Playground gang rape has NYPD asking public for help

Story highlights
5 men forced father to leave playground so they could rape his 18-year-old daughter, police say
NYPD releases video of the suspects in a bodega, asks public's help in identifying them
New York (CNN)New York police are looking for five men who forced a father at gunpoint to leave his daughter behind so they could take turns raping her, according to a press release.

The 18-year-old was with her father at the Osborn Playground in Brooklyn around 9 p.m. Thursday when they were approached by five men, according to the release from the New York Police Department.

One of the men pulled a gun on the father and daughter and demanded that the father leave the area, the press release said.

Then each of the five suspects raped the teenager, according to the NYPD.

"The father returned a short time later with two uniformed police officers," the press release said. The suspects then quickly fled the park and evaded police capture.

The men are suspected to range in age from teenage to 30s, according to NYPD spokeswoman Arlene Muniz.

Authorities on Saturday released a video, taken in a bodega before the rape, that they say shows the five attackers. Police are seeking the public's assistance in identifying the suspects.

The victim was taken to a nearby hospital where she was treated and released, according to the press release.

She sustained cuts to her arms, neck and knees during the assault, Muniz said.

If you wanna kill her, kill me first.

If you wanna threaten her, you threatening me.

Either way what I'm not doing is leaving her...at least not outside a body bag

I was told that's tantamount to blaming her father for her rape so I fell back but no.

We both gonna get raped, we both gonna get shot whatever is going down is happening to both of us or neither of us, but be damned if I'm leaving her

But there is damage either way. Chances could have been they would have shot him and still raped her. So at least he can be there to help her heal, if she will forgive him.

Damage done tho. What scumbags.

In response to Reply # 0

like okay he was scared for his life and left his daughter there. I wouldnt. But he should have had cops there within minutes right? But there was enough time for all 5 of them to have a go. Am I under estimating the time it takes for the cops to show or for how it takes to rape someone? I assume the former takes much much longer than the latter.

you might as well pack up and leave if you willfully not letting someone use your phone in some emergency type of situation. This is the part of the whole thing that makes me really look at the dad sideways.

like maybe 40,50,60% of me dads would leave idk.

But i can't see 5% of dads not being able to get the bodega dudes phone or to have the bodega guy call himself.

match up with what's best for the overall situation.

The "honorable" thing is from him to catch the L defending her, then they rape her anyway. Unfortunately, it kind of looks like she was going to raped either way, which is a really harsh and ugly thing to state outright, but appears undeniable to me.

if a shot was fired. Sticking around to assault the girl would be the least likely thing to happen had that been the outcome. It's a lose lose though regardless. Someone is going to lose their life or their life as they knew it.

There just isn't anything noble in that I guess and at the very least fighting to protect your own win or lose is something worth fighting and dying for and yeah we all say that, but I think for a lot of us we mean it too.

That this man couldn't find it in himself to put his life on the line for his own kid(s) is all the more bothersome and to think how he must be feeling -- this whole thing is just awful.

how I would have reacted in that situation, especially considering that we do not have all the details. Not to mention that this is not a situation most people would find themselves in. That being said, absent any further info incriminating him, I can at least see the rationale for his decision.

The 20 minutes to find the cops (apparently the bodega owner wouldn't let him call).

I don't doubt some fucked up shit happened at all, but something doesn't add up, and I hope the 'pops' isn't more involved then he is letting on.

This is HUGE NYC news because while most crimes in Brownsville get ignored by the press(teen shootings, your avg rapes) ; this was front page in the times. So we will get clarity one way or another.

but my point was that there aren't too many ethnic groups that have been displaced from their ancestral lands multiple times and at the same time faced at least two attempts at extermination. Other groups that have had such scenarios have been wiped out, yet this one group still remains despite that.

