"Trump reimbursed Cohen for $130,000 payment to Stormy Daniels"

http://thehill.com/homenews/administration/385965-giuliani-trump-reimbursed-cohen-for-payment-to-stormy-daniels?__twitter_impression=true

Former New York City Mayor Rudy Giuliani (R) said Wednesday that President Trump reimbursed his personal attorney Michael Cohen the $130,000 paid to adult-film star Stormy Daniels to stay quiet about their alleged affair.

Giuliani, who recently joined Trump’s legal team, told Fox News’s Sean Hannity that the payment was “perfectly legal” and was “not campaign money,” meaning the arrangement didn’t violate campaign finance law.

“It's not campaign money. No campaign finance violation. They funneled through a law firm and the president repaid it,” Giuliani said.

"He didn’t know about the specifics of it as far as I know, but he did know about the general arrangement, that Michael would take care of things like this," he said.

Hannity returned to the payment later in the interview, giving Giuliani an opportunity to clarify.

“That was money that was paid by his lawyer, the way I would do, out of his law firm funds or whatever funds, it doesn’t matter. The president reimbursed that over a period of several months,” Giuliani said.

Hannity then pressed Giuliani, saying he “distinctly” remembered that Cohen had made the payment on his own without discussing it with Trump.

“I don’t know, I haven’t investigated that. No reason to dispute that, no reason to dispute his recollection,” Giuliani replied.

“The fact is, just trust me, they’re going to come up with no violation there,” he said. “The payment was perfectly legal, all documented."

Cohen has said that he made the payment, but that it was made with money out of his own pocket.

Trump admitted that Cohen had represented him in the arrangement with Daniels during an interview with "Fox & Friends," but that he didn't know about the payment.

Trump told reporters earlier this year that he didn't know about the payment made to Daniels.

Daniels, whose legal name is Stephanie Clifford, is suing Trump over the nondisclosure agreement she signed in exchange for the $130,000 payment, claiming the deal is void because Trump never signed the document.

She is also suing Cohen for defamation for suggesting that she lied about her alleged affair with Trump. Cohen is asserting his Fifth Amendment rights in the case.

FBI agents raided Cohen's office last month, reportedly searching for records related to the payment to Daniels, among other things.

Here's a fun fact: campaign finance law violations over $25k are felonies. The in kind contribution of $130k to Stormy Daniels was over that line. The reimbursement constitutes a separate crime of covering up the true source of a contribution. Also likely banking law violations.

https://twitter.com/tedlieu/status/991898421656109056

4 possible felonies from Rudy Giuliani admission:
1. $130k payment to Stormy was in-kind coordinated contribution above limits
2. Cohen was a straw donor used to cover up true source of contribution
3. False statements on financial disclosures
4. False statements on banking forms

But can Giuliani really make an "admission" of something he didn't do?

I'm not a lawyer, but if Giuliani clarifies that he simply misspoke/speculated incorrectly about motivations he wasn't privy to, and no paper trail or other contemporaneous evidence comes out confirming that campaign considerations guided the payment, I'm not sure Trump won't get away with claiming the payment was unrelated to the campaign, especially if Trump had made similar payments in the past, as seems likely he has.

i dont think he will backtrack either (even tho he could).

i think he was stating what he already knows the feds have evidence of.

its interesting that the case is taking place in sdny (where rudy was a us attorney) and the fbi ny field office (who presumably leaked info to rudy about the clinton investigation).

i wonder if rudy is getting a tipped hand.

>What I'm trying to say is he can't be a total jackass idiot

Oh, but HE IS a total and complete jackass now.

Dude is 73 - there can be a cognitive decline entering "old age." For example: Ever know someone who was reasonable and smart when they were 40, or 50 that became addicted to gambling at a certain point? My dad did, and he was smart and when he was younger he had very little interest in gambling. Something changed in his brain.

But things happen to the brain in some cases.

And lets not forget 911 happened - that is a VERY traumatic and stressful event. Imagine the pressure he was under - that could end up contributing to a delving in thinking. Plus he was probably hiding what an asshole he was better in the 1990s when it was bad taste to be openly insane.

Since 911 he's definitely been unhinged. And frankly if I was on the island that day there's a good chance I would have become unhinged too.

The old grey mayor just ain't what he used to be.

check the stats for all major cities in the 90’s. Crime went down across the country.

