Virginia Democratic gubernatorial hopeful Ralph Northam omitted any mention of Justin Fairfax, the party's African American candidate for lieutenant governor, from about a thousand pieces of campaign literature, which Fairfax called a "mistake." The incident has stoked tensions within the Democratic ticket, threatening to alienate African American voters three weeks before Election Day.

The palm cards with photos of Northam and Attorney General Mark R. Herring (D) were produced for canvassers with the Laborers' International Union of North America (LIUNA), which asked that Fairfax be excluded because it did not endorse him. Fairfax has spoken critically of two proposed natural gas pipelines that the union supports.

The literature was a sliver of the 1.5 million pieces produced by the Northam campaign, and homes that received palm cards without Fairfax also received literature with the entire ticket, the Northam campaign said.



Nevertheless, a photo of two palm cards — one with and one without Fairfax — made its way around social media this week and provoked outrage.

"It reeks of subtle racism, if not a tone deafness about how we are going to win in November," said Quentin James, the founder of Collective PAC that supports black candidates, including Fairfax. "Leaving Justin Fairfax off . . . even if it's only for a small universe of union members, still sends the wrong message."

In an interview Wednesday, Fairfax called the move to exclude him a "mistake" by the Northam campaign but wouldn't call it racism.

"Everyone who is looking at this will make their own judgments about this particular instance," he said. "This should not have happened, and it should not happen again, and there needs to be robust investment in making sure that we are communicating with African American voters and we are engaging our base."

Hours later, Fairfax's campaign released a more conciliatory statement.

"This is a strong ticket and one that is working well together," it said. "One piece of literature does not change that. Voters from across the commonwealth have responded enthusiastically to Justin's candidacy and the entire Democratic ticket. They are excited about our plan to offer more educational opportunity, economic growth, and more access to health care and they will reject the divisive and cynical politics of our opponents. That's why Justin's been endorsed by organizations like the VA AFL-CIO, Virginia Education Association and Planned Parenthood Advocates of Virginia."

Some black leaders called the issue a distraction.

"Democrats, particularly minority Democrats, need to stay focused on the goals, and the goal is to make sure Justin wins, that Ralph wins, that Mark wins," said Andrea Bailey of the Prince William County NAACP.

The dust-up comes the day before former president Barack Obama is scheduled to headline a rally in Richmond with Northam, Fairfax and Herring. Obama's appearance, at the city's convention center, is designed to motivate the Democratic base, particularly African American voters.

Most polls have shown a tight contest between Northam and Republican Ed Gillespie. Virginia is holding the nation's only competitive statewide contest, which is being closely watched as a hint of what's to come in next year's midterm elections.

Fairfax would be the first African American elected statewide in Virginia since L. Douglas Wilder became the nation's first elected black governor in 1989. Blacks make up roughly a fifth of the Virginia electorate and are crucial for Democrats to win statewide.

Fairfax and Northam discussed the matter over the phone Tuesday, both campaigns confirmed.

A spokesman for Northam said the exclusion of Fairfax from the palm cards was not meant as a snub. "We are committed to winning all three statewide offices and will continue to work together — as we have been working together — throughout the final weeks of the campaign," Northam campaign spokesman David Turner said.



LIUNA did not respond to questions about its canvassing efforts, but it defended its decision to not endorse Fairfax.

"It is not in interest for us to back a candidate who has a record of opposing infrastructure projects that our members will work on and rely on to provide them with good family-supporting middle-class jobs," said Dave Allison, business manager for the union's Baltimore-Washington District Council.

Phillip Thompson, president of the Loudoun County NAACP, said the exclusion of Fairfax from literature reinforces a perception that the Democratic Party sees him as an outsider and is taking the black vote for granted.

"A lot of us feel the Virginia Democratic Party has never been a very inclusive group, and they always kind of marginalize African Americans without providing any grounds for advancement," said Thompson. "Hillary won the state of Virginia because of the African American, Hispanic and minority vote. . . . Justin is a perfect person to help them do that again, and they still don't support him."

Fairfax, a 38-year-old attorney from Fairfax County, ran for attorney general in 2013, largely unknown to Democratic Party insiders.

He narrowly lost in the primary and spent years cultivating relationships with party officials before his second statewide run. But tensions persisted, including when he was denied a speaking slot at a party convention in 2016.



Turner stressed that Northam has been working to help Fairfax and other Democratic candidates.

"Ralph Northam is making a historic investment in the coordinated campaign, including giving or raising $9 million in Get Out The Vote efforts for the entire ticket without asking for any additional investment from the ticket mates," Turner said.

Michael Halle, a political adviser to Gov. Terry McAuliffe (D) who ran the Democratic coordinated campaign in 2013, said the omission of Fairfax from the palm cards was being blown out of proportion. Democratic voters targeted by canvassers are inclined to vote for the entire ticket, and the full ticket often is not on literature — including Northam, when he ran for lieutenant governor in 2013, Halle said.

"The more important thing is getting people out to vote than who is on the piece of literature," Halle said. "There's no effect in mobilization from whose picture or whose name is on literature."

Virginia Republicans and conservative media outlets pounced Wednesday, highlighting the incident to emphasize intraparty divisions.

The GOP has also been accused of racially tinged attacks against Fairfax.

Fairfax's Republican opponent, Jill Holtzman Vogel, questioned whether he could "talk intelligently" about issues in their last debate — a comment that the chair of the Democratic Party of Virginia said belongs in 1957 instead of 2017.

Northam publicly apologized Friday for the medical school yearbook photo and acknowledged that he appeared in the image of one man in blackface and another in a Ku Klux Klan robe.

But State Sen. Louise Lucas (D-Portsmouth) said that Northam called her Saturday morning and told her he did not think the picture was of him and he did not plan to resign.

Virginia Senators Mark Warner and Tim Kaine have released statements addressing a Northam yearbook photo that shows two men in blackface and a KKK robe.

Senator Mark Warner said "This photo is shocking and deeply offensive, all the more so because of Virginia's long and painful history of racism and violence toward African Americans. The Governor must now listen to the people and communities he has hurt, and carefully consider what comes next."

