest pandemic relief bill passed by the House contains language that would restrict the removal of a watchdog to neglect of duty or malfeasance.

“Where are my Republican colleagues?” Senate Minority Leader Charles E. Schumer (D- N.Y.) asked last week on the floor as he denounced the removals. “They are so afraid of President Trump, they cling, almost, to his ankles.”

As Schumer spoke, Sen. Charles E. Grassley (R-Iowa) released a letter to the president that asked for an explanation of Linick’s removal. Inspectors general, Grassley wrote, “should be free from partisan political interference from either the Executive or Legislative branch.” Sen. Mitt Romney (R-Utah) also took issue with the firings, citing “a threat to accountable democracy and a fissure in the constitutional balance of power” in a tweet after Linick’s removal.

But as of last week, no Republicans had joined Democrats in calling for a permanent fix to give the inspectors general more protection.

Kris Kobach wears the aw-shucks smile of the star quarterback on prom night, naturally winning the approval of his date’s demanding father, the doors of power and privilege swinging wide. Just as he knew they would. Kobach’s enthusiastic beam says, “I belong here, never doubted it.”

It was November 20, 2016, just 12 days after Donald Trump’s surprise victory, and the Kansas secretary of state stood confidently alongside the president-elect at his exclusive New Jersey golf club, one of many gilded transition sanctums. Kobach had been exchanging emails with Gene Hamilton, the Trump transition official overseeing the administration’s immigration policy, plans for a Muslim travel ban and appointments to Homeland Security and Justice. In them, Kobach, the architect of the nation’s strictest voter-ID and anti-immigration measures, assured Hamilton that he had already begun writing amendments to the National Voter Registration Act that would “make clear that proof of citizenship requirements are permitted.” That day, he carried a brown leather portfolio case with one paper-clipped document visible. Cameras captured its title: “Kobach Strategic Plan for First 365 Days.”

Sure, the media, most academics, and election-law experts had mocked and dismissed Kobach’s claims about voter fraud, but Kobach pressed eternally forward, deaf to fact-checkers, as one can be when every media profile notes your degrees from Harvard, Yale, and Oxford. At Bedminster, his ideas had gained currency at the center of power. Aides opened the giant white doors for the secretary of state and the president-elect. Kobach beheld the staircase where Ivanka Trump and Jared Kushner took their wedding photos, and entered a clubhouse where the initiation fee alone ran upward of $300,000. Anything must have seemed possible.

Trump emerged from his meetings with Kobach convinced that he would have won the national popular vote if it wasn’t for voter fraud, and when the media asked how he explained the missing 2.8 million votes, the White House pointed to Kobach for the proof. Then Trump soon appointed Kobach, along with Vice President Mike Pence, as co-chairs of a presidential commission to investigate election integrity. Kobach’s plan was easy to discern: The commission was to be the front through which a cabal of shadowy Republican activists and oft-debunked academics, backed by misleading studies, laundered their phony voting-fraud theories into a justification for real-world suppression tactics such as national voter ID and massive coast-to-coast electoral-roll purges.

How could Kobach know, as he felt the hand of the next president of the United States on the small of his back, that over several weeks in 2018 a seemingly easy-to-dismiss pal from Maine would help pull all of it down? Before the nation, Kobach’s entire case for fraud and its facade of election protection would be shredded, decisively, and even seen as fraudulent itself, like some exclusive, glittery Trump Vineyards label pasted over a bottle of Two Buck Chuck.

Far, far from Trump National sits the secretary of state’s suite in Augusta, Maine, tucked upstairs in a brick building that feels nothing like a clubhouse and more like a long-retired elementary school. Enter Matt Dunlap’s office and you’re greeted not with a colossal chandelier or fancy marble floors, but a giant black bear rug.

The rug makes for a rather jarring sight. As Maine’s secretary of state, Dunlap is responsible for administering elections, the state archives, and the department of motor vehicles. His office runs student mock elections and the Eighth Grade Citizenship Awards. You’d expect a rug displaying the state seal, perhaps walls covered in license plates — especially since Dunlap, balding and bespectacled, looks like a secretary of state. The actor who played Kevin on The Office could portray him in the movie. But it was Dunlap who brought this bear down himself through superior patience — waiting weeks, months, ramrod-straight and silent in a tree stand just 10 minutes from his home until the ideal moment to strike presented itself.

