along with that Albuquerque incident that happened a few months ago.

I was getting ready to defend them, thinking that they didn't know if it was a real gun, and maybe he pointed it at them or something. But it didn't even get to that point.

They pretty much just sniped him while he was doing absolutely nothing. There was like a quarter of a second between him even noticing the cops were behind him and him getting shot.

Was we walking around the store in a way that made people believe he had a gun?

Wasn't he on his phone with someone when the cops approached him? I imagine that he was walking around the store, holding this gun, talking on the phone. Not aiming it at people in a threatening manner.

It's an open carry state as long as you don't make them nervous.

Well, he picked up the toy rifle (which was out of its box) and walked around the store with it. But, unlike the 911 caller lied about, he never points it at anyone or waves it around. He most just held it at his side. At one point he rests it on his shoulder, then puts it down again towards the ground. Most people that see him go about their business.

That's pretty much the exact description of what happened. The 911 caller lies and says he's waving it around and pointing it at children. But after seeing the tape synched up with the 911 call itself, you can see there was nothing of the sort.

The December night before the shooting, Tracy Roberson sent LaSalle a text message that read in part, "Hi friend, come see me please! I need to feel your warm embrace!" according to court papers. LaSalle apparently agreed.

Darrell Roberson, a 38-year-old employee of a real estate firm, discovered the two, his wife clad in a robe and underwear.

When Tracy Roberson cried that she was being raped, LaSalle tried to drive away and her husband drew the gun he happened to be carrying and fired several shots at the truck, authorities said.

Darrell Roberson's attorney did not immediately return a call for comment.

His wife also was charged with making a false report to a police officer — for allegedly saying she was raped — and could get up to six months behind bars on that offense. It was not immediately clear whether she had a lawyer.

She had not been arrested as of Friday afternoon.

Xenia is deep in red territory. Type of town where everyone has Police Benevolent Association stickers on their cars and the radio stations are all Christian, Contemporary, Classic, or Country.


The jurors probably only had to see a photo of John Crawford III to decide the police must have been taking justified action.


There'll be no justice there unless the DOJ can build a case to pursue.

parts of Ohio while up there. One was from Columbus and had much to say about areas between there and about Dayton. Much of it not so good lol... Also, it was also right about the time I picked up more awareness of politics/demographics interplay, and even registered to vote in time for the 2004 presidential election. Its statewide results were similar to 2008's, but just on the other side of the fence.


As for Xenia itself, I'm definitely inferring from the small towns I visited around the NE OH area. It was decidedly red in both of the aforementioned election maps, like them, and there's some things that most smaller towns just have in common.

Beavercreek has always had a healthy fear of black folks. Recently, they tried to stop additional bus stops at Fairfield Commons because they didn't want black folks having such easy access to their neighborhood.

A lily-white Ohio suburb is doing everything it can, including risking millions in federal highway funding, to keep mostly minority bus-riders from a nearby city from entering their community.

The showdown began in 2010 when the Greater Dayton Regional Transit Authority proposed adding three new bus stops in Beavercreek, a largely white suburb 15 minutes east of Dayton. These new stops would give Dayton bus-riders access to Beavercreek’s major shopping mall and nearby businesses, as well as a medical clinic and Wright State University.

Facing the prospect of buses coming in from Dayton, the Beavercreek City Council began enacting as many hurdles as they could to stop the new bus stops. Among the dozen roadblocks included mandating that bus shelters included heated and air conditioning as well as high-tech surveillance cameras, features that would be hugely expensive and are not common at other stops. Unsurprisingly, these demands couldn’t be met and the council rejected the expansion. “We turned downed an application because they didn’t meet our (design) criteria,” Beavercreek City Councilman Scott Hadley explained to Eye On Ohio.

Many in the area argue that their opposition boils down to a simple reason: race. According to the 2010 census, 9 in 10 Beavercreek residents are white, but 73 percent of those who ride the Dayton RTA buses are minorities. “I can’t see anything else but it being a racial thing,” Sam Gresham, state chair of Common Cause Ohio, a public interest advocacy group, told ThinkProgress. “They don’t want African Americans going on a consistent basis to Beavercreek.”

A civil rights group in the area, Leaders for Equality in Action in Dayton (LEAD), soon filed a discrimination lawsuit against Beavercreek under the Federal Highway Act. In June, the Federal Highway Administration ruled that Beavercreek’s actions were indeed discriminatory and ordered them to work with the Dayton Regional Transit Authority to get the bus stops approved without delay.

Beavercreek, though, isn’t particularly keen to do that. The city council voted most recently on Friday to put off consideration of the matter until later this month. They are weighing whether to appeal the federal ruling, or perhaps whether to just defy it altogether. Appealing the ruling could cost the city hundreds of thousands of dollars in legal fees, according to a Washington D.C. lawyer the council hired. However, non-compliance with the ruling could cost Beavercreek tens of millions of dollars in federal highway funds.

The city council has until September 11, 2013 to begin complying with the Federal Highway Administration order. They will meet again on August 12 to decide how to proceed.

Gresham, for one, is flabbergasted that the council would even consider risking millions of dollars in federal highway funds. “Their worldview and logic are two entirely separate things,” he said.

The Crawford shooting was wrong. The police were told that it was a REAL gun, not a BB gun, because they were given incorrect information by a liar. They entered the situation thinking they were dealing with live ammo and a real gun, and they shot first without giving any commands to drop the gun, and then they lied about that fact.

And in the Tamir Rice case, the dispatcher did not tell the officers that the caller said the gun was "probably fake," which was one of the big beefs that people had (aside from the obvious quickness that they shot him, and the ineptitude of the officer at his previous job). The reason people were pissed that the dispatcher left that out, is because the police would obviously respond to the call differently if the dispatcher said "there's a child pointing a fake gun at people"

which is the HUGE difference you should be talking about

John Crawford was killed because (a) a lying bigot called 911 and said that there was a black man in the store with a *loaded* and *real* gun and was pointing it at people (none of which was true) and because (b) the inept police showed up on the scene prepared to encounter an armed black man, and based on their ineptitude, fear, and probably bigotry, fired on sight without bothering to try to apprehend him.

In this incident, store security called 911, and truthfully told the dispatcher that the suspects were armed with non-lethal weapons (BB guns), and so the police entered into the situation prepared to deal with people who were not armed with deadly weapons, and therefore didn't need to be as trigger happy.

Additionally, you asked me if I thought it would have the same end result if the situation was the same but the suspects were black. If you start saying that the information would be relayed incorrectly, then the situation isn't the same anymore.


In the Tamir Rice case, the information was not relayed correctly, and the boy died as a result of the negligence of the dispatcher and the incompetence of the officer.

In the Walmart killing and Tamir Rice case, it was pretty much ambiguous as to what they were carrying (real or fake guns).
In fact, it was a little worse than that. In one situation the cops were told it was a real gun.

Now compare to the situation in this story.
There is perfect information here. It is 100% clear what the suspects possess.
And while BB guns are a nuisance and can be dangerous, it is not a threat worthy of a shootout.

So yes, ironically the man who was shit and killed at Walmart (sorry I forgot his name) would have been better of if he loaded and shot people with the BB gun.
That information would have changed how police responded to the scene