Senator Tim Kaine also released a statement, writing, “The racist photo from Governor Northam’s 1984 yearbook is horrible. This causes pain in a state and a country where centuries of racism have already left an open wound."

"I hope the Governor—whose career as an Army officer, pediatrician and public official has always manifested a commitment to justice and equality for all—now takes the time to listen to those he has hurt and reflect on how to move forward,” Kaine continued.

The president of the United States questioned why the Civil War was fought. Virginia Lt. Gov. Ralph S. Northam was among many who answered.

“We had a Civil War because people owned other folks as slaves. Read a book,” read a tweet directed at President Donald Trump from Northam, who is in the midst of a tight race with Tom Perriello for the Democratic nomination to be Virginia’s next governor.

At the time of his May 1 tweet, Northam was not aware that some of his ancestors on Virginia’s Eastern Shore owned slaves. He recently called his father, retired Judge Wescott Brownlee Northam, to ask.

“The news that my ancestors owned slaves disturbs and saddens me, but the topic of slavery has always bothered me,” Ralph Northam said in an interview. “My family’s complicated story is similar to Virginia’s complex history. We’re a progressive state, but we once had the largest number of slaves in the union.”

The Northams are from Accomack County, one of the two counties on Virginia’s portion of the Eastern Shore — the peninsula between the Atlantic Ocean and Chesapeake Bay known for its wondrous outdoors and waterways, farms and history.

Wescott Northam’s father, Thomas Long Northam, also was a judge and died when Wescott was 14. All the Northams before him were farmers, Wescott Northam said. Wescott’s grandfather was Levi Jacob Northam, and Levi’s father was James Northam — the great-great-grandfather of Ralph Northam.

The slave schedules with the federal census in 1850 and 1860 show James Northam owned eight slaves in 1860 and nine slaves in 1850. The 1860 slave schedule listed Levi Northam with three slaves, two of whom he employed but were owned by others. The schedules listed the slaves’ ages — from 1 year old to 60 — but not their names.

Wescott Northam, 92, who lives in Onancock, said he grew up with minimal knowledge of slavery — “what little I picked up in school, grammar school. It was just a matter of history.” His grandfather, Levi, was long gone when he was born so his knowledge of his ancestry was not extensive, he said.

After Wescott Northam retired, he began thinking about his ancestors and researched a deed to trace the ownership of the Accomack County farm owned by his father, where Wescott was born. The property included a 4-acre mill lot, and Wescott wanted to know how his great-grandfather, James, acquired it.

During his research, he said, he encountered documentation showing that James Northam owned some slaves.

“I was focusing on trying to track the chain of title. That was all my sole interest and, to me, it was just something that I saw and forgot about,” Wescott Northam said.

Dennis Custis of the Craddockville area of Accomack County taught Ralph Northam government at Onancock High School, later became a principal and knows the area’s history.

In 1861, he said, Accomack County had the highest percentage of free blacks of any county in Virginia — one in two were free, he said. Neighboring Northampton County had the highest percentage of black slaves.

Northampton plantations might have had 50 to 75 slaves, while Accomack was made of smaller farms with a smaller number of slaves.

Custis, whose ancestors owned slaves, taught children about slavery for many years. More than a few black students’ last names were Custis, he said. “One of the things that I would point out to the kids is slave owners are like people today. Some good, some bad.”

In 1850, a little over half of the white households on the Shore owned slaves, according to “Slave and Free on Virginia’s Eastern Shore,” a book published in 2014 by Shore native and author Kirk Mariner. Twenty-one percent of slave owners in Accomack and 24 percent in Northampton owned just a single slave.

“Again and again, month after month, year after year, this trade in slaves flourished on the Eastern Shore, a routine, year-round practice of the slave society, the buyers local, the sellers local, and none of them suffering disrespect for their part in it,” Mariner wrote.

In an interview about his family history, Northam said he was thankful his parents raised him and his brother to be of service and to not emphasize skin color. He and his brother attended public schools in the early 1970s.

“I have led my life accordingly and that is to help others and really not see color as an issue,” said Northam, a state senator before his election as lieutenant governor in 2013.

Northam is the vice chair of the Fort Monroe Authority, the fort where Union Gen. Benjamin Butler protected fugitive slaves during the Civil War, and he has been outspoken about making that history accessible to the public.

For this story, the Northam campaign provided information from the “Manumission Deeds of Accomack County, Virginia,” compiled by Richard H. Smith Jr.

The book shows that James Northam freed two slaves, named Ann and Isaac, in November 1858. A slave of James Northam named Raymond Northam was freed on Nov. 4, 1863, due to enlistment in the 9th Regiment of Colored Troops. Northam campaign spokesman David Turner said they believe the James Northam referenced in the deed is the same one who was Ralph Northam’s great-great-grandfather.

Union forces invaded the Eastern Shore after gathering on the Maryland line on Nov. 15, 1861, and sending a printed proclamation down the Shore saying they were “a force too strong to be successfully opposed,” Mariner wrote in his book. When they marched down the next day, they found no opposition.

“After only six months in the Confederacy, the Eastern Shore of Virginia would now spend the rest of the Civil War in the Union,” Mariner wrote.

Recruitment of blacks into the Union Army began in fall 1863. Slavery officially ended on the Shore on April 11, 1864, he wrote.

U.S. Rep. A. Donald McEachin, D-4th, a descendant of slaves who grew up in Richmond, said he had friends from high school whose ancestors owned slaves. The history of Northam’s ancestors is no surprise, he said.

“I find that not unusual, because we live in Virginia.”

A Democratic source with direct knowledge of Northam’s conversations with lawmakers on Saturday, who spoke on condition of anonymity, said Northam told lawmakers on Friday evening that he did not remember being in the photo. On Saturday he told them that after speaking with friends from medical school he doesn’t think it’s him in the photo.

The source said that leaves significant questions about why he issued a public statement Friday saying that the photo was of him and apologized for it, and Democrats will be watching to see if he addresses those questions in his 2:30 p.m. statement.

Northam EVMS roommate: 'Neither of them looked like Ralph to me'
Dr. Rob Marsh, who was Northam’s roommate for two years at EVMS, said when he first saw the photo, he didn’t think it was real.