The sound the gunshots would make would alert someone in the neighborhood. the father found cops on the block so its safe to assume they hear the shooting and come. I would actually scream to my daughter to run while I lunged at the guy with the gun. I may not make it, but its a better chance than having my daughter gang raped in a park. She will mourn me, but she will always know her father was there to protect her. And she would not have the emotional and physical scars of rape.

the ppl who committed the assault were kids. Not one of them was over the age of 17 (1-14. 2-15, and 1-17). Kids are stupid. maybe they thought the man wouldn't get help. they could have said "call the cops and we will kill her." who knows. but the story is still odd.

my dad wouldn't have left. he would have went down fighting and I would have been screaming and someone would have been alerted...even my mom wouldn't leave me. but let me say this, different cultures of people think differently in this situation. and most black men are of the cloth to fight for their children, so maybe they aren't american and don't have that type of nature in them.

None of us knows the exactly details of the circumstances so it's kind of full of shit to say "ain't no way I am leaving".

I mean imagine if it came down to, if I don't leave we are both dead. If I leave maybe I can get help and stop the whole thing. In that case you are opting for both of you dying to protect your honor?

No amount of data showing that going to get help minimises the harm suffered by all parties (given that fighting risks two deaths and what that does to those left behind) would matter it appears.

Just IMO though.

had a gun pointed at him because I've never been in that situation, there's NO way I could leave my daughter like that. Yeah, maybe they'd kill me. But there is a CHANCE that they were just threatening thinking dude would back down (and he did) but wouldn't actually want a murder charge on top of rape. There's also a big chance that they wouldn't kill me and just stay there and rape my daughter, so I could possible save her with my death.

I'd have to take those chances. There's no way I could live with myself after running away and having her go through that.

91. "Then you're dead if you stay to fight"
In response to Reply # 61

In what world are you overpowering 5 guys with gun(s)?

So now two people are dead, so also two witnesses, and all the loved ones left behind have two deaths to cope with rather than one.

I'm all for staying and fighting if the logic stacks up, but no-one in this thread is providing a good case for it one on five with gun(s). Right now the best chance of those guys getting theirs and minimising the daughter's potential harm is to get help.

Just IMO though.

I've promised my children that I would protect them in a time of danger. I would rather die trying to keep that promise than live leaving them in the situation to fend for themselves, thus breaking that promise.

Different strokes for different folks.

I ain't judging that man because I wasn't there. I just know that promise I made my own children. And I don't make many promises. At all.

You can't even occupy them long enough to escape. Trying to fight 5 armed men isn't about protecting your daughter, it's about your pride.

How do you know they weren't going to just execute her as soon as you left? You don't. You don't know shit. All you have is your instinct. And my instinct tells me to not leave my kids, my wife, or my mom.

If that ain't you, that ain't you.

But you ain't protecting or saving shit by running. No guarantee of anything.

Ain't no right or wrong answer here.

Ain't no win.

Make as much of a scene as you can and grab that gun. Once the Adrenaline kicks in those kids being able to multi task (deal with your aggression and simultaneously assault someone) becomes far less likely. If both parties resist it becomes even less. Fighting is the option with the best odds for the assault to not take place.

Half the Mugs in here don't know what to do if they get in a basic car accident. Still, this is the same kind of Horrible Mess that Slaves had to deal with then the Master took a gun, put it to their heads and made them leave so that he could rapped their wives.

Now, in my mind, I'd like to think that my inner super hero would shine and I would remember every Kung-Fu move I've ever seen, but this ain't Total Recall or the Matrix. So, I'll just speculate and say, "NO I wouldn't leave" and pray that things would play out like I'm assuming in my mind.

they've seen you shot in the head at point blank range right in front of them.

i can't second guess what this father did b/c both he and his child survived. so his act sounds pretty good to me. it worked.

i agree that i dunno what i'd do - but sitting here w/perfect hindsight vision i think i'd have focused on trying to get both of us out that shit alive. i'd have to put the rest out of my mind and focus on doing what is most likely to get us out of this alive. me staying there and getting shot is likely to get us both out of alive. me leaving and going to get help (police or otherwise) is more likely to result in both of us getting out alive. yeah they might kill her while i'm gone - they might kill her if i stay. w/perfect hindsight vision the 'me leaving' option seems best. so i'd take it - b/c then maybe i can save her. i couldn't save her by staying there w/a gun to my head.

fuck you.

