As some of y'all might know some of the details of the case have gotten fuzzy.

The accused was cleared
The accuser never filed a police report (not uncommon)
The accused name has gotten out and has become a pariah (understandable)

And at the end of the day, I'm really not sure how I feel about all of this. She's clearly benefited from this, but shouldn't she, assuming the assualt did happen?

Help me out y'all. Let's rap a taste about this.

By the way, are your familiar with Chuck Johnson? He was the one who really revealed some of the ambiguities in the case, but the way he did it....

I dunno what's driving her. But I can understand why the university's investigation and hearing process resulted in his acquittal. There's not enough credible evidence - even with such a low standard. I also understand the lack of criminal charge here - I don't think a reasonable jury could find him guilty beyond reasonable doubt.

his main advantage in this case is that he has not ever been charged criminally or sued civilly. which means this case has stayed OUT of any court of law. the university investigated and didn't find the allegations the main woman brought were credible. another woman's allegations were also unfounded, said the school. a 3rd woman's allegations resulted in a trial where his conviction was overturned on appeal. he will not face any further legal or administrative action in these matters.

if he files a civil suit he will open himself and his life (including his sex life) to the civil discovery process. as part of that process the defendant(s) can probe into the darkest corners of his life looking for relevant evidence to support their defense. that process could/would involve depositions and written interrogatories. it could get very ugly for him - especially if he has any secrets. other women who claim he's been creepy or rapey w/them will be brought in to the case. all of it will be on the record. and all b/c he brought the case to court. i dunno if he has anything to hide or anything he'd rather his parents and employers and friends and peers don't find out.

i think his better course, the safer course, is the one he seems to be on. he should fight the case in the court of public opinion where he can still rightly claim that the cases have been investigated and none of the allegations resulted in criminal charges. the one case where the allegations were initially found to be true was overturned. he has been fully exonerated. he should stick to participating in interviews w/friendly journalists and bloggers and just leave it there. eventually this will blow over. when ppl search for his name on the Internet he can work to be sure they find articles that lay out the exculpatory evidence and remind readers that he was never criminally charged, let alone convicted.

if i were him i'd leave it there.

he appealed it, and won on a technicality of sorts. My point isn't that he did it. My point is that there's a grey area, and you can't really be sure from the outside where the truth falls.

Same as i have no idea about the girl w/the mattress. The people coming down hard on one side or another are the crazy ones to me.

I couldn't convict the guy of anything based on what I've read, but I also am not the type to want to take up the banner for the guy as some kind of innocent victim.

this seems to be the crux of the issue with SO many
trust you are quite banal in your line of thinking

the fact is rape is messy
its never ever a perfect case
there are no perfect victims
it really hasn't zero'd in with people that a majority of victims KNOW their rapists
and how this plays out in the real world
same with abuse

folks want the I LEFT HIM immediately
and that rarely if ever happens in relationships let alone abuse and then let alone rape

much of the time the victim is trying to sort out what happens and maintain normalcy in whatever way possible

what she did was take was is actually a typical date rape scenario on campus and brought to light how messy it is

kudos to that girl

its really hard for me to outright dismiss her claims-
and maybe because i believe most survivors actually dont lie when they do come forward
and those that do lie... well its really a disservice to survivors
however, i do admit her story doesnt really hold up... so there's that

but my bigger concern though is how the uni handled all this

the case was dismissed - and hopefully she was provided with all options to help her deal with all this
but in the same vein, i'd consider the whole 'carry-the-mattress' to be a bit of harassment
especially if there is the potential that these allegations were not true
i dont know what the uni could have done to stop that, but i think they should have...
they should've offered equal protection to both parties in a case as problematic as this.

the mattress-woman's story doesn't read like the UVA woman's fake story - she didn't encounter road blocks from Columbia when she tried to report. i haven't read anything that gave me the impression Columbia tried to bury her allegation.