"I don't remember that ever happening,” said Marsh, who graduated from the school one year before Northam did and now has a medical practice in Middlebrook.

Marsh, 63, said Northam was “very respectful” to others as a medical student, and he never heard Northam “mock anybody of any other race.”

“I did not recognize either one of those people or that event. Neither one of them looked like Ralph to me,” Marsh said.

Marsh said he did not remember details of how the school yearbooks were put together. He said he remembers Northam at the time as a “super straight guy.”

“He wasn’t going to do anything to embarrass his family. I find it bizarre,” Marsh said.

RICHMOND, Va. — As Virginia Governor Ralph Northam faces increasing pressure to resign over a racist photograph from his 1984 medical school yearbook, the man who would take his place -- Lt. Governor Justin Fairfax -- is responding to accusations of his own.

The allegation involves an unsubstantiated claim of sexual assault against Fairfax during the Democratic National Convention in 2004. The claim was posted Sunday night on the same website that first published the racist photo from Gov. Northam's yearbook.

The Washington Post, as well as our sister station WUSA9 in Washington D.C., have known about the claim for months, but have not been able to corroborate the allegations.

“Lt. Governor Fairfax has an outstanding and well-earned reputation for treating people with dignity and respect,” read the statement released on Twitter.

“He has never assaulted anyone – ever – in any way, shape or form.”

A post on the conservative website Big League Politics went live just as the Super Bowl ended late Sunday. Allies of the likely heir apparent to embattled Gov. Northam called the development a clear smear tactic, as Fairfax's profile rises.

"This is part of the sad and dark politics that the Lt. Governor has dedicated himself to helping Virginia and the nation rise above," the overnight statement read.

"The Lt. Governor will take appropriate legal action against those attempting to spread this defamatory and false allegation."

WUSA9 is refraining from publishing further details of the claim, as key elements have not been able to be verified. Broad outlines of the claim are only being published after Fairfax's office released an official statement now in public view.

The development unfolded hours before Northam is scheduled to hold a meeting with top staff members in Richmond, when a possible resignation will be discussed.

Five officials with direct knowledge of the continuing deliberations said state lawmakers will hold off on removing Northam through untested mechanisms in Virginia's constitution, in order to avoid escalating tensions.

What's crazy is I know both, accuser and accused, from school. Though they didn't attend same school (I don't think).

If I had to guess what happened I would say an awkward dude made a drunken aggressive move on an awkward girl who has suffered real trauma in her past.

She made a post on Friday that I knew would make news by the end of the weekend. I was hoping dude would go directly to her and address. They both dropped me from FB by this morning.

and have my finger on the pulse of whats going on there politically.

even tho a lot of people werent really excited about voting for him (he was a pretty dry candidate) a lot of anti-trump and anti-va-gop sentiment drove him across the finish line in big numbers.

his 1st act as governor was almost backing away from a promise to expand medicaid (he started to sound like a republican pushing for work requirements). but ultimately he came to his sense and got it through.

after that...the sense was that a lot of people were warming up to him (happened with the previous governor). he was one of the most popular 1st termers in the nation.

this shit came outta left field tho and will wreck him. it could wreck the entire state party too if he doesnt bounce quickly.

I don't consume much of the political news cycle, but I do remember during the campaign, when the story about came out, everyone was in "let's not lose focus," mode, rather than giving proper attention to the huge gaffe. Bread crumbs perhaps? A friend also remembers (with consternation) how early Northam and Herring secured victory and how long it took for Fairfax to get his.

A school board member running for chair of bd. of supervisors made some other strong points about whether Ralphie may just have been outed or whether he's evolved:

"But there have been many opportunities for the Governor to use his power as a legislator and executive to overcome that repugnant past, and he has not. Northam has been absent the past two years when Lt. Gov. Justin Fairfax sat alone in protest while the General Assembly's adjourned to honor Robert E. Lee and Stonewall Jackson. He has taken no firm stands on the monuments that dot our capital, the roads that snake through our Commonwealth, and perhaps worst of all the schools educating black children that bear Confederate names."

I live in NOVA which in many ways is like a different state compared to Richmond et al. It's the only reason why VA is a purple state rather than red with blue polka dots.

I honestly have no opinion on him yet. What I respected greatly about McAuliffe is him restoring voting rights for 13,000 felons. THAT is some impactful shit right there.

Ralphie really ain't done nothing up to this point. I was one who felt that while a Fairfax 7 year run (VA gubernatorial candidates cannot run in successive terms but since he didn't run for governor he could fill the slot then run again), I didn't necessarily want dude to resign, IF he owned his racism and started a frank convo about how many white people are casually racist, "telling on folks" so to speak (I grew up in NOVA so while better than Richmond, still was on that casual racist tip), detailing how pervasive it is and how it affects decision making and opportunities, and made it his top priority to eradicate white supremacy in VA in terms of legislation and policies.

That's asking a lot, but it would greatly improve the state if he did.

there are important elections coming up in nov that could help dems gain unified control of govt and affect things like permanent/automatic re-enfranchisement of felons, voting access in general, redistricting after 2020, etc.

northam hanging around the neck of the party would almost certainly hurt their chances (especially with the poll numbers i posted below).

the best course of action would be for him to leave, get out of the news cycle, and let the party regroup as fast as possible.

aside from the evidence being kinda flimsy at this point...i think fairfax benefits from the timing as well...since the story was dredged up right when it was possible he might assume office. it looks like a hit job.

maybe that changes if this woman comes forward in a more public manner and gets a bunch of press with some credible info.

Follow the bread crumbs. This whole thing is a GOP power grab.

The GOP knew of this in Northam's past. They discovered this during their opposition candidate research. Honestly, Northam's actions were so blatant, wasn't really hard to discover.

Northam was trying to change Virginia's law on abortion. He wanted the law revised that a woman only needed the consent of one doctor versus the current state law which requires the consent of three doctors. This didn't sit well with the GOP so they put this plan into motion.

Now, if Northam would have to step down, the Lt. Governor takes over. So, what happened yesterday? A story claiming Fairfax committed sexual assault in college.

