It is always listening. But it would require so much storage space to hold 24/365 recordings of every Amazon Echo owner.
From how I understand it, whenever you give it the command to wake up it goes back a second or so and sends that snippet to be analyzed.
On a similar note, have you ever checked out https://myactivity.google.com/
Man....that can get you caught way the hell up. If you have an android, it records literally everything you do. What time you opened an app, what you searched, where you visited, etc.
