Family sues Hammond police over traffic stop violence

A simple traffic stop for an unworn seat belt turned into a nightmare for a family on their way to visit a sick loved one in the hospital, after police officers drew their guns, smashed a window and used a Taser on an unarmed passenger.

According to a lawsuit filed this week, Lisa Mahone of Indiana was pulled over by police officers in Hammond, Indiana while en route to an Illinois hospital to visit her ailing mother. Soon after the stop, Mahone says police laid out spike strips in front of her car.

Officers then order Mahone’s boyfriend, Jamal Jones who was sitting in the passenger seat to get out of the vehicle.

In cell phone video captured by a terrified 14-year-old sitting in the back seat of Mahone’s car, you can hear Mahone on the line with a 911 operator saying that she fears for her life and that moments earlier officers had pulled their guns on the couple.

“I’m scared for my life,” Mahone is heard telling the operator. “He just pulled a gun on us and we don’t have a gun.”

Jones refused to exit the vehicle because he feared for his safety, according to the lawsuit filed on Monday. An officer is then seen in the video smashing through the passenger side window with what appears to be a night stick and shocking Jones with a Taser.

Jones is seen writhing in pain as he’s dragged from the car, placed on the ground and shocked again.

Joseph Ivy, the teenager who shot the video, and his little sister, Janiya, were reportedly injured by spraying glass, according to the complaint. In the aftermath of the arrest, the younger passengers can be heard sobbing.

“He was never told he was being arrested and he was never told why they were ordering him out of the car or asking him to get out of the car,” attorney Dana Kurtz told NBC Chicago. “Thankfully Joseph videotaped it. I mean, what a great, smart 14-year-old to videotape this so there is actual evidence, and to be able to protect them and other citizens from this kind of conduct.”

The lawsuit claims that the two officers involved, Patrick Vicari and Charles Turner, both of whom are white, used excessive force, false arrest and battery against Jones, who is African-American.

Jones was subsequently charged with resisting law enforcement, failure to aid an officer and cited for not wearing a seat belt, according to Hammond police. Mahone was issued a citation for failure to wear a seat belt and a license plate reciprocity violation.

Hammond police said officers took appropriate action after Mahone lurched her car forward after officers pulled her over and Jones’ refusal to step out of the vehicle. In a statement released on Tuesday morning, Lt. Richard Hoyda of the Hammond Police Department said that during the stop Jones’ repeatedly reached toward the rear of the vehicle and that officers feared he may have been reaching for a weapon.

Hoyda said officers pulled over Mahone’s car about 3:45 p.m. on Sept. 24 after they spotted Mahone and Jones not wearing their seatbelts. Hoyda said that Mahone handed over her license when asked but told officers that Jones didn’t have any identification with him.

When officers asked Jones to provide his identification on a piece of paper, he refused to lower his window more than a crack, according to Hoyda.

Jones then told the officer that “he was not going to do his (the officer’s) job,” and for police to provide a piece of paper for him, police said.

Hoyda said officers then called for back-up after Jones refused over and again to provide his identification and was seen reaching toward the back seat.

According to police 13 minutes had gone by and at least three different officers had asked Jones to get out of the car.

“Fearing the occupants of the vehicle may have possessed a weapon, and seeing the passenger repeatedly reach towards the rear seats of the vehicle, the first officer then broke the passenger side window of the vehicle and the passenger was removed from the vehicle and was placed under arrest,” Hoyda said.

“The Hammond Police officers were at all times acting in the interest of officer safety and in accordance with Indiana law.”

The episode is just the latest in a string of troubling, fatal encounters between unarmed African-Americans and white police officers.

In July, police in Staten Island, New York choked to death Eric Garner minutes after accosting him on a street corner for selling loose, untaxed cigarettes.