So if Northam and Fairfax both have to step down, the Speaker of the House becomes the governor. You'll never guess the party affiliation of the Speaker of the House.

The yearbook photo that could bring down the Democratic governor of Virginia was first posted online by young web outlet best known for defending white nationalists.

Big League Politics was founded in 2017 by a group of former Breitbart News staffers, who decided that the nationalist media outlet previously run by Steve Bannon had gotten too mainstream. BLP started as the media arm of a pro-Trump, “populist nationalist” political action committee, which bills itself as the “attack dogs” for the American First Agenda. The site is now owned by North Carolina political consultant Reilly O’Neal, who worked for Roy Moore, the Alabama Senate candidate whose run was derailed by child molestation charges, and Corey Stewart, a Republican from Virginia popular with white supremacists for his support of Confederate monuments. Last year, Stewart unsuccessfully challenged Sen. Tim Kaine (D-Va.), and the site covered his race extensively.

The man who first posted the Northam yearbook photo is BLP editor-in-chief Patrick Howley, a former reporter and provocateur for Breitbart and Tucker Carlson’s Daily Caller. Howley has made news in the past, but for more ignoble reasons. In 2014, he and Carlson were forced to apologize to reporter Rosie Gray, then at BuzzFeed, after Howley tweeted a pair of gross, sexist comments about her. Breitbart also suspended Howley in 2016 after he publicly questioned whether one of his co-workers had lied when she said she’d been manhandled by Trump campaign manager Corey Lewandowski at a press event.

Under Howley’s leadership, BLP has published stories attacking anti-fascist activists and trying to downplay the role of neo-Nazi violence in the death of Heather Heyer at the Unite the Right rally in Charlottesville in 2017. It went so far as to falsely blame an anti-racism activist and professor from the University of North Carolina-Chapel Hill for her death. The site also wrote favorably about the white nationalist Paul Nehlen, who unsuccessfully challenged former House Speaker Paul Ryan in his GOP primary in 2018. The Daily Beast reported that Nehlen was a client of the site owner’s fundraising firm.

Howley has tried to fashion BLP into an investigative reporting outfit, and the Northam yearbook photo would certainly qualify as a big scoop. But Fox News contributor Dan Bongino said the photo had been kicking around in conservative circles for months before Howley finally posted it Friday, after Northam came under heavy fire from conservatives for his comments supporting a bill in the legislature that would have loosened restrictions on late-term abortions in the state.

Bongino tweeted Friday that he’d been sent a copy of the photo in October 2018 but couldn’t independently verify that Northam was one of the men in the photo.

I was sent the disgusting photo of Northam in Oct, 2018. I was not able to independently verify that the photo was of Northam therefore I did not publish the story. But,this indicates that the photo was probably known about by others who may have squashed it for political reasons

The allegation has come to light just as Fairfax could be on the verge of becoming the state's chief executive in the wake of a scandal involving Democratic Gov. Ralph Northam and a blackface yearbook photo.

The woman making the accusation against Fairfax has retained Katz, Marshall and Banks, a Washington, D.C.-based firm, and is consulting with her attorneys about next steps, according to a source close to the legal team. The law firm assisted Blasey Ford as she came forward during Kavanaugh's confirmation process with allegations that he assaulted her when the two were in high school.

Suggestions of the accusation against Fairfax were first published on the conservative site Big League Politics, which also broke the story on Friday about the photo on Northam's 1984 medical school yearbook page, which depicts a person in blackface and another in a KKK robe and hood.

In response to the story, Northam quickly released a statement acknowledging he was in the photo and apologizing. The following day he walked back the admission, saying that on further reflection he does not believe he was the person in the photo. However, he did acknowledge having appeared in blackface as part of a Michael Jackson costume around the same time.

Northam is facing strong pressure from Democrats across the country calling for his resignation, which has put Fairfax — who would take over the governorship in the event of Northam's resignation — in the spotlight.

NPR has not confirmed the allegation against Fairfax.

In a statement early Monday, Fairfax called it "false and unsubstantiated" and noted that The Washington Post had looked into the same accusation more than a year ago and decided not to go forward with a story.

Later in the day, the Post published a piece describing the allegation and the newspaper's steps in reporting the story. According to the story, Fairfax and his accuser met in 2004 at the Democratic National Convention in Boston. The woman alleged that what began as consensual kissing escalated to a forced encounter that included oral sex. Fairfax says the encounter was entirely consensual.

The newspaper said it could not corroborate either person's version of events and decided not to publish at the time.

the only reasons the speaker is a repub (aside from gerrymandering) is that during the 2017 elections...1 race resulted in a tie as a result of tens of voters being 'mistakenly' placed in the wrong district. of course...that particular precinct had an overwhelmingly black population who were likely to vote for the democrat.

a republican-majority panel of judges marked it up to something like an incidental error that that wasnt worthy of the court mandating a remedy (like letting those people vote in their real district or calling another election). and the tie was then broken by picking one of the candidates from a piece of paper out of a bowl. the repub was the one picked.

thats a hard sell to a lot of black people tho.

i think fairfax has the best chance of surviving. just because it cant be proven and he hasnt admitted to it.

in fact...nobody is even really talking about what the actual accusations are. just that he is being accused in the midst of all these other scandals.

the only thing really standing in his way is the dem party hardline stance on #metoo (especially during the kavanaugh hearing). if there was a more patient/reasoned approach like due process, weighing all of the 'evidence', warranted standard of proof, etc then it wouldnt be as dire a circumstance as it seems right at this moment.

This news flooded me with painful memories, bringing back feelings of grief, shame, and anger that stemmed from an incident with Mr. Fairfax that occurred in July 2004 during the Democratic National Convention in Boston.