^ i read that. it seems the university's investigation resulted in a hearing a few months after the initial complaint was filed. there was some delay - occasioned by the accused's academic requirements (indeed the complaint was filed in April which is likely just before the end of the school year...finals and all that jazz). the accuser complained that the process seemed dragged out unreasonably. also she complained about being questioned during the hearing and that she was questioned several times during the investigation while the accused only made one written statement.

after reading it i see her complaints about the university seeming to drag its feet. i don't necessarily agree that the university was trying to bury the allegations or the investigation though considering the timing of the complaint (just before the end of school year) and the final decision (during the fall semester of the next school year). i think if the university had really wanted to drag the case out to silence her it would've taken much longer to issue its finding. the delay of which she complains doesn't seem unreasonable to me. also, her being questioned multiple times doesn't seem unreasonable either as that typically happens during any investigation. and her being asked for specific details of the assault is also normal and doesn't strike me as unreasonable.

and i had heard a little info about the case before i read those.

then i read Cathy Young's account. and since then i've read several other articles and blog posts - i've either posted them here or i found the links to them here.

anyway, back to CU...it seems like the university may have overdone it in trying to support the accuser after the investigation and the finding that accused was not responsible for a code violation based on her allegation. i think CU may have wanted to avoid appearing like it was trying to sweep her story under rug in part b/c as you point out the university is interested in maintaining its 'liberal' reputation.

you are confusing cops not finding evidence and a prosecutor unwilling to prosecute because they don't feel they have a case
with "not guilty"
it really isn't the same thing

this hasnt resulted in them lowering tuition fees or not getting that NIH research funding

she has had the opportunity to provide evidence of her claims
she has been allowed to have this as her thesis project regardless
i agree if she feels she didnt receive the right recompense she should take it up further
and with all due and necessary support
im just not sure her claims are valid and this is where we disagree.
and (for me) especially if this is the case then its harmful to others who may face similar situations

if i were a juror in a criminal case against homeboy where the prosecution has the burden to prove the allegations beyond any reasonable doubt...i'm not convicting him based on what i've seen, heard and read thus far.

w/in the four corners of the case the allegations against the accused are not credible. i remain unconvinced.

this even though i generally tend to believe rape accusers and offer them the benefit of doubt and view their allegations in a light most favorable to them. i wouldn't do that as a juror, of course, but when i do that in THIS case i still don't believe this particular accuser. even when i extend her the benefit of my doubt i find her less than credible.

I've read some things on both sides, including a letter written by another accuser, and lets just say we're probably not in a situation to call it either way.

I can read some text messages and say I wouldn't have written them, but I've heard that maybe pretending like everything is normal is a not-uncommon coping mechanism? So who knows...

This situation seems kind of foul on both sides, but no way do i have all the details. I'm not comfortable painting the guy as a raper, nor am i comfortable saying that she's a crazy liar. Could break either way for me... either way the situation sucks.

I think the more interesting aspect is how certain factions of people want to hold either party up as symbols of their stupid movements. There's no room for grey area with either crazy faction, when in this case there seems to be a shit ton of grey area.

'Sara' and 'Natalie' spoke w/each other before they filed their complaints. it seems 'Sara' had heard rumors about 'Natalie' having split w/the accused and probed her for details. then some time after the conversation they filed their complaints.

the bartender @ that APD party (Josie in the linked article) filed some time in spring semester 2013. she complained of sexual assault that didn't rise to the level of what we commonly call 'rape'. it was more like a battery (unwanted touching) that gave rise to a 'reasonable' fear of imminent rape.

I think dude is probably very rough with women. Probably watches too much porn and thinks that you are suppose to manhandle women.

Probably goes from 0 to 100 in the bed room (e.g., kissing straight to anal).

But of course, all women don't like that. I think he has probably gotten with more than one woman who didn't like it but also didn't speak up to air their displeasure.

We send women (and guys too) this weird conflicting message where we tell them to be assertive, speak up and stand up for themselves...except when it comes to sex. With sex the rules are totally different and a women shouldn't have any obligation to express what they dislike EVEN in instances where there is no reasonable threat of violence.

There is a worthwhile debate to be had over whether women have an obligation to say no about certain sex acts or if I guy needs to proactive get a consent from a woman before engaging in certain sex acts but that conversation always goes sideways with accusations of victim blaming and MRA crying.


And for the avoidance of doubt, I am talking about this sort of "date rape" and not jump out the bushes or any other sort of stranger rape, or anything that involves violence or drugging or anything of that sort.

the mattress-carrier's accusation doesn't, IMO. i think she's an unrequited lover who regrets having had sex w/several friends and is using this case to further her personal gain. her allegations are unlike those made by the other 2 women - neither of them claim he was as violent as she claims he was w/her.

the ex-girlfriend seems to have been unduly influenced by the mattress-carrier. she says she didn't like that he would hold her arms behind her head when they had sex and didn't speak up about it or consider that non-consensual sex until months later.

the bartender is complaining that he groped her at a party where alcohol was involved. she doesn't say he was particularly violent though. the university initially found the accused 'responsible' for a code violation but later reversed after she declined to testify during his appeal hearing. her refusal casts some doubt on the veracity of her claim. especially since she couldn't be bothered to testify against him a 2nd time but has commented about the case in the media.

i don't agree that he's a 'pig' based on the stories these women tell.