In the end, the beast never saw Dunlap coming. Neither would Kobach, having underestimated the focus and determination behind those shirt sleeves and 1950s frames. Kobach’s impressive-sounding Presidential Commission on Election Integrity failed spectacularly, felled by arrogance, cartoonish incompetence, even a shadowy right-wing researcher arrested for child pornography. The commission’s disingenuous creation and private White House emails were laid bare thanks to the courage of Dunlap, the small-state hunter they underestimated.

“It was a dishonest effort from the very beginning. It was never really meant to uncover anything,” Dunlap tells me, more mournful than outraged. “It was meant to backfill an unprovable thesis that there’s voter fraud — then to issue a fake report justifying laws or executive orders that change the fundamental nature of how we run elections. I think that might have been the real danger that we averted.”

Though many critics recognized the commission as a show trial, steered by Kobach — an Inspector Clouseau who gazes into his mirror and sees Sherlock Holmes — toward confirmation of his own false theories, Dunlap nevertheless wanted to serve. Kobach understood that the commission needed to be bipartisan, on the surface, at least. Dunlap accepted his appointment knowing that he’d be criticized for lending legitimacy to a pseudoscientific charade. Nevertheless, he thought a committee that lacked perspectives like his own might be more dangerous if left unchecked. He also thought Maine had a story to tell about clean elections run entirely without voter ID; this appointment might give him the opportunity to share it before the national media. Then, if Kobach went too far, Dunlap thought he might be a valuable counterweight. Dunlap never expected to star in Kobach’s show, but he had no idea just how passive and “supporting” his role was intended to be.

The first clue came in June 2017, when Kobach, in the name of the commission, demanded voluminous voter data from all 50 state-election officials, including Social Security numbers, party registration, and voting history. This came as a surprise to Dunlap and other commissioners, who’d reminded Kobach on a conference call just the day before how zealously secretaries of state protected that data. Even officials from Trump and Kobach’s own party saw the dangers in handing over such personal information. “They can go jump in the Gulf of Mexico,” replied Mississippi Secretary of State Delbert Hosemann, a Republican, to Kobach’s request.

Then, in September 2017, just before the commission met in New Hampshire, Kobach published an opinion piece on Breitbart News Network, a conservative-media organ once run by Steve Bannon, suggesting that it was election fraud that cost Trump the state’s electoral votes and the seat of GOP senator Kelly Ayotte. Kobach’s reasoning in his essay was creative: More than 6,500 people had voted on Election Day 2016 with an out-of-state driver’s license and only 1,014 of them had obtained a New Hampshire license since, cinching in his mind that the remaining 5,486 votes were fraudulent Democratic ballots that tilted the results. “I issue drivers’ licenses!” Dunlap says. “Making an equation between voting and not updating a driver’s license is like saying, ‘If you have cash in your wallet, it’s proof that you’ve robbed a bank.’”

In October 2017, a shockwave rattled the Election Integrity commission, when a staff researcher was arrested for possessing child pornography on his phone. Dunlap and others on the commission were unaware that the commission even had a researcher. Dunlap learned about the staffer, and the arrest, when The Washington Post connected the bust to the commission, and his inbox erupted with media inquiries. Then he learned about a potential late-fall commission meeting only after a conservative voting group boasted that it had been invited to give testimony.

Was there a forthcoming meeting? What was the deal with this researcher? Dunlap’s emails to Kobach were ignored. Voicemail boxes at the White House were too full to accept new messages. Dunlap had had enough. He wrote a formal letter to the commission. “I just want to know what’s going on,” he tells me, saying that he still saw himself as a team player. “I want to know who we’re talking to. I want to know what we’re talking about. I want to know what our reference materials are. And most of all, I’d like to get a handle on our schedule.”

Instead, his letter got no reaction from either Kobach or the vice president’s office. “Silence,” he says. “If they had handed me a bunch of binders, I probably would have been satisfied. But they didn’t do that.” Ten days later, he got an email from Pence’s office. They were reviewing his request with legal counsel. For the first time, but not for the last, Dunlap wondered if he was even actually on the commission.

