"Uh-oh, Childish Gambino accused of biting This Is America"

https://pitchfork.com/news/childish-gambino-collaborator-denies-this-is-america-plagiarism-allegations/

One of Donald Glover’s creative partners has denied claims that Glover “stole” the music for his No. 1 single “This Is America” from a March 2016 song called “American Pharaoh” by New York rapper Jase Harley. Fam Rothstein is a co-principal of the creative agency Wolf + Rothstein (which is comprised of himself, Donald Glover, and Wolf Taylor), and he also co-produced the music video for “This Is America.”

This morning, in response to a user who claimed that Glover “stole the song,” Rothstein tweeted: “The internet is a place of no consequences. I hate that Toronto Akademiks/every white blogger can say something as gospel and y’all take it. This song is 3 yrs old, and we have Pro Tools files to prove it.” Find his tweet below.

https://twitter.com/famlikefamily/status/1011244111754506240

Allegations of plagiarism against Glover surfaced on Reddit this past weekend, with Redditors citing comments on Jase Harley’s Instagram. Someone wrote to Harley, “People are saying Donald Glover bit your song ‘American Pharoah’ with ‘This Is America.’ What do you think?” Harley responded, “I always felt my song inspired it lol from the first time I heard it.”

Harley added, “It’s cool tho.... Glad they liked my song. It’s all love.” He also wrote that “a shout out would be cool,” that it’s “dope could’ve had some influence on the record,” and that “all artist get inspired by others.” Find Harley’s Instagram post below.

but ya know what....I know what I am about to say is insensitive as fuck and do think Donald should 100% give it up to dude

that said

Donald's final product is not even on the same planet as far as final polish and execution. The original track all feels like a reference track or a sketch in comparison.

Give that dude a producing credit and a check.

But isn't this is America sort of a parody of trap music?

I don't think there is anything copyrightable that was taken, but then I thought the same for blur lines.

If they heard it, they should offer a credit and some dough.

I don't grant the genius label lightly tho.

I've seen people say he's genius for the reason that he does multiple things well, whereas I just call that multi-talented. Genius is another level imo.

This shit sounds like a straight jack, flow wise, down to the inflection on certain words. just changed the lyrics around and the beat.

Oh.. I'll read this as a correction, b/c your subject line said sampling, but the body seemed to use inspiration as its synonym. No need to be mad at me for catching it.

Either they're in denial or suddenly they find artistic thievery ok, b/c "everybody steals" or "no idea is original" or whatever variation of that is used as an excuse to be a bandit who sits around waiting on actually creative people to come up with ideas that they can steal.

- did an increased reliance on tech make music more accessible and, in turn, more "biteable" ?

or

- did acts always bite and, because we didn't rely on technology as much, we were easily kept in the dark?

musical acts came out of local live plating scenes so if you blatantly stole that other bands riff others in the scene could vouch for the victims and check the perps

118. "I mean, songwriting of the 1900s has some pretty distinct eras"
In response to Reply # 78

The Songbook era, the Hit Factory era and the Singer/Songwriter era (there's a reason such an obvious idea became an entire genre to some people) and now we kind of just do all of it.

But "he/she writes their own songs" is such a post-60s idea, the more I came to terms with that the less I cared about whether Dr. Dre wrote his own raps, or whether The Beatles covered Motown songs, at least in terms of artistic relativism.

In their specific case, I give them a little credit for being one (long) step removed from the situation going on in the States at the time. And once they were a national act, they quickly dropped the covers. It's pretty clear they were just doing what every other British band from small fishing towns hoping to make it big on the BBC was doing, and that's covering the soul acts across the sea.

I mean, I get jacking a style

but I get lost in the question when I think about Jazz and jazz standards or when jazz artists reference riff's and melodies from other songs and other jazz musicians.

then again, jazz has the concept of "jazz standards" which allows for this sort of stuff to happen to a point

In response to Reply # 83

Copyright law is based on this notion that artist create spontaneously and sui generis-ly whereas I think art has always been abotu "remix-ing" and transforming pre-existing work.

The greatest artist are always great historians and are much better at masking their influences and borrowing many little bits from a variety of places. Terrible artist are artist who don't have a lot of different sources and do very little to tranform the work that influences their work and end up creating derivative.

I think it gets easier to see that art works this way the older you get because while you were a kid everything seemed knew. You'd hear hip-hop songs and not even know it was a sample of a disco record. Been around long enough and you see trends come in and go out of style and it gets easier to see where artist borrowed from.

In response to Reply # 89

I doubt dude has any parts of that.

Yet, that's what he creates a show about. Could've been about in infinite number of other topics, but yet it's the streets, drugs, guns and rappers.

Then makes a song/video (that seems to me) criticizing the very culture he profits off.

I always thought the show was about his roots as a southerner - even in his early standup he was coming off a lot more country than how he sounds now. The streets, guns and rappers angle I would argue is less about him walking in unfamiliar territory and more about the life of underdogs and showing various aspects of blackness.

then with the video I took it more as top level criticism of American culture, the value of life, our media attention span, consumerism and the spectacle (crit theory) while including the above mentioned things as layers of meaning but not the actual subject matter in itself.

Same Black American he portrayed dancing in the video was the one that did all of the shooting and killing.

in his case it's not just that he's too poppin but also because he pivoted from being thought of as a cornball brother to now being loved because of his blackity black show and a funk homage album.