In early August, police officers in Beavercreek, Ohio fatally shot John Crawford III at a Wal-Mart store after he’d picked up a toy gun off a shelf. Minutes earlier, a customer had called 9-11 and alleged that Crawford was armed with a gun and aiming it at children and other shoppers. Surveillance video contradicts that Crawford ever aimed the gun at anyone, and captures police gunning him down as he nonchalantly talks on his cell phone while toying with the plastic gun.

Just days later on Aug. 9, a police officer in Ferguson, Missouri shot and killed unarmed black teen Michael Brown after the officer stopped the teen while he was walking with a friend from a nearby convenience store. Several witnesses say Brown was fired on as he attempted to run away from the officer and that the fatal shots came as he was turning with his hands up in surrender. The killing sparked national outrage and protests and rioting locally.

On Sept. 10, police in Saratoga Springs, Utah fatally shot Darrien Hunt, who family say was armed with little more than a toy Samurai sword when he was killed. Police say he lunged at them with the toy sword, but inexplicably to Hunt’s supporters, Hunt was shot and killed dozens of feet away from where the altercation allegedly began.

In South Carolina, on Sept. 26, a police officer was arrested and charged with aggravated assault over his response to a routine stop at a gas station earlier in the month. The cop, who is white, stopped an African-American for a seat belt violation on Sept. 4, according to the report. When the driver reached into his vehicle to grab his ID, the officer suddenly fired several gunshots at him, the video allegedly showed.

Across the country, encounters with the police are being captured on video by citizens, some of which show how volatile and dangerous encounters with police can be.

the drama wasn't about the brother's non-compliance it was about the officer's being mad that the brother had copped an attitude. they wanted to teach him a lesson - that's all this was about. and it's disgusting.

that does NOT excuse what the officers did.

the officers were the professionals in this situation. they were trained to handle this situation and had several options. they chose the wrong option. and b/c they're held to a higher standard, they're wrong act trumps the brother's wrong act. and that should be the focus here.

the lesson about obeying cops - teach that to your kids based on this. good idea. but it's not something that needs to be a broader conversation based on this. we don't need to teach our young Black men that they need to comply w/cops based on this. i mean, we as parents of kids do need to warn our kids. but the public conversation needs to focus on the cops and their wrong. b/c their wrong trumps the brother's wrong.

I have taught my Black Son how to comply with the police as a means of survival. I have taught him that he might be right but don't fight or talk back, because what ever was done wrong can sorted out later with a lawyer, but I need him to stay alive until we can get things in order.

why was the officer ordering him out of the car in the first place? he had no real need for that. the brother had been observed riding as a passenger in car w/o a seat belt. that's a traffic violation - not even a criminal offense. the officer approached the car and didn't develop any probable cause that another crime had occurred. the officer wanted to run the brother's name through a database to look for warrants. he needed the brother's name and date of birth for the warrant check. so he asked the brother for identification. brother didn't have any. so the cop asked for the brother's name. he asked the brother to write it down and hand it to him.

none of that necessitated the brother getting out of the car. the cop wanted the brother out of the car b/c the brother gave him attitude. the cop wanted to show the brother who the boss was. that's what went down.

the brother in south carolina was hella respectful, polite and compliant. in fact, he was too compliant. he responded, apparently, too swiftly to the officer's request for identification, and the cop snapped and fired 6 shots at him. dude is apologetic and incredulous yet still mad polite, bleeding, on the ground, and the cop thinks of nothing better to do than cuff him.

cops treat these tasers like cattle prods. oh, you upppity? zzzzzzAAPP!!!

shit ain't funny.

the backdrop to this is that they had already went to 100 after dude reached into his bag (pulled guns on him).

now, objectively, *maybe* its in the cop's self-interest to draw their weapon on some just in case shit (despite the fact that dude was complying with the officers at that point and there were kids in the car... ok, he's going into a bag). once dude came out with paper, as stated, the officer should have de-escalated and said, 'we intend no harm, but you can't take too many chances out here' or something like that.

the brother in the passenger seat is now shook because, from HIS perspective, he is being fully compliant and rewarded with it by having cops aiming guns at him. in light of all the national shit, of COURSE he is going to be leery about getting out of the car. it's their word against his. he is asking for a white shirt (i'm assuming a commanding officer) to help diffuse what he sees as an escalating situation.

