"Dallas: Officer mistakenly walks into wrong apartment, kills man"

So she didn't notice that the apartment had completely different decor from hers, but did notice the guy inside? How was she not interviewed yet (aside from the obvious "she needed time to get her story straight in a way that will allow her to skate?") How are they going to spin this to him "not complying?"

https://splinternews.com/cop-walks-into-the-wrong-apartment-kills-the-man-who-l-1828880798

A Dallas police officer got off her shift Thursday night, walked a block home, and entered an apartment that she believed was hers. It was not. She shot and killed the man who lived there, according to police.

In an early morning press conference, Dallas Police Sgt. Warren Mitchell said that before 10 p.m., the yet-to-be-named officer called police dispatch to “say she had been involved in a shooting.” Mitchell said that she was still in uniform and had just gotten off of a “full shift.”

Mitchell said that when additional police arrived at the scene, the officer told them that she had walked into the wrong apartment, and that “at some point, she pulled her weapon and shot the victim.”

The victim was 26-year old Botham Shem Jean, NBC’s Dallas affiliate reported. Mitchell said that he was later pronounced dead at the hospital.

During the press conference, Mitchell declined to comment on whether or not the officer thought the man was an intruder, and said that neither the officer nor anyone else who may have witnessed the shooting had been interviewed yet.

In a statement, Dallas PD said that they were conducting a joint investigation with the district attorney, and that the officer had been placed on administrative leave while the investigation is ongoing.

We’ve reached out to the Dallas Police Department to ask what a “full shift” means and how long the officer had been living at the apartment, and will update if and when we receive a response.

I really want to hear more on this, because I want to know how she got in.

Why is she being treated like a cop? This happens to any other person, they are processed immediately into the system.

Dallas Morning News says you can get into units via a key or a code on a punchpad. Someone in the comment section of the article I swiped said the key was still in the door when other cops showed up (indicating that she tried to unlock it and her key wasn't working) but I haven't seen an actual news source with that.

Only things I can think of (if it was the wrong apartment and this wasn't intentional) would be if his door was unlocked OR she was trying her key, it wasn't working, he got up to see what the commotion was at his door and she shot him when he opened.

Dallas police tell me the just off shift officer who shot and killed a man in his own apartment, was on the WRONG FLOOR. HER apartment was on another floor. Her key didn’t work in the door. Shooting happened shortly after resident opened his own door.

especially if she was drunk, you dont notice you get off on the wrong floor and walk to where your apartment should be. would be weirder to get off on the right floor yet somehow still walk to a different apt thinking its yours.

why she would shoot him after he opens the door is hard to explain.

I need a timeline. Was she drinking while on duty? Or did she have time between getting off duty and getting home to get so drunk that she didn’t know what floor she lived on when she got home? Does that mean she drove home drunk? Did they test her sobriety at the scene?

Sounds suspicious as fk. She needs to be in jail.

and if thats how it happened thats unfortunate. the response from the police is not understandable though. looks like at minimum this is manslaughter.

theyre treating her like she was on duty and responding to a call even though their own statements say otherwise.

that does make me think they are hiding more details.

Shit, turns out dude was just getting into his black Nissan Sentra that was parked next to mine. Shit happens, lol.

Actually, all of this is true, except once I thought the guy was in my car I looked closer and saw it wasn't mine, so I un-puffed my chest and lol'd about it with my lady (she saw me get a bit agitated, then calm down).

She was in the wrong
I’ve had a similar situation happen to me that could’ve gone left
In Houston dude that used to live upstairs from me came home drunk one night tried to get in my place
I told him multiple times he had the wrong place
Then I went and got my knife
Then I opened the door. With my knife very visible

In retrospect that situation could’ve gone a whole other way

Virtually no Black people outside the Milwaukee city limits.

Suburbs are strictly off-limits. Never seen anything like it.

Her first reaction was to pull out her gun and kill him?!

Not call 911
Not ask him questions
Not shoot for the leg

SHE messed up and then killed him out of spite. I'm not trying to hear she feared for her life.

White terrorists get taken alive but this innocent man is dead.

The public needs her name so they can fully investigate her background....

https://www.dallasnews.com/news/crime/2018/09/06/shooting-reported-cedars-near-dallas-police-headquarters

Police intend to seek a manslaughter charge against a Dallas officer who shot and killed a 26-year-old man Thursday night when she entered his apartment near downtown, apparently mistaking it for her own.

"This is a very unique situation," Police Chief U. Renee Hall said at an afternoon news conference. "We have ceased handling it under our normal protocol as an officer-involved shooting."

I mean, it seems like there are only two reasonable scenarios. She either knew what she was doing or she didn't.

I doesn't seem like they knew each other, so I'm leaning towards the latter

long story short my roommate hit the button for the floor below ours in the elevator as a joke, let me get off and walk to what i thought was our dorm room. nobody in our dorm ever kept their doors locked so when i walked in and saw someone else in what i thought was my dorm room i rushed him and yoked him up for 2 secs before i realized it wasnt my room.

so i can see how she might've capped him in a disoriented moment.

The apartment was exactly one floor below hers (#1478 vs #1378). Door was slightly ajar, so it fully opened with her key. It was dark (10pm). Interior lights were off.

