He waited a couple of weeks when Souter and Stevens retired. He'll probably wait a bit longer since this was a death rather than a retirement but there's no way he doesn't try to nominate someone.

There was a bit of discussion about this a few weeks ago when somebody suggested it to Hillary at a town hall.

The biggest issue is that Justice Obama would have to recuse himself from every case involving a law that he had signed, including Obamacare.

the best way to fix the supreme court is to impose 20 year limits (I think that's the right time frame), after about 50 years it would allow each president two appointees. Something like that. I read about it a while ago.

But in no circumstances should Hillary appoint a right of center person.

The truth is this is great news for Hillary. Strenthens her case and if she gets to appoint two nominees she starts off with a huge legacy securing achievement.

Heck she might even get a democratic senate.

This is also good news for ted cruz who has been campaigning all along that it is all about the supreme court. Evangelicals are going to come out in droves. But if Bernie loses are his fans going to pack up and take their marbles and not show up?

Keep meaning to blog this but I haven't. This is the weakest crop of candidates in my lifetime and they are all going to need a rival to vote against as much as they need people to vote for them.

It's why Trump, while he does match up well against HIllary, is great for Clinton because people will come out in mass to stop Trump from being President. The Republicans had it good with Clinton and Bernie but now that there's potentially an instant seat on the line? People are going to support whoever to make it happen. That's the point...People don't USUALLY vote for Presidents on their VP choices...No doubt they help in giving some semblance of balance though...

LBJ, Palin, Ferraro (for much more sexist reasons...not to mention Mondale was weak to begin with...) and Joe (Obama, being the black guy needed a SOLID, WHITE VP pick....) were the only four VP choices in the history of Presidential campaign that were deemed as make or break...The rest? Not so much....

picking up votes and still game this late in the race. You'd have the coronation that many people in the Democratic Party believe they deserve. Like Gore, this election has its made man and the lefty who won't drop out at the behest of party. We've been through the this before only this time it has even more momentum.

When you want to crack a boulder you don't hit it with a hammer once. You score it. Then you hit that score several times until it breaks. Nader was the score. He didn't break the rock. Sanders is a blow. He may not break the rock either but he will make make easier for a more progressive candidate after him. Eventually we will finally get a viable third party candidate in office or a true progressive democrat in office.

If you can't see the connection between Nader and a democratic socialist now running as a viable democratic candidate I don't know what to tell you.

Voting for Nader was a long term strategy not only to chip away at the two party system but more specifically a response turn around a Democratic Party that was trailing so far to the right (Nafta, welfare to work and crime bill) that it was left in name only, back toward left of center, if not a progressive ideology. Moderate democrats throw all the same shit at berners as they did at Nader lovers for years even after the election. Except it's not sticking the way it used to because we've been through it before.

As far as the scotus...
Moderate democrats always talked about "tipping the balance" and the dream of a liberal majority court just as much as replacing dem for dem. So why pity pat with Obama when he could actually prove his worth by putting up and vigorously fighting for a scale tipping judge?

Come January 2017, Republicans have a chance at controlling the House of Representatives, the Senate and the White House.

So it stands to reason that Republicans have very little incentive to even consider President Obama's suggestion for who should replace Justice Antonin Scalia, who died Saturday.

There's some historical precedent for them to do just that. A hazy rule dating back decades that congressional experts say is really more of a tradition suggests senators of the opposition party of the White House can oppose some judicial nominations in the months before a presidential election.

It's known as the "Thurmond Rule," for reasons we'll get into, but there is widespread disagreement on what it even means and when it can be invoked.

"It's not a rule," said Russell Wheeler, a judicial expert with the Brookings Institution. "It's just sort of a pie-in-the-sky flexibility that both parties try to disown when it's convenient for them and try to say it means something when it's not."

Whether rule or tradition, it pops up throughout history in times like these, when a high-stakes judicial nomination collides with a presidential election.

But Wheeler and other congressional experts think the rule is less in-play now than in the past. Republicans have control of the Senate and can simply sit on the nomination if they want -- no matter how much the other side cries foul.

Wheeler said the argument they can make to do that is less about a somewhat-arcane parliamentary tradition and more about whether it's fair to consider a life-time judicial nominee by a lame-duck president before such a pivotal presidential election.