His letter, however, did catch someone’s attention in the “deep state.” One fall afternoon, Dunlap returned from a meeting in Bangor and decided to take the afternoon off to “button up my yard.” His cell phone buzzed: a Facebook message from a well-connected friend in Washington. The tone was urgent: Call me, but on my cell. What followed played out like a scene from All the President’s Men, akin to Bob Woodward rearranging plants on his balcony to signal a meeting with his secret super-source Deep Throat. Dunlap’s friend said that he carried a message from the chief of staff of a United States senator who wished not to be named. “He said, ‘Matt, look, people are talking about you down here.’” They’d noticed the letter and wanted to help. Better even than Dunlap, they knew the kind of resources he’d need. “You’re not going to be able to take on the Department of Justice and the White House alone.’” Dunlap, chilled, didn’t realize that was what he’d done. “You need attorneys. I’m going to give you a name and number. You ought to give them a call.”

Terrified, Dunlap hung up. He had merely asked when his commission met next. He didn’t want to go to war with Washington or re-enact Three Days of the Condor. Still, unsure of what he was doing or whom he might be calling, Dunlap climbed into his car for privacy and left a message at the number he’d been given. “My name is Matt Dunlap. I’m the secretary of state for the state of Maine, and I was given your name by a third party who wishes to remain anonymous. I think I might be in some kind of trouble.” He’d reached a new nonprofit, American Oversight, a world-class assemblage of legal talent dedicated to high-impact litigation and investigation. “It’s like having a company softball team and all of a sudden Dustin Pedroia shows up,” he cracks, referring to the Boston Red Sox all-star. The group knew more about the commission’s workings than Dunlap — and, fatefully, Kobach. Dunlap would learn that the commission was subject to something called the Federal Advisory Committee Act, which requires that any such presidential commission embrace diverse viewpoints and a broad spectrum of political views, maintain open public records, and be conducted with complete transparency. American Oversight wanted to bring a lawsuit immediately. Slow down, said Dunlap, spooked and unsure whom he could trust. “I’m from Maine,” he said, where there’s a certain circumspect way of doing things. “I’m glad you like the apple sauce, but I really need the Mason jars back.”

Folksy Vacationland wisdom aside, there was no time to lose. Dunlap didn’t want to go to war, but he was determined to know what was going on behind the scenes. In mid-November, mere weeks after that chilling call, Dunlap and American Oversight led suit. They alleged that the commission’s “superficial bipartisanship has been a facade” and that Dunlap and other Democratic commissioners were being “excluded from the commission’s work.” The panel’s operations have “not been open and transparent, not even to the commissioners themselves,” they charged.

Dunlap still hoped the suit might wake people up in the vice president’s office and put things back on track. Perhaps Pence aide Andrew Kossack would return his phone calls and even apologize. Dunlap understood what it was like to run a busy office, after all. He just wanted his schedule. Instead, Kobach called Dunlap’s suit “baseless and paranoid,” and insisted that Dunlap was “making assumptions about commission business occurring without his knowledge.” Kobach said he looked forward to refuting it all in court. Three days before Christmas, however, a federal judge quickly found in Dunlap’s favor, ruling that the commission’s “indefensible” position “ignores the law.” They could not exclude Dunlap from a presidential advisory commission of which he was a member.

The court ordered the commission to turn over thousands of pages of documents, ensure genuine transparency, and also to include Dunlap as a full participant in all deliberations and activities. “I said to the attorneys, ‘I half wonder if they don’t pull the plug on this now,’” rather than accede to the court’s demands for balance and transparency, says Dunlap. It was a good hunch. The White House waited for cover, a moment when the Beltway media was distracted. That soon arrived, with the publication of Michael Wolff’s salacious Oval Office tell-all Fire and Fury, loaded with gossipy tidbits — such as Steve Bannon’s description of Ivanka Trump as “dumb as a brick” that created a cable-news and Twitter tinderbox. “Sure enough,” says Dunlap, “January 3rd, we got the email that they dissolved the commission.” Kobach had surrendered. When Dunlap and American Oversight later released all the documents online, it was clear: Kobach and Pence were running a phony and partisan investigation into a “voter fraud” problem that doesn’t actually exist. His commission wasn’t defending democracy. It was a charade that threatened it.

While the president dissolved the commission, Dunlap wasn’t finished yet. While the government argued that its dissolution should also end the fight over its records — and Dunlap’s access to the documents — courts saw it otherwise. In August 2018, Dunlap received all the records and posted the 8,000 pages online. There were revealing exchanges between White House aides, back-channel conversations between right-wing researchers, Kobach and then-Attorney General Jeff Sessions, even email chains limited to Kobach cronies and commission conservatives. Kobach had been running an inquisition, not a commission, and his dim Keystone Kops weren’t bright enough not to leave an email trail. “It wasn’t until I read these documents that I realized how much of a fix was already in on this thing,” Dunlap says.