Of course, this is from the affidavit so it's only her side. She may be filling in the gaps to make it look less bad for herself.
But the apartment # thing leads me to believe it was truly a confusion thing.

She messed up. Big time. But I don't see this as a malicious type of deal. If anything, it's a reflection of the trigger happiness of some people.
If she noticed potential danger in the house, she should move away from the danger and let the (on duty) police handle the situation.

shooting someone doesnt.

sometimes we are distracted and dont notice the small clues that would tell us we are in the wrong place.

i can even understand her freaking out as she got in what she thought was her apartment and noticed someone was in there. going from that to shooting him doesnt make sense though.

unfortunate for sure.

Every investigation of a wrongful shooting by cops should be done by the FBI and the justice department.

Even if you give her every single potential benefit of the doubt, she still looks like someone grossly unqualified to be a police officer who ended someone's life because she didn't know how to do her job. I don't know how they're going to argue it in court in a way to make her look good, but I'm already angry about it.

If she blew a 1.4 then we all know that means she was:

2. Grossly negligent leading to death

If she was coked or pilled up even worse for her. Entitled because her personal comfort and safety apparently comes before anyone else's life.

Staring at the fucking phone, drunk, high or just fucking dumb and unaware.

At a hotel, motel or someone else's place I get. But your own home? How does one not notice their shit looking different? Lights and switches in different places on the hallway walls. Not just dude, but the other apartments on the floor were probably decorated differently.

Shit, if the cleaning staff moves something on my desk over the weekend I'm looking like "Something's not right... who's been here?"

https://www.yahoo.com/news/attorneys-family-criticize-affidavit-dallas-shooting-062117989.html

At a news conference Monday evening, Merritt said two independent witnesses have told him they heard knocking on the door in the hallway before the shooting.

He said one witness reported hearing a woman's voice saying, "Let me in! Let me in!" Then they heard gunshots, after which one witness said she heard a man's voice say, "Oh my God! Why did you do that?"

the average person is getting treated like a career criminal.

but this case is already being framed around whether she used plausible discretion as a law enforcement officer (even tho she was off the clock). its being set up to look like another officer-involved shooting where the officer was in fear for her life (regardless of how reasonable that fear was or what part the officer played to put herself in that situation).

Yeah maybe she didn't take the cookies. But her height has nothing to do with anything.

If there were any exculpatory evidence, I feel like we would have heard about it with the quickness. Like if she passed the drug test, we would have heard by now.

And the "he ignored her commands" thing is attempting some master level judo on our insane cultural deference to police - leaving unspoken that what amounts to a home invasion is somehow legitimate if a cop does it.

They're trying their hardest.

They'll find a semi-plausible story, maybe dig up some dirt on the victim like they do with every victim of a cop shooting ("it says here in 2008 he had a parking violation that he was delinquent on! THUG!")

Or maybe just wait for the news cycles to move on from the story so there is no outrage when they let her off with a slap on the wrist

122. "The NRA’s Catch-22 for Black Men Shot by Police"
In response to Reply # 0

https://www.theatlantic.com/ideas/archive/2018/09/the-nras-catch-22-for-black-men-shot-by-police/570124/

The NRA’s Catch-22 for Black Men Shot by Police

A National Rifle Association spokesperson says Botham Jean would still be alive if he’d had a firearm. But when African Americans legally bearing arms are shot by police, the organization’s media outlet doesn’t defend them.

6:00 AM ET

Adam Serwer

The city of Dallas, Texas, has been rocked by news of an off-duty police officer shooting a black man in his own apartment. On September 6, the off-duty police officer Amber Guyger entered Botham Jean’s apartment and shot him dead. She has since claimed—after a number of shifting accounts—that she mistakenly thought she was entering her own apartment and believed it was being burglarized.

Most people reacted to the news of the shooting with outrage—regardless of the circumstances, shooting an innocent man dead in his own home is a horrible tragedy. Conservatives such as National Review’s David French have argued that Guyger “committed a crime by forcing open Jean’s door, deliberately took aim, and killed him.” Commentary’s Sohrab Ahmari observed, “Even within the four walls of his castle, his home, Jean was not safe from undue police violence.”

The National Rifle Association’s spokesperson sees the incident a bit differently. Dana Loesch argued that Jean would still be alive had he been armed and shot Guyger instead. “I don’t think there’s any context that the actions would have been justified,” Loesch acknowledged, but asserted that “this could have been very different if Botham Jean had been, say he was a law-abiding gun owner and he saw somebody coming into his apartment.” At a time when many conservative writers were expressing empathy for Jean and hoping that justice would be served, Loesch’s disciplined adherence to the NRA’s bottom line stands out.

Loesch’s reaction is an example of what one might call the “Rice rule,” after Tamir Rice, the 12-year old killed by a white police officer while playing in a park with a toy gun: There are no circumstances in which the responsibility for a police shooting of an unarmed black person cannot be placed on the victim.

At the same time, scolding dead people for being unarmed is standard procedure for the NRA, which attacked Clementa Pinckney, the pastor of Mother Emanuel AME Church, where nine parishioners were massacred by the white supremacist Dylann Roof, for supporting gun control. The group similarly suggested that shootings at Planned Parenthood; at Umpqua Community College in Oregon; in Fresno, California; and at the Capital Gazette in Maryland were so deadly because the victims weren’t armed. The NRA even faulted James Shaw Jr., who prevented a mass shooting at a Waffle House by tackling the shooter, for not being armed while he did it. Ted Nugent, the closest thing the NRA has to a celebrity spokesperson, once called mass-shooting victims “losers” who “get cut down by murderous maniacs like blind sheep to slaughter.”