Senate Majority Leader Mitch McConnell (R-Ky.) appeared to say just that in a statement Saturday night. "The American people‎ should have a voice in the selection of their next Supreme Court Justice," his statement read. "Therefore, this vacancy should not be filled until we have a new President.”

Senate Minority Leader Harry Reid (D-Nev.) fired back in a statement that spending an entire year without considering Obama's nomination to replace Scalia is unprecedented.

"It would be unprecedented in recent history for the Supreme Court to go a year with a vacant seat," he said. "Failing to fill this vacancy would be a shameful abdication of one of the Senate's most essential Constitutional responsibilities."

Reid's office circulated some recent stats noting that, since the Ford administration circa 1975, it has taken on average two months between a judicial nomination to the final Senate vote. Today, it's about 75-90 days on average from the time of a vacancy to appointment on the Supreme Court.

Reid is banking on historical precedent that the Senate has typically stopped considering judicial nominations the summer before a presidential election, after each party has nominated its nominee. In other words, the Thurmond Rule hasn't typically extended to an entire year.

But the rule is really a guideline that is often pulled out by both parties whenever is expedient. Here's the background:

In the summer of 1968, Sen. Strom Thurmond (R-S.C.) opposed President Lyndon B. Johnson's choice of then-Justice Abe Fortas to the top spot on the Supreme Court of chief justice. (In the Senate, one senator can block just about anything.)

Thurmond's rationale for blocking Fortas's promotion was was both parliamentary and political. Johnson, who wasn't running for reelection, was a lame duck. It was just six months or so before the presidential election that Thurmond's party had a good chance to win.

Fortas never got the top job. And opposing judicial nominations in the summer before an election year became known as the Thurmond Rule, and it's pops up in the Senate from time to time, especially recently.

In 2004, Senate Democrats, then in the minority, debated dusting off the then-dormant "rule" to block President George W. Bush's nominees before the election. At the time, some senators probed by reporters didn't even know what the rule referred to.

The Hill reported at the time: "Sen. Trent Lott (R-Miss.) could only come up with a guess at what it might mean: for a senator to stay in the Senate 'until you can’t walk.'”

In June 2012, McConnell, then the minority leader, said his party would block some of Obama's judicial nominees to the circuit court until September.

Have a better than decent record on civil rights, so that a case on police brutality can make it to the Supreme Court and change the way the law is applied to from the current narrow interpretation that makes it nearly impossible to prosecute individuals of depriving someone of their civil rights even if they kill them in state sponsored violence.
I need someone who understands that corporations are not people and that laws around abortion and its administration by states cannot be excessively obstructionist and what level of obstructionism is actually a violation of a protected right.

Yes, The Senate Arbitrarily Blocked A SCOTUS Nom Before--In The Mid-1800s

Senate Republicans can claim some precedence for blocking any of President Obama’s nominees to replace the late Justice Antonin Scalia until a new president is elected -- if they reach back to the mid-1800s.

The GOP’s insistence -- immediately upon news of Scalia's death -- that the Supreme Court must wait until the next president to gets its ninth seat refilled is not unprecedented, but is nonetheless very rare. In fact, all the unsuccessful Supreme Court nominees of the last century ran into problems because of their own traits, rather than some arbitrary obstruction aimed at the president.

The closest comparison to the wholesale rejection President Obama is about to face with his nominee is President John Tyler, who holds the unenviable record of having four of the five men he put forward fail to make it to the Court. The fight was part of a larger clash between Tyler and the Whig-controlled Senate, where Whig lawmakers hoped Sen. Henry Clay of Kentucky would win the next presidential election in 1844.

Over the course of 15 months in 1844 and 1845, in an effort to fill two Supreme Court vacancies, Tyler submitted and resubmitted his nominees a total of nine times. Samuel Nelson was finally confirmed in the last weeks of Tyler's presidency. But the second vacancy wasn't filled until well after Tyler left office, with the confirmation of Robert Cooper Grier in 1846, more than two years after the seat was opened up by the death of Henry Baldwin. It seems unlikely the Scalia vacancy will break that record, assuming the Senate takes up a nomination in the months after the 2017 inauguration.