I have no idea if he did the heavy lifting in NYC but since he was in charge he gets the credit.

and 9/11 was horrible but those first responders were going in regardless of who the mayor was at the time. I feel like he has taken a lot of credit and I’m not sure he deserves all of it or most of it.

He did the heavy lifting converting it into the theater district it is today
Battling the mob
Handgun ban
Etc...

He had an impeccable rep as NYC Mayor

Let's not forget he was geared for POTUS campaigns on the strength of his mayorship...how ever many cycles ago...

Then 911 happened
His marital affairs became public

...and dude was never the same...

Some of it does feel like a natural decline in cognition

But it feels more to me like get back for those that opposed him in the above examples

Ever since then he's seemed to go as far right as possible...in some twisted effort to get even with the 'left'

IMO

But yes, as Mayor he did the heavy lifting

I'm sure it's actually pretty tough to do well. But if you picked better people to trust and were, like, two degrees less brazen about your obvious graft then you'd be better than the president at being a criminal.

the only things that will get Trump and Co. in any trouble is concrete irrefutable evidence and lies told under oath, correct? Trump lying to the press won't mean anything in terms of getting charges pressed on him, right?

No, if they can prove intent to obstruct by lying then it's a crime.

There's a bunch of government ethics rules and campaign laws and obstruction statues that I'm not super familiar with.

But you can't try to obstruct an investigation - and lying to the press, or to witnesses , or asking others to lie can fall into the illegal realm.

>He is good at this PR stuff

Daniels’s lawyer seems to be drawing from Trump’s P.T. Barnum-like playbook in his attempts to stoke media attention and provoke the White House. Avenatti, like Trump, has a bombastic style and reality-television instincts. He’s spent the past several days egging on high-profile figures with ties to Trump—including challenging Rudy Giuliani to a live-TV debate. Avenatti has also used the president’s preferred medium, Twitter, to whip up suspicions about a possible connection between the Russian probe and the Daniels scandal. And, in a tweet over the weekend, Avenatti seemed to acknowledge his behavior is part of a strategy to get to Trump.

“The constant media/PR pressure has forced Trump, Cohen, et al. to make a series of huge errors and to make damaging admissions helpful to our case,” Avenatti said. “This was not by accident. And we’re not changing.” Avenatti’s strategy is, of course, its own kind of PR effort.

Probably for consulting services. Oh....Trump met with the CEO for dinner later.

<
Novartis made four payments of $99,980 into the account in late 2017 and early 2018. Following the payments, totaling just under $400,000, Trump had a dinner meeting with Novartis’s incoming CEO ahead of a World Economic Forum gathering in Davos

I see this narrative a lot and it sounds wishful. that they didn't think they'd wi. Russia has been grooming and working with Trump since the 80s

And they pulled out ALL the stops
Hacking
Propaganda
Blackmail
Astroturfing
Helping smaller campaigns
Suppressing the vote via propaganda
Suppressing the votr via deregistering people
Buying influence via the NRA
Buying influence via smaller races

If there was a point of entry they prodded it, measured it for strength, and attacked accordingly.
They targeted minorities, media, the left, nativism .... everything
They exposed America for all of its flaws and created more.
They did everything to ensure victory. So it doesn't make sense that they didn't expect to win because it doesn't reflect their level of effort and commitment to this still ongoing fight.

They did pull out all of the stops but I still think it was more about damaging Hillary’s presidency and sowing division. IMO they wanted Trump to win but I don’t think they actually believed it would happen. My guess is that becoming president is the biggest regret in Trump’s life.

and yeah, I also think Trump winning was a long shot but they damn sure played that shit perfectly. It also didn't help that Hilldawg went missing in the final few months AND fainted on 9/11. I wouldn't be surprised if she was drugged by some Russian barista at Starbucks. The timing was way too convenient.

Trump kept implying she was weak and then she faints on 9/11 of all days?

Man.. sometimes I think all this shit is planned in advance. Even the Obama win. Hilldawg thought she had that in the bag and didn't even know the rules about primary delegates being split. How the fuck you wanna be president all your life, spend all those years watching your husband run and win but you don't know how the shit works?

but yeah.. Russians damn sure pulled out all the stops to get Trump close enough to win and he brought it home.

