13266140, Gayle King Thinks #MeToo Needs Due Process Posted by legsdiamond, Wed Jun-13-18 12:25 PM
https://www.nytimes.com/2018/06/12/magazine/gayle-king-thinks-metoo-needs-due-process.html
You’ve talked about the potential for backlash to the #MeToo movement. How do you see that playing out?
I do worry about that, because I think when a woman makes an accusation, the man instantly gets the death penalty. There has to be some sort of due process here. All of these inappropriate behaviors are not all the same.
---------
Is being fired a particularly harsh punishment?
In some cases, yes.
---------------
But what about the rumors that some of these men will have a comeback?
Sometimes it just doesn’t seem as if they’ve really taken a hit. It depends on who you’re talking about. We’re talking in generalities here, because many of the cases are different, but what I do know is you can’t come back if you don’t get the lesson and you haven’t acknowledged that you behaved badly.

13266258, how is there a side of this? Posted by Rjcc, Wed Jun-13-18 02:33 PM
there is absolutely no justification for what she's saying.
no one has received any death penalty.
it is a non-thing.

>there is absolutely no justification for what she's saying. > >no one has received any death penalty.
I'm fairly certain that her "death penalty" line was hyperbole. And due process doesn't have to be a judicial thing.
Most of the cats that have been caught up in this have eventually copped to it. That's fine. Send them on their way.
I don't see a problem with allowing someone to present their side of the story to show that they may not have done what they're accused of.
|
13266295, who has said they can't? Posted by Rjcc, Wed Jun-13-18 03:22 PM
that's not a side.
and if they haven't received the death penalty then let's be precise in our language.
what exactly has happened, and based on what?
because if you look at what people have actually gotten, I don't know how you would describe that as not due process.
but that would involve an actual description of what we're talking about and not admitted "hyperbole"

No one has said they can't. Damali's post indicated that she thought the opposite about what Gayle was saying, therefore I wanted to understand her (Damali's) side. Let's not play the semantics game, man.
|
13266315, her post said that Gayle is not right. Posted by Rjcc, Wed Jun-13-18 04:18 PM
which is accurate, but it doesn't imply anything about a side.
it's like I said, there are no sides in this because the thing that Gayle is claiming is a problem, simply doesn't exist.

There have been some instances where men have been struck hard after accusations have been made some some instances where men are still able to work and collect paychecks, so IMO, it's a bit tough to make sweeping generalizations about this #metoo situation.

13266278, Ehh...kinda feels like you have to play the court of public opinion angle Posted by bentagain, Wed Jun-13-18 02:54 PM
just to get to the due process part
The Cosby allegations were out there for a long fucking time
it wasn't until the court of public opinion decided to hear the case that he faced legal ramifications
I'm sure Weinstein was no revelation either
I follow her logic, some of the accused are going to suffer disproportionate penalties...and some may even be innocent
But part of the issue is the accusers are not taken serious legally and their cases weren't moving past the accusation phase
seems like a catch 22 to say...we should have faith in our legal process...when that legal process has failed for so long IRT sex crimes.

I met a math dude at the university here who was working on an algorithm just to try and help police predict how many serial rapists they'd find based on these unprocessed kits and the numbers are staggering.
like, dragged women kicking and screaming off the street, and then were never ever caught even though their victims reported the crimes.
but we're worried that things are going too far

There's none in the court of public opinion and I've gotta admit that I believe just about every allegation bc we all know a grimy dude or two and have probably engaged in some griminess of our own.
At work? It's all business decision... these companies aren't firing highly paid employees on a mere allegation.

No one wants their company associated with this scandal, because ultimately these companies only care about keeping up appearances and keeping the money flowing. I think there's some pressure on some of these guys to stand down. I don't have any proof, I'm just making a guess because I know people who know people that got caught up.
|
13266299, How many famous men have been accused that haven't Posted by Marauder21, Wed Jun-13-18 03:31 PM

Weinstein put out a "I'm too busy bringing down Trump and the NRA to remember this and here's a fake Jay-Z quote" statement the day the first NYT article came out.
Louis had a statement Spacey used his to come out of the closet to distract Franken stayed talking about it Cosby had two different days in court
Maybe I am missing someone, but who has had their job prevent them from saying something?

13266343, I'll start here: correct on both Posted by Damali, Wed Jun-13-18 11:16 PM
Gayle King is not known for being particularly knowledgeable or eloquent or current on social issues...that aside
the #metoo movement has not yet gone far enough...especially when far more concern is shown for the men that have been affeccted by the exposure than for the women they victimized..named and unnamed. for every woman that comes forward, there are 2, 3, 4 or more that didn't and simply quit their job, ended their career from being discouraged, lost the confidence to continue, were blackballed...etc etc
Weinstein singlehandedly ended Mira Sorvino's career by spreading a rumor that she was difficult to work with. No one would hire her. he cost her money. and that's just one case we know about
Matt Lauer, the Ren and Stimpy dude, Louis C.K....so many women that they demeaned and harrassed and molested simply gave up.
where is the concern or remorse or renumeration for them?
So no. too many women have been sacrificed at the altar of patriarchy. for patriarchy to end, men have to lose a little bit of footing...that's not about revenge; its about making space for fairness and equality. to make space, you gotta move. period.
none of these dudes have died. only 2 so far have actually been arrested...the rest are sitting in the wings waiting for the right time to make their comeback, which WILL be allowed because patriarchy
but there's no comeback for most of the women that have spoken out, so far. their names are not so easily unmuddied..they are forever scarred as the slut who lied to get fame and money
so no. fuck this misplaced concern for men who cling to toxic mores and behaviors and hide behind the social contract that says its "not that bad" or "not real assault". nope.
this shit is just getting started.