If I leave and return with help there's at least a chance she lives. If I stay there's less of a chance that she lives. So it wouldve been nearly impossible for me to leave (bc I'm a parent and I wouldn't want to leave my child in peril) but I think it's the wise choice. I dunno that i could've done it but from here it seems like the wise choice.

Greater odds that they both live if he goes for help. Indeed - he went for help and they both lived. Each now has to live with wondering if he couldve prevented the rape if he stayed. But key part is both are alive. If he stays maybe he's now dead, she witnessed it and she got raped repeatedly.

Odds. Again - I'm posting here without having been in the situation. I doubt if I were in it that I could've left her to go get help. But it would be the wisest choice, imo.

Rapists are cowards to begin with and want an easy victim. Making things difficult for them is just as viable an approach. Folks who say let my child get raped -- okay that's an interesting choice, but I don't see where protecting the child comes into play with that angle.

Getting her out of there is top priority. "Having her sdee her dad shot in the head" Really... as traumatizing as that is, to know she was safe is my solace as a father. So gun to your head you would leave your child with 4-5 criminals? I am not speaking for that dad, I am speaking as one. No way in hell. Period. For me.

I really don't understand what the issue or debate or dialogue is. I would protect my child with my life. No more ifs ands or hypotheticals.

My instinct may be to fight first, but if you start weighing the options like in a kidnapping. You hope that your child is not harmed and that you will live.

But it's not as simple as acting like Rambo.

I can't reason that downm bro. I love my kid too much to be "logical". Its your kid. What's the point of fatherhood if protecting your child isn't paramount? I am actually struggling to see any other angle/side etc. Sorry.

And why does protecting your kid have to have an "inner hero"? be Rambo etc. Its your child...

All things considered the options are as follows:

I stay:

-She gets raped.
-I possibly get killed.
-I possibly get us both killed.
-We both wind up beaten and/or killed outright.

I may be able to put up enough of a fight to draw some attention and fend them off from the worst long enough to get some kind of help or give my daughter a chance to get away.

We may survive. Maybe. No guarantee.

I go:

-She gets raped.
-She may also get beaten and/or killed outright.

-I can return with help. Maybe in time to save her life. Maybe not. No guarantee.

NO chance of creating an opportunity for my daughter to get away.

Everything about this is a gamble that heavily favors the house and there’s no real way to quantify the odds.

I don’t think I could leave her alone in that situation. In the end my thinking would need to focus on saving her life though and that’s the real crux of this. That’s really the only point that any of us, as men, fathers who love our child and place their lives above our own, needs to consider, and neither option is attractive.

We’re in a bad way either way. I think I’d just try to stall, talk my way out, back away, and try to figure something out. In the end, if I was unable to find a way out I’d probably do my best to channel my inner Jason Bourne if there’s one guy with one gun and take my chances. Yep, inner super hero, Case. I’d look for him. I’d pray for him. I’d wish, hope, whatever, trying to make that guy a reality somehow, because you don’t just LET these guys rape your child. Five of them at that. So yeah, I think I’d try. I’ve successfully held my own several times while getting jumped in the past, even when they had weapons, and I’d take my chances.

Really, there’s one reason for that: because there’s no guarantee.
I’m playing the odds either way. If they let me just walk off, there’s no way they don’t expect me to return with cops so they have every motivation to do their evil business and kill her before I can get back to her. That didn’t happen in this case, thank god, but it was a gamble. I don’t know that I could bring myself to leave my child in that situation. I’d fight like hell to save her from any of that so that at a minimum, if things don’t work out, she doesn’t have to endure the added emotional burden of me leaving her to these animals.

They pull the gun out and tell you to leave, but you stay. There is a possibility that they don't REALLY want to kill someone and face a murder charge. Shooting you would draw attention to the scene because of the gunshot, and they wouldn't be able t stay there and rape your daughter.

Yeah there's plenty of ways it could go bad, but that's the one possible way that both the father and daughter get out of there unharmed.

They will likely kill the daughter as well rather than leave witnesses.

