...the Niners kinda had to do what they did. It was at the least the fifth incident involving him. In the post-Pacman Jones world, teams are pretty much forced to cut bait after that many off-field incidents. Shit, the "bomb threat" was overblown too, but it was a big reason he got suspended for nine games for the DUI.
I'll also say even if this overblown, I think dude still has serious alcohol issues and shouldn't be playing right now. Kinda sucks that he has no one looking out for him.

Like Bruce Miller's domestic violence arrest, Ahmad Brooks' issues, etc., there was no way the team was going to take a "Let's wait and see" approach to a player who'd already been suspended for over a half season and had all those other problems.

and i am not sure what CA's DUI laws are but most likely what triggered the arrest was his refusal to blow. In most cases since they only have visual evidence to an impairment here in VA a good lawyer can get the DUI tossed or at least downgraded, but with his history and CA law i have no idea how that would work. I have not heard anything about toxicology taken at the station so i imagine he refused there as well.

legally, you're only required to blow or take a blood test if/when they take you to the station/jail, assuming the cops had probable cause to arrest in the first place (harder to establish without field sobriety tests as evidence).

but it is an automatic year loss of license for refusal. It seems though since the charge was failure to take it with priors it seems that refusing was a violation of some sort of probation.