But the NRA’s conspicuous lack of outrage after the shootings of Philando Castile, Jason Washington, and Alton Sterling, all black men killed by police while in possession of a firearm, suggests an impossible double standard. When armed black men are shot by the police, the NRA says nothing about the rights of gun owners; when unarmed black men are shot, its spokesperson says they should have been armed. To this day, Loesch defends Castile’s shooting as justified—despite the fact that Castile informed the officer he was carrying a firearm. In Washington’s case, Loesch said she was “never going to keyboard quarterback what police are doing.”

There’s also a catch-22 here: If Jean had been armed, Guyger would have a much more plausible defense. If innocent unarmed black men like Jean are shot, it’s because they lack firearms; if innocent black men who are armed like Castile or Sterling are shot, it’s because they had a gun. Heads, you’re dead; tails, you’re also dead.

Yet the NRA did release an ad siding with President Donald Trump against the NFL players protesting police violence. One might ask why the NRA waded into the conflict over the NFL protests at all. The group has long urged citizens to arm themselves against the possibility of government tyranny, only to come down on the side of the state when it kills innocent people who are black. An additional irony is that, historically, the only American population to be forcibly deprived of its weapons was black Americans at the end of Reconstruction, disarmed by racist paramilitary groups.

In recent years, the NRA has made frequent forays into culture-war disputes that have little to do with gun rights per se. This week, its NRATV hosts attacked a children’s program featuring anthropomorphic trains for introducing a train from Kenya. Previously, they argued that undocumented children separated from their parents under the Trump administration are “better off,” complained that American men “are being turned into second-rate women,” described laws banning anti-gay discrimination as “slavery,” called for the imprisonment of people protesting Trump Cabinet officials, dismissed the Women’s March as “anti-American,” and attacked the media for being insufficiently pro-Trump. None of this has anything to do with gun restrictions. So why is the NRA doing it?

The answer may have less to do with the defense of gun rights than the sale of firearms. As Josh Sugarmann, the executive director of the Violence Policy Center, told NPR, the NRA is “a de facto trade association masquerading as a shooting-sports foundation,” funneling millions of dollars each year to the group and its affiliates. Marketing violent fantasies to its members encourages them to buy firearms. According to the Pew Research Center, three in 10 Americans own a gun, while 29 percent of gun owners own five or more. This is the NRATV’s target demographic; given its demonization of Democrats and liberals, it’s clear the outlet is uninterested in the 20 percent of Democrats who own firearms.

The NRA has long nurtured the fantasy of revolutionary violence against a tyrannical government—in 1995 former President George H. W. Bush resigned from the organization after the NRA chief Wayne LaPierre called federal law-enforcement officials jack-booted thugs. During the Barack Obama–era, however, this sort of rhetoric went into overdrive, and gun sales skyrocketed as right-wing figures warned of a need for liberty-minded citizens to prepare themselves for armed struggle against the government. It’s no coincidence that this coincided with the election of America’s first black president. During Reconstruction, terrorist groups such as the White League promulgated hoaxes about armed blacks seeking to kill white men en masse and rape white women, in order to scare up recruitment and preemptively justify violence against their political rivals. The specter of “negro rule” proved a powerful motivator.

With Obama’s departure, the NRA lost its chief gun salesman. Since then, the NRA message machine has gone into overdrive, seizing on culture-war issues that can sell as many guns as having a black president once did. NRA representatives now compare liberals to the terrorist group isis, publish fiction warning that Syrian refugees would establish an isis branch in the United States, argue that “minorities” should be blamed for gun violence, and, in a startlingly on-the-nose echo of Reconstruction-era racist propaganda, warn that if Black Lives Matter isn’t stopped whites will face mass rape and murder like white people in South Africa. No wonder former Republican Representative Joe Scarborough observed in February that NRA messaging can “come close, pretty close to inciting violence.”

NRATV tells its viewers that they are under assault from liberals, black people, undocumented immigrants, and Muslims, and that they might one day need to kill them—in self defense, of course. Like the president, the NRA has correctly divined that fomenting and exploiting white people’s fears and hatreds is an effective sales strategy. If marketing murder fantasies is what it takes to move the product, then so be it. When the answer to any problem has to be “Buy more guns,” then absurd logic, such as holding dead people responsible for being shot by police in their own home, is inevitable.

WTF they search his apartment for? He is the victim. He was shot in his house in his drawls. WTF does weed have to do with the this entire scene. Last time I checked people "hopped up" on weed are extremely chill, not belligerent.

