WASHINGTON/LOS ANGELES (Reuters) - U.S. Supreme Court Justice Ruth Bader Ginsburg is already up and working in her hospital room, a day after breaking three ribs in a fall, her nephew said late on Thursday at the Hollywood premiere of a film about her life.

Ginsburg, a ground-breaking liberal jurist who at 85 is the oldest U.S. Supreme Court justice, was hospitalized on Thursday after falling at her office at the court, a court spokeswoman said.

“The last I heard she was up and working, of course, because what else would she be doing, and cracking jokes,” her nephew Daniel Stiepleman said at the premiere of the film “On the Basis of Sex”, about a gender-based discrimination case Ginsburg tried as a young lawyer in 1972.

“I can’t promise they were good jokes but they were jokes,” said Stiepleman, who wrote the script for the film with input from the justice herself.

Ginsburg, who made her name as an advocate for women’s rights, is one of four liberals sitting on the court, to which she was appointed in 1993 by then President Bill Clinton.

The court’s 5-4 conservative majority was restored last month when the Senate confirmed Republican President Donald Trump’s appointee Brett Kavanaugh after a contentious nomination process in which Kavanaugh denied a sexual assault allegation from his youth.

Ginsburg went home after the fall but experienced discomfort overnight and went to George Washington University Hospital on Thursday morning, court spokeswoman Kathy Arberg said in a statement.

Tests showed Ginsburg fractured three ribs on her left side and she was admitted for observation and treatment, Arberg added. The court is due to hear its next arguments on Nov. 26.

If Ginsburg were unable to continue serving, Trump could replace her with a conservative, further shifting the court to the right. A potentially dominant 6-3 conservative majority would have major consequences for issues including abortion, the death penalty, voting rights, gay rights and religious liberty.

As the oldest justice, Ginsburg is closely watched for any signs of deteriorating health. She has bounced back from previous medical issues and has fallen twice before at her home, in 2012 and 2013, leading to rib injuries. She was treated in 1999 for colon cancer and again in 2009 for pancreatic cancer, but did not miss any argument sessions either time.

In 2014, doctors placed a stent in her right coronary artery to improve blood flow after she reported discomfort following routine exercise. She was released from a hospital the next day.

Trump went to the court on Thursday for a ceremony welcoming Kavanaugh to the nation’s highest court. Kavanaugh was sworn in to the lifetime job last month. The president sat with first lady Melania Trump at the front of the marble-walled courtroom near the justices’ mahogany bench, making no public remarks.

Some leading congressional Republicans, including Senate Majority Leader Mitch McConnell and outspoken Trump ally Senator Lindsey Graham, attended. The event came a day after Trump fired Jeff Sessions as attorney general; Matthew Whitaker, who Trump named as Sessions’ interim replacement, participated.

CRITICAL COMMENTS
Ginsburg called Trump an egotistical “faker” when he was running for president in 2016, in an unusual foray into politics by a justice. Trump responded, saying her “mind is shot” and she should resign. Ginsburg later expressed regret, saying “judges should avoid commenting on a candidate for public office.”

She is a hero among many U.S. liberals, who revere her as “The Notorious R.B.G”, a nickname based on a late rap star. A documentary film about her, “RBG,” was released earlier this year, and the Hollywood biopic will be released on Christmas.

The director, Mimi Leder, called described the film as Ginsburg’s “origin story”, a term used in superhero movies.

“Our thoughts are with her tonight after her fall yesterday. We send her our love and pray for a speedy recovery. I have it on good word that she’s in great shape, and she is shooing the doctors out of her room so she can work,” Leder said at the premiere. She told Reuters her own information about Ginsburg’s health had come from Stiepleman.

Ginsburg has helped buttress equality rights during her time on the high court, including in sex discrimination cases.

Her career was shaped in part by discrimination she faced as a young lawyer in a predominantly male profession: she was one of just nine women at Harvard Law School in the 1950s, and later struggled to find a firm that would hire her.

“She was making mistakes, finding out who she was, had a very young family, her husband wasn’t very well,” actress Felicity Jones, who plays her in the film, told Reuters on the red carpet. “She was juggling a lot of difficult things at the same time but always (had) this absolute commitment to the law.”

Ginsburg voiced support for the #MeToo movement against sexual misconduct after Kavanaugh was accused of sexual assault by a university professor, saying that unlike in her youth, “women nowadays are not silent about bad behavior.”

U.S. appeals court rules against Trump on DACA
Kavanaugh’s Senate confirmation process convulsed the nation just weeks before Tuesday’s congressional elections in which Trump’s fellow Republicans lost control of the House of Representatives but expanded their majority in Senate.

