This is a situation where they will punish a big hit that caused an injury. The rules are not super clear on this, if you look at it the pass does hang him out to dry and the puck is there. Only by the exceptions they have put in for head shots is this actionable. So they are basically punishing him because Eller got injured.

I wish there were not ambiguity here. They are going toward a no headshot policy and should just take the plunge already.
