CALAIS, Maine (AP) — A 22-year-old man who was drinking and celebrating the Fourth of July tried to launch a firework off the top of his head, killing him instantly, authorities said Sunday.

Devon Staples and his friends had been drinking and setting off fireworks Saturday night in the backyard of a friend's home in eastern Maine, said Stephen McCausland, a spokesman for the state Department of Public Safety.

Staples, 22, of Calais, a small city on the Canadian border, placed a reloadable fireworks mortar tube on his head and told his friends he was going to light it, McCausland said. But his friends urged him to stop.

"Apparently, he thought that was a great idea," McCausland said. "His friends they thought dissuaded him from doing it, and the next thing they knew, he ignited the fireworks and he was killed instantly."

Staples's brother Cody told the Daily News of New York that he was a few feet away when his brother lit the firework and was the first to come to his side after it exploded.

"There was no rushing him to the hospital. There was no Devon left when I got there," said 25-year-old Cody Staples, who called it an accident.

"Devon was not the kind of person who would do something stupid. He was the kind of person who would pretend to do something stupid to make people laugh," he said.

Staples' death is the first fireworks fatality in Maine since the state legalized fireworks on Jan. 1, 2012, authorities said.

Lawmakers had voted to repeal a 1949 law banning fireworks, reasoning the industry would create jobs and generate revenue.

State fire marshals were also investigating several other Fourth of July fireworks accidents involving injuries in Friendship, Jefferson, Lebanon and Woodstock. They said most of the accidents involved burns and eye injuries.

In Montana on Saturday, a 32-year-old man was killed at a Billings home in a fireworks accident involving a mortar tube.

And in New Jersey, a 52-year-old man blew off a large piece of his left leg below the knee when he set off a tennis-ball sized firework in Leonia.

We can't use skyrockets here anymore. That's made me completely uninterested in fireworks, but maybe overall it's a good thing.

(Reuters) - A Maine man died during a Fourth of July celebration on Saturday night when he tried to launch a firework from the top of his head and it exploded, killing him instantly, police said Sunday.

Devon Staples, 22, of Calais, Maine, was drinking and celebrating the holiday in a friend's backyard when he placed the fireworks mortar tube on his head around 10 p.m., said Stephen McCausland, a spokesman for the state Department of Public Safety.

McCausland said it was unclear whether the firework was already lit, or whether Staples lit it once it was on his head.

He was killed instantly when it exploded, McCausland said.

The tube Staples was using was a reusable mortar shell but said McCausland said investigators did not know what type of firework he was attempting to shoot.

Maine has allowed the sale of fireworks since lawmakers repealed a 60-year-old ban on them in 2011.

Calais is in the eastern part of the state near the Canadian border.

at each other like guns. The were pointing them at each other, shaking them, and then POW - a fire ball shoots out and hits their target (each other). And they thought this was fun/funny! They were running up and down the street laughing and screaming "I gottchu nigga!"

They started this shit at midnight and it continued until 2 AM. I am surprised none of them caught on fire or that they didn't catch someones property on fire.

I feel really bad about the whole thing and dude's mother is all messed up. The whole situation is messed up. But if folks are taking keys from drunk drivers, I just figure that they could have taken those fireworks away him. Man, I know we have free will, but I can't just stand by and watch someone do something that dangerous. I've stopped folks from doing stuff and I can't see how this happened with friends around.

Tampa Bay Buccaneers cornerback C.J. Wilson suffered an injury to his hand while setting off fireworks during a Fourth of July celebration over the weekend.

"We are aware that C.J. was involved in an accident that occurred over the July 4th holiday," the Buccaneers said in a statement. "It is our understanding that the injury occurred to one of his hands and our primary concern at this moment is for his long-term health. We have been in contact with C.J. and are continuing to monitor the situation."

Though the extent of the injury was initially unclear, Wilson's hometown newspaper, the Lincoln Times-News, reported that Wilson lost two fingers as a result of the accident.

Undrafted out of North Carolina State, Wilson was a practice squad player for the majority of last season before being promoted to the active roster in December. Set to enter the final season of a two-year contract, he appeared in two games and had four tackles in 2014. He was a reserve for the Chicago Bears in 2013, registering one tackle in two games.

Wilson is the second NFL player to suffer an injury as a result of a fireworks accident during the Fourth of July weekend. New York Giants star defensive end Jason Pierre-Paul also is dealing with a similar situation in Florida.

Texas Man Dies After Lighting Firework On Chest

A Texas man died this week after lighting a firework on his chest while partying with friends, police say.

Justin Bartek, 30, was a postal worker in Columbus, Texas. Columbus County Sheriff's officials told KPRC that Bartek and some friends were shooting off fireworks around 1:30 a.m. Tuesday at the Dollar Hole, a popular fishing spot on the Colorado River.

Witnesses told investigators that Bartek ignited a tube-type firework called the Medieval Knight on his chest and then suffered critical injuries, according to KTRK. He died shortly afterward at Columbus Community Hospital.

Bartek leaves behind a 3-year-old son, whom he had with his girlfriend of 10 years, Summer Jenkins.

Friends and family have set up a GoFundMe campaign to help cover Bartek's funeral expenses.

His friend Erica Jackson told KPRC that Bartek was a kind and generous man, and said that she will miss seeing him along his route.

"He was the light of many people's lives and the world to the people that knew him, and he would give the world to any that asked," Jackson said.

Bartek's death comes just days after a Maine man died after setting a firework off on his head on the Fourth of July.