I guess he could try to evaluate the type of people he's dealing with and make a decision based off of that.
But I'm not going to criticize the man by choosing one action over the other. It's all a gamble.

unless them dudes have murdered before, they all aren't going to be okay with killing on the spot if that wasn't part of the plan. If the first dude hasn't ever killed or even shot someone before, there's a good chance he's in shock bc of his actions.

Again, no one knows for sure but i don't believe the assumption that they will kill others to eliminate witnesses. This ain't deniro in heat.

they had to have known dude would try to get help, call the cops, or something but in that time that he fled, they still took turns raping her. They weren't worried about him coming back with help...they didn't seem to care. But they weren't killing anyone...there was NO point to them letting him go especially since they knew he saw them. They probably didn't have any bullets. Or they ain't really have the heart. Fronting for each other.

Calling that bluff still entails a huge gamble. That's an oddly specific set of circumstances: A random group of men shows up and says we're going to rape her and you need to leave or we'll kill you.

It's too specific and too random to think they don't mean business on some level. So to me there's no "calling their bluff" in this scenario. There's no "you won't do this" call to make here.

It's doing your best to find a way, some angle, some crack of light to follow your way out unscathed because every angle presents a huge maybe.

Maybe you chance you luck that the guy isn't really about it, try to snatch it off him and get into a scuffle with the five guys while your daughter has a chance to get away with less fear of being shot during the escape.

Just IMO though.

I'm sure there are a lot of other details that we aren't aware of but that seems like questionable judgement from the start at best.

Where they homeless?

Where they hiding it from mom?

Was something else going on?

its one story to have a father and daughter walking through a park and a drunk bunch of kids address them and then let the father go while they rape the daughter. the kids being drunk and stupid, i can somewhat understand what's happening

vs

a father and daughter drinking in the park. kids approach them. drunk father stumbles away and can't get help. <<<this story makes sense why the bodega man wouldn't pay him any attention and wouldn't let him use the phone. it creates an entirely different picture of the possible scenario.

it doesn't change the fact that wrong is wrong but it may add clarity to the situation.

a lot actually.

but that's the POINT tho...kids drinking beer is completely different than adults drinking beer so it actually makes more sense if the kids were drinking beer.

but again, the reports i read made it seem like the kids were drinking not the adults, which to me is a different narrative. and it's crazy, why would a dad drink beer with his daughter late at night in a park that's known for dangerous activities?

Everything is a gamble and a prayer.

Adding more “what if” questions to a situation that was already a complete “what if” doesn’t add any further insight or perspective because the entire thing, if true as reported, was a fucked up twilight zone choose your own adventure and who knows what would /could /should happen with each awful choice.

Adding an extra “if” to an armchair quarterback decision made based off of the information currently known about the situation doesn’t alter a decision made based on the known facts.

I thought they father and daughter where using the park as a short cut. Did the report change to they where drinking in the park together?
I agree something is not right about taking 20 mins to call the police. There has to be people walking around at 9pm on a weekend who he could haves stopped and ask to call 911. He could have even mashed on door buzzers of nearby apartments until someone answered and ask them to call 911 through the intercom.
I seriously doubt there was only one bodega in 20 mins walking distance either. If that one refused it took 15 to 20 mins to find another? Makes no sense.
Whoever said the father was a crackhead or something who owed money to these little piece of shit on a stick is probably correct. Either that or he was so blasted ouy of his mind he couldn't coordinate himself to call 911 or get someone else to. This is 100% a guess on my part though. Even if they say they are gonna kill her if you call the police they have no idea what you're doing once you leave. Why delay?
I try to pride myself on not wanting children charged as adults but this case test my limits. I wouldn't weep a tear if the did 15 years for this.
Normally I would be grateful to the the parents for turning them in but they didn't bother to teach them not to gang rape.

"Normally I would be grateful to the the parents for turning them in but they didn't bother to teach them not to gang rape."

only because parents do teach their kids a lot of things, and kids don't listen. but these kids knew right from wrong...and its' likely the parents of the kids who did turn them did teach their kids better, but the kids, under the influence of their friends, wanting to be king, went along with them.

the bodega owner did say these kids came in stealing from his store all the time. parents teach their kids not to steal all the time but they still do it. i don't discount peer pressure in these incidences.

