she is neither.

that's why he shouldn't have hit her.

and I'm not saying that if the two of them were on the street, that he has full reason to hit her if she starts banging on him like that. I doubt that his life may have been in THAT much danger in that situation. it would make her a much less sympathetic victim, however. that's about it.