Dunlap’s lawsuit even unearthed a draft of the commission’s final report, circulated by Kossack, the Pence aide, which confident staffers had started writing in November 2017, after just two public meetings. It’s titled “Evidence of Election Integrity and Voter Fraud Issues.” It doesn’t contain any. The report offers no more than a blank list of categories — “instances of fraudulent or improper voting,” “noncitizen voting,” etc. — that Kobach and his allies couldn’t fill with any actual examples. “Glaringly empty,” Dunlap says. In a letter to Pence and Kobach after he had reviewed those 8,000 pages, Dunlap named the larger problem: “That the Commission predicted it would find widespread evidence of fraud actually reveals a troubling bias,” he wrote. “A very few commissioners worked to buttress their preordained conclusions shielded from dissent or dialogue.”

Dunlap doesn’t get those late-night calls from Kobach on his cell phone any longer. I ask him if he has ever thought about why Kobach personally recruited him onto the commission, why he spent so much time courting him to join. Did Kobach imagine that Dunlap would merely roll over and play Democrat, allowing the Republicans to have their way?

Dunlap opens his hands wide and points at the bear rug spread across his floor. “I’m a Democrat and I hunt and I have guns,” he says. “It’s weird to him. They probably saw this guy who’s got a reputation for being nonpartisan. Not a lawyer. From a small state. Can’t be very smart. He won’t give us too much trouble.” Dunlap pauses and allows a small laugh. “Then I gave them trouble. They didn’t know what to do with that.”

U.S. Ambassador to Germany Ric Grenell is set to join President Donald Trump’s 2020 campaign amid a broader shakeup that saw the promotion of two other campaign officials on Tuesday, according to two people familiar with the matter.

The addition of Grenell, a trusted Trump ally who recently stepped down as acting director of national intelligence, comes as the president faces sliding poll numbers nationally and in a handful of key battleground states. A Fox News survey conducted before the holiday weekend found presumptive Democratic presidential nominee Joe Biden defeating Trump 48 percent to 40 percent five months out from Election Day.

A person familiar with the move said Grenell will take a senior role inside the Trump campaign, where he will be involved in fundraising and strategy. It was not immediately clear what his title will be or whether he will work from the campaign’s Northern Virginia headquarters. Grenell was seen entering the White House on Tuesday afternoon, shortly after the Trump campaign announced its promotion of senior political adviser Bill Stepien to serve as deputy campaign manager.

Grenell is the latest longtime Trump ally to be installed in a senior role that ensures deep involvement with the president’s reelection operation and communications strategy. Trump recently brought former White House communications director Hope Hicks back into the West Wing, and promoted his former body man, John McEntee, to head the Office of Presidential Personnel after he rejoined the administration last December.

“He wants to bring the band back together,” said a senior administration official familiar with Trump’s thinking.

Grenell, who is expected to step down as ambassador to Germany in a few weeks, has long been a forceful personality on Twitter — one of the president’s preferred platforms for taking on political opponents and communicating with supporters. His social media activity sometimes rankled diplomatic colleagues and career State Department officials, who worried about straining U.S. relations with Germany.

Grenell was a strong advocate of Trump’s nationalist policies, which at times didn’t play well with his German hosts. And during his short tenure as the nation’s top intelligence official, Grenell presided over a number of changes at the Office of the Director of National Intelligence, including slightly reducing the size of the National Counterterrorism Center and having the National Counterintelligence and Security Center, which is part of ODNI, take over election security briefings.

Grenell, who’s openly gay, also said the Trump administration could potentially cut back on the sharing of intelligence with countries that have criminalized homosexuality and urged U.S. intelligence agencies to do a better job of preventing discrimination against gay, lesbian and transgender employees.

In 2012, Grenell briefly served as a spokesman for Republican presidential nominee Mitt Romney’s campaign. He resigned under pressure from social conservative groups who were critical of the campaign’s employment of an openly gay man. Throughout his tenure in the Trump administration, he repeatedly denounced countries that continue to outlaw homosexuality and once met with European LGBTQ activists to discuss his push to decriminalize homosexuality abroad.

Grenell also served as a spokesman at the U.S. mission at the United Nations during the George W. Bush administration. Prior to joining the Trump administration, he worked in media and public affairs consulting.

