Father Of Att. Homicide Suspect Claims Shooting Was In Self Defense

A Nashville woman has been charged with attempted murder after she allegedly shot at a homeless man who asked her to move her Porsche.

Police said 26-year-old Katie Quackenbush shot Gerald Melton, 54, during the early morning hours of Aug. 26.

The incident started around 3 a.m. when Melton was trying to sleep on the sidewalk.

He was disturbed by exhaust fumes and loud music coming from a Porsche SUV nearby, according to a release from the Metro Nashville Police Department.

Police said Melton asked the driver of the Porsche, later identified as Quackenbush, to move the vehicle. The two started arguing, “with both parties yelling at each other,” but eventually Melton walked back to where he had been attempting to sleep, police said.

Quackenbush allegedly got out of the Porsche with a gun and fired two shots at him, one of which hit Melton in the abdomen. She then fled the scene in her Porsche, according to the release. A police spokesman told HuffPost that Quackenbush was with another woman who is not facing charges in the case.

Melton was critically wounded and remains hospitalized at Vanderbilt University Medical Center.

Quackenbush was charged with attempted murder Monday evening with bond set at $25,000. She was later released from jail, according to local station WTVF.

Her father, Texas attorney Jesse Quackenbush, claimed that his daughter shot Melton out of self-defense. He said she only intended to fire warning shots, not hit Melton.

Her father released an official statement to WTVF.
“The two women were actually acting in self defense. The man was always on his feet and not asleep as someone apparently has alleged and had accosted a group of very young women and nearly became physical with one. He then approached the white Porsche (not Lexis) with two female occupants and started verbally accosting them threatening them because their music was too loud for him to sleep... “The driver fired a round as a warning to scare him away as he came at her. He kept coming and she fired a second round, again intended to scare him away. They quickly got back into the white vehicle and left, not knowing that the man was hit by the warning shots. Both girls contacted the police and DA shortly after the incident and have always agreed to cooperate fully with the investigation.”
Jesse Quackenbush told the Tennessean that his daughter has been wrongfully charged.

“She’s never done anything like this in her life,” he told the paper. “She had an eyewitness in the front seat.”

Court records obtained by Heavy.com show that Katie Quackenbush has no prior criminal convictions, but has been charged with assault twice.

In October, 2013, the Amarillo Police Department arrested her on a misdemeanor domestic violence-related assault charge, which was dismissed six months later.

Last December, she was arrested in Potter County, Texas, and charged with misdemeanor assault. That case is still pending.

Maybe she was out in the ghost town doing some illegal shit, and the 'homeless' dude was their drug supplier that they robbed, lol.

But you right, the locations in the story are confusing. I'm guessing they meant Nashville, TN.

Basically they're bad ideas. Though I don't trust the district attorney to pursue a case.

From one poster:

If you're not prepared to shoot somebody with the first round available in the chamber, then you have to seriously question if drawing the gun was justifiable in the first place. If there is an actual justifiable need to draw the gun, then there is no further justification needed to shoot. The gun is not a magic talisman, the mere sight or sound of which will necessarily deter an eminent attack or stop an attack in progress. The idea of firing a warning shot sounds like you either have doubts about the justification for shooting, or are unsure of to which degree do you owe an assailant a warning. If you have those doubts, then don't draw the gun. It's that simple. A verbal warning, before an attack is sufficient warning. Such a warning need be nothing more than shouting, "if you come closer, I WILL defend myself." You have no moral obligation to inform them HOW you will do that. The ENTIRE responsibility for the outcome of an assault lies squarely on the shoulders of the assailant. If you are not convinced of this principle, that means you are questioning your own motives. That's OK.....but if you are questioning your own motives, then you probably can't justify drawing your gun and firing it.

"Jesse Quackenbush, Katie’s father, tells the story of the shooting differently.

An attorney in Texas, Jesse said his daughter and her friend were being accosted by Melton, whom he alleged approached the Porsche as the women sat inside, threatening to kill them and making explicit and sexist remarks at Quackenbush."

"After the man walked away, Katie Quackenbush got out of her car to escort her friend to a vehicle parked close by. She grabbed her gun and put a magazine inside."

Melton began walking toward her again, Jesse said, at which time his daughter told Melton she had a gun.

She fired two “warning shots” and then left, because Melton continued to approach the women, according to Jesse Quackenbush.

“She did say she closed her eyes when she shot both times, but they were warnings, and she thought she pointed away from him,” Jesse recalled.

When asked whether his daughter heard Melton scream or indicate he had been shot, Jesse said there was no indication he was injured.
