The replies would've been different because they probably would've killed a Black person. I've been on the streets and seen up close how police respond differently when being challenged by white people. They get way more warnings and explanations than Black folks, men or women.

What her ignorance/white privilege failed to compensate for was the fact that Border Patrol officers don't have the same standards for searches as police. At checkpoints, they can search any vehicle they desire for the most part, and by going into or out of the country, you implicitly consent to the search.

Had she realized that, maybe she wouldn't have come to such a "shocking" revelation.

They set up checkpoints far enough inside the country that you never had to leave or come into the country to go through one.

Case in point: Just east outside of Yuma, AZ Border Patrol has two checkpoints along I-8. One is permanent and about 10-15 miles east of the city limit, the other is about another 15 miles further east of that and is a temporary checkpoint. From Phoenix, I can drive to Yuma and back and never leave the country (obviously) but still have to endure going through their checkpoint.

Your logic here fails on this point: I have neither left nor entered the country as I'm already here, therefore I have not implicitly consented to anything.

I used to drive out to Yuma twice a year to pick up my profit sharing money. I've been searched by BP a total of three times. Once they damned near took my car apart on the side of the road without finding anything except the envelope of cash in my glove box with a receipt from the bank and my check stub showing that I had just cashed my check there.

They claimed the drug dog must have picked up on traces of coke on the $100 bills...

WTF ever nigga... I was delayed for so long I had the border patrol agent talk to my wife AND my boss to explain to them why I was late getting in.

THIS is the thing that cops need to get over. Border Patrol can have their jurisdiction and different treatment and protocol, but there will always be an underlying mistrust because they flex and do this stuff ALL OF THE TIME for no reason. They get to use flimsy probable cause and profiling to harass and intimidate and assault people.

And for the cop to say she assaulted him and he was forced to jack her up and tase her? No, he got annoyed, and said I'm gonna teach her a lesson and went overboard. A citizen should have a right to know why they are being detained. Had she died, I'm sure he would have feared for his life, from her menacing puppy-dog and her striking blow, of course.

shit is ridiculous.

Them: It was already explained to you when I took your ID (apparently before the camera started to roll, and she stated it a few seconds later that the officer said that it was because she appeared "Nervous" which is all the reason that Border Patrol needs to execute a search of any vehicle crossing the border).


You can be mad all you want, try to mix the two very different situations of police practice and Border Patrol protocol all you want, but the facts are that she was wrong to assume what her rights were in this case, she was warned numerous times to comply with their orders to move out of the way (they asked her to sit in the car - she refused), she didn't comply, and she got zapped for it. She was wrong, and so are you.

I ALWAYS take the side of the public in police cases when the rights of the citizen are tramples on, but that isn't the case here. It is clearly spelled out in the law, when crossing the borders, you are subject to search of your person or vehicle at the discretion of the B.P. officers, probable cause isn't necessary. Had she known that, she wouldn't have become an internet star for acting like an ass.

These are not "police", They are Border Patrol officers, which have a different set of criteria when searching people and/or vehicles. They asked her to get back into her car or if she desired, she could leave the area, but not to stand where she was. She wanted to be obstinate, flex her muscles and her "rights", and for that she got the business end of a taser gun and handcuffed. She should be happy it was a taser gun and not a handgun....at least she lived to tell the story.

Cats is doing their job. As unjest as we may feel it is, its the law, and they have a job to do and thats uphold those laws.

It's a lot of police/feds that may not agree with what laws they have to enforce, but its in their job description to enforce.

We want this to change, it needs to be on a higher up government level that changes those laws so these people don't have to enforce them.

You're really looking at the bottom of the totem pole here.

the courts and public policy. None of the "higher level" stuff will happen unless people are willing to physically challenge police and other law enforcement agencies. One of the main reasons cops continue to shoot and brutalize people, is because they're pretty sure no physical harm will come to them. That level of arrogance needs to shift.

Even if laws like stop and frisk are rescinded, cops will continue to do what they want. Only a fear of self-defense from the citizenry will stop them. Our goal should be to stop cops from killing/brutalizing us, not to put laws in place for them to be prosecuted after we are already dead. Fuck that.

IMO, there is a difference between standing up to unjust laws and standing up to police that enforce laws that you don't like.

If you feel tax laws are unjust, do you simply not pay taxes (welcome to jail), or do you protest/pressure officials or whatever to get the laws changed?

Would I blow herb smoke in a cop's face because I feel marijuana laws are unfair? Or would I write letters, urge my representatives, and join organizations to create a groundswell to get the laws changed?

Now if the police are wrongfully doing their jobs, violating my rights, breaking laws regarding my welfare, then yes, stand your ground, fight them if necessary, and if you take an "L" in the process, so be it.

Quite often you have to knock down the walls the you face. I guess I choose to use tools available to me to help knock them down when possible, as opposed to punching them or running head first into them all the time.

When cops suddenly tell you to move to an arbitrary new position "over there", what's the legal basis for it? I understand that they use it as an excuse to get physical but I'm talking in situations where you are neither blocking traffic nor impeding their questioning

In this video, her initial position was fine. then as things escalated, the cop seems to have suddenly decided that her position was no longer ok and insisted that she move to a new position 2 feet away. where do they get these new co-ordinates from? lol

..she got out of the car to ask why she was being detained and they asked her to wait in her car, then explained that it was because of her nervous actions/demeanor (well within their authority).

she was then instructed to wait in her car (again) and that a canine unit would be there shortly. she refused and asked again if she was being detained. they explained that she was free to leave if she wanted to walk away, but her car would be searched regardless. when the conversation was concluded, they asked her to sit in her car or further away from the staging area (the area that they have drivers pull over to when being questioned or detained). they ask EVERYONE to do this on a regular basis to avoid injury or further issues with traffic.

she refused.

she was arrested.

She did a horrible job of asserting her rights - and did not even attempt to humanize the situation (which is important in any situation unless the cops are being wholly unreasonable - which they weren't here).

And the cop was in the wrong for forcing her to move to a different area by physical force and then tasing unnecessarily. She did not have to move beyond where she was. Cop was just annoyed (perhaps understandably so) by her shrill, unreasonableness - but it is the cop's duty to practice restraint and serve the public, which he failed to do.

People often decry the fact that cops see the worst of society and fear for the lives. Well one, the danger of being a cop in america is, largely, exaggerated. Also, yes, they have a very tough job, that they signed up for. Therefore, since they have a TREMENDOUS amount of power, I do indeed expect them to exercise a tremendous restrain and judgement.

We are talking about life and death here.

I'm sayin', every step of this interaction has a completely different outcome if this person isn't white

Cause the logic is pretty self-reinforcing here. If she doesn't get tased.....white privilege. If she does get tased....white privilege. In fact....every possible scenario here is an example of white privilege unless she gets killed. Got it.