Neither the Trump campaign nor Grenell immediately responded to requests for comment.

'Dark money' groups dodge reporting requirement in new regulations

The Treasury Department and IRS on Tuesday finalized regulations that will excuse some politically active tax-exempt groups from having to disclose their high-dollar donors to the IRS.

The rules, which have been in the works for several years, will affect groups organized under 501(c)(4) of the tax code, which include political heavy-hitters like the National Rifle Association and AARP; labor unions; and “dark money” groups that fly under the radar.

Those organizations have no legal obligation to publicly disclose their donors' identities, but they previously had to give the IRS the names and addresses of donors who gave them more than $5,000. Under the new regulations, the groups won’t have to provide the information to the IRS at all.

Supporters of the move say the IRS doesn’t need the information and that requiring it posed privacy risks, even though the agency kept the information confidential. But opponents say it will make political activity by tax-exempt groups even more opaque and open the door to donations from foreigners.

Sen. Ron Wyden, a particularly vocal critic of the new regulations, issued a statement condemning them.

“The Trump administration has opened the flood gates to dark money pouring into our election system just months before Donald Trump is on the ballot,” Wyden, the top Democrat on the Finance Committee, said. “We’re in the midst of a global pandemic and once-in-a-lifetime economic crisis and the Trump administration is prioritizing boosting the president’s political prospects with shady cash.”

In a news release, the IRS said the "change will have no effect on transparency, as contributor information that is open to public inspection will be unaffected by this regulation."

The groups must continue to keep the names and addresses of major contributors in their own records, said the agency.

Tax-exempt groups organized under 501(c)(3) of the code, which can engage in limited lobbying, and Section 527 political organizations, which include candidate committees, will still have to disclose the names of major donors to the IRS.

Treasury and the IRS initially moved to do away with the requirement for 501(c)(4)s in 2018. But a federal judge ruled that the agencies had bypassed required rulemaking procedures. They subsequently issued a notice of proposed rulemaking in 2019, took comments and held a public hearing on the issue.

With citizenship ceremonies postponed, hundreds of thousands could miss chance to vote in November

Hundreds of thousands of potential voters will be ineligible to cast ballots in November unless the Trump administration resumes citizenship ceremonies and clears a pandemic-related backlog of immigrants waiting to take the naturalization oath, according to rights groups and lawmakers from both parties.

President Trump, who claims falsely that millions of immigrants vote illegally in U.S. elections, now has the ability to effectively deny a large number of foreign-born Americans from becoming legally eligible to register ahead of the next presidential election.

Under Trump border rules, U.S. has granted refuge to just two people since late March, records show

U.S. Citizenship and Immigration Services administers the oath of citizenship to an average of about 63,000 applicants per month, according to the agency’s latest statistics. The in-person ceremonies are the final hurdle immigrants must clear before registering to vote as naturalized U.S. citizens.

USCIS closed its offices in mid-March amid the coronavirus outbreak and canceled nearly all naturalization ceremonies, which often draw the family members of newly made citizens. Though USCIS is scheduled to begin a phased reopening next week, the agency has not committed to resuming a full slate of ceremonies nor has publicly released a plan for rescheduling the approximately 150,000 naturalizations that have been postponed because of the closures.

Joseph Edlow, deputy director for policy at USCIS, has resisted calls from lawmakers with both parties to begin allowing applicants to take the oath virtually. In response to an inquiry from The Washington Post, USCIS officials said canceled ceremonies will be rescheduled “on a case-by-case basis,” declining to say how many have been scheduled in coming weeks.

Another challenge: The fee-funded agency is running out of money because it suspended most services during the pandemic. Last week, the agency laid off 1,000 contractors, and Edlow told USCIS employees in an email Tuesday that staff furloughs will begin in July absent a cash infusion from Congress. USCIS has asked lawmakers for $1.2 billion in emergency funding.

“Naturalizing new United States citizens is a critical benefit we administer at USCIS and we’re working hard to resume that process,” Edlow said in a statement. “However, we will not ignore federal law, which has clear in-person requirements for naturalization, in the name of convenience or expediency.”

Illegal border crossings fell dramatically in April

Edlow said his staff has started conducting smaller-sized ceremonies that meet social distancing requirements, but capacity will remain limited.

“The rate of these new ceremonies are increasing as our workforce becomes more adept at implementing them for larger groups and when appropriate health and safety precautions can be followed,” he said.

