but we've got to treat crimes in America the same. if you can die for having a broken tail light and reaching for a taser, if you can die for selling cigarettes, if you can die for allegedly stealing blunts, then if you detonate bombs that kill in mass....you gotta die too.

would be fair, but Mr. Thomas makes a really good point. Also dude seemed to show a pretty strong contempt for life which is the only thing I believe warrants capital punishment.

Lastly they really did try to kill dude- it's amazing he survived. He had among his many wounds a bullet to the face.

I haven't really heard anything from him since this all went down

I know on that boat he did. But in context he wasn't in his right state of mind.

If he really did want to die he would've went out like his brother instead of being captured alive.

Dzokhar is a different kind of terrorist than his older brother. Someone who actually poses a bigger threat because they are more culturally assimilated and harder to pick out. Short of Orwellian levels of Internet surveillance - I don't really see any way of stopping it.

Fry this idiot and let these other potential half way crooks from trying it

not sure how i feel about all of this...

i'm over the death penalty in general as viable for anything...

if it cant be done cheaply...what's the point?

I struggle to find/keep faith in jurors/juries and their competence, law enforcement competence and bias, a hyper-litigious culture...

just so many things to fix and so few viable solutions

btw, this is the defense theory ^. this ^ is a large part of what they'll argue to the jury asking them to spare homie's life. LOL.

and i agree - if i were in favor of the DP i wouldn't think it's appropriate here if DT is a mere impressionable kid who was goaded into participating in this plot by his brother who is the more culpable party and is now dead. i'd think the brother should get the DP and DT should get a life sentence w/o chance of parole.

Being from Boston, this definitely hits home as I stood blocks away
from the bombings on Boylston Street. I still remember the sheer horror
and panic.

As far as the death penalty goes it's not common in Massachusetts,
so even if he does get the death penalty, he'll probably be moved
to New Hampshire or somewhere else.

Personally, I believe death is too easy. He should rot in prison.
Better yet, he should move into a cell with all of his victims posted
on the walls, so they can remain on his conscience until the day he
hangs himself.

b/c, as has been said, ppl who reach that level tend to be willing to die for the cause - if they're thinking clearly at all and most of them aren't. so DP isn't much if any deterrent.

Dzokhar runs away from that scene with his boo boos and hides in a boat. Lets the great Satan capture him alive

Yes there are plenty of terrorists who want to die and would welcome our death penalty. This idiot isn't one of them IMO

Idk about you guys but I see what DT represents is way more dangerous to us than Tamerlan.

they want the trial b/c they get to speak in open court where a transcript is created and news media will publish their words. they want a circus. they want DP b/c then they're considered martyrs.

killing terrorists tends to radicalize other terrorists who feel it's unjust for the government to kill the terrorist for doing what's right or fighting for a just cause.

these radicalized ppl don't think like us.

also, if DT is less culpable than his brother then it's particularly unjust for the government to execute him. if he's not as hardened as other terrorists like his brother then there's a chance he can be rehabilitated. even if he's never free again he can still contribute to society - there's a chance he can turn his life around if he's not the hardened terrorist who welcomes martyrdom.

fuck you.

there is very little difference in my mind in letting a rabid dog rot in prison vs putting them down...

except one will cost taxpayers more

i think the death penalty should really only be used in cases like these that are open and shut...cut and dry and where even the idea of rehabilitation is laughable

If someone is incapable of rehabilitation there is no the point in locking them up for life.

For starters, I don't really believe in the death penalty.

But - separate from that, what are the chances he actually makes it to the execution anyway? I read something yesterday, something like: since 1988 there's been 490+ people sentenced to death in America, only 3 of them have actually been executed. The rest either appealed til they were blue in the face or something else.

Fact is if he's sentenced to death there will be appeals on top of appeals on top of appeals and we'll never hear the end of it, and it'll be a bunch of time, resources and money spent on him for years to come.

Sentence him to life and they'll lock him away here:
http://en.wikipedia.org/wiki/ADX_Florence

...and we'll barely hear his name ever again, and he'll cost nothing to the country and will live in a concrete box. Surely that's preferable.

There have been 10 people actually executed so far THIS YEAR. In 2015.

The biggest year since 1988 was 1999, when there were 98 executions:

Since the reinstatement of the federal death penalty in 1988, 74 defendants have been sentenced to death of whom 3 have been executed and 10 have been finally removed from death row.

I think the 490+ number was the number of federal cases where the charges could *potentially* carry the death penalty, then only 74 (like you said) were actually sentenced to it, and only 3 have made it to execution.

So anyway yea - I just think it'll be cheaper to toss him in that Colorado prison and be forgotten. His defense team's entire strategy throughout the trial was "he did it, but please spare his life" so everyone in here who said he wants to die is wrong. He wants to live. Therefore, sentencing him to death will only cause a ton of appeals and he'll probably die naturally before he's ever formally executed so why bother.