The next closest scenario is what happened to President Andrew Johnson's 1866 nomination of his Attorney General Henry Stanbery, who was otherwise well-liked by lawmakers. The Senate, however, did not like Johnson, so it opted to pass legislation that reduced the number of seats on the Supreme Court from 10 to seven, preventing Stanbery from ever being considered.

In 2010, the Congressional Research Service issued a report studying the circumstances of Supreme Court nominees who were not confirmed. It found that out of the 36 times a president’s Supreme Court nominee was not confirmed by the Senate, the Senate’s opposition to the president himself played a role 16 times. Seven of those nominees -- all in the 19th century -- were submitted during a president’s lame-duck period between the election and the inauguration of the new president.

Opposition to the nominating President played a role in at least 16 of the 36 nominations that were not confirmed. Many of the 16 were put forward by a President in the last year of his presidency—seven occurred after a successor President had been elected, but before the transfer of power to the new administration. Each of these “lame duck” nominations transpired under 19th century Presidents when the post-election period lasted from early November until early March.

In some of those cases -- like President John Quincy Adams’ nomination of John Crittenden or President Rutherford B. Hayes' nomination of Stanley Matthews -- those nominees were confirmed once the new president took office.

In the last century or so, the nominees who have not been successful faced obstacles having to do with their own records -- many of them blocked or withdrawn over concerns about past resistance to civil rights.

Since the 1800s, only Homer Thornberry saw his nomination fail for reasons not related to his own record of activities. He was nominated in 1968 by President Lyndon Johnson to take the associate justice chair of Abe Fortas, who Johnson had nominated to replace the retiring Chief Justice Earl Warren. Fortas was forced to withdraw as the chief justice nominee because of a personal controversy but kept his associate justice seat, making Thornberry’s nomination moot.

Scalia was a law professor of mine, and was on the faculty of the U of Chicago the entire three years I attended. The law school is one of the smallest in the country, housed in one building and relatively intimate as graduate schools go. While I was there, Scalia was outed as a blatant racist to the extent that the Black American Law Students Association (BALSA) chapter at the law school brought it to the attention of acting Dean Norval Morris in several meetings. Scalia flunked every black student who took his classes that year. Nobody flunks courses in elite law schools. It's unheard of. He flunked one brother so badly, it skewered his grade average, and he became the first, last, and only student in the history of the school to repeat first year. That man went on to become a repected military judge. Ultimately, no action was taken because the source of the information was private, confidential and privileged, and Scalia's racist attitude and actions toward black students could be plausibly denied, but just barely. He stuck with his story that he had graded blindly, but it came out that Scalia had done the same thing, when he was on the faculty at the U of Virginia. However, Scalia was an academic star actively politicking for a federal judgeship with national political connections, as well as being quite personable. The school administration passed on taking any action, since the actual facts regarding his intent could not be adduced in a tribunal. However, what he thought of black people was indisputable, and believe me it was nothing nice. Being a swarthy, son of poor Sicilian immmigrants, and intent on becoming an all-American white man, he was consumed with putting as much space between himself and Negroes as possible, and becoming an honorary member of the WASP elite.

The reason I don't believe it is because Scalia failing whole classes of black students at two institutions would likely have been mentioned before. Especially given his reputation. This is a man that folks enthusiastically disparaged

When Scalia gave his comment about blacks not belonging in elite universities, why did this issue never came up? In his whole long history of making similar comments, no one ever told this story.
I did a quick google search and came up with absolutely nothing.

If a few more people come out a cosign this guys take, I'll believe it. But as it stands, it is pretty difficult to take as a true story

While on the Supreme Court, Justice Antonin Scalia, who died this month at 79, worked to make society less just for black Americans, railing against affirmative action and seeking to undermine the Voting Rights Act. His admirers would attribute this not to rank bigotry, but to his textualist legal philosophy. According to some of the dead justice’s former law students, though, a younger Scalia also went out of his way to undermine young legal scholars, simply because they were black.

After an undergraduate stint at Columbia, Arnim Johnson attended the elite University of Chicago Law School in the late 1970s, during Scalia’s tenure as an instructor there. In the spring trimester of his 1L year, Johnson took administrative law with Scalia, before temporarily moving to Washington, D.C. for a summer job with the government. Upon receiving his final grades for the term, Johnson was shocked to discover he’d failed the course with a flat F—practically unheard of at a top-tier school like Chicago, or any law school for that matter.

