Zach Anderson is no longer allowed to live at home with his family.

He can’t use the internet, take a walk in the park or go shopping.

In his words, he’s an ‘outcast from society’.

Why? Because he had sex with a 14-year-old who claimed she was 17 and is now a registered sex offender.

The 19-year-old, from Indiana, met the girl via a dating app called Hot or Not, on which she told him she was over the legal age of consent. But Zach was arrested after the pair slept together. Then he was convicted. He now finds himself on the Elkhart County sex offender register alongside child molesters and rapists.

Even the girl’s mother testified in court that she didn’t want Zach labelled as a sex offender because ‘he really is not.’

In a letter written by the girl to Zach’s family, she said she was ‘sorry I didn’t tell you my age. I really don’t want you to hate me.

‘It kills me everyday knowing that you are going through hell and I’m not. I want to be in trouble and not you.’

But Judge Dennis Wiley was far from sympathetic. Sentencing Zach, he said: ‘That seems to be part of our culture now. Meet, have sex, sayonara.

‘Totally inappropriate behaviour. There is no excuse for this, whatsoever.’

That's one of the risks that a guy faces when he jumps into bed with a young girl he doesn't really know, whether he's 19, 25 or 35. It's a KNOWN and avoidable risk.

deep down he probably suspected she was underage and said fuck it and did it anyway. At 19 I think I could spot a 14 year old.

Having said that as a 20 year-old I did have an "encounter" with young lady I later learned was 16 at the time.

yeah you can spot a young 14 year old. and depending on their mentality, as soon as they open their mouth you'd have confirmation. it's as simple as her saying she's 18 when she's really 17 and he found out because she referenced high school or something that made him question her age...

but the fact is, I know plenty of 14/15 year olds in BK that look 20/21. I also know 30 year olds who could pass for 18. It's not always that simple. SOme of the kids I mentor look and dress and speak "grown." and yeah i can see why some men would believe a girl who is working, dressing grown, long weaves, is of age. It's not farfetched.

"oh i can always tell a person's age" is false. At the same time, I was 18 in my senior year and dated a guy in college (he was a senior when i was junior and it carried over). Do I think he should have stopped talking to me? No. I don't even believe that now. So to me, a 19 year old who could be a freshman messing with a 17 year old isn't terrible.

In situations like this, the guy is going to get the worse end every time. I was always taught if the thought that she may be too young crosses your mind leave her alone.

Girls lie just as much as guys. And both types of lies can get a guy in jail.

It's about half and half

There's also a one time waiver for guys who are under 21 in this state as far as being put on the offender registry for situations like this, but if you read the article the prosecutor agreed to it and then went back on the agreement.

I do believe women are convicted less because boys are congratulated when they have sex. so you don't have some angry parent pressing charges...

but with the cases of female teachers having sex with students, that is more taboo so the women are just as criminalized in those cases.

aside from the fact that pretty much no one that has been arrested for a sex crime in the last twenty some odd years that the registry has been around was a registered sex offender and the number of crimes stopped is a statistical zero, you have people on the registry for "crimes" like this where it makes no sense. The number of lives destroyed in this manner does not balance the number of crimes prevented with the registry (essentially zero).

And I can understand dudes dilemma. I used to work at an arcade in a mall in Southfield back inna day when I was 21. Me and the crew were standing out front in the hallway talking shit as usual when these fine as fuck ass chicks with these bangin ass bodies came in. Me and the homie Kimani went over to spit game and the shit was going well, we got names, trying to work on gettin phone numbers, and shit... but something was a lil weird. Maybe it was the giggling, maybe it was something in their voices but I guess Kimani felt it too and asked "how old are y'all?"

14 and 15 years old.

There was no way to tell without them saying it. Nothing about them was 14 and 15 years old. The clothes, the bodies, nothing...

We both told them to beat it, shook our heads, and laughed about just missing catching cases over them chicks. Every now and then at least one of the crew that was there brings it up. We joked about it back then, but if either or both of us would have ended up banging either of them chicks jail time could have been the result.

meaning that the registry wouldn't have helped in any way to stop them. IIRC, over 90% of sex crimes against children were committed by someone they knew and that's not limited to adults since over a third of registered offenders convicted of rape/molestation of a child were *children* themselves (source: 2010 Crimes Against Children Research Center at the University of New Hampshire study commissioned by US Justice Dept). In this way the registry wouldn't have prevented anything.

The number of repeat offenders is quite small, quite negligible. I'll look for the paper I read about it where the whole shit was broken down.

But... You have to remember that the majority of people on the registry aren't on there for rape or molestation of a child and those people pose no threat to a child. Things like public urination can get you on the sex offender registry in 13 states and indecent exposure can get you on it in pretty much every state, this includes shit like mooning, streaking, or anything like that. Also, sexting between teenagers is still something that can get you on there (typically charged as possession/manufacture/distribution of child pornography).

Give me a bit to pull together my sources, I've got a lot going on right now and I'll get it together at some point.

I can't see why anyone that's not a sex offender would be against the list. I do agree that it needs to be amended and that people's names should come off the list after a certain period of time depending on the actions. But to completely get rid of it is a bit much...

