It is very legal. "Justifiable" is very vague. LEO can ask you to step out of your car and stand next to the rear passenger door while they wrote you a speeding ticket if they felt like it. It would be poor customer service, but it would not be illegal.

For her death in jail, NOT because anything the arresting officer did. And honestly, I'm not so sure the State of Texas will settle on this one. Seems like they will fight it.