I met Mr. Fairfax on July 26, 2004, when he and I were working at the Convention. We struck up a conversation on the first day of the Convention and soon realized we had a mutual friend. We crossed paths occasionally during the first two days and our interactions were cordial, but not flirtatious. We commiserated about our long work hours, and on the afternoon of the third day of the Convention, July 28, 2004, Mr. Fairfax suggested that I get some fresh air by accompanying him on a quick errand to retrieve documents from his room in a nearby hotel. Given our interactions up to that time, I had no reason to feel threatened and agreed to walk with him to his hotel. I stood in the entryway of the room and after he located the documents, he walked over and kissed me. Although surprised by his advance, it was not unwelcome and I kissed him back. He then took my hand and pulled me towards the bed. I was fully clothed in a pantsuit and had no intention of taking my clothes off or engaging in sexual activity. In the back of my mind, I also knew I needed to return to Convention headquarters.

What began as consensual kissing quickly turned into a sexual assault. Mr. Fairfax put his hand behind my neck and forcefully pushed my head towards his crotch. Only then did I realize that he had unbuckled his belt, unzipped his pants, and taken out his penis. He then forced his penis into my mouth. Utterly shocked and terrified, I tried to move my head away, but could not because his hand was holding down my neck and he was much stronger than me. As I cried and gagged, Mr. Fairfax forced me to perform oral sex on him. I cannot believe, given my obvious distress, that Mr. Fairfax thought this forced sexual act was consensual. To be very clear, I did not want to engage in oral sex with Mr. Fairfax and I never gave any form of consent. Quite the opposite. I consciously avoided Mr. Fairfax for the remainder of the Convention and I never spoke to him again.

After the assault, I suffered from both deep humiliation and shame. I did not speak about it for years, and I (like most survivors) suppressed those memories and emotions as a necessary means to continue my studies, and to pursue my goal of building a successful career as an academic. At the time, I found this horrific incident especially degrading given my regular volunteer work at a local rape crisis center. Over the next decade or so, I would go on to earn my PhD from the University of Chicago and become a tenured professor at Scripps College, a prestigious women's college in Claremont, California. Years later, in October of 2017, I saw a picture of Mr. Fairfax accompanying an article in The Root about his campaign for Lt. Governor in Virginia. The image hit me like a ton of bricks, triggering buried traumatic memories and the feelings of humiliation I'd felt so intensely back in 2004. Prior to reading the article, I had not followed Mr. Fairfax's career and did not know that he was seeking public office. Unsure of what to do, I felt it was crucial to tell close friends of mine in Virginia, who were voters, about the assault.

That October, as the #MeToo movement intensified, women throughout the world began forcefully speaking out about the sexual violence they had experienced and the impact of those experiences on their lives. The courage of so many women coming forward to confront powerful men and systems that allow such abuse to occur are part of what inspired me to action. I felt a responsibility to myself, the beloved students I teach, and the brave women I've tried to help overcome their own trauma. The passion and resolve of so many survivors, coupled with the job security that tenure afforded me, gave me the strength I simply did not have in 2004. By December 2017, I not only told many friends that Mr. Fairfax had sexually assaulted me but I also reached out to a personal friend at The Washington Post and spoke to his colleague about the assault.

After The Washington Post decided in March 2018 not to run my story, I felt powerless, frustrated, and completely drained. Again I tried to bury memories of this painful incident and focus on my work and my students.

On Friday, February 1, 2019, as stories appeared in the media suggesting that Governor Northam would have to resign and that Mr. Fairfax would be sworn in as Governor, I felt a jarring sense of both outrage and despair. That night I vented my frustration on Facebook in a message that I wrote as a private post. I did not identify' Lt. Governor Fairfax by name but stated that it seemed inevitable that the campaign staffer who assaulted me during the Democratic Convention in 2004 was about to get a big promotion. It was not my intention in that moment to inject myself into what has become a much larger political battle.

The following morning, I was inundated with messages of care and concern from friends— including many I had told about the sexual assault — and numerous inquiries from journalists who had become aware of my post. Over the weekend, I was undecided about whether to speak out publicly. I knew that if I did so, I would immediately face accusations about my motives and be branded a liar, as is routinely the case when women come forward with allegations of sexual misconduct against prominent men.

On Sunday night, before I had time to decide on a course of action, an online publication published a screenshot of my Facebook post, identified me by name, and posted pictures of me. In response, at 2:55 a.m. on February 4, 2019, Mr. Fairfax issued a statement further escalating this matter by calling me a liar and falsely characterizing the reasons The Washington Post decided not to run a story about my allegations. The Post was forced to repudiate Mr. Fairfax's statement that there were "significant red flags and inconsistencies within the allegations" which led it to decide not to publish a story about my account. Rather, as is often the case in situations where sexual assault by an acquaintance occurs behind closed doors years earlier, it is difficult to corroborate either the victim's allegations or the accused's denials. .

Mr. Fairfax's suggestion that The Washington Post found me not to be credible was deceitful, offensive, and profoundly upsetting. He has continued a smear campaign by pointing reporters to a 2007 educational video in which I talked about being the victim of incest and molestation. In that video I did not talk about being assaulted by Mr. Fairfax. This, of course, is not proof that he did not assault me. His reliance on this video to say the opposite is despicable and an offense to sexual assault survivors everywhere.

Since October 2017 when I first began telling friends about the assault, I have never wavered in my account because I am telling the truth. I have no political motive. I am a proud Democrat. My only motive in speaking now is to refute Mr. Fairfax's falsehoods and aspersions of my character, and to provide what I believe is important information for Virginians to have as they make critical decisions that involve Mr. Fairfax.

With tremendous anguish, I am now sharing this information about my experience and setting the record straight. It has been extremely difficult to relive that traumatic experience from 2004. Mr. Fairfax has tried to brand me as a liar to a national audience, in service to his political ambitions, and has threatened litigation. Given his false assertions, I'm compelled to make clear what happened. I very much wish to resume my life as an academic and professor. I do not want to get further embroiled in this highly charged political environment. This is the only statement I and my legal team will be making.

UNC Chapel Hill Under Fire for Blackface Photos in Yearbook

CHAPEL HILL, N.C. -- UNC Chapel Hill is receiving backlash after photos from a 1979 yearbook resurfaced online.

One of the images shows one Chi Phi fraternity member with a painted blackface alongside two other members dressed in Ku Klux Klan attire. The person in blackface also has a noose around their neck as if they are being lynched.