Did they check her for intoxicants? She is the one that killed someone in their home. Privilege/caucasity is always justified.

they still have to get "permission" to search the place where the crime was committed

what is ABNORMAL is the seemingly lack of follow up corroborating the cops story (like searching her house)

she literally could be an obsessive stalker with a shrine built to this guy where she keeps pieces of his hair

or she could be running a meth lab out of her apartment and tweeked out

just saying to take this cops word is ridiculous but... par for the course (i hope we atleast find out after the fact that this isnt the case but im not holding my breath)

when the story came out i didnt think there was enough information to make a conclusion. as more details come out it really does seem this was premeditated.

i always thought her shooting him was wrong and inexcusable but i could see how she made the mistake of the wrong apartment. i now think its unlikely she accidentally went to the wrong apartment.

her changing story contributes to this. the details of the apartment door contribute to this. her "accidentally" getting off on the 4th floor instead of 3rd is also unlikely. it would make more sense to get off earlier on accident.

Maybe I'm hoping for the best intentions here, and she was really drunk and fucked up. Not excusing her, because that is still worse that driving over someone while DUI (for example). She intentionally shot him. It's her responsibility to remain sober, aware and in-control while carrying a firearm.

Of course, this is assuming it's a mistake. Part of me thinks this was a sloppy-ass drunk hit because she was pissed at dude for some reason, had a few shots and was like "fuck that... I'm a cop"

If her tests come back clean then she should probably be charged with murder, IMHO.

was playing his music too loud for her (turns out she had made noise complaints about him before). Off that liquid courage, she goes upstairs to confront him in uniform (to intimidate him). She ends up shooting him.

Only fact that doesn't fit this fact patternly neatly is she shot him from across the room. That is he was deep in his apartment and this wasn't a confrontation at the door.

I think he let her in his apartment (which I doubt you would do for a noise complaint).

So, unless his door was broken...or a door stop is at evidence...ajar couldn't be correct.

Also, supposedly she had made a few noise complaints about him as he lived right above her.

Motive established.

https://www.dailymail.co.uk/news/article-6161483/Video-contradicts-story-white-Dallas-cop-killed-black-neighbor.html

But video obtained exclusively by DailyMail.com with the aid of a neighbor living on the same floor shows that the doors in the Dallas apartment building are uniformly heavy metal fire doors that automatically slam shut if let go.

A door could only be left ajar if it had been deliberately positioned that way with a door stopper.

Further, as a second DailyMail.com video shows, officer Amber Guyger could not have used her key to force open the door of Botham Jean, whose funeral was held today, despite claiming to have done so in her statement to Texas Rangers.

At the very least she would have been warned that she was at the wrong door because the unique electronically coded keys used in the South Side Flats building flash red if inserted in the wrong door.

i dont get why the lawyer for the shooting victim...in the immediate aftermath and while the case is still developing...says 'lets take the energy/outrage and turn this into a protest of the local nfl team and its owner'. why focus on something/someone that is loosely associated with incident (at best)? why not keep your sights (and the attention of the public) on the officer, the 2 law enforcement entities, etc?

This is about Jones stance on the whole kneeling issue. Jones is a surrogate for folks on this "kneeling is about the flag" nonsense. That being the case, if you want to send a message to the people who feel that way...send the message to the surrogate.

What does Jerry Jones have to do with my case? Why is this who MY LAWYER is appealing to for justice? What is the desired outcome? That Dallas Cowboys can kneel? So what? I got shot in my home by police. Go march around the precinct.

Don't be obtuse. It is possible to move in both the judicial courts and the "court of public opinion". The latter is where protests operate, so what is the problem with a lawyer operating in the public opinion sphere as well? There is no problem. In fact, I would say its admirable that they are attempting to reestablish the real reason for the NFL protests (and no, it's not so that players can kneel). I see the protest as an attempt to get the NFL protesters their platform back (because, Jones et al have made it about the flag...and not the deaths by LEO).

I got shot in
>my home by police. Go march around the precinct.
Why march around the precinct when AT&T Stadium is right down the street?

I mean, those folks aren’t changing their mine regardless but a lot of people are using this as an example of why they kneel

But you are right. On a Steeler site someone said it was tinfoil hat to suggest Eric Reid isn’t in a team because of his stance on kneeling.

I do think it's an interesting way to get media attention.

I think people forget that protests are suppose to be inconvenient and make people uncomfortable.

Not that difficult to figure out...awareness

Reminds me of the Eric Garner die ins

People are dismissive until you interrupt their daily lives

when those protests blocked traffic, and the die ins were staged at the Staples center, etc...

then people started to become aware

You know another reason her story doesn't add up.

Read the excerpt below. They would have us believe that she shot the she administered CPR to the person who she believed broke into her home and ONLY realized she was in the wrong apartment when the operator asked for her address? Who risks their life to give CPR to a burgler in their home? How long does it take to realize you are not in your own apartment?

https://www.cnn.com/2018/11/30/us/dallas-police-officer-botham-jean/index.html

The door was slightly ajar as she tried to use her key, which has an electronic chip. When she opened the door, she saw the interior was almost completely dark, according to the affidavit. She described seeing a large silhouette and, believing there was an intruder in her apartment, drew her firearm.

Amber Guyger is charged with killing Botham Shem Jean on September 6.

She issued verbal commands, but Jean, being in his own home, did not heed them, and Guyger fired two shots, hitting him once in the torso, the affidavit said.

Guyger, a four-year veteran, then entered the apartment, called 911 and started administering first aid to Jean. She turned on the lights while on the phone with 911, and only when asked for her address did she realize she was in the wrong apartment, she told police.

She's testifying right now.