Naturalizations reached an 11-year high last year, Edlow noted.

Critics of the Trump administration say there has been no detectable urgency to get citizenship processing back on track in time for state voter registration deadlines this fall.

“To be fair, there are logistical challenges, but that is not same as an insurmountable obstacle,” said Doug Rand, a former immigration policy adviser to the Obama administration. “The entire country is conducting its business virtually now, at a scale that is unprecedented. . . . For them to say it can’t be done doesn’t pass the laugh test.”

Rand’s firm, Boundless Immigration, calculates that more than 400,000 potential voters will be ineligible this November if citizenship processing remains essentially frozen. That includes immigrants whose ceremonies have been canceled as well as new applicants who won’t be able to schedule one in time.

“In the worst-case scenario, this is a deliberate effort to disenfranchise people who are perceived to be voters for the other team,” Rand continued. “Best-case scenario, this is a federal agency slow-walking the administration of citizenship to a population that obviously deserves it.”

Sen. Marco Rubio (R-Fla.) and Sen. Martin Heinrich (D-N.M.) sent a letter last week to Ken Cuccinelli, USCIS’s acting director, asking him to “take all necessary measures” to safely resume naturalization ceremonies, “including remotely administering oaths of allegiance and expanding small in-person ceremonies, in accordance with preventive measures recommended by the Centers for Disease Control and Prevention (CDC) and local public health authorities.”

A similar bipartisan letter is being drafted in the House by Rep. John Katko (R-N.Y.), according to a congressional aide who spoke on the condition of anonymity because the effort isn’t yet public.

A USCIS official who spoke on the condition of anonymity because they were not authorized to describe the reopening plans said the agency’s field offices would begin sending notices to applicants to reschedule canceled citizenship ceremonies. The ceremonies will be smaller and shorter in duration, the official said, with attendance limited to applicants. Those rules will allow the agency to complete in-person oath requirements as quickly and safely as possible, the official said.

Matthew La Corte, a policy analyst at the Niskanen Center, a D.C.-based think tank that favors more immigration, said the smaller ceremonies amount to “Band-Aid, tiny solutions.”

“While they are really great for those newly naturalized citizens who can participate in them, we’re talking about a drop in the bucket,” he said, noting that they will lead “to a ballooning backlog” with more potential voters unable to complete the citizenship process in time for voter registration deadlines this fall.

USCIS officials said another reason they cannot conduct virtual ceremonies is that applicants are briefly interviewed by staff members before naturalization, and they must submit a form on the day of the ceremony attesting that they remain eligible for citizenship. Applicants also are required to surrender their green cards before the ceremonies.

The agency currently has no mechanism for administering the forms nor physically collecting the green cards under pandemic conditions, officials said. The budget crisis has left USCIS with no money to set up alternative systems on the fly, officials said.

La Corte said he remains skeptical: “The logistical concerns about collecting green cards can be figured out. We send a lot of sensitive things in the mail.”

Ruby Robinson, managing attorney with the Michigan Immigrant Rights Center, an advocacy group, said dozens of people with pending oath ceremonies have contacted his organization with more than voter registration on their minds.

“They are anxious,” he said. “Maybe their green card is expiring and they don’t want to pay another $540 to renew it, especially if they’ve lost their job or are on unemployment.”

A Pew Research Center analysis of U.S. Census Data published in February estimated that 23 million naturalized citizens will be eligible to vote in November, the most ever and equal to about 10 percent of the U.S. electorate. The percentage of immigrants made eligible to vote through naturalization has increased 93 percent since 2000, the Pew estimates show.

Hispanic immigrants accounted for 34 percent of all foreign-born eligible voters in 2018, according to the study, while Asian immigrants represent 31 percent of immigrant voters. Both groups tend to favor Democrats, and more recent surveys indicate that trend has accelerated under Trump, who has made restricting legal and illegal immigration a major theme of his presidency.

She's got to be tired of being right.

I'm currently reading Hiding in Plain Sight along with three other books on fascism (How Fascism Works, The Anatomy of Fascism and Behold America). It's why I haven't had anything to contribute in your other book post

She's a hell of a writer and the opening chapter about Missouri and its role as the Bellweather state was one of the most insightful and incisive pieces of writing I've read in a long time.

In fact, the Reagan era was the true beginning of the extreme theft from the Federal gov't to private corporations and the wealthy