And it's not a deterrent, nor does it offer the chance for rehabilitation, refection, atonement, etc.

People should have to deal with what they have done and face the victims / families.

I disagree in theory. I believe that everyone has the capacity to repent and to make atonements for their actions, barring a serious brain defect. And even then I still have hope.

on the other hand, fuck that dude. he deserves to die. whether or not he wants to die is kinda beside the point. he dont need to be on this earth no more.

that said, if i did believe in the death penalty, this is the kind of case that would be appropriate for it. people who plot to kill multiple people and threaten the security of the general public...they gots to go.

Yup if he really had a death wish that our justice system can fulfill for him, wonder why It wasn't a suicide bomb? Or why did he run away from the scene after watching his brother get dropped right in front of him?

But who says this death is this painful horrible way to go out. There's a reason why many criminals would rather 'Go out shooting' then spend the rest of their lives in jail.

Id rather have him rot in jail. Despite what the neocons say (and the pittance they give when someone accidentally gets locked up) it's not exactly bed and roses; rapes, lack of human contact etc.

If you REALLY wanna punish, imho life in jail is the way to go. Its not like they put you on the crack and torture you to death, shit is pretty painless when they don't fuck it up.

That's just one reason, but it's a good one. What message does it send if we place the value of the lives lost in this tragedy above lives lost through other kinds of murder? It tells the families of other murder victims for whose killers the death penalty is not sought (for whatever reason, but often for lack of resources -- capital crimes are expensive to prosecute) that their relative wasn't worth much to the community. And that's fucked up.

There are a bunch more reasons and probably a lot are archived on this site.

don't really care how you eliminate him...just get rid of him.

Sparing the lives of homicidal maniacs somehow makes them special and worthy of extra attn and treatment.

Fuck that and fuck them.

As a society, we don't owe anyone like this the opportunity for reflection, repentance or rehabilitation...save that for lesser crimes.

The only question is...does he get the book deal now to write his memoir? Or do we need to wait a couple decades?

Can't wait to read it myself.

I'm also ready to see a 65 year old TERRORIST with Manson-like marriage proposals 20 years from now.

Which I believe is the ultimate penalty...forfeiture of your right to life.

It's a very old principle that should still be employed across the board, especially in more socially evolved societies where the law and due process are paramount.

and those that do generally are not the ones flipping the switch or injecting the needles.

if you were actually faced with having to carry out someone's death, i'd imagine most of us would hesitate.

lock him up in solitary confinement. that's probably worse than any death, it's suffering with no end in sight.

if you had no regret for taking a life

and there's a reason why solitary is used for torture. confining someone to a small space with no natural light, now sense of time for the rest of their life can drive a person mad.

Pot calling the kettle black much?

In this case, solitary confinement isn't even justice, it's removal of a threat...justice isnt served until this person no longer exists. No longer requires an entity to care for his basic human right so that they're no being violated while he's being "punished".

But if he is NOT the hardened terrorist he wants us to think he is then there's a greater chance to rehab him than if he were such a hardened terrorist. As you pointed out, the fact that he didn't commit suicide by bomb or cop plus his brother's greater culpability and greater willingness to die points to DT being a softer side of terrorist and as such, given his age, he may have a shot at deradicalization and rehab.

One act no.

One heinous heartless act that takes the lives of multiple people and injuring others...yes.

Varying degrees of crimes warrant varying degrees of punishment...some of those warrant rehabilitation and some warrant death as a form of justice.

...once he got his head straight.

His eventual murder was the clearest demo of the pointlessness of the death penalty I've seen in my life time.

Not everyone's capable of it, sure, but there's no better teacher than someone who's learned HARD lessons and changed their ways.

In a few years Tsarnaev *could* be the voice that stops another teenager making the same mistake.

Don't think I'm saying anything too secretive here.
She went through two rounds of voir dire, the second one he was there in the court. Shocking that she made it past the first round/questionnaire phase because 1) she was there the day of 2) has run Boston twice and 3) isn't too far removed, socially, from multiple victims, but I guess they were stressing pretty hard on coming up with any sort of jury given the scope of his crime and profile in the Boston area. Didn't get the word she wasn't selected until very shortly before the trial started. Strangely, when her company found out she was in the pool, they sent her "direction" that she must state she is anti-death penalty if questioned (they are in medicine).

but I don't see any inconsistency in someone who's against the death penalty being pro choice.

an abortion isn't any kind of punishment, deterrent, or whatever you want to define the death penalty as. it's a personal choice, based what they feel is best for them.

on the flipside, anti-abortion people who believe in the death penalty see the fetus as a victim who had no hand in why they're being killed. (though they should probably add an asterisk to the term 'pro-life')
