I'd say 50-50 chance to pass

They threw a token few billion dollars in opiate addiction funding. That will be enough to get the Ohio and West Virginia senators to pretend like they won and get on board.

Cruz got his amendment in which allows the sale of plans without essential health benefits. That will get the "real" Conservatives who were posturing on board.

I think Rand Paul might stay opposed with his "principled conservative" stance.

And there may be a moderate or two who can stand for the deep medicaid cuts. But once the CBO says it will cut 17 million instead of 22 million off of medicaid, they can treat that like a win and jump on board the McConnell train

Senate Majority Leader Mitch McConnell's plan to repeal Obamacare faltered Tuesday

Sen. Lisa Murkowski called for Republicans to develop a new bill in committees

Washington (CNN)Another day -- another excruciating setback for the Republican Party.

Three Republican senators said Tuesday that they would oppose a procedural vote to advance the Senate's efforts to overhaul Obamacare, once again plunging into chaos Senate Majority Leader Mitch McConnell's latest efforts to make good on the GOP's seven-year campaign promise to gut the Affordable Care Act.

Sens. Lisa Murkowski of Alaska, Shelley Moore Capito of West Virginia and Susan Collins of Maine announced that they could not support any plan that would roll back significant parts of Obamacare without a replacement plan in place.

McConnell told reporters at a news conference that it is "pretty clear there are not 50 Republicans at the moment for a replacement", saying he still wants to hold a repeal-only vote "in the very near future." McConnell did not specify when that vote would be but Senate GOP whip John Cornyn told reporters a vote is expected some time this week.

Those revelations came just hours after McConnell was forced to concede that his original attempt to repeal and replace the health care law at the same time was no longer a viable strategy.

Acknowledging defeat, McConnell had proposed a Plan B late Monday night: move ahead with a vote to take up an Obamacare repeal bill that the House passed earlier this year and aim to introduce as an amendment a 2015 bill that would effectively roll back key parts of Obamacare after a two-year waiting period.

That legislation was approved by a GOP-controlled Congress in 2015 and vetoed by then-President Barack Obama.

And the opposition that trickled out into the public Tuesday reinforced a painful reality for many Republicans to swallow -- that after years of railing against Obamacare, there is now not enough will within the party to pursue wholesale repeal of the law.

"My position on this issue is driven by its impact on West Virginians," Capito said in a statement. "With that in mind, I cannot vote to repeal Obamacare without a replacement plan that addresses my concerns and the needs of West Virginians."

She later tweeted she would not vote to move forward on a motion to proceed to repeal Obamacare without a replacement.

Murkowski called for Republicans to develop a new proposal in committees, a step that has thus far been skipped by GOP leadership in the chamber.

"I think what has to happen is the Republicans have to admit that some of the things in the ACA, we actually liked, and the Democrats have to admit that some of the things they voted for in the ACA are broken and need to be fixed," Murkowski told reporters.

White House deputy press secretary Sarah Huckabee Sanders said Tuesday that the White House's message to Congress is "do their job."

"At this point, inaction is not a workable solution so they need to come to the table and figure out how to reform the system and fix it," she said.

The weight of the most recent development quickly cast a shadow over Republicans on Capitol Hill Tuesday afternoon.

Sen. Ron Johnson, a Wisconsin Republican and a key vote, reflected that it might be time for Republicans to move on from repealing and replacing Obamacare "pretty quickly."

"I think we need to move on probably pretty quickly," Johnson said. "I mean, we've been at this. It did not, unfortunately, end in success."

Meanwhile, with some GOP lawmakers' key priorities like boosting funding for the opioid crisis now also stalled, Republicans who were planning to vote for the Senate health care bill are looking at their colleagues bewildered by the latest state of play.

"It was not the best possible bill, but it was the best bill possible," said Sen. Pat Roberts of Kansas. "When you can't even get to a motion to proceed, you're in pretty bad shape."

Asked what it said about the Republican Party's ability to govern, Roberts candidly replied "not much."

Amid the news of McConnell's latest defeat, President Donald Trump told reporters during a luncheon with Afghanistan veterans at the White House that he was "very disappointed" by Senate Republican's inability to pass health care. He added that his new plan is to "let Obamacare fail and then the Democrats are going to come to us."

Even still, Trump said Tuesday that he doesn't think the Republican plan "is dead" but it "may not be as quick as we had hoped but it is going to happen."

that the only way the hardline conservatives wouldn't simultaneously withdraw their conservative support for the bill is because this new McConnell attempt obviously will be "corrected" or "taken back" when they do that process when they combine what the House did and what the Senate did.

So, the moderates would have to know that McConnell (and the hardline conservatives) would only permit this because they think moderates will fall for anything.