The resurfacing of these pictures comes after two Virginian politicians were revealed to have also done blackface in one of their yearbook photos.

Joel Curran, vice chancellor for communications, released a statement saying, "The photos found in the 1979 student yearbook are abhorrent. We fully and wholly condemn both the photos and the racist behavior they depict. That kind of behavior has no place on our campus now or then."

The university also released a tweet condemning the photos found on page 400.

The second woman to accuse embattled Virginia lieutenant governor Justin Fairfax of sexual assault claims the alleged incident occurred a year after she said she was also raped by an unnamed Duke basketball player, A.J. Perez of USA Today reports.

Meredith Watson came forward Friday alleging that Fairfax raped her 19 years ago while the two were students at Duke, describing the incident as “premeditated and aggressive” and noting they had been friends at the time in a statement released by her lawyer.

In a second statement released later Friday, Watson claimed the attack was tied to another rape involving a Duke basketball player that allegedly occurred a year earlier in 1999. Watson reportedly told Fairfax about the incident.

From USA Today:

“He revealed that Ms. Watson was the victim of a prior rape,” Nancy Erika Smith, Watson’s attorney, wrote in the second statement. “That is true. Ms. Watson was raped by a basketball player during her sophomore year at Duke. She went to the Dean, who provided no help and discouraged her from pursuing the claim further. Ms. Watson also told friends, including Justin Fairfax. Mr. Fairfax then used this prior assault against Ms. Watson, as he explained to her during the only encounter she had with him after the rape.”

“She left a campus party when he arrived, and he followed her out. She turned and asked, ‘Why did you do it?’ Mr. Fairfax answered: “I knew that because of what happened to you last year, you’d be too afraid to say anything.”

A Duke spokesman told USA Today that they had only just become aware of the allegations and are now looking into them. Fairfax denied Watson’s claims.



Fairfax is also facing accusations of sexual assault from his first accuser, Vanessa Tyson, who came forward earlier this week to publicly accuse the 39-year-old of forcing her to perform oral sex during the 2004 Democratic National Convention in Boston. Fairfax did not deny he had an encounter with Tyson, but said it was consensual and the accusation was an attempt to smear him when he was poised to become governor of Virginia.

Virginia’s current governor, Ralph Northam, as well its attorney general, Mark Herring, have been embroiled in a controversy surrounding use of blackface for the past week. A picture of a person in blackface and another in a Ku Klux Klan outfit on Northam’s yearbook page surfaced last week, while Herring said Wednesday that he dressed in blackface in college.

Northam, Fairfax and Herring, who are now all facing calls to resign, represent the top three rungs in the line of succession of Virginia’s governorship, the fourth being Stephen Newman, the president pro tempore of the Senate of Virginia.

He's actually exhibiting that he knows the history because the first black people to arrive to the colonies close to Jamestown in 1619, arrived as indentured servants (maybe in name and of course many scholars debate it).

People from the area might know that (like myself) or people who have studied up on it, but the twitter masses reacting to that statement don't.

Anyway, seems to me dude was trying to display his knowledge of that history, not necessarily downplay the status of those black people.

Indentured Servants In The U.S.
Indentured servants first arrived in America in the decade following the settlement of Jamestown by the Virginia Company in 1607.

The idea of indentured servitude was born of a need for cheap labor. The earliest settlers soon realized that they had lots of land to care for, but no one to care for it. With passage to the Colonies expensive for all but the wealthy, the Virginia Company developed the system of indentured servitude to attract workers. Indentured servants became vital to the colonial economy.

The timing of the Virginia colony was ideal. The Thirty Year's War had left Europe's economy depressed, and many skilled and unskilled laborers were without work. A new life in the New World offered a glimmer of hope; this explains how one-half to two-thirds of the immigrants who came to the American colonies arrived as indentured servants.

Servants typically worked four to seven years in exchange for passage, room, board, lodging and freedom dues. While the life of an indentured servant was harsh and restrictive, it wasn't slavery. There were laws that protected some of their rights. But their life was not an easy one, and the punishments meted out to people who wronged were harsher than those for non-servants. An indentured servant's contract could be extended as punishment for breaking a law, such as running away, or in the case of female servants, becoming pregnant.

For those that survived the work and received their freedom package, many historians argue that they were better off than those new immigrants who came freely to the country. Their contract may have included at least 25 acres of land, a year's worth of corn, arms, a cow and new clothes. Some servants did rise to become part of the colonial elite, but for the majority of indentured servants that survived the treacherous journey by sea and the harsh conditions of life in the New World, satisfaction was a modest life as a freeman in a burgeoning colonial economy.

In 1619 the first black Africans came to Virginia. With no slave laws in place, they were initially treated as indentured servants, and given the same opportunities for freedom dues as whites. However, slave laws were soon passed – in Massachusetts in 1641 and Virginia in 1661 –and any small freedoms that might have existed for blacks were taken away.

As demands for labor grew, so did the cost of indentured servants. Many landowners also felt threatened by newly freed servants demand for land. The colonial elite realized the problems of indentured servitude. Landowners turned to African slaves as a more profitable and ever-renewable source of labor and the shift from indentured servants to racial slavery had begun.

i think what a lot of this could be is that...much like the va elections in 2017...the story on the ground might be a lot different than the story playing out in national news.

on cable news in 2017...the northam campaign was in freefall and he wouldnt be able to overcome attacks on immigration/ms13. in reality it was blowout win that might have been even bigger if weather conditions werent shitty in nova that day.

so now it looks like absolute chaos in va that threatens to tear apart the party (if you let cable news tell it)...but dem voters could be bunkering around candidates they feel are under siege.

those black poll numbers already dispel a lot of the national narrative to this point.

I think this allegation will have to all turn on whether she did actually report the incident like she said she did. There would have to be some record of that happening right? Which dean? This moves beyond two people having a misunderstanding (for lack of a better word) around sex, that is, this isn't he came at her aggressively and she was too scared to speak up. Blackface, KKK hoods and mock lynchings: Review of 900 yearbooks finds blatant racism
In one of the most extensive searches of college yearbooks ever, we found blackface and Ku Klux Klan photos like Ralph Northam's far beyond Virginia.