The other 2 women are friends of Emma and only went public AFTER Emma's initial accusation for events that PRECEDED the alleged rape. You can't dismiss the other women solely on that....but it certainly weakens the 'multiple accuser' argument.

In the case of Cosby....the fact that the multiple accusers were not known to each other in addition to having similar stories is what makes it so compelling. In this case....the accusers know each other well and have very different stories.

And all the talk about the school just 'wanting it to go away' is bullshit. The president of the school co-authored an article in support of Emma. They funded a rally for Emma on school property. The school's website had an article of endorsement that presumed the guilt of the accused. The president of the school suggested to Emma that she use her protest as a means of getting her degree. From what I've read, she never stated that the school's process was unfair or biased or flawed. She just didn't like the result.

Let's assume, hypothetically, that Emma is lying here.

Another thing....my ex was a militant feminist who edited the most popular feminist newspaper in Canada 7 years ago. In that world.....Emma's experience in addition to the way she fought back carries ALOT of currency. I'm talking 'modern-day folk hero' status. (as it should if she were telling the truth)

So let's not be naïve and act like she has no motive to lie. If people will lie about being in Vietnam for a little extra change when begging....then surely we can imagine a young girl identifying and seizing upon an opportunity like this.

The point is.....we have to stop this 'women don't lie about rape'. Women are people. People are opportunistic. Lying about rape sometimes carries opportunity.

And that's the last thing I want to address. I really can't relate to this 'I never question a woman who claims to be raped'. That's a presumption that I save for my friends and loved ones. But that's a wash cause I wouldn't suspect my friend was lying if they claimed the mailman killed their dog either. I always presume that my friends are telling me the truth. But that's precisely why I would not be allowed to adjudicate my friend's trial.

Some random name in a newspaper? Fuck that. People lie. Innocence before proven guilty. This idea that we have to presume women claiming rape are telling the truth in order to minimize their trauma is preposterous and only makes lying about it even MORE tempting for opportunistic people. We're gonna make this one exception in law....this one particular crime is an exception from others in the sense that it's deemed true as soon as it's accused?

I don't believe false rape claims are STATISTICALLY significant

taking a look back at your responses to threads like these I see two potential perspectives on you with regards to this subject:

1. Someone close to you has alleged they were raped and that alleged rapist went free. Whomever it was was likely a family member or, considering your age and where you're from, some chick that had you in the friend zone who's boyfriend was accused of raping her. It would stand to reason that you would take such a hardline stance on this issue as you're personally affected by it.

2. You have committed such an offense yourself and are filled with guilt and self loathing to the point where it manifests outwardly as contempt for individuals who have committed similar atrocities. We joke about politicians that go hard against gay this and that only to have been caught with another man themselves however this would be no different a situation. In order to try to diminish your own guilt you try to take a hardline stance against the very crime you're guilty of.

A third perspective popped up as I was writing this: A combination of 1 and 2. You have committed a similar crime though maybe you didn't consider it as such at the time... possibly even accused and acquitted of it, and not long after the same thing happened to a female loved one. When told to you the parallels were enough to cause enough guilt that you took up a hardline stance in order to help quell your own feelings.


Not long ago I figured it was #1; someone close to you wound up in a similar situation and despite her best efforts the alleged rapist walked away unscathed (well... maybe not unscathed as being accused of rape can have long lasting effects itself). However, the last few interactions show something else; you're starting to come unhinged. Your posts are a bit more erratic, more simplistic, and more about provocation where in the past there was meaningful discussion to come from you. It's a tell-tale sign of a man unraveling, falling apart under the weight of his own guilt.

And here you stand, today, taking shots at EVERYONE including folks on this board that have typically been on the same side of the fence with you. It's becoming borderline, if not full on, trolling.

Whatever the case, you need to deal with that shit dude. Talk to someone, a mentor, a pastor, imam, counselor, or whatever. This shit with you is getting to the point of being ridiculous.