Johnson explained what happened next, as he remembered it, in a widely shared Facebook post:

The school administration passed on taking any action, since the actual facts regarding his intent could not be adduced in a tribunal. However, what he thought of black people was indisputable, and believe me it was nothing nice. Being a swarthy, son of poor Sicilian immmigrants, and intent on becoming an all-American white man, he was consumed with putting as much space between himself and Negroes as possible, and becoming an honorary member of the WASP elite.

I reached Johnson over the phone at his home in Chicago, where he confirmed this account and explained what steps he took next: “I was talking on the phone, called another friend of mine who had gone to UVA. He had graduated and moved to Chicago, we’d met the summer before I went to law school, and was five years older than me.” Johnson recalls complaining about his fail grade to this friend, lamenting, “this guy Scalia.....” when the friend cut him off:

“‘Antonin Scalia? He flunked everyone at UVA, too.’”

Johnson’s recollection seems about as vivid as anything could be after 40 years, though he admits that many of the people who could corroborate the mass-flunking are dead or infirm.

He also admits that he’d been wrong about at least one classmate whom he’d remembered receiving an F, but who he now says passed the class. I spoke with one such former Scalia student, Ben Streeter, now an attorney with the Federal Election Commission, who told me that although he passed Scalia’s class, he noticed preferential treatment for a group of conservative students, who at that time were entirely white:

The final exam in the admin law class was the only exam I’d only taken at U of C that had a section of short-answer questions...What immediately struck me was that answers were something that had never been covered in class, but it struck me that this was the kind of thing that he would talk to students about if students came by to visit him.

These students who got face time with Scalia outside of class all had something in common: “In those days, the only students who came by to visit him were in the Federalist Society group,” a conservative cadre that promoted Scalia’s originalist interpretation of the Constitution. “There was not a single black member of the Federalist Society in my three years at the U of C,” Streeter added over email.
“It seemed very strange that almost every black student’s lowest grade was in Scalia’s class.”

Phillip Hampton, now senior counsel at Haynes and Boone in Washington, DC, studied law at Chicago a year beneath Arnim Johnson, and was president of the Arnim black law student group, BALSA. Although his recollection differs slightly, Hampton corroborates much of Arnim’s claims: “It seemed very strange that almost every black student’s lowest grade was in Scalia’s class,” he told me via phone. “I don’t think any black person got more than a C- from Scalia...black students received Ds and Cs, failed Arnim ” along with another black, very high achieving student.

As president of the law school’s BALSA chapter, Hampton remembers challenging the school after students realized they were being treated differently because of their race—a claim the school first opposed on the basis of blind exam testing. In short, that grades couldn’t be handed out in a racist manner because the examiner couldn’t known any given student’s race. Arnim Johnson disputed this claim, saying that Scalia (and other professors) had full access to the university’s print shop, through which exams were filtered during the testing process, and that it would’ve been easy to discern which blue books belonged to which students. But Hampton also recalls an ominous remark by Scalia: “He made a statement once that he could tell—because he was such a linguist—that he could usually tell papers that were written by African Americans.” The school finally admitted that professors “had access to the blue book numbers and names,” but only so that they could award extra credit. “I said that’s bullshit,” Hampton remembered.

No one I spoke to recalled any white students experiencing similar trouble at Chicago with Scalia or any other professor. But the class sizes were so small in those days that the contrasts were easy to detect, recalled Hampton: There were very few African Americans in my class, so my first friends were white guys, and I studied with them.” Hampton said that he “wrote the entire outline for contracts, and I had the lowest grade in class, got a C-, one of my lowest grades ever.” As for his classmates? “Pretty sure the white guys got in the mid 70s, and one got an 80, which was an A.”

The University of Chicago had no comment on Scalia’s grading practices or the allegations made against him.

Update: A university spokesperson provided the following statement:

We are saddened to hear of these allegations. Because of the length of time that has passed, and the fact that some of the individuals are either deceased or no longer work at the Law School, we are unable to comment on whether the allegations are true.

The University of Chicago Law School embraces diversity as an integral part of our educational mission, and works to ensure that every student is treated fairly both inside and outside the classroom. We would take extremely seriously any such allegation today, and our long-standing policy of blind-grading is intended to minimize the possibility of that kind of misconduct.
