it's very easy to listen to what Durst says in the bathroom and think he's confessing, but it's also very easy to listen to what he's saying and think he's speaking to himself from the perspective of the audience watching the show, or his legal counsel who told him not to do the show, or the staff of the show in the room that watched that.
Even if it's admissable in court, I don't see it being worth mentioning.