It just illustrates how badly Columbia (and various higher learning institutions) fumble these things.

They half assed it on both sides; they've got a history of being S-L-O-W to respond and to begrudgingly react to various student life incidents, rape and racial included.

On the flip side if they believe he was truly innocent of all the charges, letting someone base their thesis around spreading how one of their students is a rapist *smh*.

While he said/she said will always be murky, once the uni gets involved it should be swift and decisive...and this failed once again.

and violations carry penalties that the university can impose w/o regard for the criminal justice process. also b/c under the university's code a fact-finder need only be convinced by preponderance of evidence which is a lesser standard than beyond reasonable doubt.

it could be that the local prosecutors declined to file a charge in a given case b/c they understand no reasonable jury would convict under a beyond reasonable doubt standard. however that doesn't mean there's not enough evidence to convince a fact-finder under a lesser standard like preponderance of evidence. and so the university could have enough evidence to find a violation of the university's code of conduct though prosecutors don't have enough for criminal conduct to be found.

note: i think i read that in THIS case (the mattress-carrier case) the police investigated and local prosecutors declined to bring a criminal charge against the accused.

the boyfriend before the accused (the mutual friend) where she basically said that she was drunk and passed out/blackedout, who proceeded to have intercourse with her, though she didn't give conscious consent, THAT definitely looks like rape.

I don't think she pursued charges or a grievance in that regard. However, if one were just look at the collection of evidence for both parties, it seems as though he has exhaustively provided details and corroborating evidence to add to his assertion, and she hasn't really ramped up the evidence but rather her action in the determination which was levied against her. In all cases of rape, the accuser should be given the full spectrum of any investigation, and the process and treatment of any and all cases should definitely make it so that any future victims (male or female) be allowed to come forward with protection in doing so. That should be the basis for each and every case. And while it is hard to "prove" a rape, or disprove for that matter, if we are going to convict or dismiss with the basis of evidence, then on the evidence alone, on a case by case basis, should any proper determination be made.

It is hard to say whether the accused in this case is "innocent" of rape, because the nature of rape is very nuanced and operates on many levels. With his ex-girlfriend, it is definitely possible to be in a relationship and feel like you were compelled to sexually participate with a partner because you want access to that person. It can be seen as a consensual compromise, but it can also feel like rape when you are the one compromising. In regards to what was asserted as rape, especially in the instance of the primary accuser, that has not been purported with nuance, but rather it is VERY declarative and deliberate in the actions that took place. There is a realm of possibility for the actions of her allegations going down exactly as described. His statements and texts could be a reaction by him of leveraging that "hey, it wasn't rape, she liked that shit. look at these messages." That doesn't fly in trying to extrapolate every single past encounter to include the basis for one encounter.

A boyfriend can rape a girlfriend. A husband can rape a wife. A partner can rape a partner. Their past history has little to do with whatever she reported happened on the basis of that night. However, in order to see what happened on that night, or to at least substantiate the merit, not of her accusation, but in any executable verdict or judgment, there has to me more substance to the accusation beyond not only the hearsay of the assertion but to the descriptive nature of details provided for the act.

I can definitely see where a body or court or judge would not rule in favor of the accuser, because based on the assertion there is just more "evidence" to substantiate his point of view than her's. But we need to recognize that in dealing in fairness and in providing a safe platform for all people to come forward, there are going to be judgments and determinations where when it's all boiled down the "evidence" there is what's there. To zoom out from rape and patriarchy and everything that establishes it, to now really invest in a social consciousness and tackle what "rape" actually is and what it looks like, we need to somewhat divorce ourselves from not just victim blaming and victim shaming, but also victim labeling.

In every case there is an accuser and an accused, and BOTH potentially are victims in an unfortunate circumstance. We cannot try to place a unilateral stance on something that is based in nuance and situational conditions. It will never work. Otherwise, if I were to just say that RJCC raped me, should that be the end all be all? Or should he have an opportunity to say otherwise? We should look at all that makes this case "problematic" from inside the case itself to the society that breeds these things from occurring in the first place. It is all badness and nobody wins.

but it should be evident by now that many people who are victims of rape are reluctant to report it. One of the major reasons is because they'd rather not have the world go over their personal lives to determine whether or not they believe this person making an accusation that in no way benefits them.

whatever reaction you have, going "oh, well now that I've read these disconnected text messages and IMs and have heard this story I think I can judge what happened that day with those people" is contributing to a problem.