Steps in Reconciling House and Senate Bills

So if everything goes according to plan, and the Senate approves the health care reform bill on Christmas Eve morning, what happens next?

Since both the House and Senate have passed different versions, this historic piece of legislation must be reconciled between leaders of both houses before it’s ready to be presented to the president.

The Constitution, after all, requires that the House and Senate approve the same bill or joint resolution in exactly the same form before it’s presented to the president for his signature.

The House version, which includes a public option and strict anti-abortion language is not included in the Senate bill; meaning, the effort to merge these two bills will involve twists and turns, peaks and valleys, and skillful parliamentary maneuvering before agreement is reached.

Historically, when both houses reach a standoff like this, the next battle involves going into a conference committee to iron out their differences with the resolution required to be approved by a majority of the Senate and House conferees.

The alternate course of action — which Congress has apparently elected to take — is an informal settling of differences. This will involve amendments being shuttled back and forth between each house, each chamber proposing an alternative until an agreement is reached. Settling their differences informally carries the added benefit of not having to prepare both a conference report and a joint explanatory statement once agreement has been reached.

So what happens if informal discussions shut down without an agreement being reached?

One potential consequence might be that the bill dies altogether.

Another alternative would be the creation of a conference committee, involving members from both houses, until a mutually agreed upon compromise is reached. It’s up to each house to determine for itself how many members will be represented in the conference committee. The conference report requires agreement by a majority of conferees from the House and a majority of conferees by the Senate — never both bodies combined — which is why both houses typically appoint an odd number of members in order to avoid a tie vote.

Other alternatives include: the House may approve an entirely new version of the bill and send it to the Senate; it might agree to the Senate’s amendments, which eliminates the need for a conference; or it might amend the Senate’s amendments and return the bill back to the Senate.

WASHINGTON — A plan to cleanly repeal the Affordable Care Act appears to have failed in the Senate after three GOP lawmakers said they would not vote to proceed with the latest attempt to reform the health care system.

Shortly after Sens. Mike Lee, R-Utah, and Jerry Moran, R-Kan., said Monday night they would not even vote to allow the original repeal-and-replace proposal to come to the Senate floor, Senate Majority Leader Mitch McConnell, R-Ky., announced he would scrap that plan and move forward with repealing former President Barack Obama’s signature legislation.

“I regret that the effort to repeal and immediately replace the failures of Obamacare will not be successful. That doesn’t mean we should give up,” McConnell said on the Senate floor Tuesday. We will now try a different way to bring the American people relief from Obamacare — I think we owe them at least that much.”

And though that proposal has the support of President Donald Trump, McConnell appears to lack the votes to undo the ACA with no plan to replace it — even though Republicans have been campaigning on that promise for years. They voted for the same thing two years ago, when the certainty that President Obama would veto it made it a cost-free move to please Republican voters.

But now at least three lawmakers have said they would not vote to repeal it this time around, effectively killing the proposal because McConnell can only afford to lose two members and still advance any bill.

Sen. Shelley Moore Capito, R-W. Va., quickly became the first lawmaker to come out against a repeal-only plan. Despite voting to repeal the ACA in the past, Capito said she was concerned about the effect doing so would have on her home state.

“My position on this issue is driven by its impact on West Virginians,” Capito said in a statement. “With that in mind, I cannot vote to repeal Obamacare without a replacement plan that addresses my concerns and the needs of West Virginians.”

Sen. Susan Collins, R-Maine, quickly followed, reiterating her past opposition to undoing the ACA.

“I do not think it is constructive to repeal a law that is so interwoven within our healthcare system without a replacement in place,” Collins said in a statement. “We can’t just hope to pass a replacement in the next two years.”

And Sen. Lisa Murkowski, R-Alaska, delivered what seemed to be the fatal blow early in the afternoon, telling NBC News that she was “not there” on the repeal-only bill.

“I said in January we should not repeal without a replacement, and just an indefinite hold on this creates more chaos and confusion,” she said.

Another potential roadblock is the procedural maneuvering McConnell needs to do to arrive at a vote to repeal the 2010 law. In a statement Monday night, he said he would bring the House-approved replacement for the ACA to the floor with the intention of passing an “amendment” that substitutes a full repeal to take effect in two years — a move designed to buy lawmakers time to devise a new system.

That amendment is the same as 2015’s symbolic repeal bill. But to even introduce it, McConnell will first have to convince hesitant senators to begin debate on the House bill, which was considered “dead on arrival” in the Senate when it passed in May.

Sen. Jeff Flake, R-Ariz., voted for the 2015 bill and said he would do so again if the amendment came to a vote, but he did not know if he would even support bringing the House bill to the floor.

“I’m still trying to understand the implications of bringing up the House bill,” Flake told reporters.

