Houston’s First Lesbian Mayor DEMANDS to see ALL Sermons from Christian Pastors

Houston mayor, Annise Parker, the city’s first openly lesbian mayor, is conducting a litigious witch-hunt against religious leaders, issuing subpoenas that demand the sermons of pastors who may have spoken on the topic of homosexuality, gender identity, or Parker herself. Pastors who do not comply may be held in contempt of court.

The actions taken by Parker and her administration are a clear affront to freedom of speech, an assault on the concept of separation of church and state, and constitute one of the more alarming attempts to stop opposing political or cultural viewpoints in their tracks.

Via Fox News:

“The city’s subpoena of sermons and other pastoral communications is both needless and unprecedented,” Alliance Defending Freedom attorney Christina Holcomb said in a statement. “The city council and its attorneys are engaging in an inquisition designed to stifle any critique of its actions.”

ADF, a nationally-known law firm specializing in religious liberty cases, is representing five Houston pastors. They filed a motion in Harris County court to stop the subpoenas arguing they are “overbroad, unduly burdensome, harassing, and vexatious.”

“Political and social commentary is not a crime,” Holcomb said. “It is protected by the First Amendment.”

The report also cites ADF attorney Erik Stanley who says “the city is rummaging for evidence to ‘out’ the pastors as anti-gay bigots.”

The controversy stems from an alleged “equal rights” ordinance passed by the city in May. The ordinance calls for a ban on discrimination amongst businesses. Two things however – one, religious institutions were exempted from the ordinance and two, speech does not amount to discrimination.

In addition, one tangential aspect of the ordinance allows transgendered individuals to file discrimination lawsuits if they are not granted access to a restroom. In other words, a man would have to be granted access to the women’s restroom if he claimed to be transgender.

Opponents of the ordinance filed petitions containing 50,000 signatures, well above the threshold of 17,269, which would call for a referendum being placed on the ballot. In true dictatorial fashion, Parker and the city announced that the petitions were not valid due to alleged irregularities. A convenient suppression of opposition.

In keeping with the dictatorial theme, Parker admitted that the entire debate on gender rights, and presumably the latest assault on First Amendment rights guaranteed to all Americans, is about her.

Via the Houston Chronicle:

In just five words, Mayor Annise Parker handed her increasingly vocal opponents exactly what they wanted in the battle against her proposed equal rights ordinance: “The debate is about me.”

That comment, part of a longer utterance at Houston City Council’s last meeting, at which the body delayed a decision on the ordinance to this Wednesday, was just what political and religious conservatives have accused Parker — the first openly lesbian mayor of a major American city — of doing for weeks: Pushing the ordinance to further her “gay agenda,” or to reward gay advocates for their political support.

Sorry Ms. Parker, the First Amendment, constitutional and religious freedoms, and the foundation for which America was built has never been about one man or one woman. And it certainly isn’t changing for you and your ego.

Stanley told Fox News that “City council members are supposed to be public servants, not ‘Big Brother’ overlords who will tolerate no dissent or challenge.”

Parker and the Houston City Council need to be stopped in their tracks, or the whole of America will suffer for it.

The subpoena is part of a discovery request in a lawsuit. Some plaintiff represented by a right-wing advocacy group known for anti-gay activity has filed suit probably seeking an injunction that would hold up implementation of an anti-discrimination ordinance the mayor signed. The ordinance protects queers from unfair discrimination. The group seeks to have the ordinance repealed. The city wants to know if pastors made political speech during their sermons related to the signing of a petition seeking a referendum on repealing the anti-discrimination ordinance. The mayor claims the fight over the ordinance is about the mayor, not the ordinance itself.

The subpoena was overly broad and would fail miserably as recently admitted by both sides.

It was an obvious attempt at punishing the pastors. That's not hard to see.

that leads to LGBT community members being persecuted to death, it's interesting to see where Christians like the ones in this post focus their outrage.

They'll be the first ones to rail against abortion and euthanasia because life is sacred, but curiously silent about their community's role in seeing innocent people persecuted locally and killed globally.

That agenda is certainly more dangerous.

that protect queers from unfair discrimination. Most of those governments don't have a gay person in the executive office. So I doubt the mayor signed the ordinance just bc she's gay. And the city council passed the ordinance and sent it to her for approval - the council ain't all gay.

i also haven't heard of that btw. which is why i'm puzzled* as to why churches and/or ministers would seek to have the anti-discrimination ordinance repealed. it has no (or little) impact on them - especially since SCOTUS has said ministers don't have to abide by anti-discrimination laws that protect gays from unfair discrimination in the workplace. so a church is free to fire a gay employee for being gay even if the state, county or city government has an anti-discrimination law on the books that would otherwise protect the gay employee from being so-fired.

and of course a minister is free to preach anti-gay sentiment in the pulpit.

these ministers may be forced to respond to the city's subpoena as part of a lawsuit b/c the ministers' political speech doesn't have first amendment protection that would prohibit a court from penalizing a minister who refuses to respond. the original subpoena request does seem overbroad and the city has already said it plans to amend the subpoenas and limit the sought material to political speech related to the effort to repeal that ordinance. i dunno why the city wants that material in preparing its defense in the case b/c i haven't seen the plaintiff's complaint or the city's response.

*note...i'm not actually puzzled. the effort to repeal the ordinance is rooted in animus against queers. that's quite clear. just like all anti-gay sentiment.

Hopefully the city wins the suit and the ordinance takes effect soon. And I'm sure the content the city seeks via those subpoenas will only be used to prove some element of the city's defense and/or to rebut one or more of the plaintiff's claims. The judge overseeing the case will likely make sure of it - as there's an obvious 1st Amendment issue if the city uses the sermon content inappropriately. I expect the plaintiffs will challenge the discovery request and in consideration of the ministers' assumed 1st Amendment protection the judge will limit the material the ministers must turn over.

As long as the Clergy doesn't openly endorse a specific candidate from the pulpit they should be able to talk about any issue freely. But I take it that you want to remove the rights of clergy to address political matters from the pulpit. I guess you only want them to talk about things that favor you or that make you feel comfortable. Well the Gospel is Political.


And for the record, the Gospel of Jesus Christ and the Word of God is not about making your feel comfortable. It's about saving your eternal life, it's about recovering a Godly Relationship with the LORD, it's about moving souls towards Righteousness and Holiness in a manner that is compassionate, loving, correcting and rebuking when necessary. If I was an above board pastor I'd be happy to give transcripts of my sermons. I'd be happy to stand behind them if I'm standing up in a church that is welcoming all members of the public to come and hear me.

I'd be doubly happy to do so if I could exonerate my church from being in any way bigoted in the process. I'd be happy to have a discussion about what is said in the church and how it is important to the community.

What I wouldn't do is be out there making public statements only to get hyper sensitive about being opened to public scrutiny. Free speech isn't a right to speak with impunity. Just like a subpoena on white supremacist churches wouldn't necessarily be an attack on freedom, neither is this.

Usually when the reaction is like this it's because you've got bigots who are only have the courage to espouse their beliefs when they think the authorities aren't listening. That's not free speech worth protecting.

Just IMO though.