From what I understand, if the defense can convince the jury (beyond a reasonable doubt) that she mistakenly entered the apartment and viewed Botham John as a threat, then they have to find her not guilty of murder.

Manslaughter requires that she caused his death through reckless behavior. She didn't. She shot him on purpose. So manslaughter is out.

So sadly, I think she goes home scot free.

There still seems to be discrepency in her story regarding the CPR, 911 Call and realizing that she was in the wrong apartment.

If she called anyone before calling 911, that should be the end of her from a Jury perspective.

https://dfw.cbslocal.com/2019/09/27/accused-former-dallas-police-officer-amber-guyger-takes-the-stand/

DALLAS (CBSDFW.COM) – The former Dallas police officer accused of shooting and killing her neighbor, Botham Jean, in his own apartment last year is testifying today.

It was just before 9:00 a.m. when Amber Guyger took the stand to speak in her own defense.

The 31-year-old began by testifying about her family and upbringing in Arlington. She said she was about 6-years-old when she decided she wanted to be a police officer.

When asked why she chose that profession she said, “I just wanted to help people and that was the one career I thought I could help people in.”

She continued testifying about applying to the Dallas Police Academy and going through training. During that time she said she was taught that when confronting suspects to shout the order “let me see your hands, let me see your hands”.

Guyger testified about being accepted on the Crime Reduction Team (CRT) in January of 2017 and meeting Senior Cpl. Martin Rivera, the man she would later have a sexual relationship with.

Rivera was the man she was sexting and calling in the minutes before shooting 26-year-old Jean.

She said she didn’t want anyone to know about the relationship because, “I was embarrassed because he was married.”

Guyger testified that during their nearly yearlong relationship she and Rivera often sexted and sent sexually explicit photographs to each other. While she testified that she ended the relationship because, “I knew it was morally wrong. I didn’t want to hurt anybody and I knew it wasn’t going to go anywhere,” she admitted that their sexual flirtations continued.

The former officer moved from Uptown to the Southside Flats apartments in July 2018. She said at the time her Dallas police schedule was Monday through Friday from 8:00 a.m. until 4:00 p.m., but that it wasn’t unusual to work overtime.

She talked about receiving several texts from Rivera the night of the shooting and receiving a sexually suggestive photograph from him before leaving the police substation. She said he actually called her as she drove home.

Guyger said she believed she went to the 3rd floor of the Southside Flats parking garage to park her truck and she continued speaking on the phone with Rivera for “a few minutes” after parking.

She said at the time, “I kept thinking I got so lucky to park somewhere close where I didn’t have to carry all my equipment around or far.”

Said she got out of the truck, carrying her police equipment, entered the building and proceeded down a hallway that wasn’t marked. She said, “I was just ready to go home.”

Guyger began to cry just as her attorney began questioning her about getting to what she said she thought was her apartment door.

(credit: CBSDFW.COM)

Attorney Toby Shook had just asked Guyger to step down from the stand to demonstrate how she carried her police equipment to the door when another one of her attorneys to ask the judge if they could break so she could gather herself. Sobbing, Guyger said, “No keep going. I want to tell my side.”

Despite her urging Judge Tammy Kemp retired the jury and announced that the court would take a 10 minute break.

After being in recess for nearly half an hour court resumed and Guyger began to reenact what she had in her hands and how she entered what we now know was Jean’s apartment. She said as she started to insert her key into the lock she saw that the door was “cracked open” and that she heard movement inside.

This time she said when she put the key fob into the lock, the force pushed the cracked door open. She said she was “scared to death” because she thought someone was inside her apartment. She said as the door opened she “wanted to find the threat.”

Once the door fully opened she said, “That’s whenever, directly in the middle towards the window, is when I saw this silhouette figure standing back there.”

When she saw the silhouette she said, “That’s whenever I pulled my gun out and I yelled at him ‘Let me see your hands! Let me see your hands!’” She said she was concerned because the figure was still moving around and she couldn’t see his hands.

Guyger said once she yelled the command the figure “started coming towards me”. When asked what was going through her mind when she saw Jean moving toward her she said, “I thought that he was coming at me and since I couldn’t see his hands he was gonna kill me.”

It was then that she said Jean began “yelling ‘hey, hey, hey’ in an aggressive voice.” She said as Jean moved towards her “And that’s at that point whenever I shot.”

After she fired the shots she said, “I walked fully inside the apartment. I still had my gun outside, since I didn’t even… at that point I didn’t know if it wasn’t if he was armed. It wasn’t ‘till that point when I got to the counter area when everything started realizing that I wasn’t even… this wasn’t my apartment.”

She testified that she hadn’t noticed her surroundings before because until then she had her full attention “On the threat. On the person that I thought was inside my apartment.”

“It started hitting me that this guy I have no idea who he is and that’s when everything just, it started to spin. I was confused and that‘s when I dialed 911.”

Guyger said she started doing chest compressions with her left hand but that she didn’t perform the lifesaving effort very long because the dispatcher asked her where she was and since she didn’t know she had to leave the apartment to find out.

Said she after returning to Jean’s side she performed a sternum rub to try and revive him. “I wanted him to keep breathing. There wasn’t… the state he was in I knew it wasn’t good.”