What do you want to find?
The old yearbook photos capture the lighthearted moments from college worth remembering – smiling faces, pep rallies and cans of cheap beer.

But tucked in and among those same pages are pictures of students dressed in Ku Klux Klan robes and blackface, nooses and mock lynchings, displays of racism not hidden but memorialized as jokes to laugh about later.

Throughout the 1970s and 1980s, a stunning number of colleges and university yearbooks published images of blatant racism on campus, the USA TODAY Network found in a review of 900 publications at 120 schools across the country.

At Cornell University in New York, three fraternity members are listed in the 1980 yearbook as “Ku,” “Klux” and “Klan.” For their 1971 yearbook picture, a dozen University of Virginia fraternity members, some armed, wore dark cloaks and hoods while peering up at a lynched mannequin in blackface. In one of the most striking images – from the 1981 University of Illinois at Urbana-Champaign yearbook – a black man is smiling and holding a beer while posing with three people in full KKK regalia.


Reporters collected more than 200 examples of offensive or racist material at colleges in 25 states, from large public universities in the South, to Ivy League schools in the Northeast, liberal arts boutiques and Division I powerhouses.

STORY BEHIND THE STORY: How — and why — we reviewed 900 yearbooks

The yearbook photos reflect campus communities that tolerated open displays of racism at the parties they attended, parades they marched in and posters they hung – despite the hard-learned lessons of the civil rights movement they grew up with. In almost every picture, people appear happy.

Minority students from that era say the comfort with public behavior that would likely meet swift condemnation today further marginalized minorities on campus. And the choice to publish the images for posterity cut even deeper.

Cassandra Thomas, a black student at the University of Texas in the late 1970s, remembers seeing the photograph of someone wearing a KKK costume draped in a Confederate flag in her yearbook. But she felt she had no recourse on a campus where an almost all-white student body and administration decided what was acceptable and what wasn’t.

“It was about keeping your head down,” said Thomas, 60. “We were trying to get our degree and get out with the least amount of trouble.”

The volume of shocking imagery found in the examination, which was not comprehensive, suggests that there are likely more yearbooks that recorded racism on campuses nationwide – and countless more acts never captured on camera or submitted for publication.

The review also gives new perspective to an array of cases that have emerged since reports showed that Virginia Gov. Ralph Northam's 1984 medical school yearbook page features a person wearing blackface and another in a KKK hood. The image, uncovered in early February, has endangered Northam’s career and galvanized student newspapers and local outlets around the country to dig up other cases of politicians in racist situations.

No politicians were identified by USA TODAY Network’s review, which focused on the same time period as Northam’s yearbook, in the era after sweeping civil rights reform. Few images had captions to provide names or context and people’s faces were often hidden behind hoods or blackface.

In one yearbook, from Arizona State University, reporters discovered that USA TODAY Editor Nicole Carroll had designed a page that included a photo of two people, at a fraternity’s Halloween party, in black makeup as actress Robin Givens and boxer Mike Tyson. Carroll, who was editor of the yearbook in 1989 when the photo ran, expressed regret after learning of the photo.

“I was shocked when a colleague told me of my role in publishing a racist and hurtful photo in my college yearbook,” Carroll said in a statement. “I am truly sorry for the harm my ignorance caused then, and the hurt it will cause now, 30 years later.”


Experts say that even if school officials don’t have direct oversight over the yearbooks, responsibility rests with the entire institution: A campus culture that fostered racist behavior; yearbook staffs that chose to memorialize it; and administrations that failed to condemn the images when they were published for the world to see.

Andre M. Perry, a David M. Rubenstein Fellow in the Metropolitan Policy Program at the Brookings Institution, has studied his alma mater’s yearbooks at the University of Maryland. He said racism in higher education has a way of involving everyone on campus, so he wasn’t surprised to see it documented so regularly.

“The way to fit in, sadly, is to make fun of black people,” Perry said. “It’s a unifying act. It’s sad but racism pulls people, particularly white people, together.”

The yearbooks in the USA TODAY Network examination also show students saluting in Nazi uniforms on Halloween or wearing orange paint and a headdress to depict a stereotype of a Native American on game day. There are “slave sale” fundraisers that auctioned off young women, “plantation parties” and a “sharecroppers ball.” One picture shows a swastika banner hung up on what appears to be a dormitory wall.

But the vast majority of the offensive material show racist imagery, such as students in blackface or KKK robes, sometimes just pages away or even alongside images of minority students and university leaders.

Since the Northam news broke, Steve LaCarter, 64, said he has been waiting for a phone call about the party he and his fraternity friends threw at the University of South Carolina in the 1976 school year. They put shoe polish on their faces, wore matching pink suits and lip synced soul music on stage. Someone took a picture, which he said he keeps in a bible at home along with other old photographs.

“I don’t feel like I harmed anybody,” he said. “There were no black people in the room watching that.”

But he didn’t know the yearbook had published it, which seemed to recalibrate his position.

“I can see that, for black people, even in the '70s, seeing that in the University of South Carolina yearbook, that’s not right,” he said. “But I didn’t think about that. I didn’t think about it.”

Similar scenes are splashed across the yearbooks: There are white people dressed up as Michael Jackson, Tina Turner and Aunt Jemima for skits. A “sleazy pimp” in blackface at a fraternity’s “Pimps and Whores” party. Some students painted their face like 19th-century minstrel shows. Others marched in parades wearing blackface. Groups of friends put on KKK robes for costume parties and Halloween.

“If you dress like that for Halloween and you knock on the door of a black family, how would they perceive your costume?” said Mia Moody-Ramirez, a professor at Baylor University who researches depictions of race and gender in the media. “Would you still feel as comfortable if you’re in the company of African-Americans and you’re wearing blackface?"

As more offensive images surface from yearbooks, Americans are trying to weigh how to reckon past actions with today’s cultural norms, sharpened by more empowered minorities and social consciousness.


Experts said this is an opportunity for colleges not only to address the past, but also to focus on the racial inequalities that are still present on campus, just better hidden and more readily cast as separate from the school.

“It’s easy to forbid things when you know they’re going on behind closed doors,” Perry said.