I know kids get into a lot of nonsense that their parents tell them specifically not to do. I did. Everybody does... but a public strong arm gang rape ? Naw, that ain't stealing cakes or beating up kids or even stealing a car to joy riding in a car. I can't imagine the majority of these kids came from good homes with vigilant parents who set up rules and boundaries but ended up committing this particular crime. Could one of them gave been a "good kid" brought up well who got caught up, sure but not all four... No way.
The odds aren't in their favor.

there are a lot of stories going around...A LOT of stories going around about what happened and different news stories are reporting different things. however, the story remains that it took him 20 min to get a cop and return. which is a ridiculous amount of time if he ran into a bodega, they said no, and he ran into cops on his way out, he should have been back in less than 10 minutes.

there is a bodega on every corner and ain't no way he's standing there arguing for more than 2 or 3 minutes about using the phone.

but this is odd.

Getting drunk with his kid supposedly. Was prob smoking crack or something or else he coulda done it in the house. Or trying to buy drugs and it went wrong. Smh.

You know why this story is newsworthy?

Bc most men would fight or this would be a new story daily.

Oh and who doesn't have a cell phone in 2016 except crackheads?

And it would be morally wrong for the police to drug year the victims, but you know they wanted to.

I hope they charge him with supplying alcohol to a minor, because guess what?

if he hadn't been in the park supplying alcohol to a minor on a school night, none if this would have happened.

Sorry I really have no sympathy for this man.

Apparently the bruises she got are consistent with a rape.

Its the pops involvement.

Its come out he's the neighborhood drunk, and that they didn't have a gun.

Right now it's looking like he got them in a situation he couldn't get them out of and handled it REALLY shitty afterwards since witnesses say he was drunk

Even in Brownsville it sounds odd for a bunch of teenagers to roll up on two strangers in that kind of scenario even with a gun cause you never know who's packing what/who knows who. Its possible since he was 'that guy' in the neighborhood they saw him as negligible and basically her by herself, but its still strange.

In this case it sounds like he left and returned fairly quickly with help.

That's better than being murdered and then having daughter probably murdered too.

Two teens charged with raping an 18-year-old woman say the sex was consensual — and told cops she was having intercourse with her father in a Brooklyn park when they first saw her, a law enforcement source said Monday.

because the INITIAL story I heard was a young woman and her boyfriend/male friend were accosted. Then it changed to the man being her father. And quiet as kept, a man getting drunk with her daughter in the park is disturbing...but I ain't want to say that maybe they were having sex. Maybe he's her step dad?

But the more I read about this, the more I think these two ppl were drunk and drug addicts. And these kids thought oh they getting it in, let us get in on it too. I was hoping this story wasn't true that 5 kids raped that woman. All of this is so disturbing.

Yeah, that was weird to me...getting drunk with ya kids I can see when everyone is supergrown with families...but with your teenage daughter? does.not.compute.

Incest aside, at the very least that's a fucked family relationship there.

NYTIMES *SWIPE*

Four days after the sexual assault of an 18-year-old woman at a Brooklyn playground, prosecutors late Monday charged four teenagers with first-degree rape, officials said.

The four teenagers are Ethan Phillip, 15, Denzel Murray, 14, Shaquille Cooper, 15, and Onandi Brown, 17, the police said.

In a case that has grown more tangled by the day, investigators had been interviewing two of the suspects, holding two others and seeking a fifth suspect, all in an effort to piece together what happened on Thursday night at Osborn Playground in the Brownsville neighborhood.

Two law enforcement officials said the accounts of the suspects who had been interviewed had begun to answer some questions surrounding the attack, including how exactly the woman’s father was driven away from his daughter’s side at a moment of crisis.

On Monday, Representative Hakeem Jeffries, whose district covers the playground, said he was troubled by “several unanswered questions as it relates to the behavior of the father.”

“Something does not seem to add up,” he said.