Teachers, both male and female, still fuck their students.
kids are still being kidnapped, raped, and killed
that creepy uncle/aunt is still fiddling with their nieces/nephews.

The shit is a failure. The only thing it has managed to do is destroy the lives of people that are on the registry where their crime has absolutely nothing to do with children.

No, and there are enough studies out there to back that up. If the person was a true criminal sexual deviant, registration simply won't stop them.

I'm against it because I predicted at it's inception that it wouldn't work because it doesn't take into account the fact that most child molesters are acquaintances and when stories started popping up (almost immediately) about 18 year olds going to prison and facing lifetime registration because he had sex with his 16 year old girlfriend I knew the shit was dead wrong. Here we are over two decades later and the shit hasn't changed... in fact it's likely worse.

In that way it's like the failed "war on drugs"; a knee-jerk reaction to an issue that failed miserably in all aspects.

It's time to do something different.

And a brother mackin on online or via an app nowadays prolly would be too busy thinking 'I wonder if she's real and down' to be worried about 'is she totally not at least 17. Unless a dude has a history of cradle-robbing, logic should prevail, he should eat some degree of legality as a lesson (jail, probation, 'stay away from them young chick, mane' counseling), and then he should be able to get back to life as long as he doesn't rub elbows or anything else with younger chicks ever again.

Otherwise, again...it reeks of throwing the book at a dude who couldn't move to 'payback' other separate cases where the dude in question could dodge whatever the book was throwing (Robert Sylvester for instance).

These days it's hard as fuck to tell, especially since little girls are now being encouraged to dress like grown ass women, complete with makeup and everything.

My 16 year old is regularly mistaken for being in her 20's and that's without the skimpy clothes and goo gobs of makeup on.

My 12 year old is always mistaken for being in high school, no less than 16-17.

My 16 year old has a (white) friend the same age that recently cut her hair short. The wife and I genuinely thought she was some 30 year old sister we hadn't met.

Nah, she lied. Dude shouldn't have to resort to checking ID's, asking for a birth certificate and checkin passports and shit before he fucks. He doesn't need jail time or probation. If he genuinely believed that she was of legal age because of her lie then he should get off the hook.

So my friend knew that, in order to be there, the guy had to have proved he was 21.

Turned out he was 17.

My friend was prosecuted, convicted, and disowned by his family. His father in particular didn't know that he was gay until this arrest.

His father refused him any money and his mother was on a tight leash so she couldn't give him cash, so she would sneak out and buy him goods. Like Gucci shoes. He died of AIDS in '89 in a rent-controlled single in Santa Monica surrounded by a pile of Gucci shoes. He was so ashamed of his living space that very few of us were allowed to visit.

Anyway, how's that for strict liability? The kid didn't just lie, he did everything possible to convince people of his lie, and his family was wholeheartedly in favor of the prosecution.

Not old but just her ways and actions seemed much more mature than the rest of us. The vision of her has stuck with me for 25+ years. She even had a heavier more adult voice than the rest of the girl.

I knew she was 14 (because we'd been in school together since the 6th grade) but to the outside world she could've easily passed for 24-25. And I'm not saying that in a manner of she was "fast" or things like that--she just could easily be mistaken for an adult.

and I've been gainfully employed with a bachelors. I get your point and agree that it can still be easier for a white person with a felony, or other restriction that typically renders a person of color unhireable, to find a job. When speaking about someone with a bachelors or lower, I can definitely see it. However, it's hyperbolic as hell to say that applies to a black person with a PhD. Even to say a black person with a masters isn't as employable as a white person on the sex offender registry or a felon is just not rooted in reality.

I'm well of how white supremacy functions, regarding hiring practices. I've also had to deal with the added layer of homophobia in industries dominated by straight men. Yet, I've been able to circumvent that in states that notoriously bad for both black and gay people, much less the combination. I'm not arguing that education equalizes everything. I know that if it's between me and a white person with the same qualifications or even slightly inferior to mine, I'm losing. However, if it's between me and a felon or sex offender, I'm pretty confident that I'll come out on top.

You have a point regarding inequality in hiring practices as a result of white supremacy, but you've taken the premise beyond the scope of reality.

a lot of the "age of consent" laws are retarded, especially seeing that they're so much different in every single state. Makes zero sense to me that you can just hop across a state line and get down with a 15 year old in one state, while they have to be 17-18 in the next state.

If you're two weeks older than her, and in a state where she can't be under whatever age, and you get caught up for it...life is over. In my HS.. most fine ass girls I knew were dating like 20+ yr old dudes. There were some 8th graders fucking with like 17,18 yr olds but not a lot.

This was "normal"... enough that no one batted an eye at it in any way shape or form.

I'm not around any young girls, so I have no idea how their culture is. Like, I see how these young dudes dress, how their haircuts look, all that, and that the girls their age like that...and I don't know if these same girls see guys my age (30) and say "oh, he just looks old/played out/not cool" in comparison to the 90's when a 30 year old may have looked just as "cool" as guys their age, except with more money and a nicer car. I really can't call it.
