however it wasn't a big hit back in 08 and nobody cared. some times you slip through the cracks and sometimes crack kills. thicke couldn't write a song on his own without something to get airplay and he been doing it

Oh wait ... and this example you posted was actually credited? Then yea. Dude is at worst unoriginal but he still shouldn't have to pay for it. There's been far, far worse offenses in history and this type of decision sets a TERRIBLE precedent.