The complexities did not shake the authorities from their original premise — that the 18-year-old suffered a violent attack at a playground near her home. The father said the teenagers entered the playground brandishing a gun, and that he ran off, the officials said. Two minutes later, he returned and threw a bottle at the teenagers, to try to drive them off, but they chased him again, the officials said. When he returned 12 minutes later with police officers, the assailants were gone and his daughter was there, half clothed.

When she was interviewed, the woman told investigators she was raped by at least one of the suspects, the officials said. She was forced to perform oral sex on two others, they said, citing her account, and all of the suspects touched her breasts.

“The initial report, that all five of them raped her, is not looking like it happened that way,” one of the officials said.

Two of the suspects said a third suspect had sex with the woman. That suspect said he was present, but was on the phone, “and when he finished the call his friends were gone,” one of the officials said.

The woman did not report seeing a gun and so far, the suspects have denied they had one. The father and daughter were heavily intoxicated during the attack, the official said.

The official said the father lost custody of his daughter when she was 2. She was raised in another state, “out West,” by an adoptive family, one of the officials said.

“She reconnected with him last summer,” the official said.

Detectives found what the police said was “distant video” of the woman and her father walking into the playground, where they went to drink together after buying beer nearby, around 9 p.m.

Throughout Monday, investigators were hunkered down at a police building in Brooklyn, questioning the four suspects, as their colleagues searched the streets for a fifth suspect, the police said. But they turned up no independent witnesses who had seen or heard any parts of the attack, the police said, and had not recovered a gun either.

The woman had several recent physical injuries, Stephen P. Davis, the department’s top spokesman, told reporters on Monday afternoon.

“She had cuts and bruises and abrasions which are consistent with being physically attacked,” he said.

But Mr. Davis said it could take seven to 10 days for the results of a rape test performed on the woman to be known. “She had injuries consistent with an assault,” he said, declining to go into additional detail about any injuries associated with a sexual assault or rape.

Two of the suspects, ages 14 and 15, were taken to a Brooklyn precinct station house by their mothers on Sunday, a day after the police released surveillance video of a group of young men entering a deli before the attack. The police found the video around 2 p.m. on Saturday. After the mothers saw the video on television, they went to the police, Mr. Davis said.

The authorities then picked up a 15-year-old suspect for questioning, also on Sunday. A fourth suspect, 17, turned himself in, “knowing that we were looking for him,” Mr. Davis said.

The deli surveillance video has proved to be the best clue in an otherwise arduous investigation. Detectives began canvassing the area for video on Friday. Besides the distant footage of the father and daughter walking together into the playground, near where they live, the police also found distant video of five figures leaving the playground around the time of the attack.

“But it was nothing of any kind of value,” Mr. Davis said. From there, he said, investigators “moved out” and eventually came up with the video from Zaida Deli and Grocery.

A clerk there, Feliz Santos, said the five young men had come in around 8:45 p.m. on Thursday and bought 50-cent plastic bottles of Big Burst Fruit Punch.

About 30 minutes later, though, workers at that deli and another apparently turned the woman’s father away in succession.

At Zaida Deli and Grocery, the father said only, “Gimme the phone,” Mr. Santos recalled, adding that he did not explain why.

Mr. Santos said he refused the man because he had no idea what he wanted and because the shop needed the phone for business. The father then continued on down the block.

The father stopped at Gaston Deli, two blocks from the playground, and asked to use the phone, again without explaining why or even saying that he wanted to call the police, said Sammy, a clerk there. Sammy, who said he was busy with customers, told him no. He added that the father seemed drunk.

“How he look, how he act, how he sway,” Sammy said.

Silent security footage from Gaston Deli captures the roughly 70 seconds he spent inside. Wearing jeans and a black-and-red coat, the father stopped and stood in the middle of the store as he motioned to the clerk and spoke with two customers.

One of the customers handed him a phone, but grabbed it away before he could start dialing. The father appears to speak to the clerk, lean toward the customer, and then haltingly leave.

The father’s actions remained difficult to account for, but a picture emerged on Monday of the dark and difficult circumstances the woman had been living under. Neighbors at an apartment complex near Osborn Playground said that her father had been an alcoholic for years.

