McIntosh faces felony assault charges, along with criminal possession of a weapon. Dabeau and Edwards were charged with menacing, trespass and disorderly conduct. And then there's this: McIntosh just finished serving over a decade in prison after shooting and killing a classmate at Bronx's Evander Childs High School in 2000, when he was only 19. Man Is Charged In Mall Slaying Of Schoolmate

A 19-year-old Bronx man was arrested today and charged with fatally shooting a schoolmate and wounding an 8-year-old passer-by at the Galleria Mall here, the authorities said.

The shooting, which took place on the main shopping floor just outside the entrance to Macy's about 6:30 p.m. on Monday, occurred in plain view of shoppers and shopkeepers.

The victim, Oshan Litchmore, 17, and the man accused of shooting him, Rayon McIntosh, were students at Evander Childs High School in the Bronx. The authorities said the two men came to the mall with a group of neighborhood friends.

''They knew each other,'' said Capt. Peter A. Viviano of the White Plains Police Department. ''They were in the mall, hanging out, walking around, getting something to eat before the shooting took place.''

Mr. McIntosh, of 720 East 216th Street, was charged with second-degree murder and first-degree assault, Captain Viviano said.

Mr. Litchmore, of 1320 Hicks Street in the Bronx, was shot once in the stomach. He died in the operating room at Westchester Medical Center about 10 p.m. on Monday.

The murder charge specifies that the shooting demonstrated ''depraved indifference to life'' rather than intentional killing, and the authorities would not say whether Mr. Litchmore was a target.

Bryan Galeano, 8, a third grader from White Plains who had come to the mall with his mother and sister, was shot in the upper right thigh. He was treated at White Plains Hospital and released, the police said. ''The bullet that went through the murder victim lodged in the thigh of the 8-year-old,'' said Jeanine F. Pirro, the Westchester district attorney.

Mr. Litchmore's mother, brother and aunt came to the Galleria this morning to see where he was shot, said a woman who works at a hair-care booth about 20 feet from the bank of pay telephones where Mr. Litchmore fell. The woman declined to give her name.

''It was tragic,'' the woman said, describing both the family's visit and the events of the evening before, which she saw. ''If I didn't run away, I might have gotten shot, too. The young boy, he just screamed blood. I felt so sorry for him.''

Though the shooting took place in front of a couple of dozen people, it was business as usual today at the mall, which is anchored by J. C. Penney's and Macy's and is about half a mile from a newer and more upscale mall rival, the Westchester.

There are definitely stores that have baseball bats and/or guns behind the counter to defend the store, its employees, and its patrons from people instigating violence.

No cops around at all, and two folks clearly starting shit? Put them down for the count. We can't see behind that counter to see if the instigators are still moving, trying to get up, etc. I hope McD's gets that kid a strong-ass corporate lawyer... but that seems unlikely.

A lawyer could argue that he was yelling stay down and continued hitting them because they were still trying to attack.
