“They’re increasing the risk of mistaken identity.’’

They did that because they were aware that none of the tellers described tattoos. They took a step to increase the likelihood that he would be picked in the lineup. That alone should be disqualifying.

It would be the same if all the tellers described a red baseball cap and they made him, and only him, where a red baseball cap in the lineup.

Lineups are too f'd all ready that we need to stop cops from doing anything to help single out anyone suspect. It goes against everything lineups are suppose to be about.