They said he did not supervise a young son who often played in the trash-strewn hallway outside the door of his apartment, leaving his older children to look after the boy. Clusters of empty 24-ounce cans of King Cobra malt liquor strewn in the hallway and stairwell had been left by him, they said.

“He’s like that, a drunk, yes,” said Bertha Payne, 44, who lives next door. She said he often knocked to beg for dollar bills and cigarettes.

Ms. Payne described the daughter as a kind and quiet young woman.

When Ms. Payne asked the father on Sunday how he was doing, she said he seemed baffled by the question.

“He said, ‘I have no idea what they’re doing around here,’ ” referring to the scrum of reporters and police officers nearby at the playground, Ms. Payne recalled. “He said, ‘I didn’t do nothing.’ ”

Mayor Bill de Blasio was informed of the crime on Sunday, a spokesman, Peter Kadushin, said. A day later, the mayor said he believed there had been no delay in the police response. But after talking to the police, Mr. Kadushin said, the mayor made clear his dissatisfaction with the department’s notification of the area’s residents.

“The mayor now believes strongly that the local community should have been informed sooner and has instructed the N.Y.P.D. to notify communities more quickly moving forward, whenever appropriate,” Mr. Kadushin said.

The 17-year-old suspect will be charged as an adult, because New York is one of two states that requires people 16 and older to have their cases handled in adult criminal court. But prosecutors have some discretion in deciding whether the cases of the younger suspects go to Family Court or Criminal Court.

Under New York law, someone who is 14 or 15 will be tried as an adult if he is charged with any of a list of the most serious crimes, including first-degree rape.

In fact they could publish the victims names if they wanted to.

I think as an ethical matter alot of publications would not print the victims name though.

Unlike other countries, there is no ethical convention for not printing the names of the accused.

I think it's a fucked up practice in general.

young girl shot her mother and had a boy shoot and stab her mother's boyfriend, who it turns out she says was repeatedly molesting / raping her while the mother did nothing, then left to go party on NYE. bodies were left for days.

http://abc7ny.com/news/15-year-old-murder-suspect-partied-in-times-square-on-nye-with-bodies-at-home-nypd-says/1145430/

just cause first you hear about the murders, and you're like 'despicable!'

then you hear the motive and you're like 'i understand'

then you're like, 'but what if this girl is lying?'

plus, if she was drunk...and they seem to acknowledge that...she still might not have been legally able to give consent

edit: it's 4 years in NY from what i just read...so she's in the clear either way

I'm starting to believe the boys also bc of how quick they came in to talk to cops whether it was with family or on their own.

Making a Murderer has me fully appreciating that most public cases are decided by people before they set foot in the court room because they are tried in the media. It seems like DA offices have strategies for tainting potential jurors.

She was a victim of incest by her father in that park when this happened. That is confirmed.
The police found semen from two of the boys on her in her rape kit. That is confirmed
She was so drunk that she was incoherent and belligerent when police showed up.
We cannot assume that because she stopped cooperating with the prosecution and recanted, like many rape victims before her, that no was committed.
There are a lot of people who failed this woman and parents who failed their kids in this case, including her dad and these kids parents.

Unfortunately there's no way to really proceed legally given the info at hand.

Dad is the hugest shit bag. Those kids are definitely shitbags - having rough park sex with a random drunk you found in a park is some vile shit, whether it was 'consesual' or not. It's just tough to figure who is a criminal in this situation. Police are shitbags for releasing the names and mugshots of the kids considering they don't really know what went down.

I can't really think of a more fucked up situation that I've heard of in a while. I hope the girl finds some way to get some help.

But yeah, ugh all around.

And also, looks like incest is a crime:

"Aside from her lack of cooperation, considered vital to most sex-crimes inquiries, the prosecutors have no evidence that the woman resisted sexual contact... Prosecutors are unable to charge the woman’s father with incest because of her lack of cooperation, and even if they could, they were concerned about the impact such a prosecution might have on her well-being."

and I agree with that last part unfortunately; considering how much media attention is on this case...etc etc etc...im pretty sure she just wants this all to go away instead of getting dragged to testify against her father