Plus its America and after 8 years of a Black man ruining race relations by winning... white folks were ready to take their country back.

stormy daniels lawyer just filed a lawsuit alleging cohen and that lawyer (keith davidson) colluded on several occasions with trumps knowledge, including davidson sharing client-attorney privileged information. the allegations stem from evidence obtained in the cohen sdny case.

Not sure why the "distractions" have to be ignored. All of it can and should be covered to get the totality of how terrible this administration is for the country and the world. Leave no stone unturned.

Think this board covers any and all 45* news pretty well.

Did you not live through the 16' election cycle?

Trump being a charlatan is not news

today

or 10 years ago

...and yet, he is the POTUS...

attacking him personally...how'd that work out for everybody else?

Didn't exactly keep him out of the white house

and I expect none of this well remove him

seriously, what's the point?

this stormy/avenatti shit has already been responsible for exposing a possibly illegal campaign expenditure (which trump initially denied) and also millions of dollars of payments to a cohen shell company (novartis, at&t, an investment firm tied to a russian oligarch etc) to gain access to the president. payments that were apparently shady enough to result in frantic pr statements and some firings.

it has also played a major part in a public corruption case in sdny (which is why avenatti/stormy was involved in that).

prior to that...even i was questioning the relevance of the story. since the media was mostly focusing on the sexual scandal.

but now we have a presidents lawyer potentially pedaling illegal influence to corporations and foreign governments...and also possibly in an illegal scheme colluding with another attorney to coerce women into silence before an election (not to mention the various financial/election law violations that involves)...and we should just ignore that and focus on other things? lol.

this is all about forcing as much information out into the public as possible. even the press wasnt on this. if it wasnt for the stormy shit we might not even know about *any* of it. who knows what other information will be exposed?

you have a president with a strong economy, no new wars, and no major domestic or international policy crisis. and he is still only hovering around 40% approval with republicans hemorrhaging parts of their core constituency like women, college educated, and suburban voters while getting beat up in special elections (last night dems just flipped their 40+ seat since the prez election by 20 points in a missouri district trump won by 5).

*all* of this information coming out is responsible for that in some way. and it will only get worse as time goes on.

plus wait until the effects of the tariffs and the staggered rollout of the tax cuts kick in.

people are acting like impeachment is the only acceptable end goal. but if things lead to a dem house/senate and a severely tarnished president getting voted out in 2020 the old fashioned way...thats even better.

coming from all angles. massive ongoing corruption and illegality on a scale we havent really seen before. and thats just from what we know publicly. but none of it matters because people knew trump was a dirtbag and voted for him lol.

nyt, wsj, tmz, and the enquirer all killed various stories about trump or his campaign prior to the election. even steve bannon had his own dossier on trumps mob ties that got buried.

so apparently shit like this does matter.

even tho a lot of folks didnt necessarily want trump to win...they definitely didnt want clinton to win.

i mean...aside from even the emails...she got slammed in the press for shit like being too smart/prepared and talking loudly at her rallies lol. her husband cheated on her multiple times and somehow she got treated worse for it than he did lol.

this big comey/doj/ig report thats about to come out? its pretty much gonna blast comey for defying doj precedence and outright directives in his handling of the clinton investigation(s). dude has hated her since whitewater. and there are a lot of people in the govt and press who felt the same way and would do anything they could to keep her out of office.

They're like: https://i.imgur.com/UfdFPIq.gif

Naturally, they are just giving the people what they want. And the people love scandal.
But the expense of that is other stuff gets pushed aside.

If we're talking about electoral politics, I don't think all of this stuff matters one bit as long as the economy is good. Folks will tolerate some corruption when their pockets are fat.

If your desire is Democrat legislative victories, keep in mind that the polls were strongest in Dems favor when there were real policy fights (ACA repeal, tax cuts).
I don't think Trump is bad generates enthusiasm. But good policy initiatives do.

but that 'none of this shit matters' attitude while overlooking *blatant* corruption is exactly how autocrats rise to power and stay there (not to sound too alarmist).

once people believe there is no consequence for those actions...or that everyone else is doing it as well so theres no point in caring...its a wrap.

never said it doesn't matter

nope, didn't say it

what I said was...there are more important stories that get absolutely no coverage...at all

For example; Roseann Barr is a racist, surprise surprise (c)

That story got 10hrs of coverage
5000 death toll in PR, got 30 minutes

https://www.mediamatters.org/blog/2018/05/30/study-finds-5000-people-may-have-died-hurricane-maria-puerto-rico-cable-news-focused-roseanne/220335

and folks, like yourself, who want us to believe they are evolved intelligent creatures...take the bait and fall for the distraction everytime

the corruption is evident...I could dig in on the 'unprecedented' description...but I won't because it is my personal belief that Trump is no more corrupt than any number of presidents

Crack and Aids = Ronald Reagan
Etc...