Hilary O. Shelton, director of the NAACP’s Washington Bureau, said there is likely a range of intentions behind all of the photographs. The students in blackface dressing up for Halloween as a favorite black celebrity may have been trying to be funny and were just insensitive or oblivious to the harm they caused. The ones in KKK robes, or those who used blackface in a mocking way, might have worse motivations.

“They can argue they were ignorant to it, but it was still racist,” Shelton said. The more meaningful distinction is how those same people respond in retrospect – whether they accept responsibility and apologize or deny having done something wrong.

“That’s the bigger problem,” said Shelton. “Ignorant arrogance, which is a very dangerous thing.”

"How does that get into the yearbook?"

USA TODAY Network reached out to each university and fraternity named in this story where reporters found offensive pictures in yearbooks.

Nearly every president or spokesperson condemned the images as antithetical to school values and said they’ve taken steps over the years to become more inclusive, distancing themselves from the past while also acknowledging history’s stain on the campus.

“Many of these photos are extremely offensive and painful to view,” Jim Ryan, president of the University of Virginia, said in a statement. “But while the photos themselves are shocking, their existence is not.”


But experts say schools have a long way to go to solve disparities still entrenched in higher education today.

“The patterns of behavior in place in 1975 are not perhaps that different,” said psychologist Beverly Daniel Tatum, a former Spelman College president who graduated from Wesleyan University that year and has since written several books about racism in education.

Some universities, including American, Elon and Wake Forest, released findings from their own internal reviews to identify offensive images in past yearbooks.

On the New York school’s 150th anniversary in 1979, the Rochester Institute of Technology yearbook published a photo of nine students in KKK robes, one holding a noose. The photo is grainy, which makes it difficult to know for certain, but posing with them is either a white student in blackface or a black student.

The school blocked access to its digital archive on the web after receiving inquiries from a reporter.

“We find the photos highly offensive and not reflective of today’s RIT,” spokeswoman Ellen Rosen explained in an email, “so we did not want them easily shared.”

Tom Grotta, who now owns and curates a contemporary art gallery with his wife, was the editor of the RIT yearbook in 1979. He said the school was a progressive campus with little racial tension and that he did not remember including the photograph.

After viewing the photo, which shares a page with photos from a Halloween party, Grotta suspected that the students had just acted in a play because of the canvas wall behind them. Like the vast majority of the images reviewed by USA TODAY, it has no caption and very little context outside of other photos around it.

“I don’t regret the picture,” Grotta said. “I regret not having a caption.”

At Cornell, the Sigma Nu fraternity submitted KKK and Nazi references instead of the members’ names for captions in their 1980 yearbook photo.


Three former fraternity members at the time, including two who are Jewish, said they hadn’t seen the yearbook page until a USA TODAY reporter emailed it to them. Both said they never felt hostility from peers at the fraternity – even if some were less welcoming than others – but were stunned to learn what had been published.

“I lived in the house with all these guys,” said Eric Babat, a freshman at the time and now an attorney in New York. “How does that get into the yearbook without somebody flagging it? I don’t understand. This was in the Cornell yearbook?”

Sigma Nu spokesman Drew Logsdon denounced the “deeply offensive images” in a statement.

After publication, Martha Pollack, the president of Cornell University, denounced the captions. A spokesman for the university had initially declined to comment.

A Tradition of Racism

Though many colleges began prohibiting Confederate flag displays on campus decades ago, Confederate imagery remains a part of the fabric at some schools in the South.

For generations, the Kappa Alpha Order fraternity at schools across the South, including the University of South Carolina and Auburn University, maintained traditions of the “Old South” with parades and parties in Confederate clothing and flags, some the size of a basketball court, all recorded in dozens of yearbooks.

The fraternity has since banned the display of the flags, and in 2010 prohibited members from wearing Confederate uniforms at events. Kappa Alpha Order spokesman Jesse S. Lyons said in a statement that the racist acts documented at fraternity parties “are not appropriate at any time, do not reflect who we are, and would not be tolerated.”


At the University of Texas, prejudice at the school was so acute and institutionalized that some professors lectured about black inferiority in the classrooms, former student Cassandra Thomas recalled.

Thomas shared another moment that stung: Her white roommate freshman year moved out immediately after discovering she had been paired with a black student. She said she could go a whole day without seeing another person of color.

“We weren't trying to change the world then the way we would do it today,” Thomas said.

While southern schools may be the crucible for racist customs, the photos captured by the USA TODAY review show they extend to other parts of the country as well.

In schools across the Midwest and North, campuses often touted as bastions of liberalism and tolerance, yearbooks chronicle some of the same displays.

Until 1969, the University of Vermont celebrated a “Kake Walk” festival that featured white students who dressed in blackface as an homage to minstrel shows. But references to it, including blackface, emerged in the yearbooks in the following decades.

Minstrel shows had helped perpetuate negative stereotypes about black people – who weren’t allowed to play themselves – before the growing black political and social power of the civil rights movement squashed it from popular culture in the 1960s.

Experts say those same sort of displays can show the extreme power structures on campuses today, where the pressure to conform and protect yourself often outweighs your sense of injustice.

“People ask, 'Why are the black kids sitting together in the cafeteria?’” said Beverly Daniel Tatum, the psychologist and author. “It’s because they are protecting themselves from this kind of toxic environment.”

Reporters found five examples of black students appearing in or alongside KKK robes, including the 1981 Illinois photograph from a Halloween party.

“As a black or brown student, you have to navigate those social relationships: Try to fit in or get punished by that same social structure?” said Andre M. Perry at the Brookings Institution. “Many students just grin and bear it. They know deep down this is wrong; they’re making fun of people like me.”

Jeffrey Barkstall, 57, was one of few black students who attended Illinois at the time the yearbook published the picture of a black man, who is not identified, posing with three individuals hidden by KKK outfits.

“I’m sure at the time they probably thought that was funny,” said Barkstall, now a realtor in Illinois.

He paused for a moment to consider his time at college almost 40 years ago and whether he might have known who was behind the Klan hoods.

“Who knows?” he said. “There may be senators under those masks.”
