Perhaps the league will make a ruling, but as for you question of why no flag, I would say it's safe to assume the ref was not watching.

If people (including league people) were allowed to see things on TV and then tell the refs to throw a flag for it we'd have a whole different game.

Do you really think the refs hear every single thing that happen?

The ref could be 5 feet away and it still would not have been that clear audibly I bet.

It's not even 100% clear what he said right into the camera (I know what he said) but I can easily believe a ref not trying to hear what he said not hearing what he said.