When asked why she fired her weapon Guyger began to cry again and said, “I was scared whoever was inside my apartment was gonna kill me and I’m sorry. I have to live with that every single day that I hurt…”

While there were bandages and other first aid items in her items Guyger said she didn’t use them because she was “panicked”.

The defense then turned the case over to the prosecution who began questioning Guyger’s true concern for Jean and her actions after the shooting.

Prosecutors again played video from inside a police squad car that showed Guyger standing outside talking with officers about whether or not to continue her body cam recording and sending text messages on her phone.

Prosecutor Jason Hermus also pointed out that Guyger got into the squad car and closed the door when the body of Jean was brought out and loaded into an ambulance. She said, “I looked at my phone because I didn’t want to see his body.”

Hermus questioned Guyger’s testimony about deleting text messages from her phone because she was ashamed of her relationship with Martin Rivera. In response to questioning Guyger admitted that two days after killing Jean she again starting sending flirtatious and sexually oriented messages to Rivera talking about getting drunk.

The prosecution then turned their attention to the 911 call placed by Guyger. Attorneys told the jury that the call lasted about 5 minutes and during that time Guyger repeated “I thought it was my apartment” nearly two dozen times, but never made any mention of Jean moving toward her.

Hermus: “You didn’t express one time that you shot him because he was coming at you.”
Guyger: “I did not over the phone.”
Hermus: You did not express one time that he was armed.”
Guyger: “I did not.”
Hermus: “You didn’t say one time that he put you in fear.”
Guyger: “I did not.”

Prosecutors then went into detail how Guyger never told others officers arriving at the scene that she felt Jean had a weapon.

The topic of CPR training was then addressed. Hermus questioned, “You were trained to do CPR in the academy were you not? Guyger said, “We were trained. I’ve never done it on an actual person.” When asked if she properly performed CPR on Jean she said, “No. I did not.”

Guyger further testified, “I tried to do a little CPR.” In response Hermusquestioned, “Why would you try and do ‘a little CPR’ on a man who is dying and needs your full attention?” She responded, “Because I had to keep getting up to see where I was at.”

When questiones that, “You must have stopped completely giving him CPR when you sent a message to Martin Rivera saying ‘I need you hurry…,’ right?” Guyger said, ““I did texted him that.”

Going back to what she saw when she opened the apartment door prosecutors asked about bright lights from the hallway partially illuminating the apartment and then questioned how Guyger could have shot twice at Jean as he was allegedly approaching and have one bullet end up “over in the right most corner of the apartment, over there, if this is where he’s standing?” She said, “That I cannot explain.”

Hermus: “When you shot at Mr. Jean you knew you were using deadly force against him?”
Guyger: “Yes.”
Hermus: You know what a bullet can do, don’t you?”
Guyger: “Yes I do.”
Hermus: “And when you shot at him twice you intended to kill him?”
Guyger: “Yes sir.”

As to Guyger shouting “Let me see your hands” prosecutors referred to testimony from the apartment residents who lived closest to Jean’s unit who said they never heard her yell the command.

Going back to the topic of training prosecutors questioned why Guyger entered the apartment if she felt threatened since police training dictates that “for your safety you should have taken a position of cover and concealment and got help.”

“Yes I did go in,” she said.

The topic then returned to Guyger’s interaction with Sgt. Rivera and the more than 16 minute conversation she had with him just before the shooting. Prosecutors intimated that Rivera was sending texts asking “Are you still there?” and that she responded “I’m just leaving” because the two were making plans to see each other that night, an assertion Guyger denied several times.

Referring to past claims that Guyger was tired after work, prosecutors focused on the fact that her plan for the evening was to go home, change clothes and head to the gym to workout. She testified, “No, I wasn’t completely drained. I just wanted to go workout.”

Prosecutors pointed out to jurors that Guyger had more than 3,215 hours of training, including attending de-escalation training in April.

The former Dallas police officer was then asked why she didn’t use an unopened package of “combat gauze” and other first aid tools in her police backpack, which were next to her at the time, to stop heavily bleeding after shooting Botham Jean. “It never crossed my mind,” she replied.

On redirect defense attorneys again asked Guyger what her state of mind was that night. Fighting back tears she said, “I was calm. I was relaxed.”

“I was thinking I was relaxed right before and all of a sudden I come home and then there’s somebody’s inside my apartment. My heart rate just shot up,” she said.

believe she decided to kill this dude for no reason or even because he was playing music too loud or was an ex-lover, etc.

I was expecting to find out she had been drinking. Turns out not to be the case.

If they were smashing I think they would have found evidence of that. They found texts she tried to delete with a lover and they were with her boss, not Jean.

If it was a noise complaint gone wrong, I think there would have been more of an argument heard by neighbors. Neighbors heard a very brief exchange.

What I do believe was that she exhibited a callous disregard for a black life. If she stumbled into a white girls apartment I have no doubt she would have hesitated before shooting. I also think she didn't do everything in her power to save this persons life. I think she was too busy trying to protect herself.

I think at the very least she is guilty of manslaughter. I think she was reckless and callous to a persons life at the very least.

One of the major problems in our society is that we hold cops to a lower legal standard and it should be the opposite. So when they violate the law or someones civil/legal rights, they should be penalized more harshly.

She's been highly trained and is government paid to serve and protect. When you bypass all the things you've been trained to do in an effort to murder someone because you're startled, you don't deserve leniency.