and the cops get pissy and hostile.

mind you, all of this allegedly over seatbelts.

at the high school my daughter graduated from, in nc, the cops there would tase kids (usually black males. occasionally black females, and maybe once in a blue moon a white male) for stupid shit, like throwing a balled up piece of paper at lunch time.

they think this shit is normal. it is not.

the issue is not about compliance. it's about being black. how many black men have complied (reaching for wallet, reaching for phone), and been shot dead by cops because when they see us they see something else?

interactions with cops are a potentially fatal catch-22 for black people, regardless of compliance.

This is where the cops messed up. There is a way to talk to people to get them to comply. However, I don't think my guy would have gotten out regardless.

All that arguing just got his girl car window broken and him buzzed up.... PLUS he went to jail. That "fear for safety" shiz ain't gonna hold up in court.

I always get to keep the physical to use as an ID.
Dont get caught driving on suspended Ls or you go straight to jail.
But that suspended license is still valid for ID purposes like check cashing and buying beer and whatnot.

I moved away from my hometown over 10 years ago

and on a recent trip home the idea occurred to me

that the PD can pull you over anytime they feel like it

you have to REALLY TRY to drive 20-25 MPH

I could see it for school zones, etc...

but for an entire city grid

it's more like entrapment.

during school hours or when children are present. u know how some cities have a speed limit m-f from like 7 am to 5pm. their shit is like that 24-7. it was one am when i got pulled over. said i was doing 40 in a 25. i decided to stay off that street altogether. i avoided it for like a year.

then i got waze and a new radar detector and whenever i drive anywhere near that street, i pick up the radar and see the cops hiding

i'm a pragmatist. i calculate risk/reward all the time.

but one thing you are not taking into account is dude's stated reasons for not getting out...

he was afraid because they pulled guns on him. if his mental calculus is that 'i'm safer inside than outside...' , i don't necessarily see it as that but i can see how he'd come to that conclusion.

we're all making assumptions that if he continued to comply that the cops wouldn't have found something else to be pissed or alarmed about.

if he got out too fast, they could have shot him. i've been stopped, made to get on the ground, face down w/ guns drawn on me a few times. while walking. i've never been made to get out of a car.

i don't know the protocol for that. but really, the protocol is whatever they decide that it is on the spot.

if dude was NOT legit scared of the cops and was on some 'i know my rights' ish, like the brother in minnesota who got tased and arrested while waiting for his kids, this would be a case of 'you knew something like this would happen' as many of y'all are trying to make it. black folks don't have rights when it comes to cops, and it boils down to whether you are willing to get fucked up or killed to prove a point that we all already know.

but I'm missing how a traffic stop turns into probable cause, etc...

it's not against the law to not have ID

the man obviously felt threatened, and said as much in the video

IMO, he didn't want to get out of the car, same as the Sandusky video, because it's obvious the police are looking for more charges

but I don't see how it's legal to pull somebody over for a seatbelt violation

and that giving the police the right to investigate you with a fine toothed comb

the cops could order him out of the car. they're allowed to do so during a traffic stop.

but they didn't have to.

i don't expect these officers will be criminally charged as they didn't commit any crime here. but i do see the brother's excessive force claim in federal civil court.

the officer can legally do and what the officer isn't sposed to do. i see so many of these where people are just mistaken about what can and can't happen. like when he's telling the cop, since i'm not the operator of the vehicle, you can't break the window. that's just wrong. or when a cop was arresting a 15 year old, and someone with a camera phone said "you can't arrest her until her parent's get here" and then started tryna intervene

loud and wrong. it's best to just remain silent if you are gonna refuse to comply. remain silent or talk calmly. barking back at a cop ain't gon help a thing.

i know the cops are sposed to be trained and the civilians aren't, but you have your life to think about. now she gotta pay to get her window fixed.
