13451594, If I took a photo of a rapper can I put it on a shirt and sell it?
Posted by legsdiamond, Wed Jan-12-22 10:16 AM
I have rolls and rolls of film and photos of rappers and DJ’s from back in the day.

back in college we worked for the college paper as a hustle to get back stage at shows so I have photos of a lot of rappers and groups who used to slide through VA and DC.

Could make for some good tshirts and maybe a photo book.

13451596, Not if you're selling them

These are photos I took as a fan or as a “photographer”

Gonna do some digging.

13451623, Interesting. these Etsy shops must pay the fee then

Because there are Etsy shops on there that sell artist merch

I’ve bought a few posters and tees myself. Having trouble linking on mobile but if you search “BodegaBobby” you’ll find one store
13451600, You could probably get away with the photo book, prolly not t-shirts.

13451607, why? what is the difference?
Posted by legsdiamond, Wed Jan-12-22 11:22 AM
both images were photographed by me and would be sold for profit.

13452024, Excellent Question

And the answer is complicated. But it's the difference between "editorial use" and "commercial use". It's the reason why newspaper photographers don't need permission to publish photos but the same photographer with the same photo would need permission to put that photo on a mug or sweatshirt or, as some would argue, on the cover of that photo book.

This is outside my area of expertise but I think the answer is complicated and has a bunch of different factors. Like are the photos of the person in public (where they had no expectation of privacy) or in private. How much do you use any one artist in the photo book? etc.

If you have a lot of good pictures, I would put them together and shop them to a publisher, and let them deal with the issue.

13452029, 99% of the photos are on some “yo, Fat Joe.. let me get a photo real quick”

and he throws up the peace sign while I snap a shot

or like Camp Lo who loved the camera and made sure I used all my damn film on them.

but I get what you are saying. Its not like I was doing drive by photos at coffee shops and shit. I’ll keep digging.
13451622, you can....and get sued too
Posted by tomjohn29, Wed Jan-12-22 01:15 PM
which even if you dont win or lose it will cost money
which would defeat the purpose of selling the shirts
ive worked on copyright cases where a celebs image was used to sell a t shirts by a photog
simply filing the suit made the shirt selling going away
legal fees >> t shirt sales

13451655, basically lol…

what if you put your photo book out and I took copies of those photos and made my own t shirts and sold them? would that be legal?
13452012, I took the original photos so I’m not sure what your point is