I think about it the way I would have handled it. If I walked into an apartment complex and when I entered, someone was in my space, especially if the door was already open...I would immediately back up, look at the floor or look around to see if I notice anything that's 'mine'. It's an apartment complex and if I hadn't been completely focused, I would have had the common sense to realize I could have wandered into someone's space unaware. I would have then apologized to my neighbor and went to the correct floor.

At worst, if I was REALLY scared that someone was in my apartment, I would back out of the apartment, close the door, call for back up and draw my weapon and wait. It's an apartment complex. Only one door out or they jumping out of a window. Had this been done, eventually, it would have been discovered that I was on the wrong floor and though embarrassing, nobody dies.

If this were a stand alone house, I could see her concern. In an apartment complex, she made a grave mistake by not using her training or logic and it costed a young man his life. Hers should be ruined just the same.

15yrs.

And I laugh at how they say things like:

When asked why she fired her weapon Guyger began to cry again and said, “I was scared whoever was inside my apartment was gonna kill me and I’m sorry. I have to live with that every single day that I hurt…”

But then go to court and plead not guilty. I would have already negotiated for a manslaughter charge if I really felt guilty about it. But no...she's a cop and thinks she will get off.

2 days later sexting the married guy at that. Yeah, she doesn't think she'll face any consequences for her actions.

Good.

To everyone in here that said it either didn’t make sense or there was more to the story, I think you are over-thinking this. A person that is conditioned to be afraid of black people but handed a murder weapon to carry on their hip made one mistake (entering wrong apartment) then one pre-conditioned reaction (shoot black man). Imagine if she didn’t have her gun? Oh, the laughs they would still be having over that night. Instead...

Her mistake was super epic though so for me it's hard to believe that someone who messes up that badly has no prior history of mess ups

A police officer who is totally unfamiliar with her neighbors also is just a huge red flag

The strong effort to enter the wrong apartment without any recognition at any point that it may be the wrong place?

The phone call to a romantic partner

If it's just a case of a borderline psycho then that PD is in woeful condition

If I didn't know any better I'd say it was a hit, because it looks a lot like one

Policing has its roots in taking the lives of a certain group of people though so the more things change I guess the more they stay the same

Prosecutors now plan to introduce Amber Guyger’s DPD personnel file against her during punishment phase of her murder trial. She had been involved in a police shooting, disciplined for adverse conduct, cited for a chase policy violation and others during her 5 year career

prosecution was submitting some of that info, like the memes which weren't allowed during the trial.

I feel like this shit was a setup all along. They new they had to give her something so folks wouldn’t tear Dallas up. So roll out the black judge, black bailiff, black Texas ranger, give the bullshit ass murder conviction for which the sentence could be 5-99 years. Give her 10 in protective custody.

Amber Guyger’s Racist, Violent Text Messages Revealed During Sentencing Hearing
https://www.essence.com/news/amber-guygers-racist-text-messages/
BY KIRSTEN WEST SAVALI · OCTOBER 2, 2019
Amber Guyger, 31, the ex-Dallas police officer found guilty on Tuesday of murdering 26-year-old Botham Jean after breaking into his apartment—allegedly mistaking it as her own—previously joked in a text message about the assassination of Dr. Martin Luther King Jr. and, in another text to a friend, admitted that she was racist.

In a text message exchange dated Sept. 4, 2018, two days before she murdered Jean, a friend told Guyger that she should adopt a german shepherd, “although she may be racist,” the dog’s owner said.

Guyger responded, “It’s ok, I’m the same.”

Guyger followed that admission with another one, “I hate everything and everyone, but y’all.”

More controversial and racially charged text messages Amber Guyger preciously exchanged with fellow Dallas Police officers that are now being presented as evidence against her during punishment phase of her murder trial

In a March 9, 2018, exchange, Martin Rivera, Guyger’s married police partner, with whom she’d had an affair—and the man she was sexting minutes before murdering Jean, Rivera said, “damn I was at this area with 5 different black officers. Not racist but damn”.

Guyger responded, “Not racist but just have a different way of working and it shows”.

During a January 15, 2018 text message exchange, during the Martin Luther King Jr. parade in Dallas, someone texted Guyger, “When does this end lol.”

To which Jean’s killer responded, “When MLK is dead… oh wait…”

When discussing the crowd at the parade, Guyger said, “Just push them… or spray your pepper spray in that general area.”

Text exchange while Amber Guyger was working the MLK parade...

Friend asks: "When does this end?"

Defendant responds "When MLK is dead... Oh wait."

Damn. That's some racist shit right there.

Guyger also had a habit of liking violent Pinterest posts, including one that reads, “I wear all black to remind you not to mess with me, because I’m already dressed for your funeral.”

The state also showed the jury a Pinterest post saved on Guyger’s account.

The post reads: “I wear all black to remind you not to mess with me, because I’m already dressed for your funeral.”

Guyger commented beneath that post, “yah i got meh a gun a shovel an gloves if i were u back da f**k up”.

Guyger saved another image showing a military sniper with text that reads: “Stay low, go fast; kill first, die last; one shot, one kill; no luck, all skill.”

Under a post of a Minion character from Despicable Me, with the text, “No one ever thanks me for having the patience not to kill them,” Guyger commented, “People are so ungrateful.”