Sen. Rob Portman of Ohio did not say whether he would support the motion to proceed, but expressed concern about the uncertainty a repeal-only bill would create.

“If it is a bill that simply repeals, I believe that will add to more uncertainty and the potential for Ohioans to pay higher premiums, higher deductibles. So we’ll see,” Portman said.

Senate Majority Whip John Cornyn, R-Texas, earlier said he was unsure whether leadership had the support to bring the House bill to the floor, but implied that they would move forward with a vote in any case.

“We will find out,” Cornyn told reporters. “One of the purposes of having a vote soon is to find out where the votes are and where we go from there.”

They can pass it because it doesn't really change much in the immediate term. The mandates are already underenforced (and they were under Obama too; it's not an easy thing to enforce, politically). That's exactly WHY the individual market is still struggling.

All this mandate repeal would do is promote that chickenshittery to a law, make it impossible for even a future administration to shore up the market.

And all the while they'll claim to be doing it BECAUSE the individual market is struggling.

This vote is on the motion to proceed. That is, just to bring a bill to the floor. An actual vote on a bill is at least a few days away.

There are senators who have agreed to proceed. That doesn't mean they've promised to support the eventual bill. Once the bill comes up, amendments begin, and everything can explode the same way it has so many times before.

Heller, Portman, and others were presumably promised a bill with minimal changes, preservation of Medicaid, and big new opioid programs, which would cause a revolt among Senate conservatives and be a tough bill for a conference committee to swallow.

They can tell their anti-obamacare constituents that they were fighting the good fight.

They can tell their Trump supporting constituents that they were sticking it to the Democrats.

And they can tell their constituents who depend on Medicaid or the Obamacare rules that they were only voting to hold a debate, that they're just riding along to keep representing their interests in the negotiations.

Senate rejects proposal to repeal and replace Obamacare

Washington (CNN)Senate Republicans voted Tuesday afternoon to advance to floor debate on their efforts to re-write health care policy, with Vice President Mike Pence breaking the tie.

But hours later, the Senate decisively rejected a Republican proposal to repeal-and-replace Obamacare, a sign of the chaos expected to envelop Capitol Hill as GOP leaders work to find a plan their conference can agree to.

Wednesday morning, floor debate on the legislation to overhaul the Affordable Care Act will continue, even though there aren't any guarantees the votes are there to eventually pass it -- and it's unclear what a final bill will look like.

But little may match the drama of Tuesday's vote on the motion to proceed, when Sen. John McCain returned from Arizona to applause from fellow senators to cast what would be a critical vote for the Republicans. Two GOP senators -- Susan Collins and Lisa Murkowski -- sided with all Democrats in opposition, meaning all remaining Republicans and Pence were necessary for the motion to pass.

Emotions were high all afternoon -- as the vote began, protesters in the Senate gallery shouted "kill the bill" and "shame, shame, shame!"
The vote came as Senate Majority Leader Mitch McConnell and President Donald Trump dared their fellow Republicans to block their seven-year campaign promise to repeal and replace Obamacare.

Senators late Tuesday cast their first vote on what could be dozens of amendments considered to it.

This first vote dealt with a measure that combined a previous Senate proposal known as the Better Care Reconciliation Act -- that was rejected by several Republican senators -- with $100 billion in extra money for people on Medicaid desired by moderate Republicans and a proposal from conservative Sen. Ted Cruz, R-Texas, to allow bare-bones health insurance plans.




Democrats moved successfully to kill the amendment, which was possible because it had not been officially scored by the Congressional Budget Office and therefore didn't meet the complicated reconciliation rules that the Senate is using to consider the bill.





Republicans needed 60 votes to keep the amendment alive. It died on a 43 to 57 vote.




The vote came after a Senate clerk was forced to read the text of the amendment aloud in the Senate chamber, all part of the delaying tactics Democrats employing to express their overall unhappiness with the bill.




On Wednesday, senators are expected to cast a vote on a "repeal-only" proposal. It too is expected to be defeated because many Republicans as well as all Democrats reject repealing without a replacement ready.
Drama before Tuesday's big vote

The vote was up in the air until the last moments, when several Republican holdouts announced their support, including Sens. Rand Paul, Dean Heller, Rob Portman and Shelley Moore Capito.

Trump, who has repeatedly said he's ready to sign any repeal legislation, celebrated the vote, which creates a path to give him the major congressional victory that's eluded the White House thus far.
"I'm very happy to announce that with zero of the Democrats' votes, the motion to proceed on health care has moved past and now we move forward toward truly great health care for the American people. We look forward to that. This was a big step," Trump said at a White House news conference.

"I want to thank Sen. John McCain," he added. "A very brave man. He made a tough trip to get here."