On Wednesday, Trump credited the fight over confirming Kavanaugh, who was strongly opposed by Democrats, for the gains in the Senate.

she had a chance to act in the best interest of the country but she opted for individual agrandizement in holding a seat longer than john paul stevens and oliver holmes.

theres no take more selfish than that.

if a repub prez...especially trump...gets to appoint a justice to her seat then it will
put the future of the country in even more peril than it already is in. and it would have been completely preventable.

did you think that was an obstacle to getting a judge confirmed?

obama got 2 judges through in his 1st 2 years. coulda been 3.

dems controlled the senate til 2015. they could have done it at any point up until then.

with the post-2010 legislative gridlock in congress ...there was plenty of time to confirm a new sc judge. the same way there was plenty of time for obama to flood the lower courts, reshape the judiciary, and flip several conservative district/apellate courts to liberal.

and if repubs filibustered the sc nomination...dems could just nuke the sc filibuster like they did the one for the lower courts.

there was only one variable preventing ginsburgs replacement. ginsburg.

obama nominated garland to replace scalia. not to replace ginsburg. what does that tell you?

instead obama ended up replacing david souter who is almost a decade younger than ruth (and without all of the various health problems).

obama could have filled 3 seats if he wanted to. filled another seat in the lame duck period before the new congress was sworn in (repubs would do it in a heartbeat).

mitch mcconnell didnt become majority leader until after the 2014 midterms when repubs took the chamber. dems still had a 10 seat senate majority even after 2010 and 2012.

if dems wanted to push the issue and at least attempt to replace her before then...they could have (including nuking the sc filibuster like the lower appointment filibusters). the only person holding anything up was rbg.

when justices have their old age and health factor in how civil liberties are determined, it puts everyone's well being, rights and safety in an unnecessary limbo. especially in the current social/political climate -- which will clearly be detrimental to have donald trump nominate another right leaning pig for a lifetime seat.

she's clearly not well and should've stepped down long ago.

a fixed term of 18 years would suffice.

And presidential appointments should be staggered to allow each potus two appointments per term. one in both the first and third year.

..to be implemented. Not sure I agree with your problem with term limits, as what you've described above is already the facts on the ground.

I'd say 16-20 years for the House, and 24 years for the Senate. Towards the problem you mentioned, I'd also try to add a lobbying ban afterwards, preferably 5 years.

under our current campaign finance system.

without incumbency, name recognition, etc...the seat would basically just go to the highest fundraiser. itd just be a revolving door of lobbyists and donor appointed candidates.

and you would wipe out a ton of institutional knowledge gained experience throughout several eras, administrations, etc.

repubs regularly swap out seat holders more frequently than dems (for various reasons) and look what it does to their ability to govern once they have power.

then imagine entire waves of politicians being lame ducks at the same time with no reason to care about voters electing them again. no real reason to do anything other than ram through handouts and favors to the corporations who will prolly employ you next. or no real reason to even show up to work and do your job at all.

if you look at states that have implemented shorter legislature term limits like mo and ne...you will see the negative effect it has had on their politics.

plus...its sort of a bandaid for undesirable voter behavior. most of the onus for poor representation belongs with the people who continually/willfully put them in office. term limits wouldnt necessarily fix that. its more likely it would just make it worse.

term limits for judges make more sense tho because theyre appointed and not elected. so they have no accountability to voters or no performance assessment at the ballot box. and the reasoning for the super long terms (the law doesnt change with every political tide) has pretty much been thrown out the door as these conservative judges have become more noticeably partisan/activist.

im sure someone in here is gonna object to us talking like this but the reason why republicans are even still a national party is because they play as a team from top to bottom while we are more worried about individual gratification and personal milestones.

like repubs just regularly rotate out players serving the same cookie cutter agenda for decades...and dems are worried about being the 1st to do something, the oldest to do something, getting individual credit/praise for their signature legislation, etc.

rbg is more worried about being some iconic figure and being lauded for still 'fighting' at an old age than she is about the life of her party and the republic itself.

anthony kennedy stepped down as soon as it even *looked* like repubs might lose the senate. conservative fed judges nationwide are retiring early so mcconnell can fill their seat before dems possibly take the senate in november.

this is how they ensure the maintenance of their political power and their ability to continue to shape the nation in their image.

no such consideration or forethought from rbg tho (and people on our 'side' actually glorify her for it).

its even more foolish when you consider all of the health issues she continuously deals with. new and recurring. its not like shes super healthy for her age,

and even now...theres no guarantee she would even step down as soon as biden is inaugurated. she said she wants to be the oldest justice ever on the supreme court (jps was 90 years old). rbg is 3 years younger than that and might presumably even wanna serve another year past 90.