According to WFAA, Guyger’s attorneys objected to the prosecution showing jurors the texts and online posts, arguing that they would unfairly sway the jury while they consider her sentence.”

The judge ruled that the evidence was admissible after review.

As ESSENCE previously reported, on the night that Guyger murdered Botham Jean, she claimed that she was so exhausted after working a 14-hour day that she parked on the 4th floor of the South Side Flats apartment building, instead of the 3rd floor.

Consequently, Guyger claims that she walked down the wrong hallway and mistakenly entered apartment number 1478–Botham Jean’s apartment, instead of her apartment 1378—and killed him because she perceived him as a dangerous threat.

Guyger, who was fired after she killed Jean, cried during her trial testimony, claiming that she wished it was Jean who had a weapon and not her.

America has imported more warlord theocracy from Afghanistan than it has exported democracy.

It's something in the water over there that breeds coons. Why are they are they cooning it up like this?

His brother forgave Amber on the stand and hoped she didn't go to jail over this.

Miss me with the tough talk outside the courtroom after all that cooning going on inside it.

Amber Guyger didn't mean to kill Botham Jean, she meant to kill Joshua Brown, a known drug dealer, Police confiscated 12 pounds of marijuana, 149 grams of THC cartridges and more than $4,000 in cash, who had been previously shot in November 2018 shooting, at a Dallas strip club last year which left Brown wounded and killed Nicholas Shaquan Diggs.

Here is what makes sense. Amber was known to be making plans to party that night. She knew a guy in her building was a drug dealer. Maybe she bought from him before. She goes to buy from him but she knocks on the wrong door and gets Botham. Things go left quickly and she shots him.

If she tells the truth why she was on that floor she goes to jail for a very long time. So does the Drug Dealer. Amber and the drug dealer don't even have to conspire. Brown may have heard something or not. But he knows he should back her story.

Or maybe not. But it makes more sense than Amber mistakenly shooting Botham Jean because she thought she was in her apartment.

But what about the people in custody. 3 PEOPLE!! That's a lot to neatly wrap up.

I had not heard of that dude until he got shot. He wasn't that visible.

Cause he had been out of work for a minute cause of the trial.

Brown showed up to testify.

Hard to verify tho because it doesn’t show the defendant.

As far as 3 suspects. It’s not hard to round up 3 felons and put a murder on them. If video and physical evidence support it I might believe it’s true.

Why would anyone believe cops tho.

I've been telling people in other convos its really heard to know what's going on in local stories judging from a far.

I've seen Shaun King play himself by ringing the alarm without knowing all the facts.

It seems like doing a lot to kill a witness AFTER a trial.

But sticking to my own rule, I am just going to chalk it up to we don't know what's going on down there.

+ as mentioned above, if he was a 'known' drug dealer...even if we're going with the above conspiracy theory of the defendant knowing that

...the prosecution would use all of that information to discredit the witness...

+2, how do you get shot in the mouth in a shootout?

+3, who TF drives from Louisiana to Dallas to buy weight

c'mon...this some bullshit IMO.

Show me any nigga who hustlin that would take the witness stand
AGAINST a COP ... I'll wait

The Prosecution would be aware of the fact their star witness is
hustlin and not put him on the stand because he's not credible

The Defense would have destroyed this dude because I'm sure they
did their research on Fam trying to find an angle to invalidate
his testimony

I can't go along with this. Anything that any COP says should
be scrutinized. Especially in this case ... Don't fall for the
Okey Doke

-The Knicks’ coaching search still includes a lone frontrunner, Kurt Rambis, whose qualifications for the position include a strong relationship with Jackson and a willingness to take the job.

We know we don't know the whole story and I am only going to ride so hard on the idea of no way will a person do a dumb thing.

I can't go out on a limb with any certainty of what's going on down there. I'll wait until someone tells the whole story.

and who folks just going along with this
...

So they kill ol boy and leave all the work,
thats 12lbs, 149 vape catridges and 4k in cash ...

So they drove all the way from Louisiana to catch a body
and left all the work.

Also they're saying that 2 of 3 suspects are caught and the
one at large is the one who has the murder weapon and the
supposed weapon that ol boy used to fire on them first.

Why would you take the gun of the guy who just shot you after
you fired back and killed him but you won't take the work ???

"Open and shut case Johnson, sprinkle some crack on em and lets get outta here"

What dude drives 4 hours, gets shot and gives up all the names and admits he was at a drug deal gone wrong?

What drug dealer you know has all that shit in his apartment and has no partner or crew to clean his shit up?

He is some lone dealer with all that work and these dudes just drive off WITH his gun and nothing else.

And more over how you know what dude was questioned about when he was on the stand? You out here reading court transcripts and motions to suppress?

Here's his testimony if you really want to watch it

https://www.youtube.com/watch?v=RCKJRfeFD60

I only watched the first couple of minutes...which was in regards to his character, criminal convictions, etc...

I would assume if a witness was a known drug dealer, it would have come up in that line of questioning

Here's an interview with his lawyer, who states he thought an attempt on his life was made in 2018

https://www.cnn.com/videos/politics/2019/10/07/joshua-brown-attorney-intv-cooper-acfc-vpx.cnn

...carry on...