But while Trump was happy with the result, he also acknowledged there's a long road ahead for the legislation and criticized the two GOP senators who opposed the motion.

"We had two Republicans that went against us, which is very sad, I think," Trump said. "It's very, very sad -- for them. But I'm very, very happy with the result. I believe now we will, over the next week or two, come up with a plan that's going to be really, really wonderful for the American people."






Democrats are united against the bill, saying it would end health care coverage for millions of Americans.







"Anyone who thinks this is over is sadly mistaken," said Minority Leader Chuck Schumer, D-New York. "There are many, many Republicans who don't like this bill, who don't want to vote for it. They are under enormous pressure to vote for it. ... Anyone who voted to move to proceed and certainly anyone who votes to send this bill to conference is virtually, certainly, voting to kick millions off health care, to make it much harder to get coverage if you have a pre-existing condition, to slash Medicaid and give a huge amount of tax cuts to the rich."

Sen. Bernie Sanders Monday called the bill the "cruelest, most destructive and irresponsible piece of legislation ever brought to the United States Senate in the modern history of this country."

In a speech at the NAACP national convention, highlighted the possible effects of the bill's provisions, which include cutting Medicaid, defunding Planned Parenthood and roadblocks for those with pre-existing conditions

Ironically, we probably need the insurance companies' lobbyists to get on the senators over what a bad idea that is. Repealing the mandates really would kill the individual market, as a few of the insurers have already said. The mere flirtation with this idea has supposedly been the main driver lately on premium increases and carriers dropping out.

'Repeal-only' health amendment fails in Senate


Washington (CNN)The Senate rejected a proposal from Republican lawmakers to repeal Obamacare on Wednesday, marking a significant milestone in the Republican Party's years-long political crusade to gut former President Barack Obama's legacy health care law.

The vote was 45-55, with seven Republicans opposing the measure.

The failed effort was a remarkable contrast from less than two years ago, when a Republican-controlled House and Senate passed an identical measure and sent it to Obama. He vetoed the bill. In 2015, the passage of that legislation was largely viewed as a political messaging exercise: GOP lawmakers were keenly aware that Obama would not sign it into law.

But now, with Republican President Donald Trump in the White House and ready to sign a bill, the stakes are real -- as are the realities of voting to repeal the current health care law without a replacement in place. The failure crystalized the new reality for Republicans: more than seven years after the enactment of Obamacare, there is growing recognition within the GOP that a straight repeal of the law is not viable.

Sens. Shelley Moore Capito, Susan Collins, Dean Heller, Lisa Murkowski, John McCain, Rob Portman and Lamar Alexander all voted against the amendment.

"I'm for repeal and replace and we're going to continue to work on replacement," Portman, R-Ohio, said after the vote.

"I didn't think repeal only was appropriate because it didn't provide for those people who are stuck in the status quo."

The proposal would have significantly gut the Affordable Care Act by repealing its unpopular individual and employer mandates, ending Medicaid expansion and rolling back a slew of the law's taxes. The repeal would not go into effect for two years -- a "transition period" during which Republicans would draft a replacement plan.

The Congressional Budget Office estimates the proposal would result 32 million more uninsured over the next decade. Three-quarters of the nation would live in areas with no insurers participating in the individual market by 2026, CBO said, leaving many without an option if they do not have employer-provided or government health insurance, such as Medicare or Medicaid.

The vote came during the Senate's second day of a marathon debate to dismantle Obamacare, with Republican senators continuing painstaking deliberations to reach an ultimate agreement on health care reform.

Senators were initially scheduled to vote on the 2015 repeal measure around mid-day, but that plan was unexpectedly delayed until later in the afternoon. According to a Democratic aide, the holdup was over language in the amendment about Planned Parenthood, and whether it passed the so-called "Byrd Rule," which determines what language is permissible under the budget reconciliation process.

Senate Majority Whip John Cornyn described the snafu to reporters as a "kerfuffle" and said that there was a need to make "arguments to the parliamentarian."

What's next?



The goal for Majority Leader Mitch McConnell at the moment is to find a way to get 50 Republicans to back a final bill -- whatever it looks like.



As with the full repeal without immediate replacement vote, the GOP leadership is getting a sense of where their members are on various proposals, as well as testing out revised language with the parliamentarian on things like the Planned Parenthood defunding provision.

If McConnell can get 50 votes, he can bring the repeal and replace bill to conference with the House. That was why the emergence of the "skinny repeal" option Tuesday is noteworthy -- a scaled back version of repeal that would knock out the Obamacare mandates and some of the taxes. In no way would Republicans want something like to that to become law in isolation. But it may become an option just to get something across the finish line, for now. Then they would attempt to hammer out a more comprehensive repeal and replace proposal in the conference with the House.