For everyday citizens to be this interested in a corruption scandal instead of policies and debates that will impact their lives for years to come...is my point

whatever this is...will play out to a finality...somewhere in the future

there are things going on right now today, that we as normal citizens can have an impact on

FBI collusion investigations, etc...are not one of them.

which i would side with you on.

i wish the media would spend more time on things like puerto rico, judicial appointments, the wealth gap, the rollback of civil/workers/voting rights in repub state legislatures and courts (including the supreme). i wish they spent more time on the rampant corruption in this administration (pruitt, zinke, etc). i wish they spent more time on mitch mcconnell and paul ryan destroying democratic norms with no media accountability. i wish they would stop buying into the narrative that trump has the economy humming when its essentially the obama economy and actually slowing under trump (job growth, consumer spending, etc).

that doesnt necessarily mean that i/we are 'falling for distractions' because we discuss any one story as it breaks. some of us are capable of paying attention to multiple issues. we dont have one track minds like sally.

Business as usual mentality is just moronic at this point.

spun off into another special prosecutor and pretty much came up empty in terms of the direct investigation. until a witness in a completely unrelated case secretly taped monica lewinsky admitting to having sex with clinton and convinced her to save evidence of the affair.

clinton wasnt impeached until 1998 (*6 years later*) for basically lying about the affair under oath. the lewinsky affair didnt even begin until 3 years after the original investigation started.

investigation took so long that clinton started another completely separate scandal in the meantime and *that* was what took him down lol.

(partial swipe)

As a presidential candidate in August 2015, Donald Trump huddled with a longtime friend, media executive David Pecker, in his cluttered 26th floor Trump Tower office and made a request.

What can you do to help my campaign? he asked, according to people familiar with the meeting.

Mr. Pecker, chief executive of American Media Inc., offered to use his National Enquirer tabloid to buy the silence of women if they tried to publicize alleged sexual encounters with Mr. Trump.

Less than a year later, Mr. Trump asked Mr. Pecker to quash the story of a former Playboy model who said they’d had an affair. Mr. Pecker’s company soon paid $150,000 to the model, Karen McDougal, to keep her from speaking publicly about it. Mr. Trump later thanked Mr. Pecker for the assistance.

The Trump Tower meeting and its aftermath are among several previously unreported instances in which Mr. Trump intervened directly to suppress stories about his alleged sexual encounters with women, according to interviews with three dozen people who have direct knowledge of the events or who have been briefed on them, as well as court papers, corporate records and other documents.

Taken together, the accounts refute a two-year pattern of denials by Mr. Trump, his legal team and his advisers that he was involved in payoffs to Ms. McDougal and a former adult-film star. They also raise the possibility that the president of the United States violated federal campaign-finance laws.

The Wall Street Journal found that Mr. Trump was involved in or briefed on nearly every step of the agreements. He directed deals in phone calls and meetings with his self-described fixer, Michael Cohen, and others. The U.S. attorney’s office in Manhattan has gathered evidence of Mr. Trump’s participation in the transactions.

by Ruppert Murdock now, right? Pretty interesting that paper would publish something that could hurt Trump.

In newspapers they're formally separate (as opposed to, say, Fox News, where the boundary is blurry).

WSJ editorial board has been populated by right-wing cranks for decades now. But their news division is generally a pretty straightahead old-school journalistic outfit.

(At least that's my understanding. I've never really read them.)

-- A story kinda related to this point, though it has nothing to do with Stormy Daniels or WSJ. The NYTimes published an op-ed a few months ago from an anonymous "resistance member inside the administration." Obviously the question of who this "resistance member" was would have been big news if someone had figured it out. So the NYTimes news division actually started investigating the NYTimes editorial division to try to figure it out. Apparently that was far from the first time that a major newspaper has investigated itself. --
